Special Districts, surrounding communities, Weld County, and utility providers are receiving this particular notice. The location is west of and adjacent to 47th Avenue (WCR 33) and approximately 1000' south of Weld County Road 394. The subject site is located within the City of Evans' Urban Growth Boundary and west of the MountainTRAX Industrial Park which is in Evans. At their public hearing last night, Evans City Council determined there is interest between the City and the applicant to discuss annexation and zoning. Council set a hearing date for the first reading of the Annexation and Zoning request for October 18, 2022. Documents are provided for your comments prior to Tuesday, August 23, 2022. Loin 0 www.evanscolorado.gov pp Project Description/Narrative - Annexation and Concurrent Zoning Mountain Cement Company PROPERTY DESCRIPTION The subject property is located south of Union Pacific Railroad and west of County Road (CR) 33/ 47th Avenue. The project is comprised of two parcels, Lots A and B of Recorded Exemption No. 1057-03-04 RECX15-0163, parcel numbers 105703400001 (Lot A) and 105703400002 (Lot B) for a combined 93.0 acres. The lots are vacant and currently being farmed with row crops. PROPOSED DEVELOPMENT The applicant has requested the subject property be annexed into the City of Evans with Heavy Industrial (1-3) zoning. Per the City's Comprehensive Plan, this property is located within the future Industrial land use area with rail access. The proposed project is an Industrial Rail -Served Cement and Cementitious Products Sales Terminal for the purpose of off-loading cement, pozzolan and slag cement products in dry powder form from the railcars in a covered building and storing those products in elevated steel or cement silos. Customers will utilize semi -trucks to be loaded beneath the silos in an enclosed loading area over a scale through two lanes of operation. The site will operate year-round and will eventually have the ability for trucks to self -load during off -hours. The property will be design with the needed rail operations to facilitate rail delivery and storage of products in those cars to bridge the gaps in the delivery schedule and allow for material in the silos to be replenished between rail deliveries. The site is served by Union Pacific Railroad (UPRR) and will have dedicated on -site tracks for the delivery and pick-up of the railcars. This process will occur according to the schedule of the UPRR but is likely up to six times a week. A dual rail unloading station will allow material from railcars to be unloaded quicker to sustain operations. Material from those cars will then be transported pneumatically to the appropriate silo in the terminal. The terminal will have four product storage silos, which have the capability to load trucks with cement through self-sealing spouts and within the confines of the terminal structure beneath the silos. There will be two loading lanes for those trucks and all products will be weighed on a scale prior to leaving the facility. The proposed structures include the rail unloading building, four silos, a compressor building, an office/control room/break-room/maintenance shop, and motor control room. The structures and terminal will be installed in a single phase. The exception would be the full rail construction, which may be phased to match sales volumes. It is anticipated that business and sales will ramp up over time. The proposed project is not anticipating full -use of the property, so the subject property has potential for future additional rail service and/or other industrial business opportunities. At this time, however, no other business or expansion is planned or being requested. Page 114 The site will consist of the following areas: 1. Concrete drives for customer truck access around the terminal. 2. Gravel laydown areas or parking areas around the terminal building may be utilized. 3. Gravel rail maintenance roadways for car and rail inspection along the track corridor 4. Structures - a. Rail unloading building - i. approximately 3,000 square feet ii. provides weather -protected unloading for the dual -rail unloading stations iii. sized to completely enclose both tracks and all personnel as they work to unload the rail cars b. Four silos - i. From 32 -foot to 40 -foot diameter ii. up to 135 feet tall 1. height variance has been requested through a separate application iii. skirted down to finished grade to provide covered weather -protection for the scales and loading operations into the trucks iv. contains dry powder products c. Compressor building - i. approximately 500 square feet ii. controls the air intake quality iii. abates any operational noise iv. protects the equipment d. Office/control room/break-room/maintenance shop - i. approximately 2,100 square feet ii. manager's office iii. employee breakroom iv. restrooms v. maintenance shop for working on mechanical projects vi. storing and repairing the small loader used for on -site activities e. Motor control room - i. approximately 500 square feet ii. used to restrict access into this critical area iii. protects both the personnel and the equipment from ambient abnormal conditions 5. Area of maintained native vegetation within 50 feet of the terminal roadways where visibility is important to traffic and may be reduced to 25 feet in straight sections. 6. Rail lines 7. The remaining project area will be native grasses and is not expected to require maintenance. 8. No outdoor storage of any material is being requested. Page 214 PROPOSED UTILITIES Due to low anticipated domestic water needs to support the employees/operators, it is anticipated the project will use a City of Evans system or the existing Central Weld County Water District water main located in CR 33. There are not any water rights associated with the subject property. With anticipated low water usage, cash -in -lieu is requested for water dedication. There is no sewage collection system in the vicinity, so the project will utilize an on -site wastewater treatment system (OWTS) permitted through Weld County, which will have flows of less than 2,000 gallons per day. A sand/oil separator will be installed forthe maintenance shop and periodic rinsing of site trucks. No customer trucks will be rinsed on -site. Stormwater facilities will be determined during the Site Plan application process. However, due to flat nature of the site, a retention pond may be requested/required. The balance of the property will remain undeveloped forthe initial construction and use of the property. TRAFFIC MCC will utilize a single entrance from CR 33/47th Avenue located at the northeast corner of Lot B near the existing Evans Access Permit No. 0016-2016 location, or approximately 260' south of the UPRR tracks. CR 33 is an unpaved roadway that has been treated with magnesium chloride. The entrance to the site will be paved and will accommodate two-way tractor -trailer traffic. This is also the entrance for all personal vehicles entering the site. The entrance traffic may be controlled by automatic gate. Regular business hours for customer pickups are expected to be approximately 14 hours a day (4am - 6pm). However, special customer needs and requests may allow for extended hours. It is planned that the terminal would have no restriction on operating times, as rail cars may need to be unloaded or could come in at varying hours of the day to accommodate Union Pacific Railroad track availability. This operation is not expected to exceed ten on -site operators. However, depending on business levels and the season of operation, this number may fluctuate higher or lower. Customers are expected to use tractor -trailers for delivery pick-ups. On peak season/days in the spring and summer, operations could support up to 100 trucks per 24 -hour period. All customer truck traffic is expected to access the property via Highway 85 at CR 44, then north on CR 33. Based on typical customer requests and demands, the first peak traffic will be about 6 am, with a second peak likely to occur around 9 am when customers may return for an additional pick-up. A Traffic Impact Study will be provided during the Site Plan application process. FLOODWAY According to the Federal Emergency Management Agency's Flood Insurance Rate Map (FIRM) Community Panel Number 08123C1710E, effective date January 20, 2016, the parcel is in Zone X, an area of minimal flood hazard. There are no wetlands on the subject site or adjacent to the site. Page 314 OIL & GAS FACILITIES According to the Colorado Oil and Gas Conservation Commission maps, there are four oil and gas wells located on the subject property. Two wells have a status of AL (abandoned location) and two have a status of PA (plugged and abandoned). All buildings will be constructed with a minimum 50' clearance from the wellheads. RECOVERABLE GRAVEL RESOURCES According to "Special Publication 5-B, Atlas of Sand, Gravel, and Quarry Aggregate Resources, Colorado Front Range Counties" for Colorado Geological Survey, Department of Natural Resources, State of Colorado, published in 1974, Revised 1975, the subject property is in an area of sandy stream terrace deposits.
