James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Karin McDougal Department of Planning Services representative, Maxwell Nader Department of Public Health and Environment representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated August 2, 2022, and duly published August 5, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Enrique Retana, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0009, to exceed the maximum allowed building coverage (up to 14%) in the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter of record. Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal stated the property currently has three (3) buildings on the site, and one (1) building is not permitted and is currently in violation for being built without a Building Permit and exceeding the allowable building coverage of 10%. He described the sign posting and stated 41 notices were sent to surrounding property owners (SPO), with no comments returned. Mr. Nader relayed Development Review notes stating the parcel has a permitted, existing access onto Higgins Avenue, which is a local, gravel road which requires 60 feet of right-of-way. Additionally, no other access is requested, no additional traffic is associated with this request, and the site has a Zoning Permit for commercial vehicles, semi -trucks and trailers. He stated stormwater drainage protection has been met and historical stormwater flow shall be maintained. Mr. Nader explained the site is located within the three (3) mile referral area of the City of Fort Lupton, who did not return a referral form, nor a Notice of Inquiry. He described surrounding uses, displayed images of the site and surrounding views, and entered the favorable recommendation of the Planning Commission into the record as written. El Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stating the existing residence is served by the Aristocrat Ranchette Water Project, Cc; Pi-(-rP/MN) twig / 2022-2650 PL2835 HEARING CERTIFICATION - ENRIQUE RETANA (USR22-0009) PAGE 2 along with a septic system permitted for three (3) bedrooms, which is located to the southeast of the residence. Ms. Light relayed there is one Development Standard which addresses setbacks and there are no outstanding issues related to this request. Enrique Retana, applicant, explained the building was built for horses and storage and he would like to keep it. ▪ No public testimony was offered concerning this matter. In response to Chair James, Mr. Retana indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as presented. ▪ The Board discussed the Conditions of Approval and Development Standards. The Board accepted the Resolution as presented. Commissioner Saine moved to approve the request of Enrique Retana for a Site Specific Development Plan and Use by Special Review Permit, USR22-0009, to exceed the maximum allowed building coverage (up to 14%) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing was completed at 10:43 a.m. This Certification was approved on the 5th day of October, 2022.
