PETITION FOR ANNEXATION TO THE TOWN OF SEVERANCE, COLORADO
The undersigned, in accordance with the Municipal Annexation Act of 1965 as set forth Title 31,
Article 12, Chapters 101 et. Seq., Colorado Revised Statutes ("Annexation Act"), hereby petition
the Mayor and Councilors of the Town of Severance, Colorado ("Town"), for annexation into the
Town the unincorporated territory located in Weld County, Colorado, which is more particularly
described and depicted on the map designated as "2022 BHS Solar Annexation," attached hereto
as Exhibit A and incorporated herein by reference.
In support of this petition, the petitioner(s) allege(s) that:
1. The legal description of the land owned by Petitioner and hereby petitioned for
annexation into the Town ("Property") is set forth on Exhibit A, attached hereto and
incorporated herein by this reference.
2. It is desirable and necessary that the Property be annexed to the Town of Severance,
Colorado.
3. The requirements of C.R.S. §§ 31-12-104 and 31-12-105 exist or have been met in
that:
a. Not less than one -sixth of the perimeter of the Property is contiguous with the Town
of Severance or will be contiguous with the Town of Severance within such time
as required by C.R.S. § 31-12-104;
b. A community of interest exists between the Property and the Town of Severance;
c. No land within Property which is held in identical ownership, whether consisting
of one tract or parcel of real estate or two or more contiguous tracts or parcels or
real estate, has been divided into separate parts or parcel without the written consent
of the landowner or landowners thereof, except and unless such tracts or parcels are
separated by a dedicated street, road or other public way;
d. No land within the boundary of the Property which is held in identical ownership,
comprising twenty (20) acres or more and which, together with the buildings and
improvements situated thereon, has an assessed value in excess of Two Hundred
Thousand Dollars ($200,000.00) for ad valorem tax purposes for the year preceding
the annexation, has been included within the territory proposed to be annexed
without the written consent of the landowner or landowners;
e. The Property is not part of any incorporated city, city and county, or town; nor have
any annexation or incorporation proceedings been commenced in an area that is
part of all of the Property; nor has any election for annexation of the Property or
substantially the same territory to the Town been held within the twelve (12)
months immediately preceding the filing of this Petition;
f. The annexation of the Property will not result in the detachment of area from any
school district or attachment of same to another school district;
g.
The annexation of the Property will not have the effect of extending the boundary
of the Town of Severance more than three miles in any direction from any point of
the boundary of the Town of Severance in any one year;
h. The proposed annexation will not result in the denial of reasonable access to
any landowner, easement holder, or owner of a franchise adjoining a platted
street or alley which has been annexed by the Town but is not bounded on both
sides by the Town; and
i. In establishing the boundary of the territory proposed to be annexed, if a portion of
a platted street or alley is to be annexed, the entire width of the street or alley has
been included within the territory to be annexed.
4. Petitioner is the owner of one hundred percent (100%) of the Property, and
Petitioner hereby consents to the establishment of the boundaries of the territory to be annexed as
shown in the annexation maps submitted herewith.
5. The affidavit of the circulator of this Petition certifying that the signature on this
Petition is the signature of each person whose name it purports to be certifying the accuracy of the
date of such signatures is attached hereto as Exhibit B and is incorporated herein by this reference.
6. Petitioner and the Town specifically acknowledge an Annexation Agreement has
been or will be executed by Petitioner and the Town relating to this annexation shortly after the
execution of this Petition.
7. Upon the annexation of the Property becoming effective, and subject to the
conditions to be set forth in the Annexation Agreement, the Property shall become subject to all
ordinances, resolutions, rules and regulations of the Town, except for general property taxes
of the Town, which shall become effective on January 1 of the next succeeding year following
adoption of the annexation ordinance.
8. Except for the terms and conditions of this Petition and of the Annexation
Agreement, which terms and conditions Petitioner expressly approves and therefore do not
constitute an imposition of additional terms and conditions within the meaning of Section 31-
12-107 (1)(g) of the Annexation Act, Petitioner requests that no additional terms and
conditions be imposed upon annexation of the Property to the Town.
9. Accompanying this petition are four copies of an annexation map containing the
following information:
a. A written legal description of the boundaries of the area proposed to be annexed;
b. A map showing the boundary of the area proposed to be annexed, said map prepared
by and containing the seal of a registered engineer;
c. Within the annexation boundary map, a showing of the location of each ownership
tract in unplatted land and, if part or all of the area is platted, the boundaries and
the plat numbers of plots or of lots and blocks;
d. Next to the boundary of the area proposed to be annexed, a drawing of the
contiguous boundary of the Town of Severance and the contiguous boundary of
any other municipality abutting the area proposed to be annexed, and a showing of
the dimensions of such contiguous boundaries.
10. Petitioner hereby reserves the sole, exclusive and unilateral right to withdraw this
Petition by so notifying the Town Clerk in writing at any time prior to: (i) the effective date of the
ordinances annexing and zoning the Property; or (ii) the satisfaction of the conditions precedent to
the annexation effectiveness to be set forth in the Annexation Agreement.
THEREFORE, the undersigned respectfully petition the Town Council of the Town of
Severance to annex the territory described and referenced in 2022 BHS Solar Annexation Map to
the Town of Severance in accordance with and pursuant to the Annexation Act.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF SEVERANCE,
COLORADO, FINDING SUBSTANTIAL COMPLIANCE OF AN ANNEXATION
PETITION FOR CERTAIN PROPERTY LOCATED IN WELD COUNTY,
COLORADO AND SETTING A PUBLIC HEARING ON THE PETITION IN
ACCORDANCE WITH THE MUNICIPAL ANNEXATION ACT OF 1965
WHEREAS, a written petition requesting the annexation of certain real property
described below, to be known as the 2022 BHS Solar Annexation (the "Petition"), has been
filed with the Town Clerk; and
WHEREAS, the Petition has been referred to the Town Council for the Town of
Severance, for a determination of substantial compliance with the requirements of C.R.S. § 31-
12-107(1); and
WHEREAS, the Town Council has been advised by the staff, and has taken official
notice of all maps, records, and other information and materials on file with the Town of
Severance, Colorado, regarding the Petition.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF SEVERANCE COLORADO:
Section 1. The Petition for Annexation of the real property described and shown in
Exhibit A, attached hereto and incorporated herein by this reference, to be known as the 2022 BHS
Solar Annexation, is determined to be in substantial compliance with C.R.S. § 31-12-107(1).
Section 2. The Town Council of the Town of Severance, Colorado shall hold a public
hearing on the proposed annexation on November 8, 2022 at 7:00 P.M., or as soon as thereafter
possible, at Severance Town Hall, 3 S. Timber Ridge Parkway, Severance, Colorado 80550, to
determine if the proposed annexation complies with Section 30 of Article II of the Colorado
Constitution and C.R.S. §§ 31-12-104 and -105, or such parts thereof, as may be required to
establish eligibility for annexation.
Section 3. The Town Clerk shall publish a Notice of Public Hearing, in substantially
the form attached as Exhibit B, once a week for four successive weeks in a newspaper of general
circulation in the area proposed to be annexed, with the first publication of such notice to be at
least thirty days prior to the date of the hearing. The Town Clerk shall further provide notice to the
Clerk of the Board of County Commissioners of Weld County, the Weld County Attorney, and to
any special district or school district having territory within the area proposed to be annexed, in the

NOTICE OF PUBLIC HEARING
Notice is hereby given that the Planning Commission of the Town of Severance will hold a
review, as a regular agenda item at a public meeting, commencing at 6:00 p.m., or as soon as
thereafter as the matter may be called, on Wednesday/October 19th, 2022 at the Town of Severance
Town Hall, Council Chambers, 3 S. Timber Ridge Parkway, Severance, Colorado 80550. The
purpose of the review is to make a recommendation to the Town Council regarding a request by
SPABS, LLC, Terry Ramsey, and Jennifer Berg -Ramsey to determine whether certain real property
for which a petition for annexation to the Town of Severance has been filed with the Town, to be
known as the 2022 BHS Solar Annexation, meets the applicable requirements of Section 30 Article
II of the Colorado Constitution and Sections 31-12-104 and 31-12-105 of the statutes of the State of
Colorado and is eligible for annexation to the Town.
The Planning Commission's review shall be conducted in -person and by electronic means
(see the link below to participate in the meeting on your computer). All submitted materials and
instructions for participation will be posted at https://www.townofseverance.org, and available upon

Project Location
BHS Solar, LLC (BHS Solar), a wholly owned indirect subsidiary of Hanwha Energy USA Holding
Corporation, d.b.a. 174 Power Global, is petitioning the Town of Severance to annex two separate
parcels totaling approximately 179 acres currently located in Weld County. The property's borders
include:

• East: Undeveloped land approximately 8000 ft east of Weld County Road 19
• South: Undeveloped land approximately 2635 ft south of Weld County Road 90
• West: Undeveloped land approximately 5240 ft east of Weld County Road 19
Ramsey Parcel
• North: Weld County Road 86
• East: Weld County Road 23
• South: Undeveloped land approximately 2680 ft south of Weld County Road 86
• West: Undeveloped land approximately 450 ft west of Weld County Road 23
The area to be developed would be zoned at Rural Residential Agriculture as designated by the 2020
Comprehensive Plan. See map on last page of this document indicating location and vicinity.
Proposed Land Uses
The 2022 BHS Solar Annexation intention is to construct a large-scale solar facility, With the 2021
annexation and the proposed 2022 annexation the project will encompass approximately 1400 acres
for a proposed solar facility. The remaining acres will be comprised of ROW, easements, and land
buffers. Currently the applicant is requesting only annexation and zoning. The applicant will be
required to submit a Site Plan in accordance with Town regulations before the Planning
Commission and Town Council to provide further information and engineering documents prior to
construction.
Annexation Agreement
Per Colorado Revised Statutes 2013 134 Title 134, an agreement will be drafted between the
property owner and municipality outlining the responsibilities of each party.
Municipal Services
The area to be annexed will receive the following municipal services from the stated responsible
agencies:
• Water: To be served by North Weld County Water District. See more below
• Sewer: To be served by individual wastewater treatment systems if desired.
• Police: Severance Police Department. See more below.
• Fire & Emergency Services: See more below.
• Schools: Weld County RE -4 District and Weld RE- 9 District. See more below.
• Library District: Clearview Library District and High Plains Library District. No
adverse impacts anticipated at this time.
• Electric/Communication Service: Not applicable. If desired the developer/applicant
will be required to work with service providers to establish the most efficient manner
for extending service to the community
• Internet service: Not applicable. If desired the developer/applicant will be required
to work with service providers to establish the most efficient manner for extending
service to the community
Financing Method
The project will be privately funded by the project owner/developer.
School District Impact
The 2022 BHS Solar property is partially located within the Weld County School District RE -4 and
partially located in the Weld County School District RE -9.
The Town of Severance reached out to both the Weld RE #4 District and the Weld RE #9 District.
Both Weld RE #4 and the Weld RE #9 District has yet to respond at this time. Currently there are
no residences located within the proposes annexation boundaries.
Severance Police Department Impact
The Town of Severance reached out to the Severance Police Department and Police Chief Jim
Gerdeman comments are as follows.
"This project has minimal impact on the Police Department. Projects like this do not have
the human element, and that is where the police department would see an impact. The
facility itself will not affect the police department until humans start to trespass the
property."
Emergency Services and Fire Rescue Impacts
The Town of Severance and the Windsor Severance Fire Rescue (WSFR) hold an IGA in which it is
agreed that as/if the Town of Severance border increases or changes the WSFR protection district
will also increase accordingly. The proposed 2022 BHS Solar annexations overall boundary is
currently split by 2 fire protection districts. Ault Fire and the Windsor Severance Fire Rescue. The
applicant will need to contact Ault and WSFR fire districts to begin the exclusion/inclusion process
and the applicant will be presenting before each districts board in the coming months, if approved.
The Town of Severance must first annex this property to officially trigger this process. Town staff
has met with Windsor Severance Fire Rescue and WSFR has confirmed commitment to the IGA
and will start the inclusion process into their fire protection district once the Town of Severance
officially annexes the property to be known as BHS Solar Annexation.
The Town of Severance reached out to both the Windsor Severance Fire Rescue and Ault fire. Fire
Chief Kris Kazian from WSFR comments are below.
"Windsor Severance Fire Rescue has an IGA with the Town of Severance that stipulates all
property located in the town limits will be annexed into Windsor Severance Fire Protection
District (WSFPD). This project currently involves 2 other Fire Districts. It is WSFR's
expectation that this project is contingent on making an application for inclusion into
WSFPD immediately upon getting favorable approval from the Severance Town Board. This
will allow us to be in compliance with our IGA as well as give us a better ability as to who
should be providing the site plan reviews and fire code application. Having a project with
multiple jurisdictions is not preferred and creates challenges for the fire agencies and the
property owners/operators.
WSFR Board will be ready to consider an application for inclusion at whatever time this
project warrants and can assist in any procedural needs if requested."
Ault Fire has yet to respond at this time.
North Weld County Water District (NWCWD) Impacts
The Town of Severance reached out to NWCWD for a response. Jared Rauch NNX/CWD
Development Review Engineer comments are as follows.
"Thanks for sending this over. We don't have any updated comments at this time."
Traffic Impacts
The Town of Severance Transportation Master Plan adopted June 22, 2021, provides an in-depth
analysis of existing conditions and anticipated needs through year 2040. The analysis projects build -
out of residential and commercial uses, the traffic that would be generated and the road
improvements necessary to accommodate the traffic at acceptable levels. Further traffic analysis will
be conducted with the Site Plan submittal where a Transportation Impact Study will be required.
Traffic impact for this project is anticipated to be minimal as this project does not propose and
residential or commercial buildings.
Environmental Impacts
Existing land use has been agriculture. Currently staff has no concerns. During development review
environmental study may be required. Through the referral process Colorado Parks & Wildlife has
been involved and has provided comment below.
"CPW appreciates that the Applicants have consulted with CPW over the last two years. This
consultation can lead to a responsibly -developed project that works toward achieving State of
Colorado solar goals', while protecting sensitive wildlife species, habitats, and time frames.
Our discussions have focused on specific ways to avoid, minimize and mitigate the impacts
on the wildlife species in the vicinity of this Project, specifically to develop strategies to
minimize impacts to raptors, big game winter habitat and movement corridors, and black -
tailed prairie dog colonies in the area. CPW also appreciates that the Applicants modified the
original design to allow for four wildlife movement corridors at least 300 feet wide, and the
substation is located farther away (east) from Black Hollow Reservoir.
The mission of CPW is to perpetuate the wildlife resources of the state, to provide a quality
state parks system, and to provide enjoyable and sustainable outdoor recreation opportunities
that educate and inspire current and future generations to serve as active stewards of
Colorado's natural resources. CPW has a statutory responsibility to manage all wildlife species
in Colorado, and to promote a variety of recreational opportunities throughout Colorado. One
way we achieve this goal is by responding to referral comment requests, as is the case for this
project. CPW encourages developers to afford the highest level of protection to Colorado's
High Priority Habitats (HPHs). HPHs are defined as sensitive wildlife habitats where CPW
has sound spatial data' and scientifically -backed best management practice recommendations
to help developers with the siting process to minimize any impacts.
This 1,362 -acre solar facility is located within the following CPW-mapped HPHs:
• Mule Deer Severe Winter Range (350.86 Project acres; 25.76/s) and Pronghorn
Winter Concentration Area (938.52 Project acres; 68.91%) polygons (as shown in
Appendix A).
We recommend the following for the Applicant's consideration to reduce impacts to wildlife:
• CPW recommends that construction activity occurs between May 1 and
November 30, avoiding the big game severe winter range dates of December 1 to
April 30.

o If construction must take place during the winter range time frame, we
recommend that construction activities take place between the hours of 7
a.m. and 5 p.m. to reduce disturbance to wintering big game.
CPW is aware that the Project area will include security fencing. For specific
wildlife exclusion fencing specifications, CPW recommends that any installed
fencing should be eight feet in height, have round -capped posts (e.g., so wildlife
aren't impaled), smooth top wire to the fence (e.g., no top barbed wire) (or if two
top strands are needed, ensure they are at least six inches apart). The bottom wire
can be barbed but should be four inches or less from the ground.
CPW recommends that other non -security fencing is kept to a minimum. Where
such fencing is required, please use wildlife -friendly fencing specifications as
described in CPW's document entitled "Fencing with Wildlife in Mind".
CPW recommends that the solar facility is checked weekly (or escape structures
are installed inside the fenced area) to allow deer and pronghorn to escape if one
becomes trapped within the facility.
CPW requests that security lighting is kept to a minimum and ideally motion sensor
lights are installed. It is important to avoid lighting the riparian corridors along the
sides of the project.
If construction is slated from March 15 to July 15, please complete pre -
construction nesting surveys for songbirds, Burrowing Owls, and ground- or tree -
nesting raptors' within the Project area or in the immediate vicinity (e.g., their
buffers may extend into the Project area).
Install bird diverters on the new collector lines constructed east of Black Hollow Reservoir.
CPW appreciates the opportunity to review this project and provide comments and
recommendations to avoid and minimize impacts to wildlife resources."
Resident Impacts
The proposed annexation by itself does not directly impact residents. However, the site
development process that may occur upon annexation is anticipated to be solar. The impacts
specific to that development will be further contemplated during the Site Plan process. Similar to all
new developments being built, construction would potentially be the largest impact on current
residents. Construction noise, dust, and trash is a common resident impact. Community
Development Inspector as well as Severance Police Department Code Enforcement would work
together to keep impacts minimal by doing routine site visits as well as inspections. On the map
attached at the end of this document red dots indicate current residences. All of the parcels included
in the overall annexation boundary will continue to be owned by the existing property owners. BHS

Solar has entered into long-term leases with the property owners all of which have signed the
Annexation Petition. Additionally, the applicant has also reached out nearby residents and held a
number of neighborhood meetings including a neighborhood meeting held at Severance Town Hall
on October 10th' 2022.
Economic Impact
At this time the Town of Severance will receive a property tax increase due to this annexation.
Future development of the project (i.e., Site Plan) may lead to additional use tax revenue based on
the construction of the full solar facilities intended.
