A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
January 13, 2022 at 10:00 a.m., in the Hearing Room of the Weld County Planning Department at 1555 N 17th
Ave, Greeley, Colorado.
Members Present: Mark Alessi, Jeremy Young, Denise Beltran, and Elizabeth Relford.
Members Absent: Jared Rauch, Michael Wailes, Mike McRoberts, Shelly Bergstrom, Jerry Adams, and
Lucas McConnell.
Also Present: Chris Gathman, Department of Planning Services and Kris Ranslem, Secretary.
Chris Gathman, Planning Services, stated that the applicants are applying for a two -lot Rural Land Division.
The applicant is proposing to divide Lot A of Recorded Exemption RE -1541 into two (2) lots per this Rural
Land Division application. There are two (2) existing residences on the property. The primary residence
(addressed as 16087 County Road 40 and built in 1907) is proposed to be on lot A-2 and the second home
(addressed as 19050 County Road 33 and constructed in 1953) is proposed to be on Lot A-2. A Rural Land
Division is a subdivision and is subject to the Utility Easement requirements delineated in the Weld County
Code.
Mr. Gathman stated that this is an existing site (houses buildings and accesses are in place) so there are
some constraints. The proposed Rural Land Division can comply with the Drainage and Utility Easement
requirements on the west, north and east boundaries of Lot A-2 and along the west, north, south, and east
boundaries of Lot A-1, except for the following:
There is an existing access and landscaping easement that runs along the southern boundary of Lot A-2 and
along a portion of the western boundary of Lot A-1. This easement was granted from the property owner in
2012 under reception # 3871788. Staff recommends that the drainage and utility easement not overlap this
access easement. Additionally, a rural land division requires a privately maintained public right-of-way to
access all lots in a Rural Land Division. This right-of-way is considered to be a separate parcel and is not
within the boundaries of Lot A-1 or A-2. In this instance the applicant is proposing a right-of-way immediately
to the north of the landscape and access easement recorded under reception #3871788. On the other side of
the existing access onto County Road 33, there is an existing septic system installed/approved in 2015 (SP -
1500191), that has a leach field that is located immediately to the north of the proposed Road Right -of -Way.
Normally, staff would recommend that a 15 -foot drainage and utility easement be delineated to the north of
the proposed right-of-way. However, the easement would overlap the leach field. Therefore, staff
recommends the following:
• A 10 -foot Drainage and Utility Easement be delineated immediately to the east of and along the
entire Access and Landscape Easement recorded under Reception #3871788 along the
southwestern boundary of Lot A-1.
• No Drainage and Utility Easement shall be delineated along the south property line of Lot A-2.
• No Drainage and Utility Easement shall be delineated within the boundaries of the existing easement
(recorded under reception #3871788) along the north boundary of Lot A-1.
• Drainage and Utility Easements shall adhere to the standards delineated in Section 24-3-60 of the
Weld County Code along all other lot boundaries within the Rural Land Division.
Mark Alessi asked if the existing access and landscape easement can be amended to include utilities. Mr.
Gathman said it would be a third -party agreement between the property owner and the adjacent neighbor.
Elizabeth Relford asked if this is going to be public right-of-way, will the subdivision be vacating this easement
and rededicating it as right-of-way. Mr. Gathman said the easement would not be vacated. Mr. Gathman
stated that the utility easement is included in the bubbled area identified on the visual map and the access
would be to the north of that. He noted that the new road going in and the right-of-way will have to be entirely
out of the access and landscape easement. Mr. Gathman added that the landowner and neighbor are in the

process of modifying the language so it doesn't say access, but rather landscape.
Mr. Alessi referred to the cross-section map and noted that it is actually 28 feet across and not 30 feet. Mr.
Gathman said that is correct with 18 feet and 5 feet on either side.
Ms. Relford clarified if the 6 -foot access easement will be vacated and replaced with the new 10 -foot
easement. Mr. Gathman said that the 6 -foot easement would remain and a separate 10 -foot Drainage and
Utility Easement would be added to meet the requirements of 24-3-60 of the Weld County Code. Mr. Alessi
suggested notating it on the final plan and include a reception number. Ms. Relford said that she is used to
seeing the proposed easements identified on the plat when they are reviewing them for the utility board
meetings and suggested that it needs to be included so it is clear.
The Chair asked if the applicant had anything further to add. Patricia Stahl, applicant, stated that she ran out
of money telling them to redraw this map, so she wished to wait to see what was determined before telling
them to print the final plan. She said it is hard to make the 2020 code work with something that is 115 years
old. Mr. Alessi understands that although it is 115 -year -old property it is pretty basic.
Jeremy Young noted that the County Road 40 access will be closed and asked if it will be gated or
permanently closed. Ms. Stahl stated that it will be permanently closed and added that she has had several
conversations with Platteville-Gilcrest Fire Department, and they stated that they will not go into the site to
fight any fires but rather from the county road. Mr. Young stated that he talked to Chief Derek and added that
he said it would be nice to have access from both sides in case of snow drifts, etc. Ms. Stahl said that she
was told that they would not go through the property.
Motion: Approve the final plan for RLDF21-0002 along with Staffs recommendations, Moved by Mark Alessi,
Seconded by Jeremy Young. Motion carried unanimously.
