Clerk of the Board I of County Cornntssioners COUNTY OF WELD AND STATE OF COLORADO I ANh 1 x ,:174 Civil Action No. 25070 COUNTY C CRy AND RRCORDRR By IN THE MATTER OF PROCUREMENT ) —�eP�tY OF ADEQUATE COURT FACILITIES ) L' FOR THE NINETEENTH JUDICIAL ) ORDER DISTRICT This Court has requested on numerous occasions during the past eight years that additional space be provided the Courts of the 19th Judicial District and, more particularly, has heretofore informed the County Commissioners of the lack of adequate facilities for the Courts to accomplish the proper disposition of the normal court load that has so markedly increased in recent years , to wit : a 92. 53% increase in filings from 1968 to 1974 . The District Court of the 19th Judicial District has made every effort to improvise temporary accommodation of its needs by the utilization of areas totally inadequate . We have attempted to utilize the hearing room, designed to accommodate hearingsof the County Commissioners and state boards , which has been makeshift and is not adequate. District Court has attempted to use as office space for the water referees the women ' s jury dormitory, which has greatly disturbed the deliber- ations of juries for the District and County Courts , more than three juries having been in session at one time on several occasions . Too , the deprivation of accommodations for women in that area has caused no little inconvenience for women jurors. Because of the lack of courtroom space , the normal work of the court has had to be delayed for want of courtrooms for the past several years to the detriment of litigants who seek and deserve to have their cases heard promptly. 740638 -2- The case load already confronting the Courts of the 19th Judicial District can only be accommodated by requesting help from judges of other judicial districts . This can not be done without courtrooms. A superimposed duty on the District Court was created by the enactment of "Water Right Determination and Administration Act of 1969 , " requiring space to accommodate room for the clerical work of the Water Court provided for by Chapter 148 , Article 21, Section 11 , C. R. S . 1963 , and for hearing rooms for the referees to administer their duties in the Water Court as provided for in 148-21-10 (4) , and a courtroom for the trial of water matters and, more particularly, for the hearings required of the water judge provided for in 148-21-10, 148-21-20 and 148-21-21; furthermore, the final resolutions of Case Nos . W-7209, W-7232 , W-7249 , W-7289 , W-7290 , W-7295 , W-7296 and W-7298 relating to the rules and regulations of the State Engineer. This duty necessitates the immediate hearing of plans of augmentation as provided for in 148-21-23 by the Court. Failure to provide these necessaries to the District Court per- mitting it to perform its duties in this regard would cause irreparable harm to the economy of the South Platte river system and can and will deprive water users of their rightful access to waters to which they are entitled under the law. Chapter 37 , Article 11 , Section 10 of the Colorado Revised Statutes 1963 , as amended, provides in part as follows : "Maintenance of court facilities--. The board of county commissioners in each county shall continue to have the respon- sibility of providing and maintaining adequate courtrooms and other court facilities including janitorial service, ---. " -3- All other efforts of the Court to persuade the County Commis- sioners of Weld County , Colorado to so provide having failed, it is hereby: ORDERED ADJUDGED AND DECREED that the Board of County Commissioners of Weld County, Colorado provide the additional space set forth in the space requirements listed and attached hereto no later than September 1 , 1974 .
