Grantee;
2. The consideration was bargained on the basis of an "as is, where is" transaction and
reflects the agreement of the parties that there are no representations, disclosures, or
express or implied warranties;
3. The Property is located within a Common Interest Community and is subject to the
declaration, bylaws and Rules of such community,
4. He has been furnished with a copy of the Declaration, Bylaws and Rules for such
Common Interest Community, and that, as a member of such community, he
understands that such documents impose various financial and other obligations on its
members, including, but not limited to, the ability of the community to impose
assessments and the necessity to seek approval from the community, or its architectural
review committee, in the event any changes are made to the Property;
5. The Property will be conveyed to Grantee in an "as is, where is" condition with all
faults;
6. Grantor makes no warranty of condition, merchantability, or suitability or fitness for a
particular purpose with respect to the Property;

7. All warranties, including (i) all warranties of title, (ii) any and all warranties associated
with the availability, quality, and quantity of water, and (iii) any and all warranties
involving access to water via a public water supply or otherwise, are disclaimed;
$. He has had ample opportunity to research title to, and the quality and quantity (if any)
of water available to, the Property and is satisfied with the status of same;
9. Notwithstanding anything to the contrary contained herein, no oil, gas, other minerals,
or water rights are conveyed by Grantor to Grantee in connection with the transfer
evidenced by this Quit Claim Deed;
10. He has had ample opportunity to conduct his own due diligence of the Property
(including the opportunity to conduct whatever environmental, water, soils, or other
inspections or tests of the Property as he, in his sole discretion, deemed necessary or
desirable) and has determined that the Property is suitable for his intended purpose and
use;
11. He has had the opportunity to, and that he has been advised to, contact counsel of his
own choosing with regard to his review and consummation of the transactions
contemplated in connection with the transfer evidenced hereby;
12. He has been advised that the principal of Grantor is a licensed Colorado real estate
broker; and
13. The covenants contained in this Quit Claim Deed, and the agreements and covenants
contained in the Secured Promissory Note and Deed of Trust executed by Grantee in
favor of Grantor in connection with the transfer evidenced hereby, represent the entire
agreement between Grantor and Grantee and shall supersede any and all previous
contracts and agreements, whether written or oral, relating to the subject transfer,
