BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
WEDNESDAY, MAY 25, 2022
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, May 25, 2022, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Scott K. James, Chair
Commissioner Mike Freeman, Pro-Tem
Commissioner Perry L. Buck
Commissioner Steve Moreno
Commissioner Lori Saine

• MINUTES:
1) Commissioner Freeman moved to approve the Minutes of the Board of County Commissioners
meeting of May 4, 2022, as printed. Commissioner Buck seconded the motion and upon a roll call vote,
the motion passed four (4) to one (1), with Commissioner Saine opposed. (Clerk's Note: Cont'd from
5/23/2022).
• 2) Commissioner Moreno moved to approve the Minutes of the Board of County Commissioners
meeting of May 11, 2022, as printed. Commissioner Buck seconded the motion, and it carried
unanimously.
• PUBLIC INPUT: Steve Teets, Greeley resident, spoke on his concern for growing homelessness
while simultaneously having fewer shelters and resources to assist those who are experincing
homelessness. Steven Hall, Evans resident, expressed his support for the resolution brought forth by
Commissioner Saine, stated his opposition to a statement made by Commissioner Moreno that
government should not get involved, and called for the Board to uphold inalienable rights. Sandra Nelson,
Eaton resident, expressed her support for the Pro -Life Sanctity Resolution brought forth, and referenced
the seal behind the Chair of the Board which says, "In God We Trust," and urged the Board to protect the
sanctity of life.
• AMENDMENTS TO AGENDA: Commissioner Saine moved to add a proclamation titled,
"Expression of Support for the Sanctity of Life of the Unborn Child, and of Motherhood," to the agenda.
(Clerk's Note: Entered as Exhibit A.) Commissioner Buck seconded the motion; however, Commissioner
Freeman objected. Commissioner Saine shared various scripture references and examples of

faith -based theology as the foundation of the Nation's Constitution, with the Founding Fathers'
acknowledgment of a creator. Commissioner Buck commented it is her opinion that all children from shall
have the ability to have life from conception. Commissioner Moreno clarified there is a difference between
a Resolution and Proclamation, and he is more likely to consider this proclamation if brought forth after
June 29, 2022. Chair James commented the problem is not too little government, but of too little faith.
Commissioner Freeman expressed his Pro -Life stances, however, he struggles with the idea of
government telling individuals what to with their bodies, and referenced the COVID-19 vaccination and
mask mandates, with many saying, "My body, my choice." Upon a roll call vote, the motion failed two (2)
to three (3), with Commissioners Moreno, Freeman, and James opposed.
• CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda, as printed.
Commissioner Moreno seconded the motion, and it carried unanimously.
l_= PROCLAMATIONS:
1) MEMORIAL DAY - MAY 30, 2022: Chair James read the Proclamation for the record, and further
stated members of the Board will be present at a ceremony at Linn Grove Cemetery on Saturday, May 29,
2022, while Commissioner Buck will be attending a ceremony in Windsor. In turn, each Commissioner
expressed their gratitude for the sacrifice of service men and women who have given their lives to protect
our freedoms.
WARRANTS:
1) GENERAL WARRANTS - MAY 24, 2022: Commissioner Buck moved to approve the General
Warrants, as printed. Commissioner Freeman seconded the motion, and it carried unanimously.
• BIDS:
1) PRESENT AND APPROVE EMERGENCY BID #B2200090, MISSILE SITE SILO ROOF
REPLACEMENT - FACILITIES DEPARTMENT: Christie Peters, Purchasing Department, stated this
emergency bid is to replace the watertight membrane for the Missile Silo that was blown off in a recent
high wind event. She further stated six (6) bids were received, and staff's recommendation goes to the
lowest bidder that met all specifications, Front Range Roofing Systems, LLC, for the total amount of
$35,000.00. She futher stated staff is requesting emergency approval, pursuant to Section 5-4-110, of
the Weld County Code, to get the Missile Silo back to a watertight enivronment. Commissioner Moreno
moved to approve said bid on an emergency basis. The motion was seconded by Commissioner Saine,
and it carried unanimously.
• NEW BUSINESS:
1) CONSIDER CONTRACT ID #5826 MEMORANDUM OF UNDERSTANDING FOR ACCESS TO
COMMUNITY SERVICES BLOCK GRANT (CSBG) CARES ACT FUNDING FOR COVERING WELD
DIAPER BANK AND AUTHORIZE CHAIR TO SIGN — UNITED WAY OF WELD COUNTY: Tami Grant,
Deputy Director of the Department of Human Services, stated this Memorandum of Understanding (MOU)
will allow for increased access to essential early childhood hygiene and safety supplies for families across
the County, in collaboration with United Way of Weld County who was awarded this grant. Ms. Grant
further stated this funding will also allow for streamlined processes, improved utilization of staff's time,
and support for the foster and kinship homes. Commissioner Buck moved to approve said memorandum
of understanding and authorize the Chair to sign. The motion was seconded by Commissioner Saine,
and it carried unanimously.

_El 2) CONSIDER CONTRACT ID #5862 2022-2023 LOCAL MULTIMODAL TRANSPORTATION AND
MITIGATION OPTIONS FUND (MMOF) PROJECT APPLICATION FOR ON -DEMAND TRANSIT
SERVICES AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY - UPPER FRONT
RANGE TRANSPORTATION PLANNING REGION (UFRTPR): Evan Pinkham, Department of Public
Works, reviewed the goals of the MMOF established by House Bill (HB)18-001, and later amended by
HB21-0260, with the State seeking to benefit residents of rural communities with enhanced mobility for
seniors and those with disabilities. He stated this grant application for the amount of $685,800.00, with
20% County match funds, will provide funding for on -demand transit services through a partnership with
Via Mobility. He further stated this is of no cost to the riders, and meets the goals of MMOF funding.
Mr. Pinkham stated staff has received letters of support from most of the listed participating communities
who will benefit from this service. He futher stated Weld County is requesting a reduction of the County's
local match from 50%, to 25%, and he believes the Colorado Department of Transportation (CDOT) will
recommend approval. Chair James stated he had done some research of the statutes that allow this
initiative of grant funding to be possible, and commended the efforts of staff to create this option with Via
Mobility. Commissioner Saine stated it is the role of the government to assist smaller communities,
although she would like to explore more cost-effective options for the future. Commissioner Buck moved
to approve said grant application, authorize the Chair to sign, and authorize Evan Pinkham, Department
of Public Works, to submit electronically. Seconded by Commissioner Moreno, the motion carried
unanimously.
3) CONSIDER CONTRACT ID #5866 2022-2023 MULTIMODAL TRANSPORTATION AND
MITIGATION OPTIONS FUND (MMOF) CALL FOR PROJECTS APPLICATION FOR ON -DEMAND
TRANSIT SERVICES AND AUTHORIZE CHAIR TO SIGN AND ELECTRONIC SUBMITTAL - NORTH
FRONT RANGE METROPOLITAN PLANNING ORGANIZATION (NFRMPO): Mr. Pinkham stated this is
similar to the agenda item above, with different transportation boundary lines, with the funds being used
for on -demand transit services for senior and disabled adults who reside in Weld County for the total
amount of $342,900.00, with a 25% County match, and one (1) bus. He further stated CDOT assured a
likely reduction of the County's local match, making this more fiscally attainable and responsible. In
response to Chair James and Commissioner Moreno, Mr. Pinkham clarified the submittal process, and
explained the local match percentage baseline is 50%, which was based on certain factors and was
reduced for all but Weld County, but they are requesting the match be lowered to 25%. Commissioner
Buck thanked Chair James for his leadership concerning transportation matters. Commissioner Moreno
moved to approve said grant application, authorize the Chair to sign, and authorize Evan Pinkham to
electronically submit. The motion, which was seconded by Commissioner Buck, carried unanimously.
El 4) CONSIDER SPECIAL EVENTS PERMIT AND AUTHORIZE CHAIR TO SIGN - FRANK'S RIDE
FOR CHILDREN, FBO, MAKE -A -WISH FOUNDATION OF COLORADO, INC.: Bruce Barker, County
Attorney, stated this is an annual event with the Make -a -Wish Foundation of Colorado that will take place
at Anderson Farms, on June 11, 2022. He further stated all paperwork is complete, with no concerns
from referral agencies. Greg Risedorf, event manager, stated this is the 35th year, and this is his
retirement year. He gave the history of how this fundraising event came about, and reported to date over,
$800,000.00 in charitable donations have been raised to grant 136 wishes of terminally ill children.
Mr. Risedorf stated they anticipate this one -day event to raise between $20,000.00 and $30,000.00.
Commissioner Moreno expressed his gratitude for all that has been done through their 35 years of
service. Mike 'Cisco' Dornbusch, introduced himself as the new event manager for this organization, and
confirmed a new name will be filed with the State. Mr. Risedorf stated this event has nearly 1,000
motorcycles and side cars, alongside custom cars for miles, it is open to anyone in the public, and if
attending the event is not possible, a tax deductible donation can be made to Make -a -Wish Foundation.
Commissioner Saine offered her sentiments, and gave a token of her appreciation. No public testimony
was offered concerning this matter. Commissioner Saine moved to approve said special events permit,

and authorize the Chair to sign. The motion was seconded by Commissioner Buck, and it carried
unanimously.
PLANNING:
1) CONSIDER PARTIAL VACATION OF TWO -LOT RECORDED EXEMPTION, RE -3555, FOR
REMOVAL OF LOT B - PRESTON RANCH MINISTRIES, C/O JAY LINDSTROM: Angela Snyder,
Department of Planning Services, stated staff received a letter from the applicants dated April 19, 2022,
requesting the removal of Lot B from Recorded Exemption, RE -3555, which will result in an unplatted
parcel larger than 35 acres. She further stated there were no easements or other interests with this
Recorded Exemption, and staff recommends approval. The applicant was not present, and no public
testimony was offered concerning this matter. Commissioner Freeman moved to approve said partial
vacation, with the Condition of Approval. The motion was seconded by Commissioner Buck, and it carried
unanimously.
2) SECOND READING OF CODE ORDINANCE #2022-03, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION OF THE WELD COUNTY
CODE (OIL AND GAS, RESOLUTIONS, AND PROCLAMATIONS): Commissioner Freeman moved to
read Code Ordinance #2022-03 by title only. The motion was seconded by Commissioner Buck, and it
carried unanimously. Mr. Barker read the title for the record, and stated there have been no changes
since the First Reading. In response to Steve Teets, Mr. Baker gave a brief overview of the proposed
changes of this Ordinance. Commissioner Moreno moved to approve Code Ordinance #2022-03 on
Second Reading. The motion was seconded by Commissioner Buck, and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2022-03 was approved on Second Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:52 a.m.

PROCLAMATION
RE: EXPRESSION OF SUPPORT FOR THE SANCTITY OF LIFE OF THE UNBORN CHILD
AND OF MOTHERHOOD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has previously expressed and continues to express its support for
the sanctity of life and opposition to abortion, specifically noting the rights set forth in the Colorado
Constitution Bill of Rights, Article II, Section 3:
§ 3. Inalienable rights
All persons have certain natural, essential, and inalienable rights, among which may be
reckoned the right of enjoying and defending their lives and liberties; of acquiring, possessing
and protecting property; and of seeking and obtaining their safety and happiness.
(Emphasis added.)
WHEREAS, although the Colorado Constitution Bill of Rights contains no definition for
the word "persons" as that term is used in Article II, Section 3, the Board believes a "person" who
is entitled to the right "of enjoying and defending their lives and liberties," as guaranteed by Article
II, Section 3, includes a human being, specifically including an unborn child in utero at
any stage of development, regardless of viability, and
WHEREAS, the Board believes it is the responsibility of every mother to protect and
secure the right of the unborn child to enjoy and defend its life and liberties, as secured by the
Colorado Constitution, Article II, Section 3, by taking measures and actions to ensure the mother's
and baby's lives and health during pregnancy, and
WHEREAS, to that end, the Board provides the below listing of various resources
available in Weld County that encourage and support a mother to achieve her responsibility of
securing the right of her unborn child to enjoy and defend its life and liberties, as secured by the
Colorado Constitution, Article II, Section 3.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board hereby expresses its support for the sanctity of life protected by
the Colorado Constitution Article II, Section 3, for every unborn child in Weld County.
BE IT FURTHER RESOLVED by the Board that the following is a listing of various
resources available in or near VVeld County to encourage and support a mother to achieve her
responsibility of securing the right of her unborn child to enjoy and defend its life and liberties, as
secured by the Colorado Constitution, Article II, Section 3:
prenatal services, counseling services, faith -based family services such as The Resource Center
and Lutheran Family Services as well as adoption options and services for mothers with newborns
such as housing and food assistance, child support services, and The Nurse Family Partnership,
The Genesis Project of Northern Colorado, and the Guadalupe Community Center. This list may
be updated and amended from time to time.
