HomeMy WebLinkAbout20222460.tiffRESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR JAIL BASED BEHAVIORAL SERVICES AND AUTHORIZE CHAIR TO SIGN - NORTH RANGE BEHAVIORAL HEALTH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding for Jail Based Behavioral Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Sheriffs Office, and North Range Behavioral Health, commencing upon full execution of signatures, with further terms and conditions being as stated in said memorandum of understanding, and WHEREAS, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding for Jail Based Behavioral Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Sheriffs Office, and North Range Behavioral Health, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said memorandum of understanding. NRBH has been providing this service to Inmates while in custody and transitioning services to their organization to continue treatment and services for substance use and mental health after the individual is released into the community since the inception of this program with Weld County in 2011. Beginning July 2021, the State as part of the contract requests a written MOU with the subcontractor. NRBH works in collaboration with the Weld County Sheriffs Office to ensure these services are being met in accordance with the contract with the State of Colorado. Their services are imperative to the success of the program given their ability to provide continuity of care seamlessly to individuals receiving these services. They provide this service with reimbursement from the State of Colorado managed by the Weld County Sheriff's Office with no cost to Weld County. What options exist for the Board? (include consequences, impacts, costs, etc. of options): The Board may approve or deny the memorandum of understanding. A denial of this request would place the responsibilities of these services on the staff of Weld County Sheriffs Office, which would require additional staff to be hired, and would require an agreement with NRBH for the transition of these individuals out the community removing the seamless transition currently in place. This is a NO COST service the State of Colorado has been providing to assess and treat individuals in the jail for substance use disorders along with release planning to include continuing services and resources once released into the community. The program provides resources and programming with the objective of establishing stability for individuals in the community and focuses on reducing recidivism in the jail. For the period of July 2021 - April 2022, even with pandemic challenges, the program had an average of 80% of individuals who were successfully transitioned to the community measured at one (1) month from release from jail. This percentage remained consistent from the year prior during the period of July 1st, 2020 to June 30', 2021, in which the program also had an average of 80% of individuals who were successfully transitioned to the community measured at one (1) month from release from the jail. Weld County operates as a conduit for the reimbursement contracted services between the provider who works in the jail to deliver direct services, and the State of Colorado, who funds the program, by distributing the funds appropriately to the provider to offset the cost of services incurred each month. An approval of this contract request would continue the services provided by NRBH at no cost to Weld County and has been a proven asset to the Weld County Sheriffs Office and the citizens of Weld County. **Please note this has been reviewed by Weld County Attorney office. 2022-2460 6%/Z‘ -I so cxY-3 Recommendation: It is recommended that the Weld County Board of County Commissioners enter into this contract. Sonja Kohlgraf, MBA Budget Manager Weld County Sheriffs Office Ph: 970-400-2872 1 MEMORANDUM OF UNDERSTANDING FOR JAIL BASED BEHAVIORAL SERVICES BETWEEN WELD COUNTY AND NORTH RANGE BEHAVIORAL HEALTH THIS AGREEMENT is made and entered into this Z 'day of Il1A9hj2022aby and between Weld County, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff, whose address is PO BOX 758, 1950 "O" Street, Greeley, CO 80631 hereinafter referred to as "WCSO" and North Range Behavioral Health, hereinafter referred to as "NRBH". RECITALS WHEREAS, WCSO and NRBH are partners in ensuring Jail Based Behavioral Services are provided to Inmates in custody at the Weld County North Jail Complex as outlined in the contract between Weld County and the Office of Behavioral Health (Contract 23 IHJA 174482), which provides for treatment and case management to those meeting eligibility requirements outlined in the program. It requires collaboration between WSCO and NRBH to meet this goal and provide appropriate services. WHEREAS, this MOU is required by the Office of Behavior Health (OBH) so that the WCSO may subcontract with NRBH to assist in providing the appropriate behavioral health services to inmates while supporting continuity of care within the community after release. WHEREAS, WCSO and NRBH are authorized to enter into this Agreement by the above referenced agreement and pursuant to the Weld County Home Rule Charter. NOW, THEREFORE, in consideration of the following mutual agreements and covenants,. WCSO and NRBH hereby agree as follows: 1. Agreement: The terms of this Agreement are outlined below. This Agreement, Exhibit A and any addenda and other exhibits attached hereto are incorporated in by reference, and, set forth all of the covenants, promises, agreements and conditions between WCSO and NRBH and there are no other covenants, promises, agreements or conditions, either oral or written, between them related to the subject covered by this Agreement. Exhibit A is the HIPAA Business Associate Agreement between WCSO and OBH and is therefore, applicable to this Agreement. 2. Protocol: WCSO will work in partnership with NRBH to provide for staffing and services for Jail Based Behavioral Services in accordance with the approved contract between WCSO and the OBH. NRBH approved staff will work as contracted employees within the Weld County Jail to identify eligible individuals in custody for the primary purpose of substance use treatment, complete assessment of eligible individuals in custody, provide services for substance use treatment, and the coordination of community services upon release. 3. Compensation: NRBH will be reimbursed for preapproved expenses as outlined in the contract between WCSO and the OBH. NRBH will submit invoices, receipts, and any additional documentation needed to demonstrate proof of expenses by the 15. of each month for the prior month's expenses. WCSO will submit an invoice to the OBH to request reimbursement. Once funding is provided to WCSO by the OBH, reimbursement will be provided to NRBH. 4. Term: This Agreement becomes effective upon full execution of the Agreement by the parties. This Agreement shall continue for a one (1) year period. Upon the end of the one (1) year period, the parties may elect to renew the contract on an annual basis upon the same terms and conditions. 5. Termination: Each party has the right to terminate this agreement, with or without cause, upon ninety (90) days written notice to the other party. 6. Non -Exclusivity Agreement: This Agreement is nonexclusive and WCSO may engage or use other Contractors or persons to perform services of the same or similar nature. 7. Assignment: Neither party may assign or transfer this Agreement or any interest therein or claim thereunder, without the prior written approval of the other. 8. Compliance with Laws: WCSO and NRBH agree to comply with the applicable provisions of all federal, state, and local laws or ordinances and all lawful orders, rules, and regulations issued thereunder; and any provisions, representations or agreements, or contractual clauses required thereby to be included or incorporated by reference or operation of law in this Agreement. 9. Modification: Any amendments or modifications to this agreement shall be made in writing and signed by all parties. 10. Non -Liability: The parties agree that in no event shall either party be liable due to any stoppage, delay, or any impairment in the protocol pursuant to this Agreement where such stoppage, delay, or impairment from acts of God, war, legal or equitable proceeding, or any other cause which is outside the control of the party. 11. Government Immunity: No portion of this Agreement shall be deemed a waiver, express or implied, of any immunities, rights, benefits, protections, or other provisions which either party, or its officers, employees, or agents, may possess pursuant to the Colorado Governmental Immunity Act § 24-10-101, et seq., C.R.S., as applicable now or hereafter amended. 12. Choice of Law/Venue/Compliance with Law: Colorado law, and rules and regulations established pursuant thereto, shall be applied in the interpretation, execution, and enforcement of this Agreement. Any previous included or incorporated herein by reference which conflicts with said laws, rules and/or regulations shall be null and void. The proper venue for any action regarding this agreement shall be in Weld County, Colorado. All parties agree to comply with any applicable federal, state, or local laws, rules, and regulations. 13. Severability: If any section, subsection, paragraph, sentence, clause, or phrase of this Agreement is for any reason held or decided to be invalid or unconstitutional, such a decision shall not affect the validity of the remaining portions. The parties hereto declare that they would have entered into this Agreement and each and every section, subsection, paragraphs, sentence, clauses, and phrases thereof, irrespective of the face that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. 14. Third Party Beneficiary Enforcement: It is expressly understood and agreed that the enforcement of the terms and conditions of this Agreement, and all rights of actions relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this Agreement shall be an incidental beneficiary only. 15. Fund Availability: Nothing in this Agreement shall be construed to require Weld County to provide funding for any purpose under this Agreement that has not previously been budgeted and adequately appropriated.
