WHEREAS, American Sportsman's Club, c/o Ira B. Baker, 5026 Ward
Road, Wheatridge, Colorado 80033, has requested permission to locate a trap
shooting range on the following described property, to-wit:
A parcel of land located in the Southeast Quarter (SEj'--)
of Section Nineteen (19), Township One (1) North, Range
Sixty-six (66) West of the 6th P. M. , Weld County, Colo-
rado, containing 12 acres, more or less, and
WHEREAS, the said requested location for a trap shooting range is lo-
cated in an agricultural zone as set forth by the Weld County Zoning Resolution,
and
WHEREAS, there is no such permitted use or operation under the Zoning
Resolution of Weld County, and
WHEREAS, the Weld County Planning Commission by resolution dated
May 20, 1970, has recommended that said site for a trap shooting range be denied
on the grounds that said site lies in a potential growth area, and is a noise nuis-
ance to the surrounding property owners.
NOW, THEREFORE, BE IT RESOLVED, that the application of American
Sportsman's Club, c/o Ira B. Baker, 5026 Ward Road, Wheatridge, Colorado
80033, far a trap shooting range on the premises indicated be, and it hereby is
denied.

Mr. Billings: We will call this hearing to order, _Docket Number 31, The
American Sportsman Club of 827 Sherman Street, Denver, Colorado.
on May 27, 1x970 at the hour of 2:00 P M. This is a request for
an approval of -a site fora Trap Shoot -Range on the -following
described property now owned by Weld County, Colorado. -The
property is approximately 12 -acres in the -Southeast Quarter of
Section 19, Township 1 North, -Range 66 West of the 6th P. M.,
Weld County, Colorado. This notice was duly published -on
April 24 and May 15 1970 by the Clerk and Recorder at the
in
instructions of the Board of County Commissioners,/ the official
publication for the County of Weld which is the Greeley Booster
and the notice was also published 3n the Fort Lupton Press.
At this time we will ask the -applicants to give us his
information on how this is to be used, how it would be located
in this parcel of ground.
Ira Baker: We had filed a plat with the -Planning Commission showing
where the traps would be located going -away from the highway
and this is for trap only not for rifle or pistol shooting. Now
I have also the signatures of the major landowners in the area.
Mr. Adams on the north, Mr. Watkata on the east, Mr. Damiana on
the west ---
Mrs. Damiana: We want to withdraw that — we were not sure what you had in
mind when we signed -that.
Mr. Damiana: No I understood it was -a -gun club and not a trap until I saw
your sign out there.
Mrs. Damiana: We thought it had something to do with 4-H — we just really
didn't think about it.
Mr. Leslie : Mr. on the south has a small feedlot
on the south of the gravel pit. There has been and is shooting
going on with 'rifles and pistols contently with no supervision
whatsoever, in fact Mr. Watada had -a -bullet whiz by the side of
his house a half a mile away.
Mr. Damiana: Well this shot came -from an air rifle along the highway.
It has no bearing on this — this came from Brighton and Ft. Lupton
it didn't come from down there.

Mrs. Damianas We have a diary farm right close by there and I am sure
the noise will annoy the dairy cattle.
Mr. Billings: We will let the applicant present all their information.
Mr. Baker: If you talk to the people in the area it appears that
there is shooting going on in there practically every weekend
and particularly before the big game season most everyone foes
out there to sight in their rifles. Certainly down in a pit like
that - shotguns don't make that much not-se, you can scarcely hear
it a hundred yards away as compared to a 30-0-6.
Mr. Billings: You are planning on this to be open to be open and
under supervision.
Mr. Baker: That is correct - there will be no night shooting.
Mr. Leslie: That will absolutely be the case. There will be no one
around there without someone form the American Sportsman Club
or an employee to supervise. On other item that we are considersing
is a bow range in there - putting in a back stop with bales there.
There will be no big game rifles or anything that would carry
appreciatively. I would like to point out that the type of shot
shell loads would be just the ordinary trap load, they would be
restricted to those no larger than 3 drams.
Mr. Anderson: That would be facing which way?
Mr. Leslie: It would be to the east away from the highway.
Mr. Bakers The sound would carry east because of the direction it is
in - I guess - we don't want to cause a problem - I guess it
turned out that there was a problem there, but we can make a
check with the people and fire a shotgun, actually check to see
if its report is of any significance.
Mrs. Damianas Well if it isn't I have heard plenty.

Mr. Leslie: Are you judging rifles or by shot guns in that area?
Mrs. Damiana: Well everything.
Mr. Damiana: They had a trap shoot up there behind the grange building
they would drive you nuts from there. That was further away than that.
Years to come they had one up there at the grange.
Mr. Lorensen: Mr. Chairman, I have a diagram here of the layout.
Mr. Anderson: Are you planning on fencing that area?
Mr. Leslie: Yes. There is a fence on two sides now. It is in' the
gravel pit - I don't know what the depth 9f that is.
Mr. Anderson: Its a little over 20 feet.
Mr. Billings: Do you have any questions, Harold
Mr. Anderson: No I have no questions.
Mr. Lorensen: Mr. Chairman, I would like to ask a question. Do you plan
to use this for skeet ?
Mr. Leslie: No, just trap. Wadiscounted skeet tan cause a high - low
house - you know you suggested direction we therefore decided
we would go with the traps so it would shooting - again away
from the highway - east across the bottom of the pit. We know
that part would be a very safe situation. The skeet house would
be shooting in two different directions. We felt that would not
not be a safe situation so we restricted.
Mr. Anderson: I have one question, would that be fenced?
Mr. Leslie: It is down in the pit area - we certainly plan for a boundary
around it, but the basic pit area being down in there - I think
you will have it quite bounded by the pit but we could fence it.
Mr. Anderson: The point is this it will be more or less open to the public
unless it is fenced.

Mr. Leslie: Oh I see, we will definitely control so that people could
not go In there, other than members and employees. We don't
want people in there using that without our knowledge.
Mr. Billings: Do you have any questions, Marsh?
Mr. Anderson: No.
Mr. Billings: We will hear from the objectors of this. If you will state
your name and address.
Mr. Damiana: Frank Damiana, I object to this trap shoot on account of it
interfering with any livihood and my wife's nerves. If you have
ever lived around a trap shoot you know how they are and why
they are looking for a place to go. My objections is they say
you can't hear a shot but I have lived there for quite sometime
Mrs. Damiama: We have been there for 22 years, his family has been there
for 50 years
Mr. Damiana: I have seen that gravel pit start out from a hole and I have
lived with it long enough and I think I deserve a break on that
part of the country out there.
Mrs. Damiana: The gravel pit has been objectionable but we figured there
was nothingi we Gould do about that - we need the roads --
Mr. Damiana: The gravel pit work has to be done, this other doesn't have
to be done. We have swallowed quite a littte dust and have listened
to all your motors out there and I think we have served our time
on that pit and I object to this because it interfers with my
business. It will scare the cows I know during duck season I
know what shots do to cows because I am also fortunate enough
to live along the river, so I get all the shot gun service during
duck season and I know what it does to my cows. You say you ca-t
hear it over in that pit and I have heard all the shooting he is
talking about going on - but it doens't go on over there at night
there is night
He says there won't be any night shooting now, well, when they get
the trap in - there isn't any night shooting over there now.
This is something that should be looked into there might be some
there now and there could be night shooting any place.

Mr. Damiana: That is my main objection. They say it is going to be closed
to the public, except members, I guess it doesn't take too much
to become a member - it will be open to pretty near everybody.
Mr. Billings: Do you have letters to prove the landowners around there or
verbal

Mr. Leslie: I didn't get any signed - I didn't realize the fact
Mr. Damianas Incidently those other landowners who live around there -
they don't live there. They live in town and have cattle out
there and feed the cattle. The rest of them live about 2 miles
away from the pit. I can't go to town.
Mr. Billings: Mr. Lorensen, as the County Planner would you like to
elaborate on what the Planning Commission has decided about this piece
of property.
Mr. Lorensen: The Planning Commission at its last regular meeting recommended
that this be recommended unfavorably recommended to the Board of
County Commissioners for this reason: this land lies in-apotential
growth area and would be a noise hazard to the surrounding property
owners, livestock and nearby homes and homesites. In addition to
their recommendation I have some other comments regarding. I
looked around for regulations that other counties have and the
ones that I did come up with are those of Adams County. They
skeet and
have a provision in their regulations for trap-in/shooting fields.
The provisions are these, this alone applies to trap portion
because this is the portion they are requesting (1) that a
1 by 300 yard danger zone shall be provided for trap fields,
(2) a 3 by 600 danger zone shall be provided for the skeet field,
(3) traps-in field may be combined within a 3 by 600 yard zone
area, (4) the trap fields layout shall meet the requirements
of the American Trap Association and (5) that the skeet field
layout shall meet the requirments of the skeet shooting association.
I feel that if you had a - if you decide to do this other
than denial on this - then one they should meet similar type of
requirements to prove that they have this zoned areas and there
is some question on the map that this area exists.

In additon to that there are some other requirements
that they request in Adams County that I think would be
apropos. the perimeter of the range shall be landscaped to
provide natural noise barriers, the remainder of the range
shall be planted and amintained with grass and such for
suitable ground cover. Shooting will be conducted by a
range officer or instructor qualified by the National Rifle
Association or other military service. In addition to signs
and warnings adequate space for danger areas, parking, equipment
storage, club house shall be provided and in addition to this
list they indicate it shall be fenced, the shooting range shall
be located to take advantage of natural barriers. The entire
range including the danger area, if the range is not a safety
range, shall be fenced and warning signs shall be posted every
200 feet. I think if you do no follow the recommendation of the
Planning Commission then these -things should be built in to it
for protection.
Mr. Billings: Do you have any comments on building in this typed
requirments in that area before it would be approved?
Mr. Leslie: It is fenced up there now above the shooting area. The
pit itself is the best protection we can have. If it is necessary
we can put a fence there that we wouldn't do otherwise. The way
it measures out is a long rife won't shoot out - not shooting
at a level of a body trap.
Mr. Baker: There is no way that it can get beyond the confines of the
walls of the pit - to shoot up the shots as it comes up and
comes down, which is a projectory that would be shot at in a
trap thrown target would be about the maximum distance a shell
would carry out there - if we went out and measured this. We
are very certain if would not go out beyond the walls.
We would be willing to put up a fence. We would certainly
intend to patrol the area by access point around. As for the
number of people using this I might point out that our membership

is less than a thousand and the total fees of getting into
the club are such that the average public does not belong
to the club and would not. So the avid hunter, fisherman
are making a sacrifice to get in there. By no means would
our club be involved with the general public. It is not
that kind of an organization. We have a thousand members
in Colorado today . So as for
the quantity of people that woun't be a large factor, but
there will be shooting we will be practicing during the day.
Mr. Billings: Can you give us a complete decision as whether you
will abide by the regulations that our County Planner
has asked to be built in this - we can give you copies of
this and if you would send us a letter, as soon as possible,
that you would abide by these rules and regulations in skeet
shooting - I won't ask you to give a decision on some of the
things he has read there today, but our County Planner feels
that these are areas that we need to look at strongly and have
regulations on. We should give you a copy of those and you can
indicate by letter.
Mr. Leslie: Mr. Billings, we would be very happy to get the Winchester
and Remington people to help us lay out traps. As a matter of
fact I have contact with these people and would meet with a
representative of the County and go out and actually lay out
9hd check the measurements. We are as anxious as anyone else
that we have a safe area. We would be most willing to have you
people out along with an appropriate person from your area.
Actually we could go out there and show you in more detail what
we have - if weed be we :cruld stake out trap loads and could
assess the situation. I happen to shoot trap throught the country
professionally and it is one of the things I am fairly familar with
and you do need to have a safe situation. So we would be very
happy to comply with the ATA regulation, in fact we want to comply
because that would mean we would get registered shoots. That would
be our thought with what was just suggested.

Mr. Billings: I would be interested in knowing the noise factor as far
as these people are concerned. It would be an on the site
inspection. This is very important.
Mr. Leslie: If we _could have them on Saturdays _and Sundays that would
be the predominant period. We would like not to dirount shooting
during the week. There would no night shoot - no lights or facilities
like that. Just to assure you right here we do not intend night
shooting. We could make that a stipulation if that would help these
people.
Mrs. Damiana: No the day shooting would be the as the night - it would
still affect the cows. All our property is around there our home
and all.
Mr. Billings: On a physical inspection is what we would like to have
we can see all limitations out there and see if they can meet
the rules and regulations we feel need to be built into this.
The nosie factor your meeting with the to check this out and
then this Board could make a decision. Unless there is other
information on this I will entertain a motion to receive more
facts on this. The American Sportsman Club, as far as being able
to comply with these regulations - until this we will take the
matter under advisement.

19, Township 1 North, Range Sixty-
six (C3) West of the 6th P. M. , Weld
County, Colorado.
Dear Mr. Baker:
Your letter of October 1, 1970, accompanied with checks
for $1. 00. 00 and $1. 50 respectively, both dated March 30, 1970,
relative to the above has been turned over to this office for
attention.
4ease be advised that I have investigated the facts and
circumstances of this transaction and must conclude that your bid
was received with conditions that were never fulfilled. If you will
remember, your bid was made subject to the land being rezoned
for a trap range and your check in the sum of $100. 00 was held in
escrow pending public hearing on zone change. The change of zone
was denied and you were properly notified of the denial and your
check was returned to you, signifying that the board rejected your
bid and the matter was considered closed.
In view of the above, I regret to advise that your bid there-
fore was never accepted. Accordingly, I am returning herewith
your checks for $100. 00 and $1. 50 and we are closing our files on
this matter.
