HomeMy WebLinkAbout20222355.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, AUGUST 15, 2022 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, August 15, 2022, at the hour of 9:00 a.m. ;R ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro -Tern Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli MINUTES: Commissioner Moreno moved to approve the Minutes of the Board of County Commissioners meeting of August 1, 2022, as printed. Commissioner Buck seconded the motion and it carried unanimously. la PUBLIC INPUT: Alan Halley, Kersey resident, spoke regarding his concern of the 2022 Weld County Fair drug testing policy. He stated he supports having the drug testing and understands why it is necessary, however, he disapproves of the process in which it took place. Mr. Halley explained the process was very poorly conducted, there was no chain of custody, and no consent from the exhibitors or parents. He further stated the level of competition is extremely high, thus there are high expectations, including those on the Weld County Fair Board. He addressed the abuse of power by Christie Gable, and the need for accountability of the actions of the Weld County Fair Board. In response, Commissioner Freeman stated the Board of County Commissioners met with the Weld County Fair Board Members on Monday afternoon, prior to the Weld County Fair Board meeting that evening. Commissioner Freeman stated they had conversations with the Board members where they admitted their fault in the procedures and assured the issues that took place would not happen in the future. He further mentioned there are now three (3) vacancies on the Weld County Fair Board, and they are seeking quality candidates. la Jodi Stone, Eaton resident, concurred the second blood sampling felt like a violation, and stated there are huge consequences for the exhibitors should a positive test result happen. She further stated the Board must be held to a higher standard, and put the concerns of the competitors first in respect of all the hard work invested. 12 Sarah Pfannebecker, LaSalle resident, submitted Exhibit A, and described the treatment received by the Fair Board, while under the suspicion of surgically altering their Grand Reserve Steer and have since filed a formal complaint. She elaborated that two (2) Fair Board members and a veterinarian took Minutes, Monday, August 15, 2022 Page 1 2022-2355 BC0016 their steer, without their knowledge or consent, to shave parts of the chest before auction, and after they were cleared of any surgical alterations, Ms. Pfannebecker quoted Ms. Gable, "we all know your family is dirty." She requested a lifetime ban for Ms. Gabel in regard to her statement and blatant misuse of her authority. Justin Pfannebecker, son, spoke on this situation as the exhibitor, and stated initially he thought it was a bad joke and felt singled -out and bullied, even after proof of no wrongdoing. Commissioner Saine expressed her apologetic stance and stated there is an acknowledgement of the severe lack of leadership on the Weld County Fair Board, and there will be massive improvements. Commissioner Buck stated her sentiments and apologies for the lack of professionalism and treatment the had received, acknowledged the need for improvement, and offered her congratulations. .1 Landon Cogburn, LaSalle resident, spoke on his support of needing a change within the Fair Board and stated the abuse of power from Ms. Gabel is enraging, as his family received similar treatment two (2) years ago. He stated he will be running for the Fair Board to ensure that this treatment never happens again, as he referenced 'Agriculture Matters'. IM Chair James extended an apology, as the treatment they received was not right. He stated he appreciates the quality of competition, asserted the importance of following the rules and policies, and confirmed there will be adjustments to those policies for future Weld County Fair exhibitors so they will never experience anything like that again. Commissioner Moreno concurred with the sentiments that had been stated, and will make sure they are appointing the right people to uphold the highest standards in his final months as a Commissioner. Commissioner Freeman commented the 4H and Future Farmers of America (FFA) youth are the new up and coming leaders of this County, State, and Country. He stated he was proud of hosting the only Fair in the State during COVID-19 in 2020, and the Commissioners will do everything in their power to make the process right moving forward. AMENDMENTS TO AGENDA: There were no amendments to the agenda. I�. CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda, as printed. Commissioner Saine seconded the motion and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: Commissioner Buck stated despite the situation discussed above, the Weld County Fair was successful. She further stated she will be attending a river ride -along with Tina Booton, Department of Public Works, to learn more about noxious weeds. Commissioner Freeman stated, once again, the support of the Agricultural community in Weld County is unmatched, reaching a record -breaking $1.57 Million in Fair auction proceeds. Commissioner Moreno congratulated those who did well and participated in the Weld County Fair, and also stated he completed his Noxious Weed Inspection in a kayak along the Poudre River. He further stated it was an amazing responsibility to spot and manage weeds before they affect agriculture. Commissioner Saine stated she too is looking forward to her river tour. Chair James stated on August 10, 2022, he met with the Weld County Humane Society to come to an agreement for a more reasonable cost for animal welfare. He also attended the Highway 85 Coalition meeting hosted by Adams County, and heard progress reports on the Union Pacific Railroad. WARRANTS: 1) GENERAL WARRANTS - AUGUST 12, 2022: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner Saine seconded the motion and it carried unanimously. Minutes, Monday, August 15, 2022 Page 2 2022-2355 BC0016 BIDS: 1) APPROVE BID #62200106, ASSESSOR AND TREASURER OFFICE BUILDING (1400 NORTH 17TH AVE, GREELEY) HEATING, VENTILATION, AND AIR CONDITIONING (HVAC) AND ENTRY DOOR CHANGES - FACILITIES DEPARTMENT: Christie Peters, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, TCC Corporation, for a total amount of $88,789.00. Commissioner Moreno moved to approve said bid. The motion was seconded by Commissioner Buck, and it carried unanimously. 2) APPROVE BID #62200107, GENERATOR MAINTENANCE AT VARIOUS LOCATIONS - FACILITIES DEPARTMENT: Ms. Peters stated staff recommends selecting the lowest bidder who met specifications, Colorado Standby, LLC, for the amount of $14,600.00, for the annual maintenance, and $9,300.00, for bi-annual load bank testing. Commissioner Freeman moved to approve said bid. The motion was seconded by Commissioner Buck, and it carried unanimously. _ 33) PRESENT BID #62200111, LAW ADMINISTRATION BUILDING ROOF TOP UNIT REPLACEMENT - FACILITIES DEPARTMENT: Ms. Peters stated two (2) bids were received and staff will make a recommendation on August 29, 2022. .l 4) PRESENT BID #62200114, JAIL 1 WEST ROOF TOP UNIT REPLACEMENT - FACILITIES DEPARTMENT: Ms. Peters stated 25 vendors downloaded specifications, and three (3) attended the mandatory meeting; however, only one (1) bid was received, and staff will make a recommendation on August 29, 2022. E. NEW BUSINESS: 1) CONSIDER TEMPORARY CLOSURE OF CR 71 BETWEEN CRS 14 AND 16: Amy Mutchie, Department of Public Works, stated this closure will begin on August 16, 2022, and go through August 19, 2022, for the replacement of an irrigation culvert, with water to be used for dust mitigation on gravel portions of the detour route. Commissioner Moreno moved to approve said temporary closure. The motion was seconded by Commissioner Saine, and it carried unanimously. 2) CONSIDER EXTENSION OF TEMPORARY CLOSURE OF CR 22 BETWEEN CRS 31 AND 41: Ms. Mutchie stated the Department of Public Works is requesting a two (2) week extension for the road construction and paving on County Road (CR) 22 between CRs 31 and 37, to go through August 26, 2022, due to asphalt supply delay due to plant shutdown. She explained as of Friday, August 12, 2022, the Department of Public Works secured a secondary asphalt supplier, which allowed for the completion of the closure between CRs 37 and 41, except for shouldering, which does not impact traffic. Ms. Mutchie further stated the Department is expecting weather to impact construction for a few days, but still expect to complete the the project with construction of the last lane between CRs 31 and 37. Commissioner Freeman moved to approve said extension of temporary closure. The motion was seconded by Commissioner Buck, and it carried unanimously. 3) CONSIDER DECLARATION OF CERTAIN EQUIPMENT AS SURPLUS PROPERTY AND AUTHORIZE DISPOSAL - ANDERSEN SALES AND SALVAGE: Cheryl Pattelli, Chief Financial Officer, stated Donnie Patch, Undersheriff, requested Fleet Services dispose of trailer 15690007, a 1979 TEPE class eight (8) trailer, and confirmed the Sheriff's Office will not be purchasing a replacement. Commissioner Moreno moved to approve said equipment as surplus property, and authorize disposal. The motion was seconded by Commissioner Buck, and it carried unanimously. Livestock/Horse protests during county fair - If a protest is filed during the Fair: Judging procedures will not be interrupted for protest investigation. Any anonymous protests will not be considered. The protest must be presented within 24 hours of the occurrence of the action being protested. H. Special Exhibits - The division superintendent reserves the right to move any exhibit for special display. I. Cash Premiums - Cash premiums are paid on Sunday. July 31st from 1:00 pm to 4:00 pm at the Premium Window at the Fair Office. i. All 4-H projects, excluding Cloverbuds, that are interview judged and which receive a blue or red ribbon. ii. All 4-H and FFA Livestock projects, if placing is warranted, will receive cash premiums. iii. Open Class exhibits as defined in departmental information. iv. Premiums may be claimed at the pay booth during published hours. Allow one day following departmental judging for processing. v. Premiums, and/or cash awards, not claimed during the fair can be picked up in the Extension Office, during normal business hours of 8:00 am to 5:00 pm for 10 working days after the end of fair. vi. Premiums, and/or cash awards, unclaimed as of 10 working days after the end of fair will be forfeited. vii. Premiums for exhibits removed before release will be forfeited. Awards will be presented as they are won, with the exception of Special Awards. These awards are presented during special awards ceremonies as listed in the fair schedule. J. Curfew - There will be no overnight sleeping in the barns. A barn curfew of 9:00 p.m. will be enforced. K. Additional Classes - Superintendents will be allowed to add or combine classes as needed at their discretion. L. Pets - No pets are allowed in the Fair buildings and near show rings, except service animals. M. Sportsmanship/Conduct - Any flagrant display of poor sportsmanship or affront to a show official by or on behalf of the exhibitor, may result in exclusion of the exhibitor from competition and forfeiture of awards or expulsion from the show grounds for the person and/or exhibitor. N. Miscellaneous - THE USE OF SCOOTERS, SKATEBOARDS, ROLLER BLADES, BICYCLES AND OTHER SIMILAR DEVICES IS PROHIBITED ON THE GROUNDS DURING THE FAIR. The purpose of this rule is safety of participants and attendees of the Fair at the recommendation of the County Attorney. O. Re -issued Checks - A processing fee of $25.00 needs to be paid prior to re -issuing a check or will be deducted from the check before it will be reissued. All checks issued by the fair must be cashed within 60 days of issue or they will be voided. P. Rule Violations: All Exhibitors agree to abide by the IAFE National Show Ring Code of Ethics. Disciplinary Action — All rules pertaining to the Weld County Fair and its activities are subject to interpretation and enforcement by the Weld County Fair Board, or its designated representatives. Violation of any rule, knowingly or unknowingly, may result in penalties up to, and including, exclusion of the exhibitor from competition and forfeiture of awards or expulsion from the show grounds for the person and/or exhibitor, or disqualification from participation in Weld County Fair activities for such time as is determined by the Fair Board or its designated representatives. Upon discovery of a violation, the exhibitor will be notified via certified mail no later than 10 days prior to the next fair board meeting that the fair board will address the violation and decide upon appropriate discipline. The exhibitor may attend the scheduled fair board meeting and if so, will be given an opportunity to address the board. Following the decision of the fair board, the applicant may appeal the decision to the Board of County Commissioners pursuant to Weld County Code section 2-4-10. Appeal - Any party who seeks to modify the decision of the Fair Board may appeal the matter to the Board of County Commissioners. To do so, the party must file a written notice of appeal with the Commissioners within ten (10) calendar days of receiving the Fair Board's decision. The notice of appeal must specifically state what part of the decision the party seeks to have modified and the reasons, therefore. The notice shall not exceed five (5) pages in length. Within five (5) calendar days of receiving the notice of appeal the Fair Board may submit a memorandum brief. Any such memorandum brief shall not exceed five (5) pages in length.
