RESOLUTION t I
WHEREAS, a public hearing was held on Monday, December 7,
1970, at 2:00 P. M. in the chambers of the Board of County Commissioners
c of Weld County, Colorado, for the purpose of hearing a petition of West
Hill N' Park, Inc. , a Colorado corporation, by John Shupe, President,
Greeley, Colorado, requesting change of zone from "A" Agricultural
District to "MH" Mobile Home District, Unit Development, in accordance
with official development plat and plan, copy attached, to be recorded in
• the office of the Weld County Clerk and Recorder, and
WHEREAS, the petitioner was present, and
WHEREAS, there was opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioner and studied the recommendations of the Weld
County Planning Commission, and having been carefully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of West Hill N' Park, Inc. , a Colorado
corporation, by John Schupe, President, Greeley, Colorado, for change
of zone from "A" Agricultural District to "MH" Mobile Home District,
Unit Development, said area being more particularly described as
follows:
A tract of land located in the Southwest Quarter (SW-1)
of Section 26, Township 5 North, Range 6-6 West of
the Sixth Principal Meridian, Weld County, Colorado,
and being more particularly described as follows:
Beginning at the Southwest Corner (SWCOR) of said
Section 26, and considering the South line of the
Southwest Quarter (SW4) of said Section 26 to bear
South 89° 38' 00" West and with all other bearings
contained herein being relative thereto:
Thence North 01° 11 ' 12" West, along the West line
of the Southwest Quarter (SW4) of said Section 26,
2, 642. 57 feet to the West Quarter Corner (W4) of said
Section 26, said quarter corner also being the South-
east Corner (SECOR) of Lot 1, Block 1, Third Filing
of Arrowhead Subdivision as platted and recorded in

Mr. Billings: We will this hearing to order. Pursuant to the Zoning laws
of the State of Colorado, a public hearing will be held in the office of the
Board of County Commissioners of Weld County, Colorado, Weld County Court
House, Greeley, Colorado, at the time specified. All persons in any
manner interested in the following proposed Change of Zone are requested
to attend and may be heard. Docket No. 56 - Hill 'n Park Corporation,
John Shupe, 26th and By-Pass, Greeley, Colorado, held on December 7, 1970
at two P. M. , for the request of Change of Zone from "A" Agriculture District
to "MH-UD" Mobile Home-Unit Development.
As we get into this hearing, the testimony w ll be recorded
and we requestthat all those people who wish to testify in favor or against
will give their names and addresses so that when the transcript is made
we will have the name of the right person making the statements. We hope
that we can proceed very fast as I do have a commitment and I will have to
leave at quarter of three and if not Mr. Anderson will continue with the
hearing. I will listen to the tape and read the transcript and bring myself
up to date. Mr. Telep do you wish to make a record at this time.
Mr. Telep: Thank you, Mr. Chairman. Let the record show that this
cause came on for hearing this day, December 7, 1970, at Two P. M. , on the
petition of Hill 'n Park Corporation in care of John Shupe, 26th and By-pass,
Greeley, Colorado, for a Change of Zone from "A" Agricultural District to
"MH-UD" Mobile Home-Unit Development, for a tract of land located in the
SW4 of Section 26, Township 5 North, Range 66 West of the 6th P. M. , Weld
County, Colorado, more particularly described as was duly published, as was
required by law, by metes and bounds and containing 126.372 acres, more or
less. Let the record further show that the petitioners are presented and
being represented by John Shupe. Let the record further show that also
is present and representing the petitioners is Jim Barton of N. H. P. 8, Q .
Let the record show that there is on file from the Weld County Planning
Commission, dated September 24, 1970, a statement recommending favorabling
as to this Change of Zone. And Mr. Chairman, we will hear from the County
Planner to testify in detail as to this favorable recommendation.
With this Mr. Chairman, I believe we are ready to proceed
Perhaps either John Shupe or the representative of N. H. P. & Q, Mr. Barton,
will have an opening statement.
Mr. Barton: I am Jim Barton. Due to the fact that we do not have much
time, I will point out the high lights of West Hill 'n Park
As you know, the original Hill 'n Park was a type of Mobile Home Park, if
you will, but West Hill 'n Park is actually based on a Subdivision concept.
It will be the first of it' s kind in Weld County. There has been some
problems with it. However, the Hill 'n Park Corporation realizes this and
during the development will take steps to remedy the problems. As this is
a subdivision type thing, we think there is a tremendous market for a Mobile
Home type of subdivision. There has been a great deal of attention given
to the lack of proper housing with inflationary trends and cost of housing
and this sort of thing has put a lots of homes out of the market of the
market for the average home buyer. Consequently, a -factory built home
or as we commonly call them, Mobile Homes, is becoming quite the thing to
provide adequate housing for the wage earner. Anyway, the mobile home
Park which in some instances leaves something to be desired. Therefore,
the Mobile Home Subdivision was designed. Consequently, we have West
Hill 'n Park. Hill 'n Park has proven to be somewhat of a success
in this type of thing. On the second filing most of the lots have been
sold, so there is a tremendous demand. People will frequently place a
certain amount of money into a well designed Mobile Home and like to place
it in an environment other than a Mobile Home Park with the type of
density that is in the plan, now. We think that West Hill 'n Park is a
final development of the Mobile Home type subdivision. We are going to a
80 to 85 foot lot which will handle everything up to the large 70 footers
that are being manufactured to day, on down. Now, what we're trying to do
is to provide, as I stated earlier, a subdivision type development using
Mobile Homes or factory built homes. I want to limit exclusively to
Mobile Homes so we term them as factory built homes which leaves us open
to a lot of other manufactured homes which are because of their style
and material may not be accepted in a Subdivision.
Mr. Anderson: Are you talking about Modular Homes?
Mr. Barton: Modular Homes fall in this category, also.

Mr. Barton: In this subdivision, we have provided some open space
and have tried to disperse it throughout the area thus we are trying to
create neighborhoods within the community itself. We refer to them as
tot-lots and these things range from 4 acres to a fraction under an acre.
As tot-lots, we're talking about something the kids can walk to - readily
excessible - with play equipment - swings or slides - this sort of thing.
Also, I think what the tot-lot will do is it will provide a visual break
within the subdivision it' self. In other words, provide some open space
rather than see a long line of houses. -Also in this area, we've incorporated
areas,
some cul-de-sacs thus creating units that are smaller/pinning down the traffic.
In matter of fact there is great limited thru traffic within this area.
This is part of the plan itself. I think that we try to provide a
subdivision atmosphere using the Mobile Home concept. While some other
thing that comes up often is "Will they really be paying their way since
they are Mobile Homes?" Well, in the covenants or the development plan
which is a contract we are entering with Weld County far as development
of this area. We're proposing that all Mobile Homes, whatever structure,
will be placed on a permanent foundation depending on the size of the
structure and hopefully this will put Mobile Homes there back on ad-valorem
tax so that they will carry their share of the tax base. Basically, that
is what we are proposing in West Hill 'n Park. We have followed subdivision
type standards and Mobile Home type standards. We have provided 30 foot
set-backs on both arterials. This will be landscaped and act as a buffer
zone as well as a noise control zone, to the subdivision type of environment
which we are trying to create. Are there any questions?
Mr. Anderson: Are all mobile gomes to go into this court automatically
to go on foundations?
Mr. Barton: Yes Sir - that is specified here.
Mr. Anderson: I see it is. Who will enforce it?
Mr. Barton: This will be enforced by Hill 'n Park, Inc. , as I
understand it right now.
Mr. Lorensen: I feel it will be enforced through building permit requirements.

Mr. Telep: Mr. Shupe, do you have anything to add?
Mr. Shupe: I think Jim has covered it very well and we do plan to
build just as he has proposed and it will be governed by the County.
Mr. Lorensen: Mr. Chairman, all these indications on the side of the
sheet over here - writing out of the requirements - All these will be
enforced by the County.
Mr. Anderson: In other words, anyone getting a building permit will
have contact inspection.
Mr. Lorenson: Yes sir.
Mr. Telep: Is there anyone else here who would like to make a
comment in favor of the approval of this subdivision?
Mrs. D. Walker: May I ask a question? I am Dixie Walker. We live in
Arrowhead which is quite near the Park. We were wondering just where the
entrance to the Park is? How close it comes to us and if it will involve
our particular area?
Mr. Barton: (showing location on map) Lake Arrowhead is to the North
and West. It is approximately 3/4 mile from the subdivision.
Mrs. Kammerzell: Mr. Chairman, I am Mrs. Larry Kammerzell. How many units
does this involve?
Mr. Barton: We're talking of about 400 units - 405 to be exact. It' s
hard to say that during the final platting the actual count may be more or
less. Right now - 405.
Mrs. Kammerzell: What do you consider your percentage of children in
Mobile Homes?
Mr. Barton: Well, I 've heard pros and cons. It depends if you're a
mobile home developer or dealer. They say that they don't have as many
children as other areas. I think a mobile home area compares favorable with
an average residential area particularly a subdivision type. When you get
young couples, then again you get children. Perhaps you won't have
children of school age. My personal opinion is that you won't have that
many children of school age - You' ll have young people - say - that have
been married a few years and have 1 or 2 children that are 2 or 3 years old

and that sort of thing because this is their type of market. Then again
other types of mobile homes are for retired people consequently with few
children, if any. I say that it compares favorable with a subdivision,
perhaps a little on the lower side.
Mrs. Kammerzell: But the young couples don't move out - with the smaller
children and they do grow to school age eventually.
Mr. Barton: Yes, that is correct because they are buying the lots.
Mr. Lorensen: I would like to give a partial answer to that. I have
some figures from several cited studies. I know of one that was done in
Jefferson County which said that there was .38 of a child per each mobile
home or about 1/3 child to each or 1 child to 3 mobile homes. Adams
County did a study that was .31 - or less than that. A more recent study
indicated that the number has risen to about a z child per mobile home
which is the existing situation. This is better than residential type
housing which has one child per home.
Mr. Meyer: How many per family is represented in Arrowhead? I am
Merle Meyer - my question is how many children per family in Arrowhead -
I mean, Hill 'n Park?
Mr. Barton: I can't answer that question.
Mrs. Kammerzell: I can tell you it is a bus load.
Mr. Meyer: No, there are 2 bus loads that go out there.
Mr. Telep: Are there any more questions?
Mr. Ishiquro: Ishiguro is my name of Route 3, Greeley. My question is
What do you propose to do about the sewer area? Do you want to use the
same sanitary lagoon that is there now?
Mr. Barton: That is right.
Mr. Ishiquro: How can you take care of 400 more units when it is
stinking now?
Mr. Paul: Can I answer that. We have the same question and I do
have a letter here from Mr. Shupe and also Mr. Haley.
Mr. Glen Paul
Weld County Health Department Re: Hill-n-Park Sanitation District
Sewage Collection and Treatment
16th Street and 17th Avenue Facilities
Greeley, Colorado
The Hill-n-Park Sanitation District Board of Directors has retained this
office to do the following work:

1. Supervise and instruct the Sanitation District forces
in the removal of all vegetation (cattails) in the Hill-n-
Park lagoon.
(Mr. Paul: - This is one of the complaints because the
lagoon has not been kept up to standard and that is the
reason for the odor.)
2. Supervise and instruct the Sanitation District forces
in the cleaning of the collection sustem lines, manholes
and control boxes.
(Mr. Paul: - Well, I think Mr. Shupe and the Company
realizes that now that the lagoon can not take care of
itself. They will have to put a man on it and keep it
in condition. )
3. Conduct measurements and tests of hydraulic and BOD
loading presently being experienced. This includes counting
and measuring flows from the various mobile homes.
4. (Mr. Paul: - This will answer your question) Design and
prepare, for State and local Health officials review,
plans and specifications for additional lagoons and
aeration equipment. This design and construction will be
adequate for all present and anticipated future loadings,
including the 405 units in Hill-n-Park West.
Mr. Paul: When Mr. Telep said the Planning Commission approved this
I feel he should have said that also with the provision from the Health
Department that these things be done before - - What we really will recommend
that the lagoon system - start construction and be finished by the time they
have the petition to go in for review. I have here also a letter from Mr.
J. Shupe.
Dear Mr. Paul:
In regard to the future development of Hill-n-Park area,
It is our intention to expand present treatment in accordance with the
master plan to meet the growing demand for its usage. Specifically,

improvements will be made to increase the treatment capacity prior to
occupancy of any lots under the Second Filing of Hill-n-Park. Facilities
will be further expanded as needed to meet the needs of West Hill N' Park
prior to any occupancy in that area." So, the Health Department will go
on record stating that we will approve it with the provision that noone
will turn anymore
sewage in until the lagoon is completed our aeration.
Mr. Meyer: I would like to ask Mr. Paul a question. If he can
specifically specify any other lagoon in the state or that is in your
jurisdiction that is a 100% right.
Mr. Paul: No, I can't say 100% right. I can name one lagoon that I
don't think we've ever gotten odors from and that is the lagoon at Gilcrest.
Mr. Meyer: Well, if I recall properly there was same attorneys filed a
law suit about a year ago concerning that one at Gilcrest by a party that
lived about half a mile West. It was about a year ago.
Mr. Paul: Maybe so. I can't recall any compliants at all about
Gilcrest. You have to maintain a lagoon. You just can't let them go to
pot.
Mr. Billings: Any other questions?
Mrs. Mossberq: Where would this proposed lagoon be located?
Mr. Paul: At the present location. Do you know where it is?
Mrs. Mossberq: No, I wasn't aware there was one.
Mr. Paul: Oh yes. You know where Mr. Meyer' s place is - You know where
Tom Schank's is - -It is just adjoining Tom Schank a little to the east
and a little bit south - next to the river.
Mrs. Mossberq: Oh. 0. K.
Mrs. Carol Lutey: I 'm Carol Lutey and I 'm on Kiowa Drivw. I 'm interested
to know where the access would be and whether it will open into Kiowa Drive?
Mr. Billings: The access roads. - Will you explain where the access
roads will be on the map?
Mr. Telep: Mr. Chairman, I think we should establish where Kiowa Drive
is. Is that in Arrowhead?
Mrs. Lutey: Yes.

Mr. Barton: There are no access roads into Arrowhead. The reason for
the 100' arterial here is that we are also doing a comprehensive plan for
the City of Greeley - the regional study or the Highway system of urban
areas of Greeley proposing the 100' arterial. This is a small BEER scale
(map) to visualize it. This is what we're trying to do - is connect US 85
to another section north of US 85. (map) Right her is Arrowhead so if you
notice it is on a straight line with the line of the By-pass of Greeley.
The biggest reasons we are providing the 100' arterial is the development
to Aims College to the north. In the future, now we're talking about
Planning we will provide a need for an access we taking this into consideration
We've had to allow for the arterial going along the west side of the
property. We have 2 accesses - one to the north and one in the middle
of the property. These will be used strictly for West Hill n Park because
this is a through street. Maybe, a person could cut across here but it
would take too much of their time so we are forcing them to go around rather
than through. As we've said earlier, we are trying to discourage through
traffic. This is a subdivision and not a major highway. Also, we have
access here on three points to existing Hill n Park. Does that answer your
question?
Mrs. Lutey: No, it doesn't really. We're interested in the access road
into Arrowhead. I'm about 300 yards from your NW corner and if you are
using Kiowa Drive to enter?
Mr. Barton: No, We're not going through Arrowhead. . We're going around
to the east side of Arrowhead. The engineering will be worked out with the
present dam. That hasn't been settled yet but it will not go through
Arrowhead. No, there will not be a 100' arterial through Arrowhead.
Mr. Billings: This 100' arterial is just something proposed at this time.
Mr. Barton: That is correct.
Mrs. Mossberq: I 'd like to ask a question. I was just wondering if they
have thought about children that will be of school age and where are we
going to putthem in our overflowing school system at present?
Mr. Billings: That's a hard question to answer because the whole County all
our schools are going to be overflowing.

Mrs. Mossberq: Are we going to be taxed more for building these schools?
Mr. Telep: I think the answer is unequivocally - yes. It is unforunate
that the commissioners like this can't do anything about it but we do have
that problem.
Mr. Billings: Any other questions?
Mrs. Mossberq: How do their tax compare to standard homes? Do they carry
their load on a bond issue?
Mr. Billings: This gentleman from N. H. P. 8 Q. has indicated that these
homes will be on a foundation and will be on ad valorem tax. They will pay
the same share as any home owner in Weld County based on the valuation of
their home. They will pay there share. If they were in there on wheels
and not on ad valorem tax, there would be a question whether they would or
would not, because in this case they would have to pay buy a license and
this would be the only tax we would receive. When they are ona foundation
then they are/valuated the same as anyother home in the County and
assessed accordingly.
Mrs. Mossberq: That is on a 20 year depreciation where we are one
50 - isn't that what she said.
Mr. Loransen: This is what the Assessor's Office says.
Mrs. Mossberq: Well it still isn't even.
Mr. Telep: Mr. Chairman I would like to answer that - all taxation
especially having to do with ad valorem taxes are all dependent upon
valuation and all taxes have to be uniform. They all start out on the basic
things - all taxes should be fair and equal - if you have a $25,000 house
naturally you will pay more money than someone with a $10,000 house. If
you have a $5,000 lot you are going to pay more taxes than if you have a
$1000.00 lot.
Mrs. Mossberq: Doesn't this vary with depreciation and time.
Mr. Telep: That is purely an academic question for the Assessor's Office
it is all relative - don't you see - you have a $50,000 property you are
going to pay a lot more money. porportionatly than a person that has a
$5,000 property. Then in a $5,000 home there are five children there
say they pay as little or as much taxes as the $50,000 home.

Mr. Meyer: May I raise a question while we are on this it is very
feasible and possible that a person could have a $50,000 home in one
area and a $50,000 home in another area and pay much less - right?
Mr. Telep: That could be of course----
Mr. Meyer: __ rural taxation
Mr. Billings: You are basing this on the school taxes or the taxes in
against
a certain area, such as the Eaton area, or/the City of Greeley area.
Mr. Meyer: Well
Mr. Billings: This mill levy is set by the school board who administers
the school district yes.
Mr. Meyer: Well it can happen in .the same school district.
Mr. Billings: No - no levy which is established in the school district
is standard in that whole district- so there wouldn't be a variation within
the district - no. Are there any other questions? If not then I would
ask at this time for Mr. Lorensen to give us the opinion of the Weld
County Planning Commission.
Muu.Meyer: Mr. Chairman are you closing this hearing ?
Mr. Billings: I am not closing it no.
Mr; Meyer: Are you asking for any other comments
Mr. Billings: Yes I asked for other comments and I could see no hands.
Mr. Meyer: Well I am sure there are other people
Mrs. Albrondt: I live there and my house faces the road, which you would
consider the dam area well if they are going to run a road east of Arrowhead
it would be placing their road clear out west beyond our home to have access
to Hill'N Park. The way we are situated right now Lundvall starts to the
east of us.
Mr. Billings: This is only a proposed long range highway system for
Greeley and not a part of this subdivision.
Mrs. Albrondt: Well - previously - whether they would be using the immediate
area, our road, that is to go into Hill 'N Park, which a lot of them do now,
but if they don't propose another way of getting back and forth and they
are going to be using the road we have now.
Mr. Billings: Mr. Shupe are you actually planning on using the roads
through?

Mr. Shupe: There is no doubt there will be some use of the road
across the dam, if that is what she is speaking of but a majority of
them, like the present, Hill 'N Park people have been using the south
road which is oiled paved over to Thirty-fifth Avenue and then north
at the Elks Club. I am sure this will be the same case with the West
Hill 'N Park. There will be access roads to that road to the aouth
of the West Hill 'N Park and I am sure everyone would rather drive on
an oiled street which will be in West Hill 'N Park and along to that
county road and then east to Thirty-fifth Avenue rather than going
across the country so to speak to Arrowhead Dam. And so I feel confident
in my own mind that the majority of them will be using the road south of
the park.
Mrs. Albrent: Excuse me - I wish they would use our road maybe we would
get it paved.
Audience: They do go through Arrowhead a lot - they come from
Hill 'N Park and go through and drive through out to the other highway.
If you add more on they will come on through then.
Mrs. Albront: If they are going to have so much more traffic and you
have to really live there to have an idea because during bad weather
tha visability is just zero, you can't see the bus from the highway
come around the lake, you don't even see the headlights. When there is
a lot of congested traffic - its surprising you talk teenage drivers
you should see the adults whip off of that hill at 60 miles and hour
These little youngsters are waiting down here for a bus and you couldn't
see a child let alone a dog or a horse or a house and if it means there
is going to be this much more traffic it is going to be a hazzard for
our family plus the bus condtion. Now we know last year they put on a
new bus just for Hill 'N Park and the Country Estates Trailer area. Sixty
some children. Sixty some children alone ❑n an elementary bus, where 3
years ago our 3 children - there were 6 - on well - but they should
accomodate 1 child per seat and there were 6 children on 2 seats.

Two years ago it was a just as bad. Last year we got a new bus and
this accomodates 52 trailer areas alone.
Mr. Billings: Are there any other further questions?
Mr. Meyer: I think it would be justifiable and reasonable to',hear
from actual witnessess - from people who are experiencing living next
to a trailer court. Now other people have come here not to just set
and listen but because they had a cause and reason. I happen to be
owning the farm adjoining the present trailer court and I would like
to give you some real practical experiences that I have had. Now I
have the farm - I have a business to operate I don't have time to be
out there all the time but last summer when I had to be out there
there were two normal average young boys-13 - 14 years old- came in
to the pasture where there is a big sand bank and tunneled in approximately
six feet before I ever saw it and I was scared and I ran over there
and talked them out of it. That is just one thing. Now let me ask
you this who has the right from a selfish and monetary value to expose
me to those obligations, compels me to liability insurance to protect
somebody like that that comes on my property. Now I wouldn't mind the
children but who has the right to do that you have got to make a fair
today or
honest decision here. No doubt/in the near future. Nnw there are other
trailer court
people here - lined up here - that are neighbors to the and I hope
you call on them, and I hope they will get up. That is just one thing.
Another thing I would like to mention is this now - trailer courts - I
appreciate the fact that some people have to have a place to live but
who has the right to impose that or create that hardship, devalue property
in your area that has a potential of a housing project in order that
somebody might live there. Now that a real reasonable question as far
as I am concerned. I think - this isn't the answer.
Mrs. Albront: Well I certainly agree with him and I wasn't notified
at all of this evidently I missed it in the paper but what seems *o
strange to me is when anything like this is proposed the people in the
surrounding areas are the last ones to find out. Now we all read the
paper true

Mrs. Albront: but it is so easy for each and everyone of gs to miss it
some way or another. It seems to me that we the immediate surrounding
families should be notified because it is still our families, our property
and we are the ones who are immediately involved and I can tell you
honestly you get out there in the monning and watch that traffic situation and
you wouldn't your children waiting out there to get on a bus or for a bus.
Mr. Billings: We do publish this in the legal paper and any zone change
that comes within the immediate area of the local paper it is also published
in that paper. Mr. Lorensen was there a sign on the property" specifying
the time of the change of zone - I presume?
Mr. Lorensen: Yes.
Mr. Billings: Now we also send by registered mail - landowners who are
actually within the area we sent out 19 certified letters to people within
the area. We have it looks like 3or 4 certified letter that have been
returned without people accepting them. We use every facility at our
means to notify all the people in the area - both by legal advertisement
in the paper and also by registered mail.
Mr. Telep: Mr. Chairman, I would like to also make an observation
and add to what to what you have already said. We have complied with the
law - the letter of the law - and this is why when we don't contact people
personally by certified mail we have a right to assume that the rest of
the people are sufficiently advised, published in a newspaper of general
circulation. So we have done all we can humanly do and evidence that you
have in this meeting here and that you did come and you did find out someway
So this is the object - the fact of the matter is you did find out - so you
did get notice.
Mrs. Albront: Well the point I am trying to make, now there are roughly
30 families, living in Arrowhead right now I talked to 7 to 10 people
they are
this morning and not one of them knew about it - involved - if they
going to be if you are going to limit the area, now like Hill IN Park
there was north of us - northeast, the last time a bridge was out somewhere
on the road whereever over the Thirty-fifth we had all of that traffic.

So your kids are not allowed out on a horse or a bike or/thing either
in the morning or the afternoon when all these people come home - well
this is all fair and good too people have to live, but in the meantime

Mrs. Albront: it would seem that the people in the - the immediate
household owners we are the ones that really have the greviance
and all that was agricultural area to begin with.
Mr. Telep: This is true, of course, and we want
Mrs. Albront: That is why we moved out there
Mr. Telep: We appreciate your concern - this is true - but you can
appreciate to that the Board is called upon to hear things of this sort
it tries to do the best it can under the law they have a hearing and
whether this petition is granted or not I am sure that the Board will
do a lot of soul searching after a lengthy and well discussed hearing
and Mr. Chairman, may I answer the gentleman about who has a right to
do what with his property. Sir you have a farm and another person
has a piece of land maybe 5 acres or 10 acres you have the right to
do what you want with your land as long as you don't hurt someone else
and you have a right to put your land to the highest and best use,
whatever that might be. That is in answer to some of the questions you
brought out. N-,w you have recourse if someone does you damage, you most
certainly have the right to sue someone. The County doesn't owe you that
right and you own property and your certainly have the right to enjoy
that property. You should be free from molestation and anything else
but you have to do that on your own. You have the right to protect your
property I think I have answered your questions in part at least.
Mr. Meyer: You said as long as they - as long as these actions don' t
effect me on my property - is that right?
Mr. Telep: Thats right
Mr. Meyer: That is what you are talking about.
Mr. Telep: Yes. You said it did effect you and your property
Mr. Meyer: What else would you have stated was effecting the value
of person's property , a neighbors property, by having trailer courts
going in next to it? Now let me ask you this, if you have done any
studying, I travel around the state a lot and I have actually done
some spot checking. Home development around trailer courts is much
slower and with lots less valuation. Now if you don't think that is
right you can check into your records.

Mr. Telep: This is probably true Mr. Meyer but I don't want to get
into a lengthy discussion with you, I am just trying to tell you that
I am here on the legal end of this and I try to tell you what your legal
rights are. I am sure I don't need to because you seem to be aware
from hearing you talk - you know yourself that you can go ahead and
defend your rights from whomever you have to defend them against.
Mr. Meyer: Well as awkward as this action might be - I think it
would be very much considered by the Commissioners if they would take
reaction
this into consideration, how awkward the aet4eeimight be-by taking in
Court to regain that which you might loose.
Mr. Telep: Well we can't - like I said before - I don't want to
get to involved here. I thought I answered you in part because you
were fearful that you were being deprived of your rights. You were
being molested in the enjoying of your property. We can't guarantee
you that I just want you to know that. We couldn't guarantee you that
if we tired. Mr. Chairman, I believe that we are ready to proceed
if there are any other questions that might need to be answered.
Audience I am concerned about the total planning maybe this
is going to the County Planning Commission the area surrounding
Greeley, I have lived in two different places in the last six or
seven years and I am beginning to feel like a transcient in looking
for a place where I can live where I don't have a high density neighbor
moving in on me. I still own property on the sest side of Greeley and
the total area has been conficated by mobile homes, and I am for people
having a place to live but it seems to me we are developing ring clear
around the entire city so there is no place for people who would like
to live outside of the city that still work in Greeley. There is no
place you can live. This moving around I - this - I keep loosing
property value which I can't afford I have already had this happen
to me twice is there any area in the area surrounding Greeley where
the zoning can not be changed to mobile homes and a person can go
and find a place and expect to stay one year or two if he wants to
not move to a high density area.

Mr. Telep: Mr. Chairman the only thing I can say is it seems to me
that you had better buy a lot of land around you and isolate yourself.
There is really no assurance at all because we are having growing pains
and so is planning really. The only reason the whole area outside
of certain specific zoned areas have been zoned agriculture is because
agriculture districts are the least restrictive and from the agricultural
area when someone wants to take his land out for whatever reason , he
might be Mr. Meyer, the man on your left, immediately, he might want
to subdivide his whole farm for exclusive residential homes or estates
or things like that which are more restrictive he may want to do that
one day, I don't know what he has in mind.
Audience: I understand this but I think that it is this body
who decides whether this plan has been approved or not.
Mr. Telep: Well they try to give good planning this is true.
Audience: I guess I am questioning the assigment of the area
around Greeley and they have almost given up the entire east side
and those who own property there can kind of forget it because we lost
our property value maybe if it going to keep moving all the way around
there is no place to go.
Mr. Billings: I would like to make one statmert here in order to
t testify in Washington D. C. and I have an airplane which I have to
catch in not to long a time and so unless we can complete the discussion and
it doesn't seem like we can in the next few minutes - - -
Mrs. Albront: Mr. Chairman, may I ask Mr. Shupe one more question?
Is there any other potential development of this sort now in this area
that you are down there with now? Not just your or yours or someone
elses - how far can Hill 'N Park go the way it exists now and how much
more is there going to be in the future to develop down there - not just
this one but how much more is coming?
Mr. Shupe: I can not answer for the people but there is no more that
I know of in our present plan this expansion here is the extent of what
we ---
Marshall Anderson: Is all the land zoned?
Mr. Shupe: We still have the north have - we have land out to the north
of this particular property that will be residential.

Mr. Lorensen: There is land to the east where they are expanding their
park where they have put in part of the street system at this point.
That is immediateey to the east of the existing park and this is
immediately west,.
Mr. Billings: I think there need to be considerable more discussion
on this than we have and without any other objections we will continue
this until next Monday at 10:00 o'clock, the 14th of December. I do
have to leave it is something that I could not foresee or anything else
and the other Commissioner had to participate in a funeral today which
has created quite a problem for us. So unless there are objections
I will close this meeting until 10:00 o'clock on Monday, December 14,
1970.

Re: Hill-N-Park Sanitation District
Sewage Collection and Treatment Facilities
The Hill-N-Park Sanitation District Board of Directors has retained this office
to do the following work:
1 . Supervise and instruct the Sanitation District forces in the removal
of all vegetation (cattails) in the Hill-N-Park lagoon.
2. Supervise and instruct the Sanitation District forces in the cleaning
of the collection system lines , manholes, and control boxes.
3. Conduct measurements and tests of hydraulic and B0D loading presently
being experienced. This includes counting and measuring flows from
the various mobile homes.
4. Design and prepare, for State and local health officials review, plans
and specifications for additional lagoons and aeration equipment. This
design and construction will be adequate for all present and anticipated
future loadings , including the 405 units in Hill-N-Park West.
This is to advise you that, in accordance with your request and the directives
of the Weld County Planning Commission, all vegetation within the lagoon has
been removed. The banks have been mowed and all inflow lines and control
structures have been cleaned. In addition, the water depth within the lagoon
has been increased to five feet and will be maintained at this level by
utilizing water from Lake Arrowhead.
This office is installing wiers in the manholes at present with the intent
of making prolonged hydraulic measurements in order to establish the hydraulic
design criteria. This information will also answer question's pertaining to
seepage losses from the lagoon. Twenty-four hour composite and individual
grab samples will be taken to establish B0D loadings presently being experienced.

Mr. Gene Facetti of the State Health Department has requested that these
measurements be completed and furnished to your office and the State Health
Department office, so that actual hydraulic and BOD flows from mobile homes
can be established. This District is unique in that it services only mobile
homes.
The Hill-N-Park Sanitation District intends to accomplish the necessary con-
struction of a new lagoon and/or installation of aeration equipment as soon
as our design has been approved by the appropriate health officials . It
is anticipated that this design will be ready for review by February 1 , 1971 .
The Sanitation District has funds to complete the new construction without
a bond issue or Federal assistance.
We hope that this information will enable you to approve the filing of Hill-
N-Park Second Addition and, subject to your approval of the construction plans ,
to approve the inclusion of Hill-N-Park West.

Mr. Gene Facetti of the State Health Department has requested that these
measurements be completed and furn :s'hed to your office and the State Health
Department office , so that actual hydraulic and DOD flows from mobile homes
can be established. This District is unique in that it services only mobile
homes.
The Hill-N-Park Sanitation District intends to accomplish the necessary con-
struction of a new lagoon and/or installation of aeration equipment as soon
as our design has been approved by the appropriate health officials. It
is anticipated that this design will be ready for review by February 1 , 1971 .
The Sanitation District has funds to complete the new construction without
a bond issue or Federal assistance.
We hope that this information will enable you to approve the filing of Hill-
N-Park Second Addition and , subject to your approval of the construction plans ,
to approve the inclusion of Hill-N-Park West.

Dear Sir,
After visiting the site of Hill-N-Park Mobile Home Delelopement lagoon
and talking with Mr. John Haley, Engineer. We recommend that no future
developement be connected to the lagoon after Hill-N-Park #2 has been
completed.
The lagoon will take Hill-N-Park without any danger of over loading.
We also recommend that before any addition like Hill-N-Park West be
developed the lagoon be enlarged or other methods of disposal be completed
before the development is complete.

COVENANTS FOR H i LL-N-PARK
1 . Each lot in the subdivision shall be occupied for residential purposes
by a mobile home only.
2. No mobile home located on a lot may be other than of factory origin and
may not be more than five years old on the date it is located on a lot.
3. Any mobile home located on a lot shall be of dimensions no less than
12 feet by 46 feet.
4. Each mobile home located on a lot shall be set back at least 25 feet
from any street right-of-way.
5. Each lot on which a mobile home is located shall be fenced as follows : '
A. The entire rear portion of each lot;
B. 75% of side lines;
C. Street frontage shall be unfenced;
D. Style of fence required shall be Elcar type chain link fence
similar to type installed on Lot Fifteen (15) , in Block One (1)
Hill-N-Park. '
6. No basement house, tent, shack, garage, barn or trailer, prefabricated
structure or any out-building shall be occupied or used as a residence,
temporarily or permanently.
7. All carports and patios or additions to mobile homes shall be of
factory origin.
8. All vehicles, boats, campers, tractors, trailers or trucks shall be
parked in special lot provided in said subdivision and shall not be
parked on an individual lot.

side lot line and no more than one mobile home may be placed on any

14. In no event shall any portion of any mobile home or other structure be
erected over any easement for utilities or otherwise.
15. No lot as platted shall be subdivided for the purpose of making two or
more lots. No more than one mobile home shall be permitted on any one
lot.
16. Easements for utilities and maintenance thereof are reserved as shown
on the recorded plat.
17. Natural drainage associated with any lot shall not be altered so as
to drain onto the adjacent properties.
18. All trash, garbage and other household debris shall not be allowed to
accumulate for more than 14 days before disposal . Each property owner
shall be responsible for the proper storage and disposal of trash,
garbage and household debris in accordance with the current rules of
the County Health Department.
19. All dogs, cats and other domestic pets shall be confined to the indivi-
dual property owner's premises. No more than 4 adult animals of all
types will be retained as pets on each lot.

20. Each lot shall be accompanied by a voting and assessable membership in
the Hill-N--Park property owners association. Said association shall be
responsible for the maintenance of all parks, tot parks, buffer zones,
storage areas and other areas designated for the use of all residents of
the Hill-N-Park subdivision. Bylaws for the association will be de-
veloped, changed and enforced by the members of the association.
The developers of the Hill-N-Park subdivision shall build and maintain
all facilities within the designated open spaces and parks until such
time as 50% plus one of the lots have been sold to other voting mem-
bers;
thereafter the developers of Hill-N-Park subdivision shall vote
and pay assessments on only that number of the lots remaining in their
ownership.
