Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcel: Parcels associated with Lakota Lakes south of CR 54 and east of CR 15. The project proposes to: Amended PUD Final Plat of Corrected Lakota Lakes (PF-594) to allow one (1) second single-family home per lot in the PUD. ACCESS: Weld County Public Works has reviewed the application materials related to access. All lots, except one, associated with Lakota Lakes (PF-594) have existing accesses onto Lakota Lakes Road, the internal road of the planned unit development. Parcel 095729202001 has existing permitted access onto County Road 54 (AP14-00094). Lakota Lakes Road intersects with CR 54 approximately 760 feet east of the intersection of CR 54 with CR 15. No other accesses are requested. ROADS AND RIGHT-OF-WAY: County Road 54 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as an arterial road, which require 140 feet of right-of-way. The applicant shall delineate on the plan the future and existing right-of-way and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated or reserved per Weld County Code. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is measured from the future right-of- way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. The planned unit development has an internal road, Lakota Lakes Road, that is a paved road with dedicated platted right-of-way. Lakota Lakes Road is privately maintained. Per Chapter 8, Article 13, Section 8-13-30, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and or encroaching upon, any County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at https://www.weldgov.com/departments/public works/permits!. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC Latest Average Daily Traffic (2020) on this portion of CR 54 (aka Freedom Parkway) counted 5,101 vehicles per day with 17% trucks. The 85th percentile speed is 53 mph. The traffic information submitted with the application materials indicates that there will be approximately 12 daily roundtrips per day. However, daily roundtrips per day per residence is typically considered to be 9. Thus, at full build -out, there could be 14 homes and 126 daily roundtrips of passenger vehicles. 50 % of the traffic will be going to the east and 50 % of the traffic will be going to the west. Additional traffic information may be required during the review of the existing Improvements Agreement. IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT There is an existing Improvements and Road Maintenance Agreement (Reception Number 20052038) for the original planned unit development (i.e. PF-594). This Agreement shall be reviewed and revised as appropriate based on the increase in traffic, associated with second single-family homes, onto CR 54. DRAINAGE REQUIREMENTS Detention pond waived and a simple drainage narrative: The applicant has submitted a drainage narrative stating that the site meets drainage exception 11. An individual parcel with an unobstructed flow path and no other parcel(s) between the Federal Emergency Management Administration (FEMA) regulatory floodplain channel and the project. Located in Sec. 8-11- 40. Drainage Policy. No additional drainage information is needed. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. CONDITIONS OF APPROVAL: A. Review and revise the existing Improvements Agreement (Rec. No. 20052038) as appropriate per the traffic increase associated with a second single-family homes on each lot. (Department of Public Works) B. The plan shall be amended to delineate the following: 1. County Road 54 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works) 2. The application indicates Little Thompson Water District will provide water to the second residences. On -site wastewater treatment systems (OWTS) will provide sewer for the second residences. OWTS permits for Lots 1 through 7 indicate engineer designs may be required due to soil types. The groundwater level may require some systems to be installed at a shallow level. Based on the information contained in these permits the lots should accommodate proposed second residences served by OWTS. The following section of the Weld County Code requires a new OWTS permit and separate OWTS for the second residence unless the original OWTS was sized for multiple connections. Sec. 30-4-140. - General prohibitions. A person must not connect more than one (1) dwelling, commercial, business, institutional or industrial unit to the same OWTS unless such multiple connection was specified in the application submitted and, in the permit, issued for the system. The parcel is currently not served by a municipal sanitary sewer system. Diana, The District currently serves the propertics located in Lakota Lakes Ranch. We understand from the referral documents, the applicant is proposing an Amended PUD Final Plat to allow one second single family home per each lot for the properties located in the Lakota Lakes Ranch subdivision. The District allows service to accessory dwellings from a single, standard residential tap and the District's guideline is a size limit of 1,000 square feet for such accessory structures. The District's intent is to serve utility based accessory structures or a "mother in law" apartment which is ostensibly intended for occupancy by a family member. Should the habitable accessory dwelling or the primary residence become a long-term rental property to the same tenant, or either structure becomes located on a separate parcel through the property subdividing process, a separate tap will be required. The District evaluates the request for water service to proposed accessory dwellings through the commitment letter process on a cast -by -cast basis. A commitment request is required to be submitted to the District for each proposed accessory dwelling. We will then evaluate the proposed accessory dwelling and the projected water use. A commitment letter with all requirements and provisions for water service will then be issued. The District will not grant approval for accessory dwellings for the Lakota Lakes subdivision as a whole. We will evaluate each property separately. The District allows service to accessory dwellings from a single tap and the District's guideline is a size limit of 1,000 square feet for such accessory structures. The District's intent is to serve utility based accessory structures or a "mother in law" apartment which is ostensibly intended for occupancy by a family member. The District understands that the existing accessory dwelling living space is approximately 1,200 square feet in size. This is larger than the District's size limit of 1,000 square feet. Consequently, water service to the existing accessory dwelling will require Board approval, as this is not in compliance with the District's Rules and Regulations. Pending Board approval, the District will commit to continuing service to the above property for tap #6649 from the existing 5/8 -inch standard residential tap under the existing conditions, subject to the limitations in this letter and the following additional limitations on the provision of water service: 1) Should the habitable accessory dwelling or the primary residence become a long-term rental property to the same tenant, or either structure becomes located on a separate parcel through the property subdividing process, a separate tap will be required. 2) All improvements to District facilities required to provide service will be the financial responsibility of the developer in accordance with the District Rules and Regulations. All improvements must conform to District Specifications. This commitment letter will expire two years from the date of this letter if an additional tap is deemed necessary and has not been purchased, paid for and installed by that date of expiration. Please note that tap fees can change at any time within this two-year period. The building permit was pulled in the end of 2015 and completed in 2016. Permitted was a kitchen, living area, 2 storage rooms and ifull bath and 1 3/4 bath. The building also has its own septic system 1 and has been being used since completion. It is all on the property portal.
