NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colorado, that the Chairman of the Board be and he is hereby authorized to sign said agreement with the Extension Service of Colorado State University, according to the terms and conditions set forth in said agreement, a copy of witch is hereto attached and made a part of this resolution. The above and foregoing resolution was, on motion duly made and seconded, adopted by the following vote: AYES: 1,�• t.,��/ ', - /s c71— 1.44 4- )7,2 (4 47, �__{ , (.. � // tt . } THE BOARD OFCCOUNTY COMMISSIONERS WELD COUNTY, COLORADO DATED: March 17, 1971 MB 37: /7•4I LHk 82 710372 MEMORANDUM OF UNDERSTANDING FOR COOPERATIVE EXTENSION WORK This memorandum of understanding entered this First day of January , 19 71 by and between Colorado State University, hereinafter referred to as "University" and the County of WELD , State of Colorado, hereinafter referred to as "County" , for cooperative extension work. WITNESSETH THAT: WHEREAS, County desires to participate in the educational work as authorized by the Smith-Lever Act , as amended, and other acts supporting cooperative extension work which in- cludes the conduct of extension work in agriculture and re- lated fields , home and family living, 4-H and youth and com- munity services and resource development education in the county; and, WHEREAS , University is authorized by the United States Department of Agriculture to conduct cooperative extension work in the State of Colorado pursuant to a Memorandum of Understanding and separate project agreements; and WHEREAS, the University and County desire to enter into this Memorandum of Understanding as a master document to set out the nature of the program and the relationships of the parties; NOW THEREFORE, the parties do hereby agree to expend their best efforts to conduct and support a cooperative Ex- tension program under the following terms and conditions: Section 1 . County agrees : (a) To furnish suitable office space, and pay the essential costs of utilities , travel, office expense, supplies and equipment needed in the conduct of cooper- ative extension work in the county . (b) To contribute on a formula basis that part of the professional staff salaries as may be mutually agreed upon by annual supplements to this Memorandum of Under- standing. (c) To provide necessary clerical and secretarial personnel. (d) Submit to the Director of the Colorado Coopera- tive Extension Service an approved budget for items (a) , (b) and (c) above prior to the beginning of each calendar year. Section 2 . University agrees : (a) To maintain an office of Cooperative Extension for the management and conduct of all cooperative exten- sion work. (b) To maintain a professional staff available for assistance to the program conducted in the county. (c) To recruit and supervise professional staff to be assigned to the county in accordance with annual sup- plemental agreements . Section 3 . County and University mutually agree: (a) That supplements to this Memorandum of Under- standing will be executed for each calendar year provid- ing for professional staff for such year and the budget for the support of the program. Each supplement shall be considered a part of this contract for the year for which it is applicable. (b) To notify the other party in writing at least sixty (60) days prior to any expected major change in program which would affect the professional personnel or support of the program, provided however, that should such cause be emergent in nature the party requiring such change shall noitfy the other as soon as practicable. (c) That the University operates on a fiscal year of July 1 - June 30 and the counties of the State of Colorado operate on a calendar year of January 1 - Dec- ember 31, and that the level of financial support which the University can provide is dependent upon appropriations , allocations , adjustments and any amendments thereto made by the State of Colorado and the United States. That pur- suant thereto the University may be required to adjust or amend its budgetary allocations to the County 's Coopera- tive Extension program during the University 's fiscal year due to the level of financial support the County renders, and the appropriations, allocations, adjustments and amendments thereto made by the State of Colorado or the United States or both. Section 4. The Cooperative Extension Program is subject to the Civil Rights Act of 1964 and the regulations of the -2- Department of Agriculture implementing the same, prohibiting discrimination based on race, color, national origin, sex, or religion. Section 5. This Memorandum of Understanding shall remain in full force and effect from year to year until terminated) by either party, by written notice given ninety days prior to the end of a fiscal year. Watts Subject: Memorandum of Understanding We have reviewed the philosophy and the content of the agreements between the counties and the CSU Extension Service and have come up with an agreement which is quite similar to the one between the University and the Federal Extension Service. There is a three page "master" agreement, which remains in force from year to year unless terminated as described in Section 5, and an annual supplement, which in- dicates the levels of financial support from county and CSU budgets. For the current year, it is necessary that the University and the counties sign both the "master" agreement and the supplement; however in future years, only the supplement will have to be executed. We will appreciate it if you will have the master agree- ments and the supplements executed by the Chairman of the Board of County Commissioners and by the County Clerk. One copy should be returned to us, whereas the other copy is for the county's record.
