HomeMy WebLinkAbout710311.tiff • RES0WTI0N WHEREAS, a public hearing was held on Monday, August 9, 1971, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Donald Adsit, Route 1, Box 78, Erie, Colorado, requesting approval to locate a chicken hatchery operation on the following described property, to-wit: That part of the Southwest Quarter of Section 24, Town- ship 2 North, Range 68 *tat of the 6th P. M., Weld County, Colorado, described as follows: Commencing with the Southwest Corner of said Section 24; running thence South 89° 53' 29" East 650 feet along the South line of said Section 24; thence North 0° 06' 31" East 334.66 feet to the True Point of Beginning; thence North 00 06' 31" East 666.86 feet; thence North 89° 53' 29" West 654.81 feet to a point on the West line of said Section 24; thence South 0° 10' 0" East 666.87 feet along said West line; thence South 89° 53' 29" East 651.61 feet to the True Point of Beginning, containing 10.00 acres, more or less, and WHEREAS, the petitioner withdrew his application for location of said chicken hatchery operation and neither was he present at the hearing, and WHEREAS, there was no opposition to the request of peti- tioner for the location of a chicken hatchery operation, and WHEREAS, according to Section 3.3(3)(c) of the zoning resolu- tion of Weld County, said request to locate a chicken hatchery operation may be authorized upon the approval of the Board of County Commissioners, Weld County, Colorado, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that because the application of Donald Adsit, Route 1, Box 78, Erie, Colorado, to locate a chicken hatchery operation on the premises indicated above was withdrawn, there is no question before the Board to decide the situation is moot and the application is denied. It is estimated there will be in ex- cess of 10 ,000 people attend . Mr . Lorenson stated the Speed- way is probably a legal non-conforming use . Mr . Connell stated the Health Department has the power to forbid gatherings of people when necessary to protect the public health . There is another section of the statute that gives the department power to forbid a nuisance to be formed or to forbid that, that would become a public nuisance . How they would proceed would be be- tween the Health Department and the District Attorney. It is compatible to surrounding land use and has been recommended for approval by the Health Department and the Extension office , Soil Conservation Service indicates there are no soil problems . It should be subject to construction to begin within one year of the approval by the County Commissioners . Mr . Langley stated he would like to expand to 100 brood sows . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Mr . Lorenson ' s recommendations . Motion by Mr. Bowles , second by Mr . Watson . The Commission denied the pullet rearing aspect, but agreed to allow me to pursue the hatchery. I directed a letter to your office expressing my disappointment over not having received favorable consideration for both operations. . On June 10, 1971 you directed a letter to me, wherein you in= formed me that I had beenscheduled to meet before the Board of County Commissioners for a hearing. I have not been informed as to the date - of that hearing. It is imperative th-•t I get my operation going. Each d ay's delay is a financial loss to me. I do not understand why there has already been a time lapse of over four weeks. I would appreciate it if you would check to see if I have been forgotten, and when I can be s cheduled for a -- hearing before the board. Ashley J U L 2 7 1971 Commissioner Weld County, Colorado• COUNTY CLERK AND RECORDER ' Dear Mr. Ashley: By Deputy I have a scheduled hearing before the Board of County Commissioners on August 9, 1971 as pertains to my desire to errect a hatchery. un June 7, 1971, I met the Weld County Planning Board, in- an attempt to justify a land use permit allowing me to errect a hatchery and pullet rearing barns. 1 was denied the collective' request, but salvaged the hatch- ery aspect, wherein the Planning Board would sanction such. I was disgusted and amazed at the Planning ''oard. I was disgusted to - see that persons serving on this board, with the exception of one man, were totally ignorant of the situation. I was amazed that the Planning Board was not aware of revenue potential to the county had my request been approved. The majority of the board had not the slightest idea of what I was intending to operate. If that board is to be of anyservice to agricultural pursuits, then they should be knowledgable enough to know what an applicant is desiring. If this is an example of taxpayers' monies being spent, then you are alloying a waste that cannot be tolerated. If I were a commissioner, I am certain that there would be replacements on that board. I was contemplating seven pullet raising farms. Each had a pullet barn oosting approximately $70,000, and a home for each installation. Such would • have a real value of over $600,000.00. Tax revenues from such should have been welcomed,, but such was not the case. My pullet rearing barns were declined due to a"housing area" adjacent to my area. There is no housing area even contemplated in that area.The Boards rejection was based upon fabrications which they could not defend. The hatchery was approved only because one board memberwaq knowledgable enough to know how one operated. The rest would not have been able to identify a hatchery from a rocket ship. The Mayor of Dacona received a letter concerning my requested rezoning. He lives five miles from the proposed hatchery site, yet he was allowed to enter an opinion if he so desires as to whether I should be granted my request. He wonders, and so do I as to why he was querried on this matter. You Commissioners and Planners have a big job before you. and I sympathize with you. However, if any of you are not capable of "cutting the mustard" you should bow out and not hold, back progress. I feel that the inability of your sub- ordinates to act efficiently and ;prudent]$ are detrimental to growth of the county and that such actions necessitate that I relocate elsewhere.
