WHEREAS, a public hearing was held on March 27, 1972 in
the chambers of the Board of County Commissioners of Weld County,
Colorado, for the purpose of hearing the petition of the National Center
for Atmospheric Research, Boulder, Colorado, requesting approval of
site for the construction of two radio communication towers on the
following described property, to-wit:
The Northeast Quarter of the Northeast Quarter
(NE,NE4) of Section Thirty-four (34), Township
Eleven (11) North, Range Sixty (60) West of the
Sixth P. M. , Weld County, Colorado, and
WHEREAS, the petitioner was present and represented by
Mr. Melvin O. Baker, and
WHEREAS, there was no opposition to the request of petitioner
for the location of said radio communication towers, and
WHEREAS, the said requested location for the two radio
communication towers is located in an agricultural zone as set forth by
the Weld County Zoning Resolution, and
WHEREAS, according to Section 3. 3 (2) of the Zoning Resolution
of Weld County, said location for the radio communication towers may be
authorized on the approval of the Board of County Commissioners of Weld
County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of
the petitioner and studied the recommendations of the Weld County Planning
Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of the National Center for Atmospheric
Research, Boulder, Colorado, to locate two radio communication towers
on the premises indicated above be, and it hereby is granted under the
conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. That petitioner shall proceed with due diligence to effect
said construction of the communication towers and that it shall have up to
one year from date hereof to complete the construction of any and all
facilities therefor; otherwise, the Board may, for good cause shown, on
its own motion, revoke the permit herein granted.
3. That all applicable subdivision and zoning regulations shall
be followed and complied with in accordance with the Zoning Resolutions
of Weld County, Colorado.

DISCUSSION : Mr . Lorenson ' s recommendations were for approval . The
proposed use is compatible with surrounding land use and zoning .
The design and soils have been reviewed with no noted problems .
The proposed site has little use presently. Should be subject
to a maximum of 240 head , approval by the Health Department.
Construction to begin within one year of approval by the County
Commissioners . There was discussion regarding the disposal of
stock pen drainage into their irrigation ditch contained within
the property . Mr . Lorenson stated the legal description
should be reduced to cover the area where the dairy will be
located rather than the 80 acres , or approximately 10 acres .

Be it therefore resolved to recommend approval to the Board
of County Commissioners subject to the recommendations . Motion
by Mr . Nix , second by Mr . Anderson . A vote of "Aye" by Anderson ,

DISCUSSION : Mr. Bowles stated the staffs recommendation is for
approval . It is compatible with surrounding land use and zoning .
There are no soil or drainage problems . Three other use permits
have been granted in this area for hog farms . It should be sub-
ject to Health Department approval , a maximum of 450 hogs and
construction to begin within one year of approval by the County
Commissioners . Mr . Humphreys stated the 450 is the total number .
Mr . Paul stated the Health Department has approved the appli -
cation .

Be it therefore resolved to recommend approval to the County
Commissioners subject to the requirements of the planning staff.

DISCUSSION : Mr . Lorenson explained they have a research center on
hail . They are equesting permission to erect two communication
towers . Height will be 170 ' in accordance with the Federal
Aviation Administration. It will be a radio repeater station
for air-to-ground and ground-to-ground radio communications
during hail research commencing5/1 /72 and continuing through
7/31 /72 and for a like period for the subsequent four years .
A letter was received from the Air Force at Ft . Warren in
Cheyenne which is the nearest facility stating they had no ob-
jections provided it is properly lighted .
RESOLUTION :
Be it therefore resolved to recommend approval to the County
Commissioners subject to the towers being properly lighted .
Motion by Mr. Anderson , second by Mr. Weigand . A vote of "Aye"
by Anderson , Bowles , Heitman , Nix , Watson and Weigand . Motion
carried .
SUBJECT : Unrecorded plat for Mountain View Estates
DISCUSSION : Mr. Lorenson stated the plat for Mountain View Estates
had been approved by the Planning Commission over a year ago .
It was subject to a bond being posted for the roads . The bond

has never been posted , consequently the plat has not been
referred to te Count Commissioners . Most of the requirements
since that time have been increased . There is a sign on the
property " Lots for Sale" . There seems to be a water table prob-
lem at this location .
MOTION : By Mr. Nix to authorize Mr. Lorenson to not issue any
building permits on this rroperty until it has been properly
filed and recorded . Second by Mr. Watson . A vote of "Aye" by
Anderson , Bowles , Heitman , Nix , Watson and Weigand . Motion
carried .

APPEARANCE : Mr. and Mrs . Anderson , Clarence Hawthorne
DISCUSSION : Mr. Lorenson stated the property in this area is being
subdivided without going through the subdivision process . As
a result of this there are quite a number of people living in
the area . There is en interior road which is not on the public
right-of-way system. Mr. Bowles read the recommendations of the
planning staff that the application be denied . It is not com-
patible with surrounding land use (residences within 600 ' )and
a petition and 10 individual letters of objection to the pro-
posed dog kennel site have been received . Mr. Anderson stated
they had obtained a building permit and a septic tank permit .
Mrs . Julie Kollar stated when she signed the petition she thought
it was for 4 dogs or she wouldn ' t have signed it. Mr. Stroh
stated when they found out there were going to be 30 dogs
they felt it would be detrimental to the area . Mr. Bowles stated
that based on the past practice of the Planning Commission re-
garding dog kennels and other animal producing operations in
areas where there are subdivisions , they would have no choice
but to recommend denial because this is basically a subdivision .
RESOLUTION :
Be it therefore resolved to recommend denial to the Board
of County Commissioners . Motion by Mr, Watson . Second by Mr .
Weigand . A vote of "Aye" by Anderson , Bowles , Heitman , Nix ,
Watson and Weigand . Motion carried . There was a discussion
regarding transferring a building permit to another location .

DISCUSSION : Mr. Lorenson stated that Mr . Stroh had submitted an
application to expand his feeding operation a little over a
year ago . At the time it was recommended for denial . The Plan-
ning Commission tabled the matter and was never presented to the
County Commission . Additional information has been submitted
since that time . The lotting has been changed . Lot #7 is still
within 660 feet of the Hick ' s residence . The draw is now pro-
tected by retention ponds designed by SCS . Mr. Dinner explained
the changes which have been made . There was discussion regard-
ing the qualification of the Feeding operation being a farm feed
lot in view of the amount of roughage raised by the Strohs . The
petition has been signed by surrounding property owners except

for Mr . and Mrs . Hicks . With the new expansion the
capacity will be 3000 head .
RESOLUTION :
Be it therefore resolved to recommend approval of the
revised application to the Board of County Commissioners
subject to 3000 head of cattle . Also resolved the ap-
plication to be a farm feed lot and not subject to the
interpretation of a commercial feed lot. Also to resolve
that the applicant has a choice whether to continue through
the County Commicsionecc for a hearing or proceed with his
operation without any further action required . A vote of
"Aye" by Anderson , Nix , Watson and Weigand . A vote of " Nay"
by Bowles and Heitman . Motion carried by a 4 to 2 vote .

DISCUSSION : Mr. Deyoe presented the plat for the second filing .
He reported a letter had been received from the school district
stating they found no reason to support or object to the sub-
division . The clearance record for the utilities has been
signed , a closure sheet submitted and the street profiles . The
plat is in accordance with the preliminary plat . They will be
subject to a road improvement bond in the amount of $17 ,550 .00 .
RESOLUTION :
Be it therefore resolved to recommend approval to the
Board of County Commissioners subject to the bond being posted .
Motion by Mr . Nix , second by Mr. Watson . A vote of "Aye" by
Bowles , Heitman , Nix , Watson and Weigand , "Nay" by Anderson .
Motion carried by a 5 to 1 vote . Mr . Lorenson pointed out
approval should be subject to enlarging lot 4 to 40 ,000 sq. ft.

DISCUSSION : Mr. Lorenson presented a right-of-way dedication filed
by Glen V . Reigel showing 50 ° on a lot in the NZ SE4 Sec 8
T5 R66 namely on 71st Avenue .

the Board of County Commissioners . Motion by Mr. Watson , second

DISCUSSION : Mr. Cunningham presented the proposed zone changes ,
explaining the area they are requesting " I " zoning for was not
owned by Eastman Kodak at the time of the previous zoning .
The "S" zoning serves as a buffer zone around the perimeter of
their property except to the south where there is a bluff. Mr .
Cunningham stated the Windsor Planning Commission had recommended
approval by a unanimous vote. Mr . Smith stated had the property

they are requesting the " I " zoning for been purchased at the
• beginning , it would have been zoned " I " at the time and they
would be :.going their construction there rather than farther
east where their present buildings are . Stated it is important
that they have flexibility for their long range plans . Mr. Bowles
read the recommenatinns F the staff stating that granting an
industrial zone or scientific zone at this time without suffic-
ient information removes the county ' s ability to review any
future development . 443 acres of industrial land without any
plan concerning future access points , rights-of-way , flood plain
zone , gravel pits and their reuse , type of manufacturing oper-
ation and location of fari1ities seem to be granting a blank
check . Any other industrial concern reouesting this much re-
zoning would be requested to submit a Planned Unit Development.
A generalized PUD would be acceptable if it answered some of
the questions and provided a mechanism to allow the County
future veto power if the best interests of the community at
large were not protected . On application Z-194 the recommend-
ations were for approval . It has been recommended for approval
by the Windsor Planning Commission. It places more restrictive
zoning on the ground than now exists . It provides a buffer
use to the adjacent areas . Mr. Lorenson stated they are re-
questing the PUD on applications Z-193 and Z-195 . Mr. Miller ,
mayor of Windsor stated it had been approved by the Planning
Commission and the Town Council in view of their past record .
Also they have a Comprehensive Plan and this zoning complies
with the Plan . Mr. Lorenson explained the recommendation was
not for denial but to table the applications and they develop
a PUD. Mr . Heitman stated he felt requesting a PUD was a
logical request . Mr. Bowles stated he didn ' t think this would
impose any great hardship on the company.
MOTION : By Mr. Watson that the applications be tabled and request
the company to present a PUD. Second by Mr. Heitman . A vote of
"Aye" by Anderson , Bowles , Heitman , Nix , Watson and Weigand .
Motion carried .
An executive meeting was held at 6 :00 P. M . in the Ebony Room of the
American Legion .

Mr. Bowles called the meeting to order.
SUBJECT : Flood Plain Study
DISCUSSION : Mr. Lorenson stated letters had been received from the
Ken R. White Company who is doing the Flood Plain study.
As of March 7 , 1972 they had 20% of the survey done. In the
1 etter dated March 14 , 1972 stating they have their photography ,
aerial photos and field survey 50% complete , their photography
85%. triangulaization 10% complete .
SUBJECT : Proposed Subdivision Regulations
DISCUSSION : Mr. Lorenson presented the staffs version of Sections
6 ,7 and 8 of the Subdivision Regulations as prepared by the
consultant . These are sections that should not be affected by
anything that the State Legislature does . They cover the final
plat requ : rements . Asked that the members review them before
the next meeting .
SUBJECT : Regional Transportation District
DISCUSSION : ;Ir. Lorenson stated the Regional Transportation District
is coming up with designs that affect us very much . They are
suggesting if we want any kind of a transit system that we will
have to do certain things in our planning. They submitted a
five page document . There are some things underlined that he
felt were worthy to look at. These are interim reports .
One item is financial resources discusses how are we going to
get money for whatever ve are going to build. Another is pro-
jections , one is technology , objectives etc . They have come up
w-: tn a Phase One concept of what the transportation is going to
be in this area . The concept relates around growth and how
your going to make the growth occur. The growth concept con-
cludes that instead of allowing continual sprawl , several areas
of activities "activity centers" should be developed throughout
the metropolitan areas of the region . Mr. Lorenson felt it
deserves some study because if it is adopted , we will be re-
quired to implement it . They have presented the County with
work sheets .
SUBJECT : Meeting dates
DISCUSSION : Mr. Heitman stated he would like to having both meetings
on Monday. After much discussion , it was decided the meetings
would remain on Monday the first meeting of the month and Tues-
day the second meeting .
SUBJECT: Soil Conservation Service
DISCUSSION : Mr. Lorenson stated the SCS is indicating that they do
not have the staff to give the soil information that we would
like to have . We are buying all of their soil maps . They
are printing them at the scale of our base maps . They are
working to make us an interpretation sheet indicating what the
symbols are . Dr. Heil of CSU has been contacted and is work-
ing on these interpretations for our office .
SUBJECT: Progress report on County Comprehensive Plan
DISCUSSION : Mr. Lorenson stated the consultant is not present to
present this report. This will be on the agenda next meeting .

PROPOSED USE:
Radio repeater station for air-to-ground and ground-to-ground radio communica-
tions during hail research commencing 1 May 1972 and continuing through
31 July 1972 and for a like period for the subsequent four years. Tower height
of 170' is in accordance with Federal Aviation Administration regulations which
requires no permit for this or shorter towers and which are not located in the
vicinity of nearby towers.
