THE CITY OF GREELEY, COLORADO
RESOLUTION NO. 34 , 1974
WHEREAS the County Commissioners of Weld County, Colorado
desire to acquire the property hereinafter described for use with other
property as a location for a new County Services Building; and
WHEREAS the City of Greeley presently holds possession of said
property under a Lease Agreement dated December 11, 1959, which agree-
ment gives the City an option to purchase that property; and
WHEREAS the owner of the property disputes the right of the City
to acquire said property by exercising the option, said opposition being
apparently predicated on the fact that the property will not be used in the
future for public parking whereas under the lease the property was to be
used for public parking and, according to the owner's contention, the pro-
perty was to continue to be used for public parking even after the exercise
of the option; and
WHEREAS the City Council already has passed an ordinance author-
izing the appropriate officials of the City to exercise the option, but no of-
ficial action has been taken to authorize condemnation in the event it might
be determined by a court of competent jurisdiction that the City has no right
to exercise the option and to acquire the property, unless the property is
thereafter used for public parking;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF GREELEY, COLORADO:
1. The appropriate officials of the City and the City Attorney are
hereby authorizr i to take the property hereinafter described by eminent
domain, thro„ah a rend Paination proceeding, if the owner refuses to convey
the property to the City pursuant to the City's exercise of the option to
purchase set forth in the Lease Agreement dated December 11, 1959, and if
it is determined by a court of competent jurisdiction that if the City acquires
the property through the exercise of the option, the property must thereafter
be devoted to public parking purposes.
2. The property which is the subject of this resolution is described
as follows:
Lots 17 and 18 in Block 65, City of Greeley, Weld
County, Colorado.
