WHEREAS, a public hearing was held on Monday, June 14, 1971,
in the chambers of the Board of County Commissioners of Weld County,
Colorado, for the purpose of hearing the petition of Earl Anderson,
Route 1, Box 194, Greeley, Colorado, requesting approval for expansion
of an existing dog kennel operation on the following described property,
to-wit:
A parcel of land located in the West Half of the North
Half of the North Half of the South Half of the Northwest
Quarter (WfNZSZNW4) of Section Thirteen (13), Town-
ship Six (6) North, Range Sixty -five (65) West of the
6th P. M. , Weld County, Colorado containing 10 acres,
more or less, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of petitioner
for the expansion of an existing dog kennel operation, and
WHEREAS, the said requested permission for location of a dog
kennel operation or any expansion thereof is located in an agricultural
zone as set forth by the Weld County Zoning Resolution, and
WHEREAS, according to Section 3. 3(3) of the Zoning Resolution
of Weld County, said dog kennel operation or any expansion thereof may
be authorized on the approval of the Board of County Commissioners of
Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present: has studied the request of
the petitioner and studied the recommendations of the Weld County
Planning Commission, and having been fully informed:
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Earl Anderson, Rt. 1, Box 194,
Greeley, Colorado, for expansion of an existing dog kennel operation on
the premises indicated above be, and it hereby is granted under the
conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State IIealth Department.
2, That said dog kennel operation shall not contain more than
thirty (30) dogs at any one time.
3. That all applicable subdivision and zoning regulations shall
be followed and complied with in accordance with the Zoning Resolutions
of Weld County, Colorado.

building permit . It was Mr. Connell ' s opinion this is only
for the people within the Subdivision and there would be no
sales outside of this area . If there are sales to anyone
other than a member of the coop , it becomes commercial . Mr.
Connell stated it was indicated to him the people putting
this in is a coop of the people within the subdivision , if
they are going to sell to other people , then further action
should be taken because it would be a commercial operation .
It was agreed the building permit should be held up until it
is determined what action is necessary.

APPEARANCE : Rod Day , Division Manager and Vance Federighi Div . Engr .
DISCUSSION : Mr . Day explained they propose to build a service
station and truck bay at this location . Mr. Day stated they
had cut the zoning back 100 ' from the plat presented at the
previous meeting , containing 13+ acres . Mr. Paul stated they
need this much area because of the polishing pond . Mr. Lorensor
recommended approval and if approved , the application for the
lagoon should also be approved . The Highway Department has no
plans for expansion of the adjacent interchange , the location
is proper for the type of use proposed . The Health Department
has approved the sewage treatment facility. If approved , it
should be subject to a 150 ' turn slot on the south end of the
Kersey road as suggested by the Highway Department. There was
a question whether the lagoon should be included in the zone
change .
RESOLUTION :
Be it therefore resolved to recommend approval to the
Board of County Commissioners subject to Mr . Lorenson ' s rec-
commendations . Motion by Mr . Bowles , Second by Mr . Anderson .

RE: Dog Training Track
Dear Mr. Anderson:
This letter is to inform you that your request to locate an exercise
track on your property is approved. The basis for approval is due to
your use now on the property being approved through a special use permit.
The exercise facility is construed as being accessory to the permitted
use.
There are considerations that should be realized before installation of
such a facility. These considerations are as follows:
1 . The facilities are to be utilized only by Mr. Earl Anderson
for the purpose of training those dogs raised on his pro-
perty.
2. The facilities are to be utilized only as accessory to the
principal permitted use which is a dog kennel .
3. The facility is not to be utilized for commercial gain.
This would include leasing facilities, charging admission,
etc.
The facility should be installed so as to be temporary. The reason herein,
so the facility can be taken down if the kennel operation is ceased.
Hopefully this has answered your questions. Please do not hesitate to
