HomeMy WebLinkAbout20221157.tiff5/23 RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, APRIL 25, 2022 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, April 25, 2022, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck - EXCUSED Commissioner Steve Moreno Commissioner Lori Saine - EXCUSED Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli • MINUTES: Commissioner Freeman moved to approve the Minutes of the Board of County Commissioners meeting of April 11, 2022, as printed. Commissioner Moreno seconded the motion and it carried unanimously. • PUBLIC INPUT: No public input was given. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda, as printed. Commissioner Freeman seconded the motion and it carried unanimously. El COMMISSIONER COORDINATOR REPORTS: Commissioner Moreno stated that he, Chair James, and Commissioner Buck attended the swearing in ceremony on April 19, 2022, for Mark Clark, as the newly appointed Mayor for the City of Evans, to replace Brian Rudy. El PROCLAMATIONS: 1) PLATTE VALLEY BRONCOS DAY, CLASS 3A GIRLS BASKETBALL STATE CHAMPIONSHIP - APRIL 25, 2022: Chair James read the proclamation for the record, and invited the team to introduce themselves for the record. Tanya Schissler, Coach, expressed her appreciation for the Board's recognition again this year, and further reviewed some highlights from their undefeated season. In turn, each Commissioner congratulated the team for being leaders in their school and community, further commended their hard work, and thanked their families for their support in raising champions. Minutes, Monday, April 25, 2022 2022-1157 Page 1 BC0016 • 2) NATIONAL CRIME VICTIMS' RIGHTS WEEK - APRIL 24-30, 2022: Chair James read the proclamation for the record. Michael Rourke, 19th Judicial District Attorney, expressed his gratitude for the recognition and the incredible service providers that are there for the victim's worst times. Mr. Rourke stated he recently attended the Ending Violence Against Women National Conference, further noting that Weld County is fortunate to have access to amazing partner organizations serving victims throughout Weld County. Mr. Rourke gave thanks to: A Woman's Place, Area Agency on Aging (AAA), ASAP (Assault Survivors Assistance Program) at UNC, The Avery Center, Brighton Police Department Victim Services, Boulder County Sheriff's Office Victims Assistance, Catholic Charities, Colorado Legal Services, Colorado State Patrol Victims' Assistance, Free our Girls, Greeley Police Department Victim Assistance Unit, Lifestories Child and Family Advocacy Center, Lutheran Family Services, North Range Behavioral Health, Partners Mentoring Youth, Probation Victims' Assistance, SANE (Sexual Assault Nurse Examiners) Programs at Banner Health and UC Health, SAVA (Sexual Assault Victim Advocate) Center, Weld County Courts and the District Court Administrators, Marci Hoffman and Amanda Manbeck, Weld County Sheriff's Office Victims Assistance, and Wings to Change. Mr. Rourke invited the Board to attend the Victims' Rights event on Thursday, April 28, 2022, at the Greeley Police Department from 8:30 a.m., until 12:00 p.m. Robb Miller, Assistant 19th Judicial District Attorney, expressed his gratitude for the partnerships that serve as a front line to help the victims of Weld County with unfortunate matters. The Commissioners, in turn, expressed their pride in the longsuffering services which are provided by Weld County agencies that advocate on behalf of victims who are struggling to find their voice and affording them a safe place to share and move forward in a healthy way. (Clerk's Note: The group gathered for a photo opportunity). • WARRANTS: 1) GENERAL WARRANTS - APRIL 22, 2022: Commissioner Freeman moved to approve the General Warrants, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. • BIDS: 1) PRESENT BID #B2200082, DEPARTMENT OF HUMAN SERVICES BUILDING B ROOF REPLACEMENT - FACILITIES DEPARTMENT: Christie Peters, Purchasing Department, stated six (6) bids were received and staff with make a recommendation on May 9, 2022. m_=. NEW BUSINESS: 1) CONSIDER APPLICATION FOR JUVENILE DIVERSION AND MARIJUANA TAX CASH FUND PROGRAM FOR RESTORATIVE JUSTICE SERVICES AND AUTHORIZE ELECTRONIC SUBMITTAL: Michael Rourke, 19th Judicial District Attorney, and Kirsta Britton, Director of Diversion with the 19th Judicial District Attorney's Office, presented the application for $153,000.00, in non-competitive grant funding for the third of the three years available, and explained the Juvenile Diversion Program and its success rate for the past 17 years of running this program. Commissioner Moreno moved to approve said application and authorize electronic submittal. The motion was seconded by Commissioner Freeman, and it carried unanimously. • 2) CONSIDER APPOINTMENT OF DEPUTY DISTRICT ATTORNEY AND AUTHORIZE CHAIR TO SIGN — MIKAELA FATZINGER: Mr. Rourke stated Ms. Fatzinger came from the County Courts as a Law Clerk for five (5) of the Criminal Judges in District Court. Commissioner Freeman moved to approve said appointment and authorize the Chair to sign. The motion was seconded by Commissioner Moreno, and it carried unanimously. Minutes, Monday, April 25, 2022 Page 2 2022-1157 BC0016 El 3) CONSIDER CONTRACT ID #5722 AGREEMENT FOR CONSTRUCTION SERVICES FOR EVIDENCE STORAGE PACKAGING TABLE PROJECT (INFORMAL BID #62200074) AND AUTHORIZE CHAIR TO SIGN - KILGORE CONSTRUCTION: Toby Taylor, Director of the Facilities Department, stated this was initially published as a formal bid, but this agreement is the result of an informal bid due to the low cost, with Kilgore Construction, for the total amount of $4,260.00, for an evidence packaging table. Commissioner Moreno moved to approve said agreement and authorize Chair to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. 4) CONSIDER CANCELLATION OF CERTAIN OUTSTANDING ACCOUNTS RECEIVABLE FOR THE WELD COUNTY TREASURER - PERSONAL PROPERTY, MANUFACTURED HOMES, AND STATE ASSESSED ACCOUNTS: John Lefebvre, Weld County Treasurer and Public Trustee, provided a brief overview of the items deemed as uncollectable, and further stated typically the property has been removed and is statutorily written off in August of each year. Commissioner Freeman moved to approve said cancellation of certain outstanding accounts receivable. The motion was seconded by Commissioner Moreno, and it carried unanimously. ▪ 5) CONSIDER PROFESSIONAL SERVICES AGREEMENT FOR RANCH RODEO AND BRONC RIDING AT 2022 WELD COUNTY FAIR AND AUTHORIZE CHAIR TO SIGN - SELLE RODEO PRODUCTIONS, LLC: Jenette Masarie, CSU Extension of Weld County, stated this agreement is for Ranch Rodeo and Bronc Riding during the 2022 Weld County Fair, on Sunday, July 31, 2022, the Community Family Day. Commissioner Moreno moved to approve said agreement and authorize Chair to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. • 6) CONSIDER RENEWAL APPLICATION FOR A VINTNER'S RESTAURANT (COUNTY) LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN — RIVER GARDEN WINERY, LLC, DBA RIVER GARDEN WINERY: Bruce Barker, County Attorney, reviewed the application and stated it is in order, with no concerns from any of the referral agencies. Commissioner Freeman moved to approve said renewal application and authorize the Chair to sign. The motion was seconded by Commissioner Moreno, and it carried unanimously. IR 7) CONSIDER RENEWAL APPLICATION FOR A BREW PUB (COUNTY) LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN - TAPPIST MUNKS, LLC, DBA OUTWORLD BREWING: Mr. Barker reviewed the application and stated it in order, with no concerns from any of the referral agencies. Commissioner Moreno moved to approve said renewal application and authorize the Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously. • 8) CONSIDER APPOINTMENT TO NOXIOUS WEED MANAGEMENT ADVISORY BOARD: Commissioner Freeman moved to approve said appointment. The motion was seconded by Commissioner Moreno, and it carried unanimously. • PLANNING: 1) CONSIDER VACATION OF USE BY SPECIAL REVIEW PERMIT, USR15-0077 - CANNON LAND COMPANY, C/O CERTARUS, LTD.: Michael Hall, Department of Planning Services, stated the Board approved Use by Special Review Permit, USR15-0077, on March 9, 2016, for a Commercial use in the A (Agricultural) Zone District for a Compressed Natural Gas fill station. Mr. Hall explained staff has received a request from the current property owner's authorized representative to vacate USR15-0077, to satisfy Condition of Approval #1.A of a newer land use application, USR21-0005. Commissioner Freeman moved to approve said vacation of USR15-0077. The motion was seconded by Commissioner Moreno, and it carried unanimously.
