This meeting was called to order by Vice Chair, Tom Cope, at 12:30 pm. Roll Call. Present: Tom Cope, Lonnie Ford, Skip Holland, Sam Gluck, Butch White, Pamela Edens, Michael Palizzi. Absent: Elijah Hatch, Michael Wailes. Also Present: Kim Ogle, Chris Gathman, Diana Aungst, Angela Snyder, and Maxwell Nader and Melissa King, Department of Planning Services; Lauren Light, Department of Health; Bruce Barker and Karin McDougal, County Attorney, and Michelle Wall, Secretary. Angela Snyder, Planning Services, presented Case USR22-0005, reading the recommendation and comments into the record. The applicant has applied for building permits and the permits are on hold waiting for the USR determination. The building coverage shall not exceed 15 percent. Staff received 5 letters of support from surrounding property owners. The Department of Planning Services recommends approval of this application along with conditions of approval and development standards. Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site dust control, and the Waste Handling Plan. Courtney Thomas, 16417 Coleman Avenue, Fort Lupton, Colorado. Ms. Thomas is representing her husband, Juan Garcia. She said that they wish to build a greenhouse and a front porch that is approximately 64' x 10'. They want the front porch covered because they have experienced issues with broken windows from hail and 4' snow drifts. Ms. Thomas explained that her daughters plan to join 4-H. Once her children figure out what kind of livestock they want to raise, they will build proper accommodations to house the animals. From experience they have found that different animals produce different bacteria, so they have to keep them separated in different coops or different structures. Ms. Thomas said they take pride in their property and hope to encourage their neighbors to do the same. Commissioner Ford asked staff if the 15 percent building coverage would be great enough to cover all the structures the applicant wants to build. Staff explained that the applicant had to demo an addition on the side of a building because it encroached into the offset. The applicant plans to rebuild the side addition on the other side of the building. Ms. Snyder said the greenhouse was included in her calculations to keep building coverage no greater than 15 percent. Commissioner Ford asked staff if the Planning Commission could recommend a little more coverage to make sure they can build what they intended under this USR. He felt it would be a shame to have to come back and ask to amend the USR if the applicant didn't quite meet the 15 percent. Staff said they could make a motion to change it. CoMM,un', co.1- 0n3 6/22/2z 2022-1750 Ms. Thomas explained that once her girls figure out what animals they want to raise and compete with, they will demo buildings that are currently on their property and rebuild new structures. Commissioner Edens asked the applicant if the new structures will be the same size as the old ones. Ms. Thomas replied yes. The applicant said they do not plan on having large livestock. Commission Holland asked staff what the size of the lot is. Ms. Snyder replied it is 1.1 acres. He asked how this lot compares to other lot size in the neighborhood. Staff answered that all the lots are right at 1 acre. Commissioner Holland asked if most of the lots have outbuildings. Ms. Thomas responded that they do, and most are larger than what they have. Mr. Holland asked staff if there are properties in this neighborhood that are in violation of exceeding lot coverage. Ms. Snyder answered that there are many USRs in this neighborhood due to exceeding lot coverage. The Chair asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Commissioner Edens asked staff what the guidelines for lot coverage are in Weld County. Ms. Snyder replied that this is an agriculturally zoned subdivision, so it is based on the size of the lot. One acre allows 10 percent lot coverage. There was discussion with council if the lot coverage amount could be slightly increased. Bruce Barker, County Attorney, explained the importance of following the legal notice. Mr. Barker asked staff if the 15% was called out in the notice or application. Ms. Snyder responded it was not. She based that amount from the calculations she did by the buildings the applicant intended on having. Mr. Barker said the amount could be increased, but it would need to be in reason. Motion: Amend Condition of Approval 3 to read "The building coverage shall not exceed 17 percent". Moved by Pam Edens, Seconded by Michael Palizzi. Motion passed unanimously. The Chair asked the applicant if they have read through the Development Standards and Amended Conditions of Approval and if they are in agreement with those. The applicant replied that they are in agreement. Rick Bailey, Industrial Tower West LLC, 205 South Maloney Road, North Platte, Nebraska. Mr. Bailey explained that he has been working on this project for several years. He said they have many towers in Weld County and they are usually in rural areas. Their primary carrier is Viaero Wireless which is a rural carrier. There is a significant coverage gap north of Stoneham which is where the proposed site will be. The Chair asked if there was anyone in the audience who wished to speak for or against this application. Linda Craig, 47828 Highway 71, Stoneham, Colorado. She said that she has good cellular service with Verizon and there are currently 4 other cellular carriers in the area. Ms. Craig is also representing her mother. She said they protest the proposed cellular tower. Their property is located directly across Highway 71 on the east and would be yards away from the proposed tower. Her family homesteaded land on this ranch over 100 years ago and has lived at their farmstead for 82 years. Ms. Craig stated there are many scientists, researchers and medical doctors who now study the destructive effects of electromagnetic field radiation (EMF) that these towers produce. She said there are consequences to humans, domestic animals and wildlife. Ms. Craig read articles about EMF radiation that included findings of cancer, lower birth weights, headaches, infertility, heart issues and several other symptoms. Commissioner Gluck asked Ms. Craig if the proposed tower was on her property. Ms. Craig responded no but that her home was yards away. Roger Blake, 75144 County Road 110, Stoneham, Colorado. Mr. Blake stated that him and his wife object to the proposed Viaero cellular tower. They have ranched on their property for 50 years on land that is approximately 4 miles northwest of the proposed tower site. There is an existing cellular tower a few miles from where they live. They have pastureland that is 2 miles away and they also run cattle on the Craig's property. Mr. Blake shared the same concerns about the harmful effects of EMF radiation. They had a neighbor who currently passed away from cancer. He said his wife is in delicate health and they do not want to have added negative effects from EFT radiation. Mr. Bailey explained that the tower project will have to meet requirements from local, state and federal governmental entities. He said it is a lengthy process. Mr. Bailey explained that they have a license issued by the FCC for the radio waves used. The FCC controls the standards that must be met. He also explained that the cellular tower would not broadcast constant like an AM radio station. It sends a signal when it is responding to a cellular user's request. Commissioner Cope asked the applicant if they researched using other towers in the area. Mr. Bailey said they did but the other towers would not cover this gap in service. The Chair asked the applicant if they have read through the Development Standards and Conditions of Approval and if they are in agreement with those. The applicant replied that they are in agreement. CASE NUMBER: USR22-0008 APPLICANT: BRIAN AND JODI WARREN PLANNER: MAXWELL NADER REQUEST: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT FOR OIL AND GAS SUPPORT (DIRECTIONAL DRILLING) OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT. LOCATION: WEST OF AND ADJACENT TO CR 43; APPROXIMATELY 0.45 MILES NORTH OF CR 74. Maxwell Nader, Planning Services, presented Case USR22-0008, reading the recommendation and comments into the record. Staff received 11 letters from surrounding property owners; 3 letters were in opposition. The letters in opposition address a dispute with a shared access which is a civil matter and does not involve the County nor the decision of the USR application. One letter addressed concerns about the traffic hazard to County Road 23. 7 letters were in support of this request. The Department of Planning Services recommends approval of this application along with conditions of approval and development standards. Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site dust control, and the Waste Handling Plan. Tim Naylor, Agprofessionals, 3050 67th Avenue, Greeley, Colorado. Mr. Naylor is representing Directional Plus and the Warren Family. Directional Plus provides horizontal boring under roads for utilities in places where conventional trenches are not practical. The equipment will be transported to the location of the project until the project is complete. Once the project is complete, they will move the equipment to the next location. If they are between projects, the equipment will be stored on the owner's property. Mr. Naylor said employees will come to the Warren's property to pick up vehicles to take to the worksite; they return the vehicles at the end of the workday. There are no onsite employees. He said they are working with an engineer and will bring the barn up to commercial standards. The Chair asked if there was anyone in the audience who wished to speak for or against this application. Greg Worrell, 36459 County Road 43, Eaton, Colorado. Mr. Worrell said their property is south of the Warren Family's property. The Worrell's have been farming on their property for 10 years. He explained that they share an access point with them. Mr. Worrell said that the Warren's put up a fence on the south side of the shared access point that has hindered their hay sales and sales from their orchard. Commissioner Gluck asked Mr. Worrell if he has contacted the Sheriff. Mr. Worrell explained that they are in process of a civil suit. Karin McDougal, County Attorney, explained to the Planning Commission that the access civil matter is separate from the USR application being proposed today. Mr. Worrell explained that he is in opposition of the proposed business because it is interfering with his business. Mr. Naylor said the access is a civil matter that is in court. He said it will get worked out. Mr. Naylor pointed out the access points on the PowerPoint slide and showed where the Worrell's have another access point to their property. Mr. Nader proposed to modify the current request language to read as ""A Site Specific Development Plan and Use by Special Review Permit for Oil and Gas Support and Service for establishments principally engaged in serving the oil and gas industry, including directional drilling, outside of subdivisions and historic townsites in the A (Agricultural) Zone District" This modification does not change the specific use being proposed nor the overall foundation of the request. The modification is to ensure clarity for the proposed use on site for the current owner and future owners of the property. Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site dust control, and the Waste Handling Plan. Ana Ornelas, 6736 East 123. Place, Brighton, Colorado. Ms. Ornelas said she is representing herself as one of the property owners and also the trucking community. She said she is the owner, host and organizer of Colorado Truck Madness. It is a huge event held annually at Pikes Peak International Raceway. Mr. Ornelas said she has been contacted by Aurora and Denver police departments requesting her assistance in finding a safe place for the trucking community to meet instead of them trespassing and having gatherings, doing burnouts, etc., on private property. The Chair asked if there was anyone in the audience who wished to speak for or against this application. Debbie Shipps, 17164 Weld County Road 100, Nunn, Colorado. Ms. Shipps stated that she is the Assistant Chief of the Nunn Fire Protection District. She owns the property that is directly north of the applicant's property. Ms. Shipp said several hundred cars come and go from the events that are held on the property. She said that the Nunn Fire Department has to respond to several calls for injuries or fights that happen at an event. Although there is an ambulance and security present on site, people use their cellphones to call 911 in an emergency. She shared her concerns about the hundreds of vehicles leaving the site at the same time and safety issues. Ms. Shipp said people drive on her fields, neighboring fields and surrounding intersections to do burnouts. She said the applicant does a pretty good job in picking up the trash the next day. Commissioner Holland shared his concerns about what happens after the events are over. He doesn't feel that these types of events are compatible with the area since people get in accidents or go on other properties and cause damage. Staff explained there are development standards that help to mitigate many of these concerns. Ms. Aungst said there are 5 events allowed per year. Commissioner Gluck said he would be concerned that burnouts being done in neighboring fields could cause sparks that could create a fire. Ms. Shipp said that she has worried about fires as well. Melissa King, Development Review, explained that the applicant currently operates under a traffic impact study that is associated with their USR from 2017. The 2017 USR contains that there will be 5 major events which could draw up to 2,000 spectators. Mr. Ornelas was not aware that people were going onto Ms. Shipps' property, and she apologized. Ms. Ornelas said she will hire traffic control people and signs to mitigate that problem. Traffic control will make sure traffic does not head north on CR 37. Commissioner Ford asked Ms. Ornelas if there is adequate parking for 2,000 vehicles. Mr. Ornelas replied yes, their property is 80 acres in size. Ms. Ornelas stated she only plans to have 5 big events where she can give the truck community a place to gather and do their burnouts, etc. There was discussion about adding traffic control preventing traffic from leaving north into the resolution. Ms. King read Condition of Approval 1.B. "The existing Improvements and Road Maintenance Agreement (Rec. No. 20180334) shall be reviewed and revised, as necessary, to address the traffic associated with the proposed use of the site." Commissioner Cope said that he thinks the Condition of Approval is adequate to cover this concern. He feels this traffic control concern should be addressed in the Improvements Agreement. The Chair asked the applicant if they have read through the Development Standards and Conditions of Approval and if they are in agreement with those. The applicant replied that they are in agreement. Kim Ogle, Planning Services, presented Case 2MJUSR21-02-1343, reading the recommendation and comments into the record. The Department of Planning Services recommends approval of this application along with conditions of approval and development standards. Planning staff has one amendment to the PC Resolution, a modification to COA 1.B. The current language reads, "The applicant shall attempt to address the concerns of the Town of Firestone as stated in their referrals dated November 18, 2021, and February 26, 2022, including submitting an annexation agreement with a date certain to perfect this action. Written evidence of such shall be submitted to the Weld County Department of Planning Services. (Department of Planning Services)." Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site dust control, and the Waste Handling Plan. Alex Schatz, Ready Mixed Concrete, 5775 Franklin Street, Denver, Colorado. Mr. Schatz said this site is a daytime operation as an aggregate facility. They did include both a hot mix (asphalt) and a ready mixed (concrete) batch plants on this application; however, it has not been determined if that will happen on this site. He said they expect to mine this site for 10 to 15 years. The end use of this project is to be a water storage facility. Mr. Schatz explained that the current site access is off of County Road 28 into the property permitted for the in -situ water storge facility. A new access will be requested east of County Road 17 on County Road 28 for the proposed company maintenance facility access. A new possibly shared Commercial access is proposed to be off of Highway 66. He said they are willing to work on traffic issues. Mr. Schatz said they concur with the staff report and request approval from the Planning Commission. The Chair asked if there was anyone in the audience who wished to speak for or against this application. Linda Pyeatt, 13895 County Road 21, Platteville, Colorado. Ms. Pyeatt said they began meeting with the applicant about a year ago to discuss this project. They had concerns about the commercial access on County Road 28. She said if they have an access off Highway 66, she does not think they should be allowed to have a second access on County Road 28. Ms. Pyeatt said that Highway 66 is a 2 -lane highway with no shoulders. The traffic is horrible. She said there are improved intersections are on Highway 66 and County Road 19 and Highway 66 and County Road 13. Ms. Pyeatt is concerned about the congestion of traffic that will come through on US -85 through Platteville. She hopes to see more traffic go west to l- 25. Ms. Pyeatt said she would like to see a signal either at the pit entrance or at County Road 19 whether it meets the CDOT warrants or not. She does not want trucks using County Roads. Bruce Wilson, 2108 Kelley Drive, Longmont. Mr. Wilson said he has 2 farms on County Road 28 east of County Road 19. He said that he has also been working with the applicants to try and figure out the best solutions to better the neighborhood and entire process. Mr. Wilson said he would like Ready Mix to honor the well monitoring agreements that neighbors had with Owens Brothers. He does not think a batch plant is compatible in the area and requests that language be removed from the USR at this time. Mr. Wilson agreed that truck traffic should use Highway 66. He said the access on this USR request is at County Road 28; if approved, they will use County Road 28 until an access is built on Highway 66. The intersection on County Road 28 and County Road 19 is very dangerous. David Reitz, 10898 County Road 28, Fort Lupton, Colorado. Mr. Reitz and his wife live on County Road 28, to the east of the site. His primary concern is the traffic on County Road 28. Mr. Reitz is concerned about trucks bypassing the route on Highway 66 to US -85 and using County Road 21 to connect to County Road 28, then east to US -85. He said traffic exceeds speed limits and it is dangerous with people driving farm equipment. He is also worried about the safety of neighbors walking dogs or riding horses. He hopes that there will be a signal light to control traffic on Highway 66. Mr. Reitz stated a lot of people have died on Highway 66 in the last 10 years. John Martini, 9268 County Road 28, Platteville, Colorado. Mr. Martini said he lives south and east of the site. He said he agrees with Mr. Wilson who brought up the ambiguities with the permit. Mr. Martini also agrees the permit needs to clearly say the access will be off Highway 66 and not County Road 28. He is worried about more accidents and added traffic in the area. Mr. Martini is also concerned about the added changes to the application and their wells being damaged. Paul and Traci Perez, 8677 Highway 66, Platteville, Colorado. They are the owners of Jasper's Boarding Doggy Daycare. Mr. Perez said they are concerned about the traffic on Highway 66. As a business owner, added truck traffic is a big issue. He hopes that CDOT will put in a traffic light to help with traffic. Mr. Perez was concerned about Condition of Approval 1.A. that requested a letter from the applicant to vacate SUP -240. He was worried that was his permit for his doggy day care business. Mr. Perez said he did not receive any information in the mail regarding these changes. Ms. Perez stated that with the added truck traffic on Highway 66, it will equate to a truck a minute going past their property, home and business. She said some of their clients are scared to bring their dogs because of the traffic. Customers have a hard time getting in and out of their property. Ms. Perez said they report at least one accident a week at Highway 66 and County Road 19. She agrees there should be a stoplight. Commissioner Holland explained that an organization cannot pay for a stop light because there are serious warrants that must be met before a stop sign or a stop light can be put in. He said he uses Highway 66 and understands everyone's' concerns. Only the United States Government Federal Highway Department can make the decision to add a traffic light. Freddy Marquez, 9673 State Highway 66, Platteville, Colorado. Mr. Marquez said he was just informed of this application and hearing yesterday. He is against the applicant's proposal. Mr. Marquez is upset that the applicant didn't try harder to speak to their neighbors about their plans. Geoff Morris, 8553 Highway 66, Platteville, Colorado. Mr. Morris said his property is across the street from the proposed access. He is not looking forward to a line of trucks waiting to turn into the site right across from his driveway. It will be hard to pull his horse trailer out into traffic. He also said he foresees when he is waiting to turn left into his driveway, he will have a long line of vehicles stopped behind him while he waits to turn. Jim Flynn, 9163 County Road 28, Platteville, Colorado. Mr. Flynn lives a' mile east of the intersection of County Road 19 and County Road 28. He said there are 7 houses along County Road 28 between the intersections of County Road 19 and County Road 21 and the speed limit is 25mph. No one drives 25mph; he said they are lucky if people are driving 40mph. Mr. Flynn said a sheriff deputy once told him that they call County Road 28 the Platteville Bypass. They do not want more traffic on County Road 28. Becky Weinkauf, 10610 State Highway 66, Platteville, Colorado. Ms. Weinkauf stated that living near a batch plant is not desirable. She is concerned about a decrease with her property value. Ms. Weinkauf is concerned about ground water and their wells being monitored. She thinks that a batch plant is industrial and is concerned about her health and air quality. Ms. Weinkauf shares concerns with her neighbors about traffic and safety. She said there are many bad accidents at the intersection of Highway 66 and County Road 21. Mr. Schatz apologized that some of the neighbors have not received any information from them. He said that is not intentional. Mr. Schatz explained that there is a special use permit on the Ready Mix site for a dog kennel. That is the special use permit that they want to vacate; not the neighbor's kennel Jasper's Boarding Doggy Daycare that is across the street. Mr. Schatz said they are still working with CDOT and they have the safety of everyone in mind. They will continue to find the best solution for traffic in the area, possibly meeting some warrants. Mr. Schatz said that the batch plants would not be long term, but job attached. They would be mobilized for a couple months, then demobilized. He said they will work with the neighbors. Mr. Schatz said he is willing to speak to the neighbors after the meeting about their concerns. They can discuss water well monitoring agreements. He said their process should not affect well levels. The Chair asked the applicant if they have read through the Amended Development Standards and Conditions of Approval and if they are in agreement with those. The applicant replied that they are in agreement.
