CHALET WEST SUBDIVISION FIRST FILING:
BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, that it does hereby approve the dedication of the perpetual rights-of-
way over the public roads, streets, highways, and easements in behalf of the public
in Chalet West Subdivision, First Filing being a subdivision located in the
West Half of the Southwest Quarter (W$W4) of Section 24, Township 5 North, Range
66 West of the Sixth Principal Meridian, Weld County, Colorado and being
more particularly described as follows:
Commencing at the West Quarter Corner (WiCor) of said Section 24, and consid-
ering the West Line of the Southwest Quarter (SW4) of said Section 24 to
bear North 00° 59' 40" West, and with all other bearings contained herein
being relative thereto:
Thence South 00° 59' 40" East, along the West Line of the Southwest Quarter
(SW4) of said Section 24, a distance of 945.56 feet to the true point of
beginning,
Thence North 89° 00' 20" East, 56.00 feet;
Thence along the arc of a circular curve to the right which has a radius of
50.00 feet and a long chord that bears North 56° 30' 20" East, 84.34 feet;

Said tract of land contains 17.284 acres.

BE IT RESOLVED, that the accompanying plat is approved for filing
and the public roads, streets, highways and easements thereon shown are approved,
provided, however, that the County of Weld will not undertake maintenance of said
streets, roads, and rights-of-way until they have been constructed by the subdivider
according to specifications and accepted by the County of Weld: and
BE IT STILL FURTHER RESOLVED, that the subdivider shall furnish a demand
note in the amount of $17,222.53 in lieu of a bond as recommended by the Weld
County Planning Commission.

TOPIC: PROPOSED SUBDIVISIONS
Rieker, Haney Mr. Lorenson reported that all requirements has been met and letters
8 Smith regarding sewer, water and road specifications were on file. Also,
a demand note in the amount of $17,222.53 has been signed and given E CHALET WEST, to Weld County in lieu of bond in the amount of $18,802.48 as
First Filing recommended by the Planning Commission. It was also recommended by
- - _— Mr. Lorenson to shorten the time length to two years. This being
acceptable with Mr. Rieker, the change was made. After some dis-
cussion of drainage, a motion was made to accept this subdivision.
Foster S. Schott Mr. Lorenson reported this request for acceptance of subdivision
was all in order with necessary demand note in the amount of F"
$11,750.00 on file. He recommended the time to be changed to
NORTHWEST ESTATES, two years and a paragraph added to reflect re-negotiation of
First Filing note at the end of two years, if necessary, due to construction
costs. The subdivision was then to be accepted after the changes
were made and the demand note signed by both partners.
College Green, Inc. It was noted by Mr. Lorenson that the College Green, First Filing
c/o Jake Pfleiger proposal was recommended unfavorably by the Planning Commission e
to the Board of County Commissioners due to the fact that the ^—
Plat does not meet the Planned Unit Development plan filed and
COLLEGE GREEN, recorded. This does not show an entrance onto 47th Avenue.
First Filing After discussion for and against this request, it was decided
to meet at 11:00 A.M. the next day (2-15-72) on the subject
property and see if some decision could be reached.
E. R. Austin This proposal was noted by the Weld County Planner as being all
in order with necessary demand note in the amount of $7,300.00
in hand along with all other requests in order. It was agreed

• This note is given for the purpose of securing the Board of County
Commissioners, Weld County, Colorado, against a contingent liability
by reason of said Board of Commissioners, Weld County, Colorado,
granting subdivision rights to one or more of the undersigned within the
County of Weld, Colorado, as outlined in Subdivision Agreement dated
February 2 19 72 , and guaranteeing installation of certain /lee

Amount of note shall be conditioned by damages which the Board of County
Commissioners shall suffer by failure of undersigned to perform under

The makers; endorsers, sureties, guarantors and assignors of this note

protest and of non-payment, and agree and consent to any extensions of
time of payment, without notice, by the holder on request of any of them.

maturity or in case of default (whether by suit or otherwise) ten percent

WATER SERVICE AGREEMENT
THIS AGREEMENT, made and entered into this a / day of // , 1977
by and between the CENTRAL WELD COUNTY WATER DISTRICT, hereinafter called the District
and Russell K. Haney, G. Frank Smith, Jr. and Louis C. Rieker , herein-
after called Customer, WITNESSETH:
WHEREAS, District has been organized as a legal body and is known as the Central
Weld County Water District, and
WHEREAS, Customers are taxpaying electors within said District, or desiring to
join said District, or and,
WHEREAS, Customers are desirous of purchasing water taps from the said District,
for service to approximately twelve single family residences, thirty-five fourplexes,
and forty-five duplexes.
NOW, THEREFORE, in consideration of the premises and the terms of this agreement,
it is mutually agreed as follows:
1. Customer agrees to pay the total meter fees in effect for taps required.
2. The description of the premises for which these taps are being purchased is
as follows :
A tract of land of approximately 38.5 acres located in the West half of
the Southwest Quarter (Wi SWk). of Section 24, Township 5 North, Range
66 West.
3. This agreement, when approved by the Board of Directors, shall become a legal
and binding contract upon all parties hereto.
4. Customer further agrees to execute any and all easements needed by District
at no expense to District, across Customer' s property for the purpose of installing any
pipelines constructed by District. District shall be responsible for restoring surface
area back to reasonable condition at District cost.
5. It is further mutually agreed that this agreement shall extend to and be
binding upon the heirs, executors, administrators and assigns of the parties hereto.
6. Customer further agrees to the following special provisions:
A. To provide satisfactory storage tank site on property if
determined necessary by District within one year of this
agreement.
B. Make payment of advance tap fees to District when additional
facilities are required to serve said property.
C. See attached Supplemental Water Service Policy to District
Rules and Regulations.
7. Customer further agrees to abide by the rates established and the rules and
regulations of the District.
IN WITNESS WHEREOF, the parties hereto have hereunto and hereunder set their
signatures the day and year first hereinabove written.

Subject: Development of 35th Avenue
South of by-pass
Gentlemen:
Reference is made to your letter of January 25, 1972 concerning the
improvement of 35th Avenue South of 34 by-pass, and in particular the
frontage of Chalet West P.U.D. The developers of Chalet West will in-
stall a vertical curb and gutter section as outlined in the above ref-
erenced letter, and in conformance with the City of Greeley standards
as shown by specifications for improvements furnished by the City.
Chalet West will seal the area between the installed curb and gutter
and 35th Avenue, but will not pave or improve the area. Paving and
improving will be done at a later date, and if done by the City, will
be handled in accordance with ordinances in effect at that time for
such improvements.
Chalet West agrees to and has furnished a right-of-way 56 feet in width.
If satisfactory, it is requested that a copy of this letter be signed
and returned to the undersigned.
