The proposal has been reviewed for the Weld County Department of Public Works requirements. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues may
arise during the remaining application process.
COMMENTS:
Parcel: 147127000022
The project proposes to: Change of Zone from the A (Agricultural) Zone District to the 1-2 (Medium
Industrial) Zone District.
ACCESS:
Weld County Public Works has reviewed the application materials related to access.
The parcel has existing access onto County Road 4. This portion of CR 4 is under the jurisdiction of the
Town of Brighton. The applicant shall contact the Town concerning access.
ROADS AND RIGHT-OF-WAY:
This portion of County Road 4 is under the jurisdiction of the Town of Brighton. The municipality has
jurisdiction over access to the road. The applicant shall delineate on the plat the future and existing right-
of-way and the physical location of the road. Pursuant to the definition of setback in the Weld County Code
Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that physical
roadways may not be centered in the right-of-way. Please contact the municipality to verify the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit.
CONDITIONS OF APPROVAL:
The plat shall be amended to delineate the following:
This portion of County Road 4 is under the jurisdiction of the Town of Brighton. Please contact the
municipality to verify the right-of-way. Show and label the right-of-way. Show the approved access(es) on
the site plan and label with the approved access permit number if applicable. (Development Review)
DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. The property owner or operator shall be responsible for controlling noxious weeds on the
site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development
Review)
2. Access on the site shall be maintained to mitigate any impacts to the public road including
damages and/or offsite tracking. (Development Review)
3. The historical flow patterns and runoff amounts will be maintained on the site.

Environmental Health Services has reviewed this proposal for a Change of Zone from the A
(Agricultural) Zone District to the 1-2 (Medium Industrial) Zone District.
There are two residences located on the parcel. The residence constructed in 2011 is served
by a domestic well (288990) and an on -site wastewater treatment system permitted for 3
bedrooms (SP -1200212). The well permitted as 288990 cancelled permit 57284 per item 9 of
permit 288990. The residence constructed in 1973 is served by a domestic well (10498) and an
on -site wastewater treatment system permitted for 3 bedrooms (G-19721103).
We recommend the following appear as notes on the plat:
1. Water service may be obtained from an appropriately permitted well.
2. The parcel is currently not served by a municipal sanitary sewer system. Sewage
disposal may be by an on -site wastewater treatment system designed in accordance
with the regulations of the Colorado Department of Public Health and Environment,
Water Quality Control Division and the Weld County Code in effect at the time of
construction, repair, replacement, or modification of the system.
3. Activity or use on the surface of the ground over any part of the OWTS must be
restricted to that which shall allow the system to function as designed and which shall
not contribute to compaction of the soil or to structural loading detrimental to the
structural integrity or capability of the component to function as designed.

The Staff of the Weld County Oil and Gas Energy Department (OGED) appreciates the opportunity to
comment on the captioned planning case. Staff has completed review of the proposal and have no
conflicts with the proposed activity. We have included additional comments below:
1. There are no active or proposed 1041 WOGLA Permits on the associated parcel. There are
several oil and gas well sites in the area surrounding the parcel, none directly on the
associated parcel.
2. The Change of Zone lands may include additional oil and gas related infrastructure, such as
off -location flowlines or pipeline which are a use by right and not regulated by Weld County.
OGED requests that the applicant reviews flowline data available from the COGCC map viewer
and utilize Colorado 811 prior to any excavation activities.
This determination is based upon the review of the application materials submitted by the applicant and
other relevant information available on the E -Permit site.

The City of Brighton will not support annexation for this property for this use. Additionally, the City of Brighton will
oppose this use at this site when given a review by Weld County as the proposed use is not in alignment with the City's
Comprehensive Plan Designation for this Property.

We met on Aug 2nd and discussed the annexation process and concluded that the City of Brighton would not pursue
annexation of this property and that I should go through the county. I have applied through the county and the county
is asking that you email them directly that your (COB's) intent is not to annex the above described property. I am also
attaching a copy of the NOI that was presented and signed at the meeting.

Dear Diana Aungst:
We have received your November 8, 2021 proposal to change the zoning of the property at 15509 Weld
County Road from Agricultural to Medium Industrial. The intent is to expand a current storage facility
onto the property.
This referral does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a), C.R.S.
Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county
planning directors, this office will only perform a cursory review of the referral information and provide
informal comments. The comments do not address the adequacy of the water supply plan for this project
or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the
comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
Estimated water demand and proposed uses were not provided. According to the submitted material,
the property is served by two existing wells permitted under well permit nos. 10498 and 288990.
Well permit no. 10498 was issued January 2, 1962 for domestic use. Well permit no. 288990 was issued
August 1, 2012 for ordinary household purposes inside two single-family dwellings, the watering of the
user's own non-commercial domestic animals and the irrigation of not more than 1 acre of home gardens
and Lawns. As currently permitted, the wells cannot be used to serve a commercial business. If the
Applicant intends to use the wells to provide water to the commercial business, well permits allowing
such use must first be obtained.
The permitted location of well 288990 does not place the well on the subject property. The Applicant
should file an Application for Well Location Amendment (form GWS-42) with our office to correct the
well Location. The form is available on our website at eForms.
