WHEREAS, a public hearing was held on July 29, 1974, in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing the petition of State Highway Department, c/o
Leo O'Conner, 1420 Second Street, Greeley, Colorado (Elmer Stroh Land),
requesting permission to locate a gravel pit operation on the following
described property:
A tract of land located in the South Half (SZ)
of Section Two (2), Township Four (4) North,
Range Sixty-seven (67) West of the Sixth (6th)
P.M. , Weld County, Colorado, and more
particularly described as follows:
Beginning at the West Quarter Corner of
Section Two (2), thence East parallel to the
South line of Section Two (2) a distance of 880'
to the true point of beginning; thence continuing
East parallel to the South line a distance of 820'
to a point; thence South parallel to the West line
of Section Two (2) a distance of 420' to a point;
thence West parallel to the South line of Section
Two (2) a distance of 520' to a point; thence North-
westerly parallel to the East right of way line of
the Union Pacific Railroad a distance of 440' to
a point; thence North parallel to the West line of
Section Two (2) a distance of 100' to the true point
of beginning. Said tract contains 6. 29 acres, more
or less, and
WHEREAS, the petitioner was present, being represented by
Mr. Leo O'Conner, and
WHEREAS, there was no opposition to the request of petitioner
for the location of said gravel pit operation, and
WHEREAS, the said requested gravel pit operation is located in
an agricultural zone as set forth by the Weld County Zoning Resolution,
and,
WHEREAS, according to Section 3. 3(8) and Section 6. 1(3) of the
Zoning Resolution of Weld County, said gravel pit operation may be authorized
upon the approval of the Weld County Planning Commission and the Board of
County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the testi-
mony and statements of those present; has studied the request of the petitioner
and studied the recommendations of the Weld County Planning Commission,
and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of State Highway Department c/o Leo
O'Conner (Elmer Stroh Land), to locate a gravel pit operation on the pre-
mises indicated above be, and it hereby is granted under the conditions
following:
1. That any water and sanitation facilities to be installed shall be

approved by the State Health Department.
2. That petitioner shall proceed with due diligence to effect
construction of said gravel pit operation and that he shall have up to one
year from date hereof to begin the construction of same; otherwise, the
Board may, for good cause shown, on its own motion, revoke the permit
herein granted.
3. That a standard three strand barb wire fence be erected
around the full perimeter of said gravel pit operation, and that no tres-
pass and danger signs be posted around said perimeter at least at 100'
intervals.
4. That when gravel extraction is completed said permitee shall
immediately notify the Board of County Commissioners and said permit
shall automatically be revoked without further action of the Board.
5. That the operation and development of each gravel pit excava-
tion and rehabilitation shall be in accordance with the rules and regulations
for the operation of gravel pits as adopted by Weld County, Colorado.
6. That all applicable subdivision regulations and zoning regula-
tions shall be followed and complied with in accordance with the Zoning
Resolutions of Weld County, Colorado.

Dear Sirs,
Attached is a copy of our application for a Special Use Permit for
a temporary gravel pit to obtain material for the surfacing courses in
the construction of U .S. Highway 3L from the Weld - Larimer County
line Easterly.
We have already made application to the State Land Reclamation Board,
taken them on a tc:ur of the location, and received their tentative
approval of our application pending approval from the County.
Our proposed gravel pit lays in a terrace and meadow of the Big
Thompson flood plain. The excavation will begin on the terrace,
encompassing present areas where gravel has been removed. Then, if
additional material is required, we would continue working Easterly
into a portion of the meadow.
The area is presently covered with sparce to thick grass, four holes
where gravel was previously removed, and small stockpiles of overburden
and Gravel.
The overburden depth within the pit area appears to be from approximately
1.5' to 2.0'. It is anticipated that the majority of the overburden
will be utilized in the production of the gravel.
While Te were unable to ascertain the exact depth of gravel in the
area, *-e will require the Contractor to remove all useable material down
to a depth of approximately 18'.
The water ta.-')le level in the present pits and in our investigation
holes CT-s from 31 to 6'. Our test holes indicted gravel depths from
8'+ to 101+, therefore, cur excavation will result in a lake with depths
from approximately 1a,' to 12' deep. It is felt that the underground
water mo--ement thrcu,h the -ravel in the river bottom area will Prevent
the pond from having any stagnant water problem.
The top 0.3' of the pit area is to be stripped and stockpiled. At
the completion of our gravel operation the pit and pit area is to be
smoothed up and left in a neat condition. The top 0.3' stripping is to be
sprecd over the plant and stockpile area. All backslopes are to be left
no greater than 2:1.
We will conform to Weld County Zoning and Reclamation Regulations for
the removal o`.' the 1*ravel and the reclamation of the area.

open mining:
The ton 0.3' to be strinned end stockpiled. We will start our removal
operation in the area *-here sand and °ravel was previously removed.
Then if additional material is required the operation would be extended
Easterly.

12. Set out a time table giving the periods of time which will be required for
the various stages of the operation:
Stripping and stockpiling top 0.3' — 2 days
sand and gravel removal 6 to 8 weeks
smooth un pit area and replace top 0.3' - 3 days
13. Attach two copies of an accurate map of the area affected by the opening
mining which map shall include, but not be limited to, the following:
a. The map shall be made and certified to by a registered land surveyor,
professional engineer registered in the State of Colorado, or a
qualified person.
b. Identify the area on the map, with colored ink or some other manner,
which corresponds with the application.
c. Indicate adjacent deep mining and adjacent surface owners.

d. The map shall be to a scale of not less than one hundred (100) feet to
the inch and not to exceed six hundred sixty (660) feet to the inch.
e. Indicate the name and location of all creeks, roads, buildings, oil
and gas wells and lines, and power and communication lines on the area •
of affected land and within two hundred (200) feet of all boundaries of
such area.
f. Indicate the total area to be involved in the operation including the
area to be mined and the area of land affected.
g. Indicate the topography of the area with contour lines of sufficient
detail to portray the direction and rate of slope of the land in
question.
h. Indicate the general type, thickness and distribution of soil over
the area in question.
i. Indicate the type, character, and density of present vegetation
covering the area in question.

A bond must be submitted together with Board Form 2. (You will be
advised in writing of the amount of the bond after this application
has been reviewed.)

a. The bond must be payable to the State of Colorado.
b. The bond must be conditioned upon the operator faithfully performing
all requirements of Chapter 92, Article 13, CRS 1963 as amended.
c. The bond shall be signed by the operator as principal and by a good
and sufficient corporate surety authorized to do business in the
State of Colorado.
d. Said bond must be submitted with the application unless the Land
Reclamation Board authorizes the operator to use one of the alterna-
tive plans set out in Section 92-13-8, CRS 1963 as amended.
16. A land stabilization and reclamation agreement may also be required
pursuant to the provisions of Section 92-32-5, CRS 1963 (1969 Perm. Cum.
Supp.)

FECIAMi,TION PLAN
The location of our proposed gravel pit lays in a terrace and
meadow of a river bottom flood plain. The excavation will begin on
the terrace encompassing present areas there gravel has been removed.
After the material from this higher area has been removed the pit
will be extended Easterly into the meadow.
The area is presently covered with sparce to thick grass, four holes
where gravel T:as previously removed and small stockpiles of gravel
and overburden.
The overburden depth -within the pit area appears to be from l.5'
to 2.0' approximately. It is anticipated that the majority of the
overburden will be utilized in the production of the gravel.
1thile we were unable to ascertain the exact depth of gravel in
the area T*e will require the Contractor to remove all useable material
down to a depth of approximately 18'.
The ,,,titer table level in the present pits and in our investigation
holes —as from 3' to 6' . Our test holes indicated gravel depths
from 8'-'- to 10'+, therefore, our excavation will result in a lake
with depths from anproximatelt 1 ' to 12' deep. It is felt that the
underground water movement through the gravel in the river bottom area
Bill prevent the pond from having any stagnant water problem.
The top 0.3' of the pit area is to be stripped and stockpiled.
At the completion of our gravel operation the pit and pit area is to
be smoothed up and left in a neat condition. The top 0.3' stripping
is to be spread ovfr the plant and stockpile area. All backslopes are
to be left no greater than 2:1.
