James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine — EXCUSED Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Karin McDougal Department of Planning Services representative, Chris Gathman Department of Public Health and Environment representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated August 23, 2022, and duly published August 26, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Jeffrey Futter, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0017, for Buildings exceeding the Maximum Building Coverage in subdivisions (up to 17.5%) in the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter of record. Chair James reviewed the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Commissioner Saine being excused. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and location of the site. He relayed 14 referrals were sent out, six (6) were returned, three (3) with comments, and three (3) without comments. Mr. Gathman explained the existing residence will remain as a single family dwelling. He stated the site is located within the three (3) mile referral area of the City of Dacono, and the Towns of Erie and Frederick. He shared, per the Development Review staff, the site currently has two (2) existing, unpermitted access points, one onto Pikes Peak Street and one onto Spruce Drive. The application materials request the access onto Spruce Drive remain, the other be closed and reclaimed, and an Access Permit shall be obtained for the existing unpermitted access onto Spruce Drive, which is a paved, local road and requires 60 feet of right-of-way. He stated traffic counts on this portion of Spruce Drive counted 127 vehicles per day, with 11% being trucks, the 85th percentile speed is 30 MPH, and traffic will be residential in nature and is considered to be nine (9) round trip, passenger vehicles, per day. Mr. Gathman stated the applicant has submitted a Drainage Narrative which indicates the site meets a drainage cc', PL (T rft-%uJ/6G) 1./27/22 2022-2741 PL2839 HEARING CERTIFICATION - JEFFREY FUTTER (USR22-0017) PAGE 2 detention exception, and the historic drainage flows and runoff amounts on the property shall be maintained. Mr. Gathman displayed images of the site and surrounding views and entered the favorable recommendation of the Planning Commission into the record as written. Lauren Light, Department of Public Health and Environment, stated the existing residence is served by the Left Hand Water District and there is an On -site Wastewater Treatment System (OWTS) permitted for three (3) bedrooms; however, once the addition is complete, the OWTS shall be abandoned, and a new system will be added to the north of property. She shared staff has requested one (1) Development Standard (DS) which addresses setbacks and there are no outstanding issues with the application. Jeffrey Futter, applicant, stated staff provided a complete report. No public testimony was offered concerning this matter. In response to Chair James, Mr. Futter indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as presented. The Board discussed the Conditions of Approval and Development Standards, which they approved, as presented. El Commissioner Freeman moved to approve the request of Jeffrey Futter for a Site Specific Development Plan and Use by Special Review Permit, USR22-0017, for Buildings exceeding the Maximum Building Coverage in subdivisions (up to 17.5%) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Moreno, and it carried unanimously.
