September 5 , 1972 at 3 :15 P. M. in the 4-H Building , Island Grove
Park.

Mr. Anderson called the meeting to order, stating inasmuch as there
was not a quorum, the cases would be heard and decisions made at a
later date.

APPEARANCE: Mr. Fagerberg , Jay Freese , Don Vornholt, John Houtchens
DISCUSSION : Mr. Freese presented the preliminary plat. It has been
approved by the Utility Board . A 2' water line is available and
the water district indicates this is adequate, and a 2' fire
hydrant is to be installed at the request of the Eaton Fire Pro-
tection District, even though fire hydrants are not required for
subdivisions under 10 lots . There are 6 lots in the proposed sub-
division. Mr. Ohi read the recommendations of the planning staff:
Utility Board has approved the plat, a variance for the 2" water
line and for overhead powerlines was requested . Gas will be by
propane tanks and all lots will be served from existing County road .
The area is proposed for agricultural use in the Greeley Compre-
hensive Plan which is presently zoned "E" Estates . The proposed
subdivision meets the lot area and lot width requirements for an
"E" zone . Existing structures in proposed lots 1 and 2 dp not
meet minimum setback requirements . Centerline of Bliss Lateral .
should be shown on plat. Bliss Laterial is requesting a 25 ' ease-
ment along east ROW and access easements at both ends of tract .
Mr. Houtchens stated Mr. Vornholt is secretary of the ditch company
and he is representing the ditch company. Mr. Houtchens stated
the ditch abuts the back end of the lots and questioned how to make
the ditch and residential units compatible. The ditch company is
requesting the easement in order to properly maintain the ditch .
Mr. Freese felt the request was excessive of what would be nec-
essary to maintain the ditch. Mr . Anderson statedthe problem
should be worked out between the developer and the ditch, company.

the zone change and PUD of Tracts A and B for which the County
Commissioners approved . Mr. Britzman stated all of the requirements
have been submitted . Mr . Ohi stated the plat follows the approved
official unit development plan . The City of Greeley has approved
the plat. If approved it should be subject to a corrected official
unit development plan , an agreement with Home Light & Power con-
cerning the relocation of existing power lines . completed subdivi -
sion improvements agreement. A letter has been received from the
County Engineer approving the drainage plan . Mr. Britzman stated
they are negiotiating with Home Light and Power and Mountain
Bell regarding the relocation of existing lines . No action taken .

DISCUSSION: Mr . Adams stated there had previously been a dairy at this
location . There are several dairies in the area . It is an approved
agricultural operation and would conform to agricultural green-
belt planning . It has been recommended for approval by the Health
Department . The design was judged adequate by the County Extension
Agent . It is shown as agricultural use on Greeley' s Comprehensive
Plan . If approved it should be subject to a sealed lagoon as in-
dicated by the soils report , a maximum of 120 head plus replace-
ments . and construction to begin within one year of approval by
the Board of County Commissioners . Mr . Schmidt stated plans for
the corrals are being drawn by the Soil Conservation Service .

DISCUSSION : Mr . Adams stated the feedlot complies with Greeley' s
Comprehensive plan , it is recommended for approval by the Health
Department . The design is judged as good by the County Extention
agent and adequate water is available . If approved it should be
subject to a total of 750 head , if sand and gravel is encount-
ered in first 4 feet during construction a lagoon would be re-
quired and construction to be begin within one year of approval
by the County Commissioners . Mr . Koehler stated the new area is
designed for 720 head and they now have pens for 180, making a
total of 900 head . Mr . Paul stated he did ' nt think a lagoon would
be necessary. Mr. Watson suggested that Mr. Koehler apply for a
maximum of 1000 head . No action taken.

and has been recommended for approval by the Health Department .
If approved , should be subject to a maximum of 30 dogs and adequate
fencing due to the proximity of Sunnymeade chicken operation .

o SCUSSION : Mr . Bob Britzman stated he could represent Mr. Gilbaugh
who intends to own most of the property and live on the site .
Six parcels shown on the plat will be in pasture for any
tenants , through the covenants, can pasture their horses . There
will be a riding ring around the pasture . The barn will operate
the same way. The road is suggested as a private road, and will
be maintained by Mr. Gilbaugh. Water will be furnished by North
Weld . Percolation tests have been taken. Mr. Ohi read the items
to be considered : it has been approved by the Town of Eaton ,
Mountain Bell and Home Light & Power. Health Department has
approved the septic systems . North Weld Water District intends
to serve the water. The Overall density would be 415 acres for
each unit . Covenants covering common use of pastures , trails ,
riding ring and barn are needed. Adequate means of maintaining a
private road is needed. There should be dedicated a 1 ' strip along
County Road #41 to block access . ROW widths should be clarified .
The eaton Fire District recommends a 3rd fire hydrant. Matter
taken under advisement. No action taken.

DISCUSSION : Mr. Hammond stated they wereltack to try and resolve
some of the problems that were discussed at the previous meet-
ing . Mr. Hammond presented a letter from Mr. DeGood of the
Farmer' s Ditch Company. They have met with the developers and
have worked out a procedure to resolve any questions . Mt . Olhausen
read a letter regarding the comments presented by Mr. Ohi at the
previous meeting . Mr. Chotvacs stated in regards to the dedication
Mr. Capron of the Highway Department still feels that the Highway
Department would request that the 150 ' be dedicated for highway
improvement , however they would be amenable to any proposal that
they would make and be willing to take it into consideration . He
thought consideration should be to the highways . Mr. Chotvacs
stated that 34 is a major thoroughfare and access should be con-
trolled by some means . Mr. Stobbe stated there is no way they can
afford to dedicate the ROW because of economics . Mr. Hammond
stated they would agree to a designation on the plat and not
platted into lots and they are not trying to increase the value of
this designated area . There was discussion regarding substandard
lots with less than required lot frontage . These would require
excessive front yard set-back to meet the minimum required lot
frontage . Mr. Shupe stated they have a meeting scheduled with
the ditch company to work out the details of an agreement with
them. A letter from Wm. Southard , attorney for the ditch company ,
was read. Cindy Telep read a note from John fo-utchens , attorney
for Ray Aren , who objects to the development as it wtll result
in comments from the inhabitants of the development regarding his
cattle feeding operation to the south of the area. He is also
concerned about the sewage disposal from the area . Mr. Stobbe
stated they feel the design of their treatment plant will be ad-
equate and efficient so as to eliminate any seepage. Mr. and
Mrs . Carl Amen appeared in behalf of the development. Mr. Ohi
read a letter from Howard Schwalm opposing the proposed development.
expressing concern regarding schools , police protection , etc .

RESOLUTION
WHEREAS, a public hearing was held on August 28, 1972, in the
chambers of the Board of County Commissioners, Weld County, Colo-
rado, for the purpose of hearing the petition of Edward E. Meyer,
Route 1, Box 140, Greeley, Colorado, requesting permission for ex-
pansion of an existing cattle feed lot operation on the following des-
cribed property, to-wit:
The West half Northeast quarter of the Southeast quarter
(W+NE1SEt of Section Two (2), Township Five (5) North,
Range Sixty-four (64) West of the 6th P. M. , Weld County,
Colorado containg 20 acres more or less, and
WHEREAS, the petitioner was present, and
WHEREAS, the said requested expansion of an existing cattle
feed lot operation is located in an agricultural zone as set forth by
the Weld County Zoning Resolution, and
WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution
of Weld County, said cattle feed lot operation or any expansion thereof
may be authorized upon the approval of the Board of County Commissioners
of Weld County, and
WHEREAS, the Board of County Commissioners heard all the testi-
money and statements of those present; has studied the request of the
petitioner and studied the recommendations of the Weld County Planning
Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Edward E. Meyer, Route 1,
Box 140, Greeley, Colorado, for expansion of an existing cattle feed
lot operation on the premises indicated above be, and it hereby is granted
under the conditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. That petitioner shall proceed with due diligence to expand said
cattle feed lot operation and that he shall have up to one year from date
hereof to begin construction for the expansion thereof.
3. That when expansion of said cattle feed lot is completed, same
shall not contain more than 5, 000 head at any one time.
4. That petitioner shall construct/or seal any lagoon and/or exist-
ing lagoons on said premises.
5. That all applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the Zoning Resolutions
of Weld County, Colorado.

DISCUSSION : Mr. Lorenson read a report written by Jim Ohi regarding
the existing wells recommending that a change in use and yield
be applied for in the Water Courthand that both wells be adjudi -
cated . The use should be changed from domestic to feedlot . Mr .
Lorenson stated the Soil Conservation Service recommended a
sealed lagoon . Mr. Meyer stated the lagoon has been in existence
since 1966 and had drainage from the feed lots , it had been approved
by the State Pollution Control and they have had no problems . Mr.
Lorenson recommended the legal description be reduced to 20 acres ,
approval of well water source by the State of Colorado , determine
the size of the lagoon as requested by the Health Department , a
maximum of 5000 cattle , construction to begin within one year of
approval by the County Commissioners and sealing the existing
lagoon .
RESOLUTION :
Be it therefore resolved to recommend approval to the Board
of County Commissioners subject to the recommendations of Mr.
Lorenson . Motion by Mr. Nix , second by Mr. Clark . A vote of "Aye"
by Anderson , Bowles , Clark , Nix , Rothe and Watson . Motion carried .

patible with land use and zoning , it has been approved by the
Health Department . The Soils are suitable for proposed use . It
agrees with Greeley ' s Comprehensive Plan , however , Greeley propose`
to expand to the west approximately 1 mile south of this site and
air pollution could be the result for future residences to the
south of the Poudre River. if approved it should be subject to
locating the pens with respect to tic total parcel , a sealed ia000e
as indicated by the soils report , a maximum of 10 , 000 cattle ,
construction to begin within one year of approval by the Board of
County Commissioners and correcting the Waste Inventory acreage .
Mr . Lorenson stated their plan does not relate to the total parcel .
Mr . McKay stated another firm is drawing new designs for the pen
area which will be submitted in a few days .

that were not shown on the original plat of Sonny View Estates .
Mr. Lorenson stated these plats are recommended for approval .

The recommendations of the planning staff are for approval subject
to the proposed lagoon , a 50 ' green belt on Highway 52 and Co . Rd .

DISCUSSION : Mr. Lorenson announced the annual meeting to be held
Sept. 13 - 15. The institute will be different from past confer-
ences on planning . Its objective is to produce a mandate for
planning in the state written by planning officials . Planning goals
and recommendations will be transmitted to state and federal agencies
for action .
SUBJECT : Letter from Ag Council
DISCUSSION : A letter from Norman Carlson , President of the Agriculture
Council regarding possible air pollution created by the approved
location of Monfort' s to the dairies in the area . No action taken .
SUBJECT : Building inspections for Keenesburg
DISCUSSION : Mr. Lorenson read a recommendation from Jim Ohi regarding
a contract and implementation of providing building inspections for
the Town of Keenesburg , also other incorporated towns . Mr. Lorenson
recommended that the legal council draw up a model contract under
the guide lines set forth by Mr . Ohi for providing building inspect-
ions .
RESOLUTION :
Be it therefore resolved to recommend to the Board of County
Commissioners to adopt the proposed contract. Motion by Mr . Anderso►

Mr. Bowles called the meeting to order.
SUBJECT : Revised Regional Work Program (A-95 review) TAPE 438
DISCUSSION : Ben Cruce reported the Regional Planning Commission
has been allowed an extra $20 ,000 through HUD. This will be
on the Regional Planning Commission agenda through an A-95
review. The additional money will be used for a study on
sewer planning and comprehensive planning , plus adding to
several projects already planned . It will help the planning
staffs in upgrading the comprehensive plans for the small towns .
Mr. Cruce stated he and Mr . Lorenson and Mr. Whitney have met
with the State Planning Office and revised the work program.
They added to open space , to drainage , sewer treatment planning .
An item in the budget will be for the County to aid the small
towns by providing building inspections . In kind services
will be through the county offices , such as salaries ,equipment ,
etc . Each town after July 1 , 1972 to make an application for
HUD money must have must have a Comprehensive Plan and pro-
bably will have to have a work program.
MOTION : By Mr. Clark to approve the additional funding and the work
program attached to it. Second by Mr. Anderson . A unanimous
vote of "Aye" Motion carried .
SUBJECT : Highway TOPICS Program tape439
APPEARANCE : Al Chotvacs and Mike Majia
DISCUSSION : Mr. Chotvacs explained the Highway "TOPICS" program,
the Traffic Operations Program to Increase Capacity and Safety.
The program consists of making traffic operation improvements
and miscellaneous kinds of work that are considered minor items
on regular urban highway construction projects . Mr . Chotvacs
explained the types of projects the county can apply for. A
map was presented showing the urban boundaries which can be ex-
panded . The only expense to the County would be the plan draw-
ing and the engineering . The State does the paper work , submits
the plan , lets the bid , controls the construction and turns the
road back to the County for maintenance. This program only
applies to small projects and cannot extend for a long distance .
Mr. Majia explained the County could take the the projects
that fall in the list of items that can be covered and make
it a TOPICS project and put priorities on them and the Highway
Commission will act upon them. Various problem areas were dis-
cussed . Mr . Lorenson appointed Mr . Watson to serve on a com-
mittee with the County Engineer and the Highway Department to
determine the problem areas to submit as a TOPICS project .

Mr. Edward Meyer has requested this office to furnish you the soils
information and interpretation for the E'SE' Sec. 2, T5N, R64W, Weld
County Colorado. Mr. Meyer plans to enlarge an existing feedlot.
The area is located on the old floodplain of Crow Creek and the soils
are moderately coarse to coarse textured and are shallow (12 to 20
inches) to sand and gravel. Crow Creek has been relocated in this area
and now runs along the foot of the sandhills to the east, minimizing
the threat of flooding. The area is quite level and has little runoff.
If a lagoon or holding pond were needed it would necessitate a blanket
of impervious material. /if
