Answer the following questions per Section 23-2-50 of the Weld County Code. Please type on a

1. Describe the purpose of the proposed Change of Zone.
Response:
The primary purpose of the change of zone is for a commercial development on approximately 10-
13 acres (site is 19.98 acres) on the western portion of the property with the remainder available for
future construction
2. Describe the current and previous use of the land.
Response:
The land is currently vacant farmland, and historically has been agricultural.
3. Describe the proximity of the proposed use to residences.
Response:
City of Brighton residential area is approximately _ miles to the East
Todd Creek Metropolitan District is south of the site with the edge of the existing residential area
away
4. Explain how the proposed rezoning will correct what the applicant perceives as faulty
zoning, or how the proposed rezoning will fit with what the applicant perceives as the changing
conditions in the area.
Response:
The proposed rezone (from AG to C-3) matches the existing land uses surrounding the property;
including outdoor RV storage and self storage. Currently, the RV storage facility is undergoing an
expansion and is in the process of rezoning to C-3 as well. The site is also within the Weld County
Opportunity zone, on the southern edge of the county, and a corner lot making it an excellent
location for commercial businesses.

5. Explain how the uses allowed by the proposed rezoning will be compatible with the
surrounding land uses. Include a description of existing land uses for all properties adjacent to the
subject property.
Response:
Parcel: 146934300005 across County Road 19 to the East is approximately 35 acres and is an
outdoor storage lot for RVs.
Parcel: 146934300009 to the East is a self storage facility (Fortress Self Storage)
The Parcel directly south in Adams County has a large oil and gas operation
Parcel: 146933400033 is adjacent to the North -Northeast portion of the property. It appears to be
currently used as a personal storage yard and building
Parcel: 146933400044 is adjacent to the northern edge of the site and is currently a residence with
a large horse facility/equipment building on the site.
Parcel :146933400042 is directly west and is primarily vacant agricultural land that is located in
Weld County's opportunity zone.
Current and proposed use of the property is consistent with the surrounding area and the Weld
County Comprehensive Plan.
6. Does the soil report indicate the existence of moderate or severe soil limitations? If so, detail
the methods to be employed to mitigate the limitations for the uses proposed.
Response:
According to the USDA- NRCS Soils Report there are no soil conditions that limit the proposed use
(attached Soils Report). A Subsurface Investigation is enclosed.
7. Explain how this proposal is consistent with the Weld County Comprehensive Plan per
Chapter 22 of the Weld County Code.
Response:
The property is located within the Weld County Opportunity zone and the proposed use is
commercial. See figure 1 below

8. Explain how this proposal will be compatible with future development of the surrounding
area or adopted master plans of affected municipalities.
Response:
The RV storage site to the east (312 COUNTY ROAD 19 WELD) is currently pursuing an
expansion of the site and a rezone from AG to C-3. Per conversations with Todd Creek
Metropolitan District, Todd Creek also envisions future commercial uses in the surrounding area
9. Explain how this proposal impacts the protection of the health, safety and welfare of the
inhabitants of the neighborhood and the County.
Response:
Minimal dust is produced by trucks entering/leaving the property, when necessary, the owner will
water the access road.
Regular noise produced by trucks and cars entering and leaving the property
10. Explain how this proposal complies with Article V and Article XI of Chapter 23 if the proposal
is located within any Overlay Zoning District (Airport, Geologic Hazard, or Historic Townsites
Overlay Districts) or a Special Flood Hazard Area identified by maps officially adopted by the
County.
Response:
The property is not located within any existing CPAs or IGA and is within the Weld County
Opportunity zone. It is not located in the FEMA Flood Hazard Area.

RE: Conditional Will Serve Letter for Parcel Number 146933400039 Weld County,
Colorado —
Dear Ken & Vicki Knudson,
Mr. Bob Demaree has indicated that he is the owner's representative of Parcel Number
146933400039 Weld County, Colorado (the "Property"). The listed property owners are
KENNARD M KNUDSON and VICKI J KNUDSON so this will -serve letter is being sent to you.
The Property is located on the North side of WCR 2 between WCR 17 and WCR 19 in Weld
County, Colorado. The Property is located within the service area of Todd Creek Village
Metropolitan District ("TCVMD"). It is the understanding of TCVMD that you may develop the site
(the "Site"). Therefore, this Site is the subject of this conditional will serve letter from TCVMD.
TCVMD is willing and able to provide potable and non -potable water service and sanitary sewer
service to the Site (the "Service") for either residential or commercial uses subject to the following
conditions, which shall be conditions precedent to any obligation on the part of TCVMD to provide
such Service:
1. You shall pay TCVMD's then current water tap fees and all other fees, rates, tolls and
charges imposed pursuant to TCVMD's then current rules and regulations.
2. You shall design, construct, acquire easements and install any and all infrastructure
required or deemed necessary by TCVMD to provide Service to your Property (including but not
limited to: service taps, service lines, mainlines or any other improvements and facilities required,
including any permits or improvements required by Weld County for work within County R.0W).
You shall design all such infrastructure according TCVMD's design standards and in accordance
with TCVMD's rules and regulations. Further, you shall reimburse TCVMD for any and all costs it
incurs related to its review of the infrastructure design, construction and installation, including
reimbursement of its engineers and consultants.
3. This Conditional Will -Serve Letter, as it relates to sewer service availability, is subject to
the District receiving approval of its pending application with Metro Water Recovery to be deemed
a "Special Connector" that is allowed to utilize Metro Water Recovery's sewer services.
TCVMD will provide you with non -monetary assistance in your acquisition of easements
necessary to provide for offsite infrastructure to allow TCVMD to provide Service to the
Property. In addition, TCVMD will provide the terms of, and administer, reimbursement or

cost recovery agreements related to the installation or upsizing of offsite facilities or
infrastructure designed and constructed by you benefiting future development receiving
Service from TVCMD. The standard life span of such reimbursement agreements is ten
years.
Potable and non -potable water service will be provided to the Site subject to and conditioned
upon the terms of the TCVM D's rules and regulations as they may be amended from time to
time and the payment of all fees, rates and charges imposed thereunder. This commitment
shall run only to the Site and shall not be transferrable or assignable in any manner
whatsoever.
This conditional will serve commitment shall not be effective until you purchase a tap from
TCVMD indicating your willingness to be bound by the terms set forth herein.

improve, inspect, repair and remove electrical and communication facilities for the purpose of
transmission or distribution of electricity and appurtenances thereto, as may from time to time be
useful to, or required by Grantee, on, over, under, and across the following described property in
the County of Weld, State of Colorado to -wit:
A ten foot (10) wide easement in a tract of land described as follows: A part of the
SE1/4 of Section 33, Township 1 North, Range 67 West, of the 6th P.M., Recorded
Exemption Number 1469-33-4 RECX 13-0106.
Beginning at the SW corner of Lot 'A' of said Recorded Exemption a distance of 5
feet to the centerline of said ten foot easement; Thence S 00°12'59" E. a distance of
459.29 feet more or less, across Lot 'B', to the north right of way line of County
Road 2.
Those facilities will be underground and / or at grade and may include, but not be limited to,
cables, conduits, wire, conductors, transformers, manholes and supports of whatever materials,
including braces, guides, and other fixtures or devices used or useful in connection therewith. At
grade equipment applies to transformers, switch gear and other facilities which cannot be
installed underground.
Grantee shall have the right of ingress and egress over and across the lands of the Grantor to and
from the above described property, and the right to clear and keep cleared all trees and
obstructions as may be necessary.
The right and authority of Grantee hereunder may be exercised by its successors, assigns,
licensees, contractors and permitees.
Grantor reserves the right to occupy, use, and landscape said easement for all purposes not
inconsistent with the rights granted to Grantee so long as said use does not damage or interfere
with the Grantee's facilities or the maintenance, repair and replacement thereof. Grantor shall not
install permanent structures or facilities of any kind on, over, under, or across said easement
without the written approval of Grantee, except for a driveway, right-of-way, road, or other
access across the easement. Grantee shall pay Grantor for any damage to any driveway, right-of-
way, road, or other access across the easement caused by the construction and maintenance of

Grantee's facilities. Upon completion of construction, Grantee shall restore the surface of
Grantor's property to the same condition as practicably that existed prior to construction.

Assessor.
The specific route and course of the right-of-way and easement conveyed hereby (the "Right -of -Way Lands-) is more particularly
described and depicted on Exhibit "A" attached hereto and made a part hereof. The Right -of -Way Lands may be expanded up to
screnty-live feet t75't in wdth during construction. installation, repairment. replacement. modification. maintenance and other
similar operations. Following such operations, the width of the Right -of -War Lands shall be fifteen feet (15.f as described and
depicted on Exhibit A.
Grantee shall have all rights. privileges and he_netits necessary or convenient for the full use and enjoyment of this Agreement.
including, hot not limited to. the right of ingress and egress across Grantor's lands lying adjacent to the Right -of -Way Lands for
any and all purposes necessary and incidental to exercising Grantee's rights hereunder.
Alter the initial construction and installation of the Pipeline. Grantee may. from time to time. temporarily use Grantor's lands
parallel and adjacent to the Right -of -Way I .ands. -,r) the extent reasonably necessary, to operate. inspect, maintain, monitor_ mark,
protect. repair. alter. modify, change the size of. replace. abandon or remove the Pipeline.
The Pipeline to be laid under this Agreement shall be constructed a minimum depth of forty-eight (-,1R) inches below :he surface: of
the ground. at the time of construction. Grantor aurees not to increase or decrease the surface elevation of the Right -of -Way Lands
without the prior written consent of Grantee.
During construction. installation, replacement or similar operations, topsoil shall he segregated in accordance with local and state
regulation. including those found at the Colorado Oil and Gas Conservation Commission. Grantee agrees to restore the lands
disturbed during such operations as nearly as practicable in the condition that existed at the time immediately prior to construction
and installation of the Pipeline and reseed the same as soon as possible. Grantee tiinher agrees that, if within a reasonable time
after constriction. installation. repairmen!. replacement. modification. maintenance or similar operations. any settling of the Right-
ot-Way i,ands or lands adjacent thereto occur, Grantee shall make all necessary repairs at Grantee's sole cost and expense. During
construction. installation. repairment, replacement. modification, maintenance or similar operations. Grantee shall adequately fence
the work site it necessary to protect Grantor's livestock.
Grantee shall take reasonable measures n3 keep the Right -of -Way hands free of noxious weeds and litter.
Grantee shall have the right, prior to installation of the Pipeline, and the continuing right thereafter, to clear all trees, undergrowth
and other obstructions from the Right -of -Way Lands. Grantor agrees not to build, construct. or create any obstruction. fence,
buildings, engineering works or other structures or improvements on. across or under the Right-of•Wav I.ands that may impair or
interfere with Granter's rights hereunder without the prior written consent of Grantee.
Grantee agrees to pay for, repair. replace or otherwise conipensa'e Grantor fa- any and all damage, to crops, timber- fences, drain
tile. or other improvements on said premises resulting from Grantee's activities and operations on the Right -of -Way Lands:

power and authority to enter into this Agreement.
Grantee shall defend, indemnify and hold Grantor harmless from and against all claims, causes of action, liabilities, losses, damages
and expenses arising out of Grantee's activities and operations on the Right -of -Way Lands or the exercise of Grantee's rights
hereunder, except to the extent such claims arise from a breach by Grantor of this Agreement, or from the sole or gross negligence
or willful misconduct of Grantor.
Except for the parties' separate agreement regarding the compensation payable to Grantor by Grantee as consideration for this
Agreement, this Agreement contains the entire agreement of the parties.
This Agreement cannot he modified, except by an instrument in writing executed by Grantor and an authorized representative of
Grantee.
The rights granted hereunder may he assigned in whole or in part, and the terms, conditions and provisions of this Agreement shall
be a covenant running with the land and shall extend to and be binding upon the heirs, executors, administrators, personal
representatives, successors and assigns of the parties hereto.
The signatories below represent and warrant that they have the full right and authority to enter into this Agreement on behalf of
their respective principals, if any.
The terms and conditions of this Agreement shall be construed, interpreted and enforced in accordance with the laws of the State
of Colorado, without regard to any conflict of laws provision.
This Agreement may be executed as one document, or in several partially executed counterparts, and the original and counterparts
shall be construed together and shall constitute one instrument.

THIS EASEMENT AND LICENSE made and entered into this 5th day of
Oanuary . A.D., 19 84 , by and between The Signal Reservoir
and Irrigation Co. , a Colorado corporation, as First Party and
Union Rural Electric Association, Inc. , as Second Party.
WITitESSETH:
THAT WHEREAS, First Party is the owner of that certain Canal known as the
final Reservoir and Irrigation Co. irrigation pipeline
in Weld County, Colorado; and
WHEREAS, Second Party desires to construct, operate and maintain an under-
ground electric line under and across the right-of-way of said
irrigation pipeline at the point hereinafter described; and
WHEREAS, First Party is willing to grant the rights and easements requested
by Second Party;
NOW THEREFORE, in consideration of the sum of $ 50.00 paid to
First Party, receipt of which is hereby acknowledged, and the agreements of
Second Party to be performed hereunder, and upon the conditions and for the period
herein state, First Party does hereby grant to Second Party, its successors and
assigns, the use of a right-of-way at the point hereinafter described to construct,
install, lay, operate, maintain, alter, repair and remove an electric line over
and across the right-of-way of the irrigation pipeline at the location
shown and set forth in the map attached hereto, and marked Exhibit "A" and which
is by this reference made a part hereof, said right -of -w y crossfr►; being located
in Section �� Township IN Range fc7W of the 6th P.M., Weld
County, Colorado.
The construction of said electric line at the right -of. -way crossing shall be
in accordance with the specifications and plans applicable to crossing as the same
are outlined on the applicable map which is a part of Exhibit "A" hereto attached.
It is understood that, if the First Party only owns an easement for said
irrigation plepline right-of-way, or any part thereof, at the location described
in said map marked x ribit "A", this instrument shall grant to Second Party only
such rights as First Party may under such circumstances grant.
Said irrigation pipeline shall be bored
In laying and constructing said electric line and thereafter in operating,
repairing, maintaining or removing same, Second Party shall do so in such manner
as not to damage said Canal or the embankment thereof and so as not to interfer
with the floe of water in said Canal. Any and all excavations made shall be im-
mediately leveled off, and any damage to the canal embankments, fences, roads or
other improvements shall be promptly repaired by Second Party at its sole cost.
Second Party agrees that it will at all times maintain said electric line
and repair all breaks, leaks and damages therein and thereto at its own expense,
and further, that if by reason of any break, fault or damage in and to the elec-
tric line, injury to the properties of First Party is sustained, then Second
Party will, with all due diligence, repair and replace such property of First
Party in the same condition as the same was in prior to such a break, fault or
damage in and to the said electric line and will pay any and all monetary damages
from such break, fault, or damage sustained or incurred by First Party of its
stockholders or water users.
Second Party further agrees that, if at any time the electric line causes
any settling in the ditch embankments, the road therein, or any part of the
ditch right-of-way, it will upon notification from First Party, immediately
make all repairs required by First Party at Second Party's expense.

The Second Party further agrees to indemnify and save harmless First Party,
its successors, assigns, employees and stockholders on account of any damages or
loss sustained by them or any of them arising out of the construction, operation,
maintenance Or removal of said electric line.
if in the future First Party should desire to enlarge, deepen or otherwise
change or relocate said Canal or to construct any other canal, ditch or waterway
on said Canal right-of-way, or do any other thing incident to the operation of
said Canal, or any other portion of the irrigation system of First Party, th

Second Party agrees, at Second Party's expense, with all due diligence, to change,
relay and reconstruct its electric line so as to comply with such plans and spec-
ifications as First Party may prescribe as being necessary to permit the proper
maintenance and operation of First Party's irrigation system.
Second Party agrees to protect First Party and save and hold it harmless
from any and all third party claims and damages caused by Second Party's operation,
construction, maintenance or removal of said electric line and Second Party hereby
releases First Party, its successors, assigns, employees and stockholders from any
and all claims and damages of whatsoever character to said electric line or other
property of Second Party located in, along or across said Canal right-of-way aris-

consideration in hand paid, the receipt of which is hereby acknowledged, the undersigned Grantors) hereby grant*

The easement encompasses a continuous strip of land 50 feet in width at all points on the property crossed by
the above -described centerline and extending to the boundaries c&the adjacent property.
The above sum is acknowledged by the undersigned as fulconsideration for the easement and also for damages
to both 'and and growing crops occasioned by the initial installation of facilities. The Grantorlsl reservelil the right to
cultivate, use and occupy said premises for any purpose consistent with the rights and privileges herein granted and
which will not interfere with or endanger any of the facilities therein or use thereof. Such reservation by the Grantor(s)
shall in no event include the right to construct any buildings or structures, to impound any water, or to plant any trees or
shrubs upon the easement. The Grantee, at ail times, shall have the right of access by a reasonable route to the ease-
ment and along and upon the same for the purposes hereof, which include surveying, inspection and testing. Grantee
shall pay Grantor(s) for actual damages to land and growing crops occasioned by any future installations, construction,

Earth Engineering Consultants, LLC (EEC) personnel have completed the geologic hazards and
mineral extraction evaluation you requested for the referenced project. Our evaluation was carried
out by reviewing readily available data concerning soil and groundwater conditions for the site,
principally through review of United States Geological Survey (USGS), Colorado Geological
Survey (CGS), and United States Department of Agriculture Natural Resources Conservation
Service (MRCS) published information. A listing of the references reviewed as a part of the
geologic hazard evaluation is included with this report.
The property is located in the Southeast 1/4 of the Southeast 1/4 of Section 33, T 1 N, R67W of the 6th
Principal Meridian, northwest of the intersection of CR 2 and 19, approximately 3 miles northeast
of Brighton in Weld County, Colorado. The development parcel includes approximately 18 acres
planned for mixed -use commercial lots. A diagram indicating the approximate location of the
development is included with this report (Figure 1).
The purpose of this evaluation is to identify potential geologic hazards and mineral resources
which may conflict with proposed development. The conclusions and recommendations presented
in this report are based upon the acquired field data, review of the available literature and previous
experience with similar geologic conditions in this area.

Based on our site review, and site visit, the site can generally be described as follows. The proposed
development area is unimproved and covered with a thin mantle of topsoil and vegetation. The
ground surface appeared relatively flat with apparent drainage to the north and east with slopes of
about 1 to 2%. Evidence of other prior building construction was not observed at the site by EEC
field personnel. No apparent areas of slope instability were observed during our site visit.
Literature Review
Soil/Geologic Review
The site geology presented in this report is based upon the review of the available literature and
maps, and previous experience with similar geologic conditions in this area. The locations of
geologic features are approximate and should be considered accurate only to the degree implied
by the methods used to make those measurements.
The project site lies in the Colorado Piedmont Section of the Great Plains Physiographic Province.
The sediments which compose the Colorado Piedmont were formed when uplift of the present-day
Rocky Mountains in Late Cretaceous -Eocene times (70-30 million years ago) produced a large
increase of stream sediments resulting in deposition of sediments on the flanks next to the
mountain belt and outlying areas. The Colorado Piedmont is an elongated trough in the Great
Plains, adjacent to the Front Range of the Southern Rocky Mountains. The Colorado Piedmont
was formed when uplift of the area in Miocene times (20-5 million years ago) produced an increase
of stream erosion resulting in scouring next to the foothills and outlying areas. The Piedmont is
bordered by the Southern Rocky Mountains to the west, Great Plains escarpment to the northeast,
and Palmer Divide to the south.
Structurally, the site lies within the Denver Basin, a thick accumulation of Paleozoic and Mesozoic
Era sediments involved with down -warping of the basin area and uplift of the adjacent highlands.
Small anticlinal folds occur adjacent to the Front Range. It is our understanding that faulting has
not taken place in the recent historic past in this area.
According to the geologic mapping of the area (Keller & Morgan, 2018), near surface soils are
likely a Loess, a wind (eolian) deposits of sediments of fine grain soils (Figure 2). More
specifically, soil classification mapping (Natural Resources Conservation Service, July 9, 2022)
suggests the near surface subgrades within the development area predominantly consist of clay

and silty clay loam identified predominantly as Nunn loam with smaller amounts of Ulm clay loam
and Wiley -Colby complex (Map Unit Symbols 40, 67, 82, respectively) (Figure 3). The near
surface soils are underlain by Laramie Formation bedrock consisting of claystone, shale and sandy
shale with interbedded sandstone and lignite. Groundwater depths are suggested at depths greater
than 80 inches.
Landslide
Landslides as defined by CGS form on a preferential weakness zone causing a 'dry' mass of rock
to slide downhill under the pull of gravity. Slopes appear to be relatively gentle on this parcel and
no zones of preferential weakness were observed on aerial photos available on Google Earth;
therefore, it is our opinion that the risk from landslide to be negligible at this particular location
under current conditions.
Oil and Gas Potential
A review of the Colorado Oil and Gas Conservation Commission (COGCC) database (Colorado
Oil and Gas Conservation Commision, 2022) indicates the site is located within an identified oil
and gas field; furthermore, oil/gas facilities and/or wells (either abandoned or in operation) are
present on adjacent properties (Figure 4). Based on the available information, it appears potential
oil/gas resources could exist; however, a comprehensive evaluation by others would be required
to evaluate that possibility.
Coal Mines
The project site appears located within the Denver Coal Region possibly containing bituminous
and subbituminous coal. The coal/lignite may underly approximately 150 to 2,000 feet of
overburden materials (Carroll, 2006). A review of the available mapping (Colorado Geological
Survey, 2022) was performed to locate nearby active and historical coal mining operations. No
coal mines were listed in the vicinity of the project site. Based on the available information, it
appears potential coal resources could exist; however, a comprehensive evaluation by others would
be required to evaluate that possibility.

Radiation
Review of the available information (Colorado Geological Survey, 2022) indicates that no deposits
of radioactive minerals have been identified at the referenced property. Although radioactive
minerals were not identified, mitigating radon within site buildings may be necessary. Typically,
radon levels are measured within site buildings after a normal operating routine has been
established.
Sand, Gravel and Quarry Aggregate Resource
Review of available aggregate resource mapping of the Colorado Front Range (Schwochow,
Shroba, & Wicklein, 1974) indicates that no significant sand and gravel deposits are expected on
this property (Figure 5).
CONCLUSION
Based on our literature review, no apparent significant geologic hazards appear on the property.
The feasibility for extraction of mineral resources should be evaluated to determine if an economic
resource exists. Geotechnical subsurface explorations are recommended for each building site to
identify existing subsurface conditions. Pre -mitigation radon control methods, such as sub -slab
piping, as well as radon tests should be considered. It is our opinion the proposed development
appears compatible with the geologic conditions at the site.
The data presented herein was collected to help determine the feasibility of this project.
Professional opinions presented in this report are based on evaluation of technical information
gathered, partly on our understanding of the characteristics of the development proposed, and
partly on our experience with geologic conditions in the area. We do not guarantee the performance

Enclosed, herewith, are the results of the preliminary geotechnical subsurface exploration
completed by Earth Engineering Consultants, LLC (EEC) for the referenced project. This
exploration was carried out in general accordance with our proposal dated May 9, 2022.
In summary, the subsurface soils encountered in the test borings generally consisted of clay soils
which extended to depths of approximately 9 to 13 feet below ground surface, underlain by
claystone with interbedded sandstone bedrock. The subgrades were relatively dry and exhibited
moderate potential to swell with increases in moisture content. Groundwater was not encountered
in the completed test borings.
Based on the materials observed in the test borings, we believe lightly loaded structures could
either be supported by spread footings bearing on a zone of over excavation and backfilled soils,
or drilled pier foundations where adequate separation from bedrock cannot be maintained. The
building floor slab could likely be supported on similar over excavation and backfilled subgrade
or structural floors on drilled piers. Over excavation and backfilling is likely below exterior
flatwork and site pavements.

INTRODUCTION
The preliminary subsurface exploration for the proposed development generally located northwest
of CR 2 and 19, approximately 3 miles northwest of Brighton in Weld County, Colorado has been
completed. To obtain information on existing subsurface conditions, three (3) test borings were
advanced within the development area to depths of approximately 20 feet below present site
grades. Individual boring logs and a diagram indicating the approximate boring locations are
included with this report.
We understand the referenced property includes an area of approximately 18 acres and is planned
for mixed -use commercial along with the associated interior roadway and utility infrastructure.
Site structures would likely be one- or two-story buildings with relatively light to moderate
foundation loads. Small grade changes are expected to develop final site grades.
The purpose of this report is to describe the subsurface conditions encountered in the borings,
analyze and evaluate the test data, and provide preliminary geotechnical considerations for design
and construction of foundations, floor slabs and site pavements. Pavement section
recommendations are included which are based on assumed traffic conditions.
EXPLORATION AND TESTING PROCEDURES
The boring locations were selected and established in the field by Earth Engineering Consultants,
LLC (EEC) personnel by pacing distances and estimating angles from identifiable site features.
The locations of the borings should be considered accurate only to the degree implied by the
methods used to make the field measurements.
The borings were performed using a truck -mounted, CME 55 drill rig equipped with a hydraulic
head employed in drilling and sampling operations. The borings were advanced using four -inch

nominal diameter continuous flight augers and samples of the subsurface materials encountered
were obtained using split -barrel and California barrel sampling procedures in general accordance
with ASTM Specifications D1586 and D3550, respectively.
In the split -barrel and California barrel sampling procedures, standard sampling spoons are driven
into the ground by means of a 140 -pound hammer falling a distance of 30 inches. The number of
blows required to advance the split -barrel and California barrel samplers is recorded and is used
to estimate the in -situ relative density of cohesionless soils and, to a lesser degree of accuracy, the
consistency of cohesive soils. In the California barrel sampling procedure, relatively intact samples
are obtained in removable brass sleeves. All samples obtained in the field were sealed and returned
to the laboratory for further examination, classification, and testing.
Laboratory moisture content tests were performed on each of the recovered samples. In addition,
selected samples were tested for fines content and plasticity by washed sieve analysis and
Atterberg limits tests. Swell/consolidation tests were completed on selected samples to evaluate
the tendency of the subgrade soils to change volume with variation in moisture content and load.
The quantity of water-soluble sulfates was determined on select samples to evaluate, in -part, the
suitability of using calcium -based soil stabilization materials, and the potential for sulfate attack
on site concrete. Results of the outlined tests are indicated on the attached boring logs and summary
sheets.
As a part of the testing program, all samples were examined in the laboratory by an engineer and
classified in accordance with the attached General Notes and the Unified Soil Classification
System, based on the soils' texture and plasticity. The estimated group symbol for the Unified
Soil Classification System is indicated on the boring logs and brief description of that classification
system is included with this report. Classification of the bedrock was based on visual and tactual
observations; petrograph analysis may reveal other rock types.
SITE AND SUBSURFACE CONDITIONS
The proposed development area was unimproved at the time of our exploration, generally
consisting of sparse vegetation and topsoil at the surface of the borings. The development area
was relatively flat with apparent drainage to the north and east with grade changes of about 1% to

2%. Evidence of prior building construction was not observed at the site by EEC field personnel.
Photographs of the site at the time of our exploration are included with this report.
An EEC field engineer was on -site during drilling to direct the drilling activities and evaluate the
subsurface materials encountered. Field descriptions of the materials encountered were based on
visual and tactual observation of disturbed samples and auger cuttings. The boring logs included
with this report may contain modifications to the field logs based on results of laboratory testing
and engineering evaluation. Based on results of field and laboratory evaluation, subsurface
conditions can be generalized as follows.
The surficial topsoil/vegetation was underlain by lean clay with sand which extended to depths of
approximately 9 to 13 feet below ground surface. The clay soils were moderately plastic, relatively
dry and very stiff. At current moisture and density conditions, the clay soils exhibited moderate
swell potential with increases in moisture content. The clay soils were underlain by claystone with
interbedded sandstone which extended to the bottom of the completed test borings at depths of
approximately 20 feet below ground surface. The claystone bedrock exhibited low to moderate
swell potential and was moderately hard to hard.
The stratification boundaries indicated on the boring logs represent the approximate locations of
changes in soil and rock types; in -situ, the transition of materials may be gradual and indistinct.
Groundwater
Observations were made while drilling and after completion of the borings to detect the presence
and depth to hydrostatic groundwater. While drilling, no free water was observed in the test borings
advanced to depths of approximately 20 feet below ground surface. The borings were backfilled
upon completion of the drilling operations; therefore, subsequent groundwater observations were
not obtained. The groundwater level observations are included on the attached boring logs.
Fluctuations in groundwater levels can occur over time depending on variations in hydrologic
conditions, and other conditions not apparent at the time of this report. Long-term monitoring of
water levels in cased wells, which are sealed from the influence of surface water, would be required
to evaluate fluctuations in groundwater levels at the site.

ANALYSIS AND RECOMMENDATIONS
General
The subgrades encountered in the test borings generally consisted of approximately 9 to 13 feet of
clay soils which were relatively dry and very stiff, and at current moisture and density conditions,
exhibited moderate swell potential. Those near surface subgrades were underlain by low to
moderately expansive claystone bedrock. Movement of foundations, pavements, and other at -
grade improvements placed directly on expansive materials would be expected if the moisture
content of those materials increases from current moisture contents subsequent to construction.
Due to the expansive soils encountered at this site, care will be needed to see that site preparation
and designs of site improvements includes measures to mitigate the potential of heaving of the site
improvements to an acceptable level. Outline herein are likely considerations for development of
this site; however, the client should recognize that building on expansive soils is risky, even when
mitigation plans are followed. Mitigation plans can reduce the risk of heaving of site
improvements, but that risk cannot be eliminated. Outlined below are general considerations for
developing this site. This report is not intended to provide any design recommendations for the
site structures; a site -specific geotechnical engineering report should be provided for each
proposed building at this site.
Shallow Foundations
Based on the materials encountered in the completed test borings, we anticipate site structures
could likely be supported on spread footing foundations bearing on a zone of over excavation and
backfilled soils, and maintaining adequate separation from bedrock. Over excavation backfill
materials could probably consist of the site clay soils; however, care will be needed to condition
those soils to develop and maintain proper moisture contents during and after compaction.
Consideration could also be given to importing granular materials to reduce the potential for post
construction movement of improvements.
For footings and floor slabs, over excavation depths of approximately 5 to 8 feet seems likely.
Floor slabs could likely bear on similar subgrades as suggested for foundation footings.

Consideration could also be given to using structural floor system which provides adequate
separation from the expansive soils (such as a crawlspace).
For design of footing foundations bearing on properly placed over excavation backfill, relatively
low design soil bearing pressures (maximum net allowable total load soil bearing pressures) are
expected. The net bearing pressure refers to the pressure at foundation bearing level in excess of
the minimum surrounding overburden pressure. Total load would include full dead and live loads.
Design recommendations for spread footings would be based on site specific borings within the
building areas.
Deep Foundations
In areas of relatively shallow bedrock or where adequate separation from bedrock cannot be
maintained, the site structures could likely be supported on deep foundations.
Deep foundations consisting of drilled shaft (drilled pier) foundations supporting the building
grade beams, stem walls and floor slab appear likely. The use of void form beneath grade beams
and floor slabs should be expected. To provide support capacity and resist the potential uplift of
the expansive underlying bedrock, the drilled piers would extend a minimum depth, sufficient to
resist uplift, into the underlying competent bedrock.
Below Grade Areas
We anticipate site structures could include below grade areas, such as basement or crawlspaces.
Since free water was not encountered at shallow depths below ground surface, below grade
building areas appears practicable. However, perimeter drain systems should still be expected
around all below grade areas to reduce the potential for hydrostatic loads to develop on below
grade walls and/or infiltration of surface water into below grade areas. In general, a perimeter
drain system would consist of perforated metal or plastic pipe, placed around the exterior perimeter
of the structures, and sloped to drain to a sump or an outfall where reverse flow cannot occur into
the system. Specific recommendations for perimeter drain systems would typically be provided
in site specific geotechnical engineering reports.

Utility Installation
Bedding around utility pipelines should be placed in accordance with recommendations from the
pipeline designer. Backfill soils placed above the utility lines should consist of approved materials
which are free from organic matter and debris. The excavated soils could be used as utility backfill.
Pipeline backfill should be placed in maximum 9 -inch loose lifts, adjusted to within ±2% of
optimum moisture content and compacted to at least 95% of the material's maximum dry density
as determined by ASTM Specification D698, the standard Proctor procedure. The near surface
subgrades would likely require substantial additions of water to bring the relatively dry clay soils
to within the recommended moisture range.
Pavement Subgrades
Prior to placement of any pavements or exterior flatwork (i.e., sidewalks, curb -and -gutter, etc.),
we recommend any existing vegetation and topsoil be removed from the planned improvement
areas. After stripping the site and after making all cuts and prior to placing any fill, we recommend
over excavating the subgrades beneath pavements and exterior flatwork. The over excavations
should extend to a depth of at least 3 feet below ground surface. The over excavations should
extend laterally 8 inches for every 12 inches of over excavation depth. The over excavation depths
recommended should reduce the amount of post -construction movement and promote more
uniform movement; even though that risk is reduced, it is not eliminated.
After completing the over excavations, the exposed soils should be scarified to a depth of 9 inches,
adjusted in moisture content and compacted to at least 95% of the material's maximum dry density
as determined in accordance with ASTM Specification D698, standard Proctor procedure. The
moisture content should be adjusted to within ±2% of the material's optimum moisture content.
Fill soils should consist of approved materials which are free from organic matter and debris. In
our opinion, the over excavated clay soils or similar soils could be used. The fill soils should be
placed in loose lifts not to exceed 9 inches in thickness, adjusted in moisture content and
compacted as recommended for the scarified soils. Care will be needed to maintain the
recommended moisture contents prior to and during construction of overlying improvements. Care
should be taken after preparation of the subgrades to avoid disturbing the subgrade materials.

Materials which are loosened or disturbed should be reworked prior to placement of
improvements.
Pavements
Summarized below are preliminary pavement sections that are based on the soil conditions
encountered and anticipated traffic conditions which are based on the planned site improvements.
The preliminary pavement sections are included to provide an estimate of the pavement sections
for initial planning; they are not for actual design and should be evaluated once site plans are
available. A final pavement design is recommended once the roadway alignments are selected,
utilities are installed and backfilled, and the roadway is at or near is final subgrade elevations.
We anticipate the site pavements will include local roads (Local Commercial) for support of low
volumes of commercial truck traffic, and collector roads (Collector Commercial) for moderate
volumes of commercial truck traffic. An R -value of 5 was assumed for the subgrade support value.
The recommended pavement sections are considered minimum; thus, periodic maintenance should
be expected.

Asphalt pavements should be graded as S or SX and prepared with 75 gyrations using a Superpave
gyratory compactor in accordance with CDOT standards. Grading SX is recommended for surface
course of the pavement. The asphalt should include PG 58-28 or PG 64-22 asphalt binder;
however, if the mix contains reclaimed asphalt pavement (RAP) material, we recommend using
PG 58-28 binder. Hot mix asphalt should be compacted to achieve 92 to 96% of the mix's
maximum specific gravity (Rice Value).
Portland cement concrete should be an approved exterior pavement mix with a minimum 28 -day
compressive strength of 4,500 psi and should be air entrained.
Corrosion Potential for Site Concrete
Results of water-soluble sulfate testing on two (2) select subgrade samples indicate water soluble
sulfate contents ranging from 0.07 to 0.18%. ACI 318, Section 4.2 indicates the site soils have a
moderate risk of sulfate attack on Portland cement concrete and indicates site concrete should be
designed using a sulfate exposure of 51 or higher.
Other Considerations
Positive drainage should be developed across and away from the site pavements and away from
any site structures to avoid wetting the subgrade materials. Subgrade materials allowed to become
wetted subsequent to construction can result in unacceptable performance of the improvements.
The individual contractor(s) should be made responsible for designing and constructing stable,
temporary excavations as required to maintain stability of both the excavation sides and bottom.
All excavations should be sloped or shored in the interest of safety following local and federal
regulations, including current OSHA excavation and trench safety standards.
GENERAL COMMENTS
The analysis and recommendations presented in this report are based upon the data obtained from
the soil borings performed at the indicated locations and from any other information discussed in
this report. This report does not reflect any variations which may occur between borings or across

the site. The nature and extent of such variations may not become evident until construction. If
variations appear evident, it will be necessary to re-evaluate the recommendations of this report.
Site specific explorations should be completed for each individual lot and/or building to define
subsurface conditions at the respective locations.

Water levels indicated on the boring logs are the levels measured in the borings at the time indicated. In pervious soils, the indicated
levels may reflect the location of ground water. In low permeability soils, the accurate determination of ground water levels is not
possible with only short term observations.
DESCRIPTIVE SOIL CLASSIFICATION
Soil Classification is based on the Unified Soil Classification
system and the ASTM Designations D-2488. Coarse Grained
Soils have move than 50% of their dry weight retained on a
#200 sieve; they are described as: boulders, cobbles, gravel or
sand. Fine Grained Soils have less than 50% of their dry weight
retained on a #200 sieve; they are described as : clays, if they
are plastic, and silts if they are slightly plastic or non -plastic.
Major constituents may be added as modifiers and minor
constituents may be added according to the relative
proportions based on grain size. In addition to gradation,
coarse grained soils are defined on the basis of their relative in -
place density and fine grained soils on the basis of their
consistency. Example: Lean clay with sand, trace gravel, stiff
(CL); silty sand, trace gravel, medium dense (SM).

Pursuant to Colorado Revised Statute 24-65.5-101 et seq., a mineral estate owner
may file in the office of the County Clerk and Recorder of the county in which the real
estate is located a request for notification form that identifies
and the mineraly sealion owner'stowmineral
estate and the corresponding surface estate by parcel
and range or other legally sufficient description.

REQUEST FOR NOTIFICATION (Mineral Estate Owner)
Pursuant to C.R.S. Section 24-65.5-101, et seq., as amended, (hereinafter referred to as the "Statute") this Request for
Notification shall serve to identify the undersigned, Kerr-McGee Oil & Gas Onshore LP, its successors and assigns,
(hereinafter referred to as "Kerr-McGee") as a Mineral Estate Owner, underlying the lands (Surface Estate) described
on the attached Exhibit A.
Pursuant to the provisions of the Statute, an Applicant who submits an Application for Development to a local
government shall send notice thereof to the Mineral Estate Owner. Such notice must comply with and be sent in
accordance with the provisions of the Statute.
All notices shall be sent to:

or such other address as Kerr-McGee may indicate by filing of record with the clerk a notification of change of address
form or an amendment to the request for notification.
Failure by the Applicant to comply with the Statute shall entitle the Mineral Estate Owner to the damages and
remedies, both legal and equitable, as provided for in the Statute, or otherwise permitted by the law, including an award
of reasonable attorney fees.
All terms used herein, including but not limited to Mineral Estate Owner, Applicant, and Application for Development
shall have the meaning provided for in the statute.
