Subject: Water Service Request, Basiliere Property, Single Family Residential Tap Request
This Letter of Intent (the "Letter") is in response to your inquiry regarding water service from North Weld County Water District
(the "District") to the property legally described in Exhibit A, attached hereto and incorporated by this reference (the "Property").
Wesley J. Basiliere and Shaun A. Basiliere shall be referred to herein as the "Developer".
In order to support you with obtaining water service, you should understand the following:
1. The District is able to provide water service to the Property, contingent upon all requirements of the District being
satisfied. If all District requirements, including all contracts, have not been satisfied and completed with the District within
1 year of the date of this Letter, the District may refuse to supply water to the Property. After 1 year, it should be
understood that the District reserves the right to refuse water service, if raw water is unavailable, and/or pipeline or water
treatment capacity is not capable of providing water service to the above -described property.
2. Before a water tap may be purchased, the Developer must provide a copy of a Warranty Deed, a Physical Address,
and provide a copy of this Letter, which Letter must be acknowledged by the Developer and also recorded on the
Property in the real property records of the Weld or Larimer County Clerk and Recorder, as appropriate.
3. The Developer must sign and execute any and all necessary Easement and Rights -of -Way Agreements regarding
specific locations, widths, size of pipeline(s) and descriptions for the Line Extension as determined by the District.
Providing water service to the Property is contingent upon execution and recording of the Easement and Right -of -Way
Agreements. Until such Easement and Right -of -Way Agreements are finalized and recorded to the satisfaction of the
District, the District will not initiate the design or construction of the Meter Set or Line Extension needed to provide water
service to the Property.
4. Based on the irrigation use of the Property along with other pertinent information provided on the Water Tap Request
Form, the District recommends the Developer's irrigated landscaping square footage not exceed 6,000 square
feet. This recommendation is based on the Full Standard Tap allocation and should be used to optimize delivery without
surcharge (i.e., to minimize the risk or likelihood of surcharge). Should the Developer desire to irrigate a larger
landscaped area, the District recommends the Developer purchase an additional allocation.
5. Developer is subject to the District's Amended and Restated Water Dedication Policy, which may be amended from time
to time (the Policy"). A copy of the current Policy is attached hereto as Exhibit B.
6. In no event shall Developer apply for a recorded exemption for the Property with a County prior to dedicating water as
required by the Policy and as set forth above. In the event Developer fails to dedicate water in relation to the Property
prior to a County approving a recorded exemption, the sole recourse of any future owners of the divided Property shall
be against the Developer
7. Any future owners of the Property or divided Property shall be third -party beneficiaries to this Letter and shall have the
right to enforce the terms of this Letter against the Developer. Nothing contained in this Letter shall give or allow any
claim or right of action against the District by a subsequent owner of the Property or divided portion of the Property. The
Developer shall be solely responsible for any claims relating to its failure to dedicate water rights as required by the
Policy.
8. The District's water tap options are shown in Table No. 1 included in Exhibit C of this Letter.
9. The District's current tap fees are shown in Table No. 2 included in Exhibit C of this Letter. Tha District's tap fees
shall be valid for 10 business days from the date the Developer receives this letter. The tap fees must be paid
within 10 business days of Letter receipt. After 10 business days of Letter receipt, tap fees will be subject to
the 'then in effect rates' (current cost) estabiistled by the District. The District is not responsible for notifying
individuals, banks, lenders, prospective buyers, real estate agents or anyone else, in any manner, of a change of rates
and/or fees.
10. The Meter Set Fee is valid only for the location shown on the map attached hereto as Exhibit D. After the water

lap has been purchased (Raw Water AFU & Plant Investment Fee), the Developer has 1 year in which to have the meter
set. The District requires a minimum 60 day advance notice to set the meter. If the meter has not been set within 12
months from the purchase date and the Developer requests in writing to relinquish the meter, the District shall refund the
Developer 93% of the tap fee. If longer than a year, the District will refund the Developer 90% of the tap fee paid. If the
Developer does not choose to relinquish the meter within 12 months of the Developer purchasing the meter and
the meter remains unset, the account will begin to be billed the minimum monthly amount.
11. The District's current usage rates and fees are shown in Table No. 3 included in Exhibit C of this Letter.
12. Water Surcharge. Water surcharge fees will be assessed when an account's year to date usage exceeds the annual
water allotment, The District's current surcharge rate is $2.00 per 1,000 gallons in addition to the standard monthly
usage fee. Surcharge fees are assessed to recover the District's costs in obtaining additional water rights for delivery.
13. Rate Differential Charge. Effective November 1, 2015, the District no longer accepts water transfers.
14. The District's current Plant Investment Surcharge is shown in Table No. 4 included in Exhibit C of this Letter. Plant
Investment Surcharge will be assessed when an account's year to date usage exceeds the Plant Investment Allotment.
The transfer of additional water will not remove this charge. Additional Plant Investment Units must be purchased to
increase the allotment and reduce the Plant Investment Surcharges. These rates are in addition to the standard monthly
usage fee.
15. The District has reviewed the Developer's Water Tap Request Application. Based on the information provided in the
application, the District's review included, but was not limited to, engineering review, field inspections, fire flow analysis,
hydraulic modeling, identification of offsite infrastructure improvement needs, preliminary pipe sizing, and/or developing
a preliminary line extension layout and fee estimate. If offsite infrastructure or a line extension is deemed necessary
to serve the Developer's property, the Developer is required to submit to the District for further Plan Review or
Design Approval prior to installation or service being provided by the District. Please reference the Process far
Obtaining Water Service workflow diagram for details on the Plan Review or Design scope of services. It is
important to note that all crossing agreements, easements or other outside third -party contracts require full execution
prior to any construction or water service being provided. It is imperative that the Developer allow ample time for the
Plan Review or Design Approval process prior to requiring water service.
The District hopes this Letter provides the necessary information to facilitate progress in meeting the requirements needed to

Acknowledgement and Agreement by Developer
The Developer hereby ada[owledges and agrees to the terms of this Leger of Intent, including its obligation to dedicate water In
relation to the Property. The Developer eda[wAedgea end agrees that It shell be solely responsible for any claims that may be
brought in the future by subsequent owners of the Property or portion of the Property in regards to Developer's failure to make
an appropriate water dedication prior to selling ell or a portion of the Property.
The Developer, its successors and assigns, hereby agrees to defend, indemnify and hold harmless the District and each of its
directors, officers, contractors, employees, agents and consultants (collectively, the "District IndemNteetr), from end against
any and all claims, demands, losses, IiebifNes, actions, lawsuits, damages, and expenses (the Veirhs% including reasonable
legal expenses and attorneys' fees actually Incurred, by the District Indemndaes arising duty or indirectly, in whole or In part,
out of the errors or omksions, negligence, willful misconduct, or arty criminal or bribes act or omission of the Developer or any
of its subcontractors, officers, agents or employees, in connection with this Letter of Intent and/or the Developer's obligation to
appropriately dedicate water prior to setting al or a portion of the Property. In the event the Deveoper falls to assume the
defense of any Claims required in this paragraph wlhin fifteen (15) daya after nogce from the Dlatrid of the existence of such
Claim, the District may assume the defense of the Claim with counsel of is own selection, and the Developer will pay el
reasonable expenses of such counsel.

AMENDED AND RESTATED WATER DEDICATION POLICY
I. Water Dedication Requirements
A. Projects in which the District has an executed Water Services Agreement with
Owner/Developer as of September 13, 2020.
i. Development Requiring Less than 5 -Acre Erect of Water. Any owner or
developer of real property who has an executed Water Service Agreement with the
District as of September 13, 2020, and who is requesting water taps requiring less
than five (5) acre feet of water for a development project, whether on one (1) or
more separate lots, tracts or parcels, shall, at its election, either (i) pay to the District
a cash payment in lieu of dedication of raw water in accordance with the then
applicable cash -in -lieu payment schedule adopted by the District from time to time
or (ii) transfer acceptable raw water rights to the District in satisfaction of the raw
water requirements for such development project.
ii. Development Requirira 5 -Acre Feet or More. Any owner or developer of
real property, whether acting alone or through one (1) or more Affiliates, who has
an executed Water Service Agreement with the District as of September 13, 2020,
and who is requesting water taps requiring five (5) acre feet or more of water for a
development property, whether on one (1) or more separate lots, tracts or parcels,
shall, at its election, either (i) transfer acceptable raw water rights to the District in
satisfaction of the raw water requirements for such development project or (ii)
transfer acceptable water rights to the District in satisfaction of seventy percent
(70%) of the raw water requirements for such development project and pay to the
District a cash payment in lieu of dedication of raw water in satisfaction of the
remaining thirty percent (30%) of the raw water requirements in accordance with
the then applicable cash -in -lieu payment schedule adopted by the District from
time to time. For purposes of this Resolution, the term "Affiliate" shall mean any
individual or entity that directly or indirectly through one (1) or more intermediaries
controls or is controlled by or is under common control with another specified
individual or entity.
iii. Cash -in -Lieu Payment Rate, The cash -in -lieu payment rate to be charged
by the District in lieu of dedication of raw water shall be Fifty -Eight Thousand

B. Projects in which a Water Service Agreement between the Owner/Developer and
District was not executed as of September 13, 2020.
i. Raw. Water Dedication. The owner or developer shall transfer acceptable
raw water rights to the District in satisfaction of one -hundred percent (100%) of the
raw water requirements for such development project. The District will not accept
cash payments in lieu of such raw water dedication. Notwithstanding the foregoing,
owners or developers purchasing a single tap from the District may make a cash -
in -lieu payment to the District in lieu of making a raw water dedication, which cash -
in -lieu payment shall be in accordance with the then applicable cash -in -lieu
payment schedule adopted by the District, as may be amended from time to time.
In the event a recorded exemption is approved by a County, owners and/or
developers of such divided and exempted properties seeking more than a single tap
are not eligible to make cash -in -lieu payment to the District, and, therefore, are
required to transfer the required raw water rights to the District in satisfaction of
one hundred percent (100%) of the raw water rights requirement° an set forth in
this paragraph.
ii. Phased Aunroach. Dedication of raw water rights may be in a phased
approach to be agreed upon in writing by the District and the owner or developer,
and which shall be memorialized in a Water Services Agreement between the
District and the owner or developer. No water taps for any phase of development
shall be issued until the agreed upon raw water dedication has been made for the
applicable phase of development.
C. Developers/Owners subject to Paragraph I.A Requirements May Opt -in to
Paragraph I.B Requirements. Developers and owners subject to the raw water and
cash -in -lieu dedication requirements set forth in paragraph I.A, above, may opt to be
subject to the requirements set forth in paragraph I.B by submitting a written request to
the District and entering into an amended Water Services Agreement with the District
setting forth the new dedication requirements. Any District costs associated with the
amendment to the existing Water Services Agreement shall be paid in full by the
developer or owner.

A. Water Rights Acceptable to District. Only those water rights determined to be
acceptable by the District shall be eligible for use in satisfying the District's raw water
requirements. Conversion factors for such raw water rights and the determination of the
amount of water available for allocation from such raw water rights shall be within the sole
discretion of the Board of Directors.
B. Transfer of Water Rights. Water rights dedicated to the District and assigned for
use to a subdivision or other real property shall not thereafter be re -assigned to another
subdivision or other real property without the prior written authorization of the District,
which authorization shall be within the sole and absolute discretion of the Board of
Directors. All water rights dedicated to the District shall be owned by the District and the
person or entity dedicating such water rights to the District shall have no further ownership
interest in the raw water rights.
C. Costs and Expenses oC Water Dedication. All costs and expenses to dedicate water
rights to the District to satisfy the raw water requirements of the District shall be paid by
the person or entity required to dedicate the water rights to the District. All costs and
expenses necessary to change such water rights so that they can be diverted and used by
the District for potable and non -potable water use shall be paid by the person or entity
required to dedicate the water rights to the District, or his, her or its successor in interest,
by payment of all required Water Court transfer fees.
D. Overlapping Municipalities with Hider Water Dedication Requirements.
Notwithstanding anything in this Amended and Restated Water Dedication Policy to the
contrary, if a municipality overlapping with the District or the District's Service Area, as
may be defined in any agreement between the District and the overlapping municipality,
requires a higher amount of water dedication under its water dedication policies and/or
under a water service agreement between the municipality and the District, then the
owner/developer shall be required to dedicate such higher amount to the District.

On March 29, 2013, an Earth Engineering Company, Inc. (EEC) representative
completed the test pit observation at the percolation test area #2 you requested for the
above referenced project. The observations and log of the 8 feet deep test pit completed
for the percolation test area #2 at the site are included with this report.
The materials encountered in the profile test pit at the percolation test site north of the
existing residence generally consisted of approximately 8 feet of brown sandy lean clay
soils which extended to the bottom of the completed test pit. At the time of excavating,
no groundwater was observed in the test pit.
Weld County standards require that neither groundwater nor bedrock be encountered
within 6 feet below ground surface in the area of a conventional absorption field. Based
on our observations of the profile test pit, the area observed and previously tested appears
to meet the County requirements for a conventional septic system. Weld County
guidelines for proximity to natural and manmade site features should be addressed when
siting the absorption field.

Earth Engineering Company, Inc. (EEC) personnel have completed the geotechnical
subsurface exploration you requested for the proposed single-family residence to be
constructed at 13813 Weld County Road 74 located in an area northwest of the
intersection of Weld County Roads 74 and 29 east of Severance in Weld County,
Colorado. Results of that subsurface exploration are provided with this report.
We understand the proposed single-family residence will be either a one or two-story,
wood frame structure with a full basement or slab -on -grade type foundation system. We
expect foundation loads for the proposed structure will be light with continuous wall
loads less than 3 kips per lineal foot and individual column loads less than 50 kips. The
residence is expected to utilize an individual sewage disposal system (ISDS).
The purpose of this report is to describe the subsurface conditions encountered in the test
borings completed within the identified building envelope on the site and provide
geotechnical recommendations for design and construction of foundations and support of
floor slabs. The results of site percolation testing are also included.
The parcel is situated in an area northwest of the intersection of Weld County Roads 74
and 29 east of Severance in Weld County, Colorado. The referenced building areas had a
slight slope toward the east and was sparsely vegetated at the time of our field work.

To develop information on existing subsurface conditions in the area of the proposed
residence, two soil borings were advanced to depths of approximately 20 and 25'h feet
below site grades at an area west of the existing residence. One (1) additional test boring
to a depth of approximately 8 feet and six (6) percolation test holes to depths of
approximately 3 feet were advanced in the identified area of the ISDS to develop
percolation and soil profile information. Six (6) additional percolation test holes to
depths of approximately 3 feet were advanced by the homeowner in another proposed
ISDS area north of the existing residence to develop percolation information. The
locations of the test borings were established in the field by the homeowner.
The borings were completed using a truck -mounted CME-45 drill rig equipped with a
hydraulic head employed in drilling and sampling operations. The boreholes were
advanced using 4 -inch nominal diameter continuous flight augers and samples of the
subsurface materials encountered were obtained using split -barrel and California barrel
sampling procedures in general accordance with ASTM Specification D-1586. In the
split -barrel and California barrel sampling procedures, standard sampling spoons are
driven into the ground using a 140 -pound hammer falling a distance of 30 inches. The
number of blows required to advance the samplers is recorded and is used to estimate the
in -situ relative density of cohesionless materials and, to a lesser degree of accuracy, the
consistency of cohesive soils. All samples obtained in the field were sealed and returned
to the laboratory for further examination, classification and testing.
As part of the field-testing, percolation tests were performed in the prepared percolation
test holes. Percolation tests were completed after presoaking the test holes for
approximately 24 hours. Results of the percolation testing are provided subsequently in
this report.
EEC field personnel were on -site during drilling to evaluate the subsurface conditions
encountered and direct the drilling activities. Field logs were prepared based on
observation of disturbed samples and auger cuttings. Based on results of the field borings
and laboratory testing, subsurface conditions in the area of the residence can be
summarized as follows.
Brown sandy lean clay was encountered at the surface at the boring locations. The near
surface sandy lean clay soils were generally very stiff to soft with depth in consistency.

The moderately plastic sandy lean clay soils exhibited a low potential for swelling with
variation in moisture content at current moisture/density conditions and extended to the
bottom of borings at a depth of approximately 20 and 25% feet below present site grades.
Observations were made at the time of drilling and approximately 24 hours after drilling
to evaluate the presence and depth to free water at the test boring locations. At the time
of drilling, free water was observed at a depth of approximately 15 feet below present site
grades at borings B-1 and B-2, respectively. Approximately 24 hours after drilling, free
water was observed at a depth of approximately 12%z and 111/2 feet below present site
grades at borings B-1 and B-2, respectively. Longer term observations in holes that are
cased and sealed from the influence of surface water would be required to more
accurately determine fluctuations in groundwater levels over time. Fluctuations in
groundwater levels can occur based on hydrologic conditions and other conditions not
apparent at the time of this report. Zones of perched and/or trapped water may also be
encountered in more permeable zones within the subgrade soils at times throughout the
year.
The stratification boundaries indicated on the boring logs represent the approximate
locations of changes in soil types; in -situ, the transition of materials may be gradual and
indistinct. In addition, the test borings provide an indication of subsurface conditions at
the test locations; however, subsurface conditions may vary in relatively short distances
away from those locations. Potential variations in subsurface conditions can best be
evaluated by close observation and testing of the subgrade materials during construction.
If significant variations from the conditions anticipated from the test borings appear
evident at that time, it may be necessary to re-evaluate the recommendations provided in
this report.
ANALYSIS AND RECOMMENDATIONS
Foundations
Based on the materials observed at the test boring locations, it is our opinion the proposed
lightly loaded single-family residence could be supported on conventional footing
foundations bearing in the near surface sandy lean clay soils. For design of footing
foundations bearing in the natural, stiff to very stiff sandy lean clay soils, we recommend

using a net allowable total load soil bearing pressure not to exceed 1,000 psf. The net
bearing pressure refers to the pressure at foundation bearing level in excess of the
minimum surrounding overburden pressure. Total load should include full dead and live
loads.
Exterior foundations and foundations in unheated areas should be located at least 30
inches below adjacent exterior grade to provide frost cover protection. We recommend
formed continuous footings have a minimum width of 12 inches and isolated column
foundations have a minimum width of 24 inches. Trenched foundations or grade beam
foundations could be used in the near surface cohesive soils.
We recommend the foundation footing design loads be balanced to promote relatively
uniform settlement, thereby reducing the potential for differential settlement. As an
alternative to balancing the design loads solely on settlement, designing the foundation
such that the dead -load pressure is balanced throughout the foundations could be
considered. Balancing the dead -load pressure would also reduce the potential for
differential settlement between adjacent footings. We estimate the long-term settlement
of footing foundations designed and constructed as recommended above would be less
than 1 inch.
No unusual problems are anticipated in the construction of the footing foundations. Care
should be taken to avoid disturbing the bearing soils. The natural site soils may be easily
disturbed by construction activities. Soils which are disturbed by the construction
activities or materials which have become dry and desiccated or wet and softened should
be reworked or removed from the foundation excavation prior to the placement of
foundation concrete.
Some zones of relatively soft sandy lean clay materials were observed with depth in the
completed borings. Care will be needed to avoid placing structural elements directly on
any soft zones of material. Careful observation should be completed prior to placement of
foundation concrete to evaluate the bearing materials. If soft zones are observed at that
time, reworking of the subgrade or removal and replacement may be necessary to develop
suitable foundation bearing.

While most of the site cohesive soils did not exhibit appreciable swell potential with
variation in moisture content, moderate consolidation was observed in some of the
samples tested. Close observation and testing will be needed to evaluate the volume
change characteristics of the in -situ soils at the time of foundation excavation. If
moderately compressible or soft soils are observed at that time, reworking of the
subgrade or removal and replacement may be necessary to develop suitable foundation
bearing.
Groundwater was encountered at a depth of approximately 11'/z and 12'/2 feet below
present site grades in the completed test borings. We recommend maintaining a
minimum 3 -feet separation between the foundation bearing elevation and peak seasonal
groundwater levels. Peak seasonal groundwater levels are typically observed in mid to
late summer.
We estimate the long-term settlement of footing foundations designed and constructed as
outlined above would be less than 1 inch.
Floor Slab and Exterior Slab -on -Grade Suberades
Any existing vegetation and/or topsoil should be removed from floor slab areas. After
stripping and completing all cuts and prior to placement of any floor slabs or fill, we
recommend the exposed subgrades be scarified to a minimum depth of 9 inches, adjusted
in moisture content and compacted to at least 95% of the material's maximum dry density
as determined in accordance with ASTM Specification D-698, the standard Proctor
procedure. The moisture content of the scarified soils should be adjusted to be within the
range of ±2% of standard Proctor optimum moisture at the time of compaction.
Scarification and compaction of subgrades in the basement area of the structure would
not be required.
Fill soils required to develop the floor slab subgrades should consist of approved, low -
volume change materials which are free from organic matter and debris. It is our opinion
the on -site soils could be used as low -volume change fill in the floor areas. Those fill
materials should be placed in loose lifts not to exceed 9 inches thick, adjusted in moisture
content as recommended for the scarified soils and compacted to at least 95% of standard
Proctor maximum dry density.

After preparation of the subgrades, care should be taken to avoid disturbing the in -place
materials. Subgrade materials loosened or disturbed by the construction activities or
materials which become dry and desiccated or wet and softened should be removed and
replaced or reworked in place prior to placement of the floor slab concrete.
As a precaution, the floor slabs should be isolated from structural portions of the building
to prevent differential movement to those elements causing distress to the structure. In
addition, we recommend the basement floor slab be isolated from non -load bearing
partitions to help reduce the potential for slab movement causing distress in upper
sections of the building. That isolation is typically developed through the use of a voided
wall which is suspended from the overhead first floor joist. Care should be taken in door
framing, drywalling and finishing to maintain a voided space which will allow for
movement of the floor slab without transmission of stresses to the overlying structure.
While laboratory testing completed for this report indicated the site soils sampled
exhibited relatively low swell potential, floor slab and exterior flatwork movement could
occur and should be expected. Slab movement is common in Colorado even in areas with
relatively low -swelling soils. Mitigation techniques to reduce the potential for post -
construction movement, such as overexcavation, moisture conditioning and replacement
could be considered; however, the risk for slab movement cannot be eliminated.
Below Grade Areas
We recommend a perimeter drain system be constructed around all below grade areas to
reduce the potential for water seepage into below grade areas and/or development of
hydrostatic loads on below grade walls. In general, a perimeter drain system should
consist of perforated metal or plastic pipe placed around the exterior of the structure and
sloped to drain to a sump area where water can be removed without reverse flow
occurring in the system. The drain line should be surrounded by a minimum of 6 inches
of appropriately sized granular filter soil and either the granular filter soil or the drain line
should be surrounded in a filter fabric to prevent the accumulation of fines in the drain
system.

Backfill placed adjacent to below grade walls above the drain system should consist of
approved, low -volume change materials which are free from organic matter and debris.
The on -site soils could be used as backfill adjacent to the below grade walls. Those soils
should be placed in loose lifts not to exceed 9 inches thick, adjusted in moisture content
and compacted to at least 95% of the material's standard Proctor maximum dry density.
The moisture content of the fill soils should be adjusted to be within the range of ±2% of
standard Proctor optimum moisture at the time of compaction.
Care should be taken in placing and compacting the wall backfill to avoid placing undue
lateral stress on the below grade walls. We recommend compaction using light
mechanical or hand compaction equipment.
For design of below grade walls where appropriate steps have been taken to eliminate the
buildup of hydrostatic loads, we recommend using an equivalent fluid pressure of 50
pounds per cubic foot. That recommended equivalent fluid pressure is based on an active
stress distribution analysis which includes an assumption of slight wall rotation. The
assumed wall rotation for an active case analysis may cause deflection on the order of
0.5% of the wall height. The recommended equivalent fluid pressure does not include a
factor of safety nor an allowance for hydrostatic loads. Point loads placed in the backfill
or surcharge loads placed adjacent to the structure could add to the lateral forces on the
below grade walls.
Other Considerations
Positive drainage should be developed away from the structure with a minimum slope of
1 inch per foot for the first 10 feet away from the building. Care should be taken in
planning of landscaping adjacent to the residence to avoid features which would pond
water adjacent to the foundations or basement walls. Placement of plants which require
irrigation systems or could result in fluctuations of the moisture content of the subgrade
materials should be avoided adjacent to the structure. Lawn watering systems should not
be placed within 5 feet of the perimeter of the building and spray heads should be
designed not to spray water on or immediately adjacent to the structure. Roof drains
should be designed to discharge at least 5 feet away from the structure and away from the
pavement areas.

Site Percolation Tests
Percolation tests and one 8 -feet deep boring were completed in the area of the designated
individual sewage disposal system (ISDS) envelope west of the existing residence. The
materials encountered in the test boring generally consisted of brown sandy lean clay
soils which extended to the bottom of the profile boring at a depth of approximately 8
feet below present site grades. An average percolation rate of 173.3 minutes per inch was
established in the percolation test holes. Percolation tests were also completed in another
area north of the existing residence in the area of the designated individual sewage
disposal system (ISDS) envelope. The holes were previously dug and presoaked by the
homeowner. The materials encountered in the percolation test holes and on nearby lots in
the area of the ISDS envelope generally consisted of brown sandy to very sandy lean clay
soils. An average percolation rate of 14.7 minutes per inch was established in the
percolation test holes located in an area north of the existing residence.
Weld County guidelines require a percolation rate in the range of 5 to 60 minutes per inch
for use of a non -engineered conventional absorption field. The measured percolation rate
does not meet that criterion at percolation test area #1 and does meet that criterion at
percolation test area #2. In addition, the Weld County guidelines require that
groundwater or bedrock not be encountered within 6 feet of ground surface at the location
of an absorption field. The test boring completed and on nearby lots indicates the near
surface site soils meet the bedrock and groundwater criteria. Based on the results as
outlined above, it appears an engineered system would be required at the percolation test
site #1 in an area west of the existing residence and a conventional septic absorption
system could be used for the residence at the percolation test site #2 in an area north of
the existing residence. In siting of the absorption field, Weld County criteria concerning
proximity to drainage ways, property lines and other site features should be addressed.
GENERAL COMMENTS
The analysis and recommendations presented in this report are based upon the data
obtained from the soil borings performed at the indicated locations and from any other
information discussed in this report. This report does not reflect any variations which
may occur across the site. The nature and extent of such variations may not become

evident until construction. If variations appear evident, it will be necessary to re-evaluate
the recommendations of this report.
It is recommended that the geotechnical engineer be retained to review the plans and
specifications so that comments can be made regarding the interpretation and
implementation of our geotechnical recommendations in the design and specifications. It
is further recommended that the geotechnical engineer be retained for testing and
observations during earthwork and foundation construction phases to help determine that
the design requirements are fulfilled.

Water levels indicated on the boring logs are the levels measured in the borings at the time indicated. In pervious soils, the indicated
levels may reflect the location of ground water. In low permeability soils, the accurate determination of ground water levels is not
possible with only short term observations.
DESCRIPTIVE SOIL CLASSIFICATION
Soil Classification is based on the Unified Soil Classification
system and the ASTM Designations D-2488. Coarse Grained
Soils have move than 50% of their dry weight retained on a #200
sieve; they are described as: boulders, cobbles, gravel or sand.
Fine Grained Soils have less than 50% of their dry weight
retained on a #200 sieve; they are described as : clays, if they
are plastic, and silts if they are slightly plastic or non -plastic.
Major constituents may be added as modifiers and minor
constituents may be added according to the relative proportions
based on grain size. In addition to gradation, coarse grained
soils are defined on the basis of their relative in -place density
and fine grained soils on the basis of their consistency.

Please be advised that the proposed Individual Sewage Disposal System for the above site must be designed bra Colorado
Registered Professional Engineer as per Weld County I.S.D.S. Regulations 3.5 and/or 4.6, as follows in part:
3.5 ....Except as provided in 25-10-107, CRS 1973, no permits shall be issued for the following systems unless they are
designed by a Registered Professional Engineer and after they have been received and approved by the Board of
Health.
D. Absorption fields for which the location cannot meet suitable soil or slope requirements.
4.6 A suitable soil shall meet the following criteria:
A. A minimum depth of four (4) feet between the bottom of the proposed absorption field and any limiting
zone(s). (Depth to limiting zone at site: At grade - loamy clay).
B. Has the capacity to adequately disperse the designed effluent loading as determined by a field percolation
rate of between five (5) minutes per inch and 60 minutes per inch or by other approved soil tests (Percolation
rate at the site: 126.0 minutes per inch).
. C. Acts as an effective filter within its depth for the removal of pathogenic organisms.
The engineer design must be approved by the Weld County Board of Health before a permit can be issued. The Board of
Health meets on the fourth Tuesday of each month: therefore, the engineer design must be submitted to this office ten (10
days prior to the meeting). Should you have any questions concerning this matter, please contact this office.

Please find enclosed data pertaining to percolation tests performed for an
Individual Sewage Disposal System (I.S.D.S.) for the above referenced site.
Percolation tests were performed by Total Engineering Service, Inc. TES)
on March 7, 1997. The average percolation rate was found to be
minutes per inch and are summarized on Table No. 1.
The average percolation rate met the County regulation rates for a
standard system. Ground water was not encountered to a depth of seven
feet six inches (7'-6"). See Log of Borings. It is our recommendation a
standard I.S.D.S. system be allowed at the above referenced site.

To Whom It May Concern:
Larry Andrews would like an early release of the building permits for Eastridge Estates, Lot 21
and Lot 22 prior to the release of the septic permits. Due to weather conditions, percolation
tests have not been performed on these properties. Individual Sewage Disposal System
permits have been applied for on these lots and if, when percolation tests are performed, it is
determined that each system must be designed by an engineer Mr. Andrews will retained an
engineer to design the systems. He is aware that there may be an additional cost for the early
release of the building permit, and that he may have to wait several days for the permits. He is
also aware that a septic permit must be obtained for each lot and that the septic system must
pass final inspection to receive a Certificate of Occupancy for the home. I am agreeable to the
building permits being released prior to the septic permits being issued.

GENERAL: Application was made to the Weld County Health Department under Permit
No. 9700121 for a replacement bed. Percolation tests and soils data
were taken April 16, 1997. The evaluation shows the top 72 inches
with silty loam with an average percolation rate of 96.4 minutes per
inch. This material is unsuitable for standard percolation rates.
The "engineered design" of sewage disposal system for this site is to
replace the open soil from 2 feet to 6-1/2 feet below the surface with
a suitable soil and construct a 24 inch absorption bed above the new
material.
From the soil profile, it appears the material at the site is unsuit-
able and imported material is necessary. A percolation rate of 10 mpi
(minutes per inch) will be used in the design of the absorption bed.
SEWAGE LOAD:
A bedrooms X 2 people X 75 gpd (gallons/day) = 600 gpd

4.6 A suitable soil shall meet the following criteria:
A. A minimum depth of four (4) feet between the bottom of the proposed
absorption field and any limiting zone(s). (Depth to limiting zone
at above site: Ground level).
B Has the capacity to adequately disperse the designed effluent
loading as determined by a field percolation rate of between five
(5) minutes per inch and 60 minutes per inch or by other approved
soil tests (Percolation rate at above.site: 67.03 m.p.i.).
C. Acts as an effective filter within its depth for the removal of
pathogenic organisms.
The engineer design must be approved by the Weld County Board of Health before
a permit can be issued. The Board of Health meets on the fourth Tuesday of each
month: therefore, the engineer design must be submitted to this office ten (10
days prior to the meeting. Should you have any questions concerning this matter,
please contact this office.

GENERAL: Application was made to the Weld County Health Department under Per-
mit No. SP 9700122. Percolation tests and soils data were taken
April 16, 1997. The evaluation shows the top 72 inches with silty
loam, with an average percolation rate of 67.0 minutes per inch.
This material is unsuitable for standard percolation rates.
The "engineered design" of sewage disposal system for this site is
to replace the open soil from 2 feet to 6-1/2 feet below the surface
with a suitable soil and construct 24 inch absorption bed above the
new material.
From the soil profile, it appears the material at the site is unsuit-
able and imported material is necessary.
A percolation rate of 10 mpi (minutes per inch) will be used in the
design of the absorption bed.

Soilogic, Inc. (Soilogic) personnel have completed the test pit observations and site
evaluation you requested to determine the suitability of the above referenced property to
support an On -Site Wastewater Treatment System (OWTS). We understand the system
will treat effluent generated by the proposed single-family residence to be constructed on
proposed Lot B, a part of Amended Subdivision Exemption AMDSE-1030 near Eaton in
unincorporated Weld County, Colorado. Results of the completed site evaluation and
OWTS recommendations are included with this report.
At the time of our site exploration on March 31, 2021, the ground surface in the proposed
Soil Treatment Area (STA) was observed to be moderately vegetated with an
approximate two -percent slope downward to the west. Evidence of prior building
construction was not observed in the proposed STA at that time. No known easements
exist within the area of the proposed septic system. In addition, unsuitable, disturbed
and/or compacted soils were not observed in the test pit observation area.
As part of our site evaluation, Soilogic personnel observed two (2) test pit excavations
completed by others in the area of the proposed STA. Graphic logs of the profile test pits
are included with this report as test pit TP-1 and TP-2. The materials encountered in the
profile test pits consisted of approximately 2 to 4 inches of vegetation and topsoil
underlain by dark-brown/brown Sandy Clay Loam with a Granular structure shape and a
Moderate structure grade (Soil Type 3) which extended to a depth of approximately 3 feet
below present site grade and was underlain by brown Sandy Loam with a Granular
structure shape and a Moderate structure grade (Soil Type 2) which extended to the
bottom of the profile test pits at a depth of approximately 8 feet below present site grade.

Soil samples were obtained from the profile test pits, sealed, and returned to the
laboratory for further evaluation. Groundwater was not encountered in the completed
profile test pits at the time of our site observation. We do not expect periodically
saturated soils exist within the upper 8 feet of subgrade soils in the area of the test pit
excavations.
As part of our services, a visual and tactile soil evaluation was completed on a
representative portion of the minus #10 (2 mm) fraction of the soil samples obtained to
determine soil classification as described by Table 10.1 of the Colorado Department of
Public Health and Environment Water Quality Control Commission, Regulation 43. Less
than 35% of the soil samples were retained on the #10 (2 mm) size sieve precluding the
need for soil replacement procedures. In our opinion, the lour (4) feet of subsurface
materials underlying the proposed infiltrative surface level can be classified as `Soil Type
2' with a corresponding Long -Term Acceptance Rate (LTAR) value of 0.60 gpd/sf and a
L'I'AR value of 0.60 was used for system sizing.
Weld County Department of Public Health and Environment (WCDPHE) guidelines
require a percolation rate in the range of 5 to 60 minutes per inch for use of a non -
engineered conventional Onsite Wastewater Treatment System (OWTS). The `Soil Type
2' classification and corresponding percolation rate of 16-25 minutes per inch meets that
criterion. In addition, WCDPHE guidelines require that neither groundwater nor bedrock
be encountered within 4 feet of the ground surface in the proposed STA. The test pit
excavations completed indicate the thickness of overburden soils is sufficient and meets
the bedrock and groundwater separation criteria at the test pit locations.
In accordance with WCDPHE design criteria and using the `Soil Type 2' soil
classification and corresponding LTAR value of 0.60 gpd/sf, a three (3) bedroom
residence utilizing a gravity fed chamber system in a bed configuration would require a
minimum STA of 630 square feet. Utilizing an equivalent footprint area value of 12
square feet per standard `Quick -4 Plus' Infiltrator® unit, a 630 square foot bed would
require 53 `Quick -4 Plus' standard Infiltrator® units in a bed configuration with a
minimum septic tank capacity of 1,000 gallons. A proposed system layout including one
(1) bed with four (4) rows of 14 units per row and a total of 56 units is included with this
report. A site evaluation and design calculation summary is also included.

In order to utilize the sizing outlined above the infiltrative surface will need to be
established at a depth of 36 to 48 -inches below present site grade in the area of the test pit
excavations. Infiltrator® units should be placed on leveled soil. Moisture conditioning
and compaction of the subgrade soils within the bed areas should not be completed and
heavy equipment should not be allowed to operate within the excavation. In addition,
care should also be taken to avoid smearing of the infiltrative surface soils.
We recommend a minimum soil cover of 12 -inches be developed over the top of the
septic tank and other system components including effluent lines, distribution box and
chamber units. We understand WCDPHE regulations require the top of the septic tank be
buried no deeper than 4 -feet below grade. The soil cover overlying the Infiltrator® units
should be graded to provide positive drainage across and away from the STA.
Care should be taken at the time of system installation to ensure WCDPHE requirements
concerning minimum required separation distances between system components and site
features and amenities are maintained. Setback distances are shown in their approximate
location on the included diagrams. A minimum 25 -foot setback is required between the
STA and potable water supply lines and a minimum 10 -foot setback is required between
the STA and property lines and lined intermittent irrigation laterals. According to the
Colorado Division of Water Resources, no water wells are present within 100 -feet of the
proposed STA. No setbacks other than those indicated on the attached diagrams are
known to affect the proposed system.
The owner should realize an OWTS is different from public sewer service and assume the
responsibility for maintenance of the OWTS. The system is relatively maintenance free
although periodic pumping of the septic tanks will be required. Water use must be
monitored so toilets and other fixtures are not allowed to continuously run. A freely
running toilet can consume in excess of 1,000 gallons per day and could flood and
irreparably harm the onsite septic system. In addition, toxic or chemically treated pool
and or spa water and plastic and other non -biodegradable materials should not be
introduced into the OWTS.
Sprinkler systems should not be installed or allowed to irrigate over the STA. In
addition, livestock should not be allowed to graze over the STA. The STA and

associated system components should not be subjected to vehicle traffic. We recommend
