BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, MAY 9, 2022
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, May 9, 2022, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Scott K. James, Chair
Commissioner Mike Freeman, Pro-Tem
Commissioner Perry L. Buck
Commissioner Steve Moreno
Commissioner Lori Saine
Also present:
County Attorney, Bruce Barker
Acting Clerk to the Board, Houstan Aragon

• MINUTES: Commissioner Moreno moved to approve the Minutes of the Board of County
Commissioners meeting of April 25, 2022, as printed. Commissioner Buck seconded the motion and it
carried unanimously.
• READ ORDINANCE BY AUDIO: Commissioner Moreno moved to read Code Ordinance #2022-03
by audio. The motion was seconded by Commissioner Saine, and it carried unanimously.
el PUBLIC INPUT: No public input was given.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda, as printed.
Commissioner Saine seconded the motion and it carried unanimously.
• COMMISSIONER COORDINATOR REPORTS: Commissioner Moreno reported that he and
Commissioner Buck attended the Department of Human Services Workforce Development GED
Graduation, and the Head Coach from the University of Northern Colorado (UNC) was the motivational
guest speaker. Commissioner Saine reported that she is continuing to spend long hours at the State
Capitol for legislative bills related to the Department of Human Services, and expressed the importance
to show up, and stand up for what you believe in.

El PRESENTATIONS:
1) COLORADO EMERGENCY OPERATIONS CENTER TASK BOOKS CERTIFICATIONS - OFFICE
OF EMERGENCY MANAGEMENT: Roy Rudisill, Director of the Department of Emergency Management,
explained the Emergency Operations Incident Task Books have been part of the certification process
since 2016, and were created for positions, or incident -specific roles, within the Emergency Operations
Center. He introduced David Burns, Office of Emergency Management, and recognized him for his
completion of the Planning Section Chief, and the Emergency Operations Center Manager Task Books.
Additionally, Elizabeth Relford, Deputy Director of the Department of Public Works, was recognized for
her completion of the Planning Section Chief Task Book. Mr. Rudisill further stated they were both
recognized at a conference in February 2022, by the Colorado Division of Homeland Security of
Emergency Management, and Colorado Managers Association as having expertise and capability to
assist other Centers in their roles, and further expressed his appreciation for their dedication to Weld
County and lending help to others when needed. In turn, each Commissioner commended them for their
leadership in gaining these certifications, and going well above and beyond their call of duty for the
citizens of Weld County. (Clerk's Note: The group gathered for a photo opportunity).
El WARRANTS:
1) GENERAL WARRANTS - MAY 6, 2022: Commissioner Buck moved to approve the General Warrants,
as printed. Commissioner Moreno seconded the motion and it carried unanimously.
• 2) COMMISSIONER WARRANTS (LORI SAINE) - MAY 6, 2022: Commissioner Moreno moved to
approve the Warrant for Commissioner Saine, as printed. Commissioner Buck seconded the motion and
upon a roll call vote, the motion passed four (4) to zero (0), with Commissioner Saine recused.
• 3) COMMISSIONER WARRANTS (SCOTT K. JAMES) - MAY 6, 2022: Commissioner Saine moved
to approve the Warrant for Commissioner James, as printed. Commissioner Freeman seconded the
motion and upon a roll call vote, the motion passed four (4) to zero (0), with Commissioner James
recused.
• BIDS:
1) APPROVE BID #B2200082, DEPARTMENT OF HUMAN SERVICES BUILDING B ROOF
REPLACEMENT - FACILITIES DEPARTMENT: Christie Peters, Purchasing Department, stated staff
recommends selecting the lowest bidder who met specifications, Select Roofing Contractors, LLC, for a
total amount of $137,294.00. Commissioner Buck moved to approve said bid. The motion was seconded
by Commissioner Saine, and it carried unanimously.
El PLANNING:
1) CONSIDER PARTIAL VACATION OF TWO -LOT RECORDED EXEMPTION, RE -2715, FOR
REMOVAL OF LOT B — MICHAEL AND JANINE FREEMAN: Commissioner Freeman recused himself
from hearing this matter, and sat as the applicant for this case. Michael Hall, Department of Planning
Services, stated staff received a letter from the applicant requesting the removal of Lot B from Recorded
Exemption, RE -2715, with the resulting parcel consisting of approximately 135 unplatted acres. Mr. Hall
gave a brief overview of the property history and location, and stated Lot A is not a part of this partial
vacation request. Mr. Hall further stated staff recommends approval, subject to the following Condition of
Approval: the applicant shall submit a revised plat and deed to the Department of Planning Services for
review, and upon acceptance, the plat shall be signed by the property owners and shall be submitted for
recording. Mike Freeman, applicant, was present for questions. No public testimony was offered
concerning this matter. Commissioner Saine moved to approve said partial vacation, with the Conditions
of Approval. The motion was seconded by Commissioner Moreno, and upon a roll call vote the motion
passed four (4) to zero (0), with Commissioner Freeman recused.

2) CONSIDER PARTIAL VACATION OF CORRECTED TWO -LOT RECORDED EXEMPTION,
RECX13-0093, FOR REMOVAL OF LOT B - CARLOS AND ERNESTINE GALICIA: Mr. Hall stated staff
received a letter from the applicant requesting the removal of Lot B from Corrected Recorded Exemption,
RECX13-0093, with the resulting parcel approximately 148 unplatted acres. Mr. Hall gave a brief
overview of the property history and location, and stated Lot A is not a part of this partial vacation request.
Mr. Hall further stated staff recommends approval, subject to the following Condition of Approval: the
applicant shall submit a revised vacation plat to the Department of Planning Services for review, and
upon acceptance, the plat shall be signed by the property owners and shall be submitted for recording.
Paula Platt, applicant representative, was present for questions. No public testimony was offered
concerning this matter. Commissioner Saine moved to approve said partial vacation, with the Conditions
of Approval. The motion was seconded by Commissioner Buck, and it passed unanimously.
3) CONSIDER FIRST READING OF CODE ORDINANCE #2022-03, IN THE MATTER OF
REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION OF THE
WELD COUNTY CODE (OIL AND GAS, RESOLUTIONS, AND PROCLAMATIONS): Bruce Barker,
County Attorney, stated this Ordinance will accomplish three (3) amendments to the Code: the royalty
amount needed to be adjusted to 22.5`)/0, as it was missed the first time it was considered as directed by
the Board; eliminate language establishing a Stay for oil and gas, as well as the need to extinguish the
Emergency Declaration that proceeded the Stay, now that all federal reimbursements have been
collected; and adjust the intent for making proclamations. No public testimony was offered concerning
this matter. Commissioner Freeman moved to approve Code Ordinance #2022-03 on First Reading. The
motion was seconded by Commissioner Buck, and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2022-03 was approved on First Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:21 a.m.
