WHEREAS, Rosella M. Rucobo dba JR'S has presented to the Board of
County Commissioners of Weld County, an application for a retail license for
sale of 3.2% beer only, and
WHEREAS, the said applicant having paid to the County Treasurer of
Weld County the sum of fifty dollars ($50.00) therefore, and having produced a
State Retail License for the sale of 3.2% beer only outside of the corporate
limits of any town or city in the County of Weld, at the location described as
follows:
Block 2, East Side Eaton Out, beginning at a point 25 feet
West of the Northeast Corner of Lot 12, West 28 feet,
South 100 feet, East 25 feet, North 100 feet to the beginning.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
having examined the said application and the other qualifications of the applicant
do hereby grant License Number 72-13 to said applicant to sell 3.2% beer only at
retail at said place, and do hereby authorize and direct the issuance of said
license by the Chairman of the Board, attested by the County Clerk and Recorder
of Weld County, good for one year from the date of issue unless revoked, according
to law, provided however, that said license shall be issued upon the express
condition and agreement that the place where licensee is authorized to sell beer
under said license will be conducted in strict conformity to all laws of the
State of Colorado and rules and regulations relating thereto heretofore passed
by the Board of County Commissioners of Weld County, Colorado, and any violation
thereof shall be cause for revocation of the license.

RESOLUTION
WHEREAS, it is the desire of the Board of County Commissioners,
Weld County, Colorado, to lease from the Greeley Leasing Company for
the use of the Weld County Sheriff's Department, the following vehicles,
to-wit:
1 - 1972 Galaxie 500 Ford Automobile, I. D. No.

1 - 1972 Galaxie 500 Ford Automobile, I. D. No.

as per motor vehicle lease agreement Nos. 278, 279 and 280 respectively,
including maintenance supplement thereto, said lease agreements and
supplement attached hereto and made a part hereof by reference, for a
total lease purchase price of Three hundred Thirty-seven and no/100ths
Dollars ($337. 00) per month for each vehicle.
NOW, THEREFORE, BE IT RESOLVED, that the County of Weld,
State of Colorado, agrees to lease from the Greeley Leasing Company
the aforementioned vehicles for the use of the Weld County Sheriff's
Department, upon all of the terms and conditions as recited in said lease
agreements and supplement thereto.

taxpayers of Weld County, and to hear appeals from the determination of said
assessments fixed and made by the County Assessor, and
WHEREAS, said Board of Equalization shall conNene on the second Monday
in July, and thereafter convene and adjourn on each day following to end on the
last business day of July.

EXPIRES AUGUST 31, 1977:
WHEREAS, the Union Pacific Railroad Company has tendered to the County
of Weld, State of Colorado, an agreement extending to and including August 31, 1972,
the term of contract dated September 17, 1937 (File #54-131) , covering the
construction, maintenance and operation of a 1-inch water pipe line and hydrant
on the right-of-way and under the tracks of the railroad company at Dacono.
Colorado, said agreement being indentified as Railroad Company's C. D. No. 2270E-E, and
WHEREAS, after careful review and consideration, it is considered that the
best interest of said County will be sub-served by the acceptance of said agreement.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County CommissionerF,
Weld County, Colorado, accept the terms of the agreement submitted by the Union
Pacific Railroad Company as aforesaid and that the Chairman be and hP is hereby

FINDINGS AND RESOLUTION
CONCERNING RETAIL 3. 2 FERMENTED
MALT BEVERAGE LICENSE OF
VIRGINIA D. SHUE
The application of Virginia D. Shue for retail 3. 2 fermented malt
beverage license came on for hearing July 5, 1972, at 2:00 P. M. and
the Board of County Commissioners of the County of Weld having heard
the testimony and evidence adduced upon said hearing and having con-
sidered the testimony, evidence and petitions filed with said Board,
and having carefully weighed the same, now makes the following
findings:
1. The evidence discloses that the applicant is the owner of
said premises sought to be licensed within the meaning of the statutes.
2. That no question was raised nor objection offered as to the
applicant concerning the standing, character or motive of said applicant.
3. The applicant has proven a prima facie case as to the reasonable
requirements of the neighborhood.
4. The desires and needs of the inhabitants of the immediate
neighborhood, as well as the needs of the traveling public, transients,
and passers-by, are not fulfilled, inasmuch as there presently is no
3. 2 fermented malt beverage, for consumption both on and off premises,
in the area designated as the neighborhood.

WHEREAS, the Board of County Commissioners of the County of

RESOLUTION
WHEREAS, a public hearing was held on Friday, June 30, 1972,
in the chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing the petition of Monfort Feed
Lots, Inc. , Greeley, Colorado, requesting permission for relocation
of an existing feed lot operation on property described in Notice of
publication, copy of which is attached hereto and made a part hereof
as Exhibit A, and
WHEREAS, petitioner was present and represented by counsel,
Clark Weaver, and
WHEREAS, there was no opposition to the request of petitioner
for the relocation of an existing cattle feed lot operation, and
WHEREAS, said requested relocation of an existing cattle feed
lot operation is located in an agricultural zone as set forth by the
Weld County Zoning Resolution, and
WHEREAS, according to Section 3. 3 (3)(c:) of the Zoning Resolution
of Weld County, said cattle feed lot operation or any expansion or
relocation thereof may be authorized upon tale approval of the Board of
County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of
the petitioner, and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Monfort Feed Lots, Inc. ,
Greeley, Colorado, for relocation of an existing cattle feed lot operation
on the premises indicated above be, and it hereby is granted, under the
conditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. Subject to a green belt being established at least 50 feet wide
along the south side of the feed lots, screening off Highway
No. 34 with a suitable type of vegetation.
3. Subject to proposed lagoons being sealed and precautions
taken to protect the north lagoon from flood plain damage.
4. All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the
Zoning Resolutions of Weld County, Colorado.

1. The evidence discloses that the applicants failed to sustain
the burden of proof as to the need for change of zone, or that the present
zone is erroneous or that circumstances warrant a change of zone at
this time.

tary to the surrounding area.
3. Investigation shows that the inhabitants of the immediate
vicinity of the area sought to be rezoned are unanimously opposed to
the change of zone.
4. That each of the preceding findings in and of themselves, and
independent of each other, constitutes a separate and individual ground
for denial of the change of zone.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of
Weld has heard the application of Nelson, Haley, Patterson and Quirk,
Weld County, Colorado, for change of zone from "R" Residential District
to "H" High Density Unit Development of said parcel of land as hereinabove
recited and made a part hereof by reference, and
WHEREAS, said Board has made its findings on the evidence and
testimony submitted to it, which findings precede this Resolution and by
reference are incorporated herein and made a part hereof, and
WHEREAS, said Board has carefully considered the petition,
evidence and testimony and the recommendations of the Weld County
Planning Commission, and has made an investigation of the area, and
given the same such weight as it in its discretion deems proper, and
is now fully advised in the premises;
NOW, THEREFORE, BE IT RESOLVED, that the petition of

Commissioners of Weld County an application for a County Retail License for the sale

WHEREAS, the said applicant having paid to the County Treasurer of
Weld County the sum of fifty dollars ($50.00) therefore, and having produced a
State License for the sale of 3,2% beer only, outside the corporate limits of any
town or city in the County of Weld at the location described as follows:

P. M. , Weld County. Colorado a/k/a No of 168th Avenue at I-80
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners
having examined the said application and the other qualifications of the applicant
do hereby grant License Number 72-17 to said applicant to sell 3.2% beer only at
retail at said place, and do hereby authorize and direct the issuance of said license
by the Chairman of the Board, attested by the County Clerk and Recorder of Weld
County, good for one year from the date of issue unless revoked, according to law,
provided, however, that said license shall be issued upon the express condition
and agreement that the place where licensee is authorized to sell beer under said
license will be conducted in strict conformity to all laws of the State of Colorado,
and rules and regulations relating thereto heretofore passed by the Board of County
Commissioners of Weld County, Colorado, and any violation thereof shall be cause
for revocation of the license.

The minutes of the lid instant were read, and there being no corrections
or objections thereto, same were ordered approved.
The following resolution was presented:
RESOLUTION
WHEREAS, the people of Weld County, State of Colorado, are
saddened by the death of Rex C. Eaton Jr. , and
WHEREAS, Mr. Eaton was a man of great courage and honor,
and
WHEREAS, Rex C. Eaton Jr. had gained the love, respect and
admiration of the people of Weld County through his great devotion to his
many endeavors, one of which included being a member of the Board of
Trustees of the Weld County General Hospital.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that by the death of Rex C.
N
Eaton Jr. , Weld County has lost one of its outstanding citizens and it does
hereby pay tribute to a man of great ability and high integrity, who has
well served not only Weld County but all of his fellow men, and does extend
heartfelt sympathy to the members of his family.

The following resolutions were presented:
RESOLUTION
RE: CLYDE BENNETTS vs. BOARD OF COUNTY COMMISSIONERS,
• WELD COUNTY, COLORADO,

WHEREAS, on or about June 7, 1972, Clyde Bennetts had submitted
a claim against Weld County claiming overtime pay in the sum of Four
1 Thousand Eight Hundred Twelve and 88/100ths Dollars ($4, 812. 88), and
WHEREAS, the voucher submitted was not properly sworn to or sub-
scribed to pursuant to the requirements of Weld County or the laws of the
State of Colorado, and
WHEREAS, said voucher was not properly routed through channels,
to-wit, the County Sheriff of Weld County prior to submission to the Board
of County COMMiSSioners, and
WHEREAS, there are discrepancies on the voucher form as com-
pared to the supporting information that was attached to said voucher, and
WHEREAS, the Board has attempted to verify the amount of time
spent by Bennetts but could not reconcile same with the information as sub-
mitted by Bennetts.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that for the aforesaid reasons,
the claim as submitted by Clyde Bennetts, be, and it hereby is denied.
BE IT FURTHER RESOLVED, that Glenn K. Billings, Chairman of
the Board, be, and he hereby is directed, to inform Mr. Clyde Bennetts
of the Board's action.
The above and foregoing Resolution was, on motion duly made and

evidence adduced upon said hearing, and having heard the testimony,
evidence and recommendations of the Weld County Planning Commission
filed with said Board, and having carefully weighed the same, now makes
the following findings:
1. The evidence discloses that the applicant failed to sustain
the burden of proof as to the need for change of zone, or that the present
zone is erroneous or that circumstances warrant a change of zone at this
time.
2. The evidence discloses that the present zoning is complimen-
tary to the surrounding area.
3. The evidence and investigation shows that the inhabitants of

the immediate vicinity of the area sought to be rezoned are unanimously
opposed to the change of zone.
4. The evidence further discloses that the area sought to be
rezoned does not have adequate water and sewer to serve a development
as contemplated.
5. That each of the preceding findings in and of themselves, and
independent of each other, constitutes a separate and individual ground
for denial of the change of zone,
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of
Weld has heard the application of Guy B. Akins Jr. , 2950 Pearl Street,
Boulder, Colorado, for change of zone from "A" Agricultrual District to
"MH-UD" Mobile Home Unit Development of E.a.id parcel of land as here-
inabove recited and made a part hereof by reference, and
WHEREAS, said Board has made its findings on the evidence and
testimony submitted to it, which findings precede this Resolution and by
reference are incorporated herein and made a part hereof, and
WHEREAS, said Board has carefully considered the petition, evidence
and testimony and the recommendations of the Weld County Planning
Commission, and has made an investigation of the area, and given the same
such weight as it in its discretion deems proper, and is now fully advised in
the premises;
