The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.

The project proposes to: Change of Zone from the R-1 (Low -Density Residential) Zone District to the A
(Agricultural) Zone District.
ACCESS:
Weld County Public Works has reviewed the application materials related to access.
The parcel has an existing unpermitted access onto NW C Street approximately 1,060 feet northwest of the
intersection of NW C Street and N 23rd Avenue. No other access is proposed.
This access appears to meet the Minimum Access Spacing Criteria, as specified in Table 1 below. An
access permit shall be obtained for this location.

Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We
strongly encourage you to discuss your access location with Public Works prior to laying out your site plan.
All "preliminarily approved" accesses are subject to change during the access permitting process. Per Sec.
24-8-40, when feasible, there shall be no net increase in the number of accesses to a public road. Minimum
access spacing widths are shown in Weld County Code Sec. 8-14-30. For shared, Public Works strongly
recommends the property owner establish an access road maintenance agreement so future owner of the
properties will be aware of their requirements for shared maintenance of the access road. This is not a
requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future.
Please refer to Chapter 8 of the Weld County Code for more information regarding access.
ROADS AND RIGHT-OF-WAY:
NW C Street is a paved road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate on
the plat the future and existing right-of-way and the physical location of the road. If the right-of-way cannot
be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-
90, the required setback is measured from the future right-of-way line. Be aware that physical roadways
may not be centered in the right-of-way. This road is maintained by Weld County.
Based on the traffic information submitted with the application and based on the Functional Classification
of NW C Street, the County road facilities providing access to the property are adequate in functional
classification, width, and structural capacity to meet the traffic requirements.
Per Chapter 8, Article 13, Section 8-13-30, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4):
This site is located in a Municipal Separate Storm Sewer System (MS4) Area which may trigger specific
water quality requirements or other drainage improvements in future land use cases. In addition to
compliance with applicable Weld County regulations, property owner will be required to be compliant with
any additional MS4 requirements.
Questions pertaining to the MS4 requirements should be directed to the Public Works Department 970-
304-6496.
CONDITIONS OF APPROVAL:
The plat shall be amended to delineate the following:
1. NW C Street is a paved road and is designated on the Weld County Functional
Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of
right-of-way at full buildout. The applicant shall delineate and label on the plat the future
and existing right-of-way (along with the documents creating the existing right-of-way) and
the physical location of the road. If the existing right-of-way cannot be verified it shall be
dedicated. The applicant shall also delineate the physical location of the roadway. Pursuant
to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is
measured from the future right-of-way line. This road is maintained by Weld County.

2. Show and label the existing access point and the usage types (Residential). The access
location will be reviewed as part of the plat submittal. (Department of Public Works)
DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. The property owner or operator shall be responsible for controlling noxious weeds on the
site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Department of

2. Weld County will not replace overlapping easements located within existing right-of-way or
pay to relocate existing utilities within the existing County right-of-way. (Department of

3. Access on the site shall be maintained to mitigate any impacts to the public road including
damages and/or offsite tracking. (Department of Public Works)
4. Prior to the release of building permits, the applicant shall be required to submit a complete
access application for a "preliminarily approved" access location as shown on this plat.

5. Any work that may occupy and or encroach upon any County rights -of -way or easement
shall acquire an approved Right -of -Way Use Permit prior to commencement. (Department

6. The historical flow patterns and runoff amounts will be maintained on the site. (Department

Environmental Health Services has reviewed this proposal for a Change of Zone from
the R-1 ( Low -Density Residential) Zone District to the A (Agricultural) Zone District.
The existing residence is served by the City of Greeley for water and an on -site
wastewater treatment system permitted for 3 bedrooms (G19800064). When a second
residence is constructed water and sanitary sewer may be supplied by the City of
Greeley.
We recommend the following appear as notes on the Change of Zone plat:
1. Water and sanitary sewer service may be obtained from The City of Greeley.
2. The parcel is currently not served by a municipal sanitary sewer system.
Sewage disposal may be by an on -site wastewater treatment system (OWTS)
designed in accordance with the regulations of the Colorado Department of
Public Health and Environment, Water Quality Control Division, and the Weld
County Code in effect at the time of construction, repair, replacement, or
modification of the system.
3. Activity or use on the surface of the ground over any part of the OWTS must be
restricted to that which shall allow the system to function as designed and which
shall not contribute to compaction of the soil or to structural loading detrimental
to the structural integrity or capability of the component to function as designed.

DEVELOPMENT STANDARDS:
A Flood Hazard Development Permit is required for all construction or development occurring in the
floodplain or floodway as delineated on Federal Emergency Management Agency (FEMA) FIRM
Community Panel Map #08123C -1528E effective date January 20, 2016 (Cache la Poudre River
Floodplain). Any development shall comply with all applicable Weld County requirements, Colorado
Water Conservation Board requirements as described in Rules and Regulations for Regulatory
Floodplains in Colorado, and FEMA regulations and requirements as described in 44 CFR parts 59, 60,
and 65. The FEMA definition of development is any man-made change to improved or unimproved
real estate, including but not limited to buildings or other structures, mining, dredging, filling, grading,

2. FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any

RE: New Single Family Residence

The above mentioned site currently has City of Greeley water service for an existing single
family residence. In order to obtain service for a second residence a number of steps must be
completed:
1. Outside of City Water and Sewer Service Agreements must be completed and approved
by the Greeley Director of Water & Sewer.
2. Because public sanitary sewer is available within 400 feet of this property sanitary sewer
service must be extended to serve the new residence. This extension will involve
extending sanitary sewer collector main from a trunk line that runs along the southern
border of the property up to the public right of way in NW C Street. This new sewer main
must be located in an exclusive City of Greeley sanitary sewer easement.
3. City of Greeley staff would need to review and approve the design of this sewer main
prior to construction. Then City staff would inspect the constructed line for acceptance by
the City. One potential route runs straight along the western boundary of this property
from the trunk line up to NW C St.
4. City of Greeley staff must review and approve construction drawings for the new water
tap and service line.
5. All appropriate fees must be paid to Greeley Water & Sewer. These fees would include
plant investment fees for the new water and sewer taps, installation and meter fees, and
potentially cash -in -lieu for the dedication of raw water.
