BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, OCTOBER 3, 2022
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, October 3, 2022, at the hour of 9:00 a.m.
IR ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Scott K. James, Chair
Commissioner Mike Freeman, Pro-Tem - EXCUSED
Commissioner Perry L. Buck
Commissioner Steve Moreno
Commissioner Lori Saine - EXCUSED

lf MMINUTES: Commissioner Moreno moved to approve the Minutes of the Board of County
Commissioners meeting of September 19, 2022, as printed. Commissioner Buck seconded the motion
and it carried unanimously.
PUBLIC INPUT: No public input was given.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
CONSENT AGENDA: Commissioner Buck moved to approve the Consent Agenda, as printed.
Commissioner Moreno seconded the motion and it carried unanimously.
COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Reports.
PROCLAMATIONS:
1) WELD COUNTY LONG-TERM CARE RESIDENTS' RIGHTS MONTH - OCTOBER 2022:
Chair James read the proclamation for the record. Tami Grant, Deputy Director of the Department of
Human Services, thanked the Board for the recognition of the dignity, respect, and rights of each resident
living in long-term care communities and this year's theme is, "Building Community." She explained this
allows for connections within long-term care facilities and into the community as an essential part of their
wellbeing. Ms. Grant explained this is the second year Weld County and Larimer County Ombudsman
Programs have collaborated to coordinate an art contest for residents to represent the theme from both
regions. She stated this year Weld County selected two (2) winners: the residents at Garden Square of
Greeley, and Good Samaritan Society at Water Valley Assisted Living and Memory Care, where their

artwork will be displayed all month long printed on yard signs at these communities. Raegan Maldonado,
Department of Human Services, stated there were 50 submissions for the arts program this year, and
the Area Agency on Aging Advisory Board selected the winners. Pam Williamson, Good Samaritan
Society Water Valley Assisted Living, introduced the resident winners who were present, Florence Annan,
Shirley Henry, and Rae Mullenix. Ms. Maldonado stated there are plaques for both of the respective
communities for recognition of their winnings. Each of the Commissioners congratulated the winners
present, and expressed their support for the rights and freedoms of long-term care residents. (Clerk's
Note: The group gathered for a photo opportunity, and Ms. Grant stated the residents from Garden
Square of Greeley will arrive momentarily. Please refer to the end of the Minutes.)
.R WARRANTS:
1) GENERAL WARRANTS - SEPTEMBER 30, 2022: Commissioner Buck moved to approve the General
Warrants, as printed. Commissioner Moreno seconded the motion and it carried unanimously.
BIDS:
1) PRESENT BID #62200136, JAIL 1 WEST ROOF TOP UNIT REPLACEMENT - FACILITIES
DEPARTMENT: Christie Peters, Purchasing Department, stated two (2) bids were received and staff will
make a recommendation on October 17, 2022.
IR NEW BUSINESS:
1) CONSIDER REORGANIZATION OF WELD COUNTY SHERIFF'S OFFICE: Donnie Patch,
Undersheriff, alongside Jill Scott, Director of the Department of Human Resources, explained when
looking at staffing in the Sherriff's Office, it was determined that a part-time interpreter position is not a
necessity as these services are provided by the Court. Commissioner Moreno moved to approve said
reorganization of the Sheriff's Office. The motion was seconded by Commissioner Buck, and it carried
unanimously.
Le 2) CONSIDER TEMPORARY CLOSURE OF CR 37 BETWEEN CR 8 AND SH 52: Amy Mutchie,
Department of Public Works, presented this closure on behalf of AB Underground and the Colorado
Department of Transportation (CDOT), and stated this closure will begin on October 10, 2022, and go
through October 31, 2022, for the south half of the intersection improvements and road paving as the
second portion of this project. She explained the detour route for the record. Commissioner Moreno
moved to approve said temporary closure. The motion was seconded by Commissioner Buck, and it
carried unanimously.
3) CONSIDER TEMPORARY CLOSURE OF CR 95 BETWEEN CRS 112 AND 118: Ms. Mutchie
stated this closure will begin on October 10, 2022, and will go through October 14, 2022, to replace an
irrigation culvert. She further stated the detour route will use water for dust mitigation on the gravel
portions. Commissioner Buck moved to approve said temporary closure. The motion was seconded by
Commissioner Moreno, and it carried unanimously.
4) CONSIDER TEMPORARY CLOSURE OF CR 6 BETWEEN CRS 47 AND 49: Ms. Mutchie stated
this closure will begin on October 10, 2022, and will go through October 14, 2022, to replace an irrigation
culvert. She further stated the detour route is gravel and will use water for dust mitigation. Commissioner
Buck moved to approve said temporary closure. The motion was seconded by Commissioner Moreno,
and it carried unanimously.

El 5) CONSIDER CANCELLATION OF BOARD OF COUNTY COMMISSIONERS MEETING
SCHEDULED FOR NOVEMBER 2, 2022: Commissioner Buck moved to approve said cancellation of the
Board meeting for November 2, 2022. The motion was seconded by Commissioner Moreno, and it carried
unanimously.
El PLANNING:
1) CONSIDER PARTIAL VACATION OF TWO -LOT RECORDED EXEMPTION, RE -3148, FOR
REMOVAL OF LOT B — RONALD AND LAURA NAUTA: Diana Aungst, Department of Planning
Services, stated staff received a letter from the applicants, dated September 6, 2022, for the removal of
Lot B from Recorded Exemption, RE -3148. She explained there is a 15 -foot access and utility easement
for the benefit of Lot B of RE -3148, and Lot B of RE -3149, and Lot A was split previously by RE -4691.
Ms. Aungst stated notice of today's partial vacation was sent to surrounding property owners, and she
further described Lots A and B are adjacent to County Roads (CRs) 98 and 17 rights -of -way, which are
not County maintained. Ms. Aungst stated the resulting parcel is larger than 35 acres, and staff
recommends approval, subject to the following condition: the applicant shall submit a signed vacation
plat to staff for review, and upon acceptance, it shall be sent for recording. Ronald Nauta, applicant, was
present for questions, but had nothing additional to add. No public testimony was offered concerning this
matter. Commissioner Moreno moved to approve said partial vacation, with the Condition of Approval.
The motion was seconded by Commissioner Buck, and it carried unanimously.
2) FINAL READING OF CODE ORDINANCE #2022-05, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING AND CHAPTER 29 BUILDING
REGULATIONS OF THE WELD COUNTY CODE: Commissioner Moreno moved to read Code
Ordinance #2022-05 by title only, which was seconded by Commissioner Buck, and the motion carried
unanimously. Bruce Barker, County Attorney, read the title for the record. Jim Flesher, Department of
Planning Services, gave a brief overview from the previous hearings, and stated there have been no
changes since Second Reading. No public testimony was offered concerning this matter. Commissioner
Moreno moved to approve Code Ordinance #2022-05, on Final Reading. The motion was seconded by
Commissioner Buck, and it carried unanimously.
PROCLAMATIONS (CONT'D):
1) WELD COUNTY LONG-TERM CARE RESIDENTS' RIGHTS MONTH - OCTOBER 2022:
Chair James acknowledged the arrival of the residents from Garden Square of Greeley who were
recognized as winners due to their art submissions. Ms. Maldonado explained these are the residents
who painted trees. Ashley Gonzales, Garden Square of Greeley, introduced the winners as Shirley Stilly,
Julia Shoemaker, and Carole Wagner. (Clerk's Note: The group gathered for a photo opportunity.)
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2022-05 was approved on Final Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:23 a.m.
