James, Chair Commissioner Mike Freeman, Pro-Tem — EXCUSED Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid County Attorney, Bruce Barker Department of Planning Services representative, Michael Hall Department of Public Health and Environment representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated February 10, 2022, and duly published February 12, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of George Zadel, for a Site Specific Development Plan and Minor Subdivision Final Plan, MINF21-0001, for five (5) lots with E (Estate) Zoning. Bruce Barker, County Attorney, made this a matter of record. Michael Hall, Department of Planning Services, presented a brief summary of the proposal and indicated Change of Zone, COZ21-0008, was approved by the Board on February 23, 2022, to change the subject parcel from the A (Agricultural) Zone District to the E (Estate) Zone District. He stated one internal roadway off of County Road (CR) 38 will serve the five (5) lots and all existing access points shall be closed and reclaimed, except an existing eastern access point, which provides access to on -site oil and gas activities. He relayed the applicant is requesting a variance with regard to the spacing criteria of the access, which is supported by the Department of Planning Services, Development Review. He summarized the anticipated traffic associated with the site, stated Development Review is requiring an Improvements Agreement and noted the site meets a drainage detention exception. He described the surrounding zoning and uses, relayed the site is within a Weld County Opportunity Zone, and confirmed the existing USR on the site is being vacated. Mr. Hall indicated notice was sent to 11 surrounding property owners (SPOs), and no responses were received, he entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. Lauren Light, Department of Public Health and Environment, stated water will be provided by the Little Thompson Water District, there will be septic systems for sewer and noted the existing house has a permitted system. cc '. No public testimony was offered concerning this matter. ki In response to Commissioner Moreno, Mr. Hall explained the need for Condition of Approval (COA) #1 (requirements of Weld County School District RE -1), and explained to Commissioner Saine the requirement of a Homeowners Association (COA #1.E) is a Standard of the Minor Subdivision application process. The Board made no changes to the Conditions of Approval. IEJ In response to Chair James, Mr. Baker indicated he had reviewed, and on behalf of the applicant, agreed to abide by, the Conditions of Approval, as presented. ---1 Commissioner Saine moved to approve the request of George Zadel for a Site Specific Development Plan and Minor Subdivision Final Plan, MINF21-0001, for five (5) lots with E (Estate) Zoning, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as presented. The motion was seconded by Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing was completed at 10:32 a.m. This Certification was approved on the 30th day of March, 2022.
