RE: ACCEPT REQUEST TO WITHDRAW APPLICATION FOR SECOND AMENDED
PLANNED UNIT DEVELOPMENT CHANGE OF ZONE, PUDZ22-0001, OF
BEEBE DRAW FARMS AND EQUESTRIAN CENTER PUD (AMZ-412)
FOR E (ESTATE), C-1 (NEIGHBORHOOD COMMERCIAL), C-2 (GENERAL
COMMERCIAL), C-3 (BUSINESS COMMERCIAL), 1-2 (MEDIUM INDUSTRIAL)
AND A (AGRICULTURAL) ZONE DISTRICT USES, INCLUDING GENERALLY
DEFINED OPEN SPACE, RECREATIONAL USES, COMMUNITY SERVICES,
AND OIL AND GAS PRODUCTION FACILITIES - REI, LLC, DBA INVESTORS, LLC,
AND BEEBE DRAW FARMS AUTHORITY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 20th day of
April, 2022, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing
the application of REI, LLC, dba Investors, LLC, and Beebe Draw Farms Authority, P.O. Box 156,
Red Feather Lakes, Colorado 80545, for a Second Amended Planned Unit Development Change
of Zone, PUDZ22-0001, of Beebe Draw Farms and Equestrian Center PUD (AMZ-412) for
E (Estate), C-1 (Neighborhood Commercial), C-2 (General Commercial), C-3 (Business
Commercial), 1-2 (Medium Industrial) and A (Agricultural) Zone District uses, including generally
defined open space, recreational uses, community services, and oil and gas production facilities
on the following described real estate, to -wit:
All of Section 17 and parts of Sections 3, 4, 5, 8, 9,
10 and 15; all located in Township 3 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, on April 20, 2022, the Board heard all of the testimony and statements of
those present and reviewed the request of the applicant and, having been fully informed,
continued the matter to October 19, 2022, at 10:00 a.m., to allow the case to be heard by the
Planning Commission on October 4, 2022.
WHEREAS, the Board was presented with a letter from the applicant, dated August 10,
2022, requesting the withdrawal of the application, stating they had decided to proceed with their
previously approved Filing 2 plat process, and
WHEREAS, on October 19, 2022, the Board of County Commissioners heard all of the
testimony and statements of those present, studied the request of the applicant and all of the
exhibits and evidence presented in this matter and, having been fully informed, deems it advisable
to grant the applicant's request and thereby accept the withdrawal of the application.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of REI, LLC, dba Investors, LLC, and Beebe Draw Farms
Authority, to withdraw the application for Second Amended Planned Unit Development Change
of Zone, PUDZ22-0001, of Beebe Draw Farms and Equestrian Center PUD (AMZ-412) for
E (Estate), C-1 (Neighborhood Commercial), C-2 (General Commercial), C-3 (Business
Commercial), 1-2 (Medium Industrial) and A (Agricultural) Zone District uses, including generally
defined open space, recreational uses, community services, and oil and gas production facilities,
on the parcel of land described above be, and hereby is, accepted and the matter is dismissed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 19th day of October, A.D., 2022.

Re: PUD 2-0001, REI, LLC and Beebe Draw Farms Authority, Applicants
Dear Mr. Hall:
Please recall that this office represents REI LLC and Beebe Draw Farms Authority (the
"Applicants") with regards to PUD -2 -0001. This matter is currently scheduled for hearing
before the Weld County Planning Commission on October 4, 2022 and before the Board of Weld
County Commissioners on October 19, 2022. The Applicants, along with their consultants, have
reviewed the PUDZ 22-0001 application and determined to proceed with their previously
approved Filing 2 plat process, rather than their aforementioned application. As such, the
Applicants request that their application for PUDZ22-0001 be withdrawn and the hearings
currently set for October 4, 2022 before the Weld County Planning Commission and October 19,
2022 before the Board o£ County Commissioners of Weld County be vacated.
