A regular meeting of the Weld County Planning Commission was held in the Weld County Administration
Building, Hearing Room, 1150 O Street, Greeley, Colorado. This meeting was called to order by Chair,
Elijah Hatch, at 12:36 pm.
Roll Call.

comments into the record. Mr. Hall noted that no written correspondence has been received; however,
Staff received a general inquiry phone call from a surrounding property owner. The Department of Planning
Services recommends approval of this application along with conditions of approval and development
standards.
Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site
dust control, and the Waste Handling Plan.
Valentin Gasca-Lopez, 42950 CR 18, Ft. Lupton, Colorado, stated that he purchased this property over one
(1) year ago as he needed more space for his family. He is requesting the cargo containers for personal
use.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
The Chair asked Staff if they had any changes to the Resolution. Mr. Hall recommended amending
Condition of Approval 1.E.10 to read "Show and label the approved access location, approved access width
and the appropriate turning radii on the site plan. The applicant must obtain an access permit in the
approved locations prior to receiving the building permit". He added that currently it reads that the access
permit must be obtained prior to construction; however, there is no construction occurring on site.
Motion: Amend Condition of Approval 1.E.10 as recommended by Staff, Moved by Michael Wailes,
Seconded by Butch White. Motion carried unanimously.
The Chair asked the applicant if they have read through the amended Development Standards and

Edward Audet, 16240 Casler Avenue, Ft. Lupton, Colorado, stated that he has some classic cars and would
like to store them in a barn to protect them. He would like to have them on his property to maintain and
enjoy.

Angela Snyder, Planning Services, presented Case USR22-0007, reading the recommendation and
comments into the record. Ms. Snyder stated that the applicant is requesting a 5 -megawatt solar energy
facility on just over 26 acres.
Ms. Snyder recommended removing Development Standard 22. The Department of Planning Services
recommends approval of this application along with conditions of approval and development standards.

Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site
dust control, and the Waste Handling Plan.
In response to Commissioner Wailes inquiry regarding Development Standard 22, Ms. Snyder said that
Development Standard 22 states that the Road Maintenance Agreement for this site may be reviewed on
an annual basis. She stated that they are recommending the removal of this development standard
because in this case the Road Maintenance Agreement is for construction only and once the facility is built
there is no need to review it annually.
Michelle Simms, US Solar, 100 North 6th St, Minneapolis, Minnesota, stated that they are requesting to own
and operate a 5 -megawatt solar energy facility on 26.4 acres. The solar facility will interconnect directly to
Xcel Energy's existing distribution system on the west side of County Road 23. Ms. Simms stated that this
facility will generate enough clean energy to power about 1,125 homes annually.
Ms. Simms stated that all residents with a home within 500 feet or a subdivision lot within 500 feet of this
solar facility have been consulted on options to either have landscape/screening installed or waive the
landscape/screening. She added that the majority of the landowners are preferring to go with the
landscape/screening route and locate it on their own property. She said that a few landowners have chosen
to waive the screening all together and added that there are a few landowners that are still deciding.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
Kaiden Brier, 32890 CR 23, Windsor, Colorado, questioned where the inverters will be located on the
property as they make noise. He expressed concern with the construction traffic at Highway 392 and
County Road 23 as he has witnessed several tragic accidents. Mr. Brier referred to the screening and
asked if they are able to choose the trees and further asked who is responsible for maintaining the
screening.
Ms. Simms stated that the inverters will be located in a centralized location on the property. At night when
they are not producing there is no noise; but during the day there is a slight hum. With regarding to the
traffic, Ms. Simms said that they are working with the Weld County Access Permit department and added
that they will make sure that they have a safe permitted access for the construction traffic to ensure that
there are no accidents.
Ms. Simms stated that US Solar will install Rocky Mountain Juniper Trees 10 feet on center and added that
they will be responsible for maintaining them for the first three (3) years to make sure that they are fully
established. She said that if the trees are located on landowner properties the landowners would be
responsible for managing them after the three (3) years. If the trees are installed on US Solar property,
they will maintain those threes.
The Chair asked Staff if they have any changes to the Resolution. Ms. Snyder recommended deleting
Development Standard 22.
Motion: Delete Development Standard 22 as recommended by Staff and renumber accordingly, Moved

The Chair asked the applicant if they have read through the amended Development Standards and

comments into the record. The Department of Planning Services recommends approval of this application

Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements.
Commissioner Holland was confused about the water and asked if North Weld has agreed to provide them
water. Ms. Light said that a letter submitted on April 5m from North Weld County Water refused the right if
they don't have enough water. Mr. Nader added that the applicant has been in conversations with the water
district regarding that letter and have essentially agreed to uphold that letter.
Wesley Basiliere, 13813 CR 74, Eaton, Colorado, stated that when they bought the property they had
horses and livestock and now that they don't have them they would like to plan for retirement.
Mr. Basiliere said that he talked to North Weld County Water District and explained that they would be going
over the one (1) year date and they said it won't be a problem but to come in with the deed and fee and the
water tap is there for them. Mr. Nader noted that this request is for the change of zone and not the final
platting and added that at the final plat is when the water needs to be finalized.

Maxwell Nader, Planning Services, presented Case 2MJUSR22-17-0003, reading the recommendation and
comments into the record. Mr. Nader noted that no written correspondence, emails or telephone calls have
been received from surrounding property owners. The Department of Planning Services recommends
approval of this application along with conditions of approval and development standards.
Commissioner Wailes stated that he knows the applicants but feels he can be impartial in this case. The
Planning Commission did not have any concerns with him hearing this case.
Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site
dust control, and the Waste Handling Plan.
Jeff Winter, 17215 CR 46, stated that they are proposing to add a heated shop building that they can work
on their equipment. He added that he is unsure when the tank farm will be built, however, he wished to
include it in the request so that they will have the opportunity to install them if they decide to. Mr. Winter
said that they are going to relocate the drainage pond and fencing. He added that the hours of operation
for the RV facility is 24/7 and would like to keep the business hours on the same timeline and operate 24/7.
Mr. Winter stated that on certain weekends there is a lot of traffic for the boating and RV, but otherwise
there is not a lot of traffic.
Commissioner Holland asked the applicant to identify the location of the detention pond. Mr. Winter
identified on the visual map where the detention map will be relocated to. Melissa King, Development
Review, said that the existing detention pond that was permitted under the original USR permit will be going
away and a new detention pond to the east side of the property will be installed. She added that Staff has
not reviewed a report yet of all the specifics but it is included in the condition of approval that the final
drainage report be submitted by a professional engineer. Mr. Holland said he is concerned as it seems like
it is going the wrong direction relative to gravity and also expressed concern with what comes out of the
pond. Ms. King said that they also review water quality while they are reviewing the detention pond.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
Tim Wojahn, 21775 CR 35.5, LaSalle, Colorado, stated that he is concerned with roads in that area. He
submitted photographs of County Road 35.5 for the record. He noted that last year the county put road
base down on County Road 35.5 and it is like a clay black muck. He added that when it rains heavy
between County Roads 46 and 35.5 it fills up with water as there is no drainage. He expressed concern
with the new road construction with the closing of County Road 46 and the Peckham area redeveloped he
said it will be a mess and something needs to be done with the roads. Commissioner Cope asked Mr.
Wojahn to bring these concerns up at the County Commissioner hearing so that they are aware of these
issues. Mr. Wojahn said that with the closing on County Road 46 the traffic will increase and is his biggest
concern.
Doug Prince, 22357 CR 37, stated that his concerns are mainly with the traffic and the crossing on County
Road 46 that will close over the railroad traffic. He added that supposedly there is to be a secondary rail
line that is proposed to be installed in the future and is a trade off with the State. He said if that happens
there will no longer be a connection between County Roads 46 and 35 and asked if those roads would
terminate at that point. Mr. Prince said that there is a high-pressure gas line that runs through the storage
facility and also three (3) well heads on the northeast corner and asked if that is a concern with the fertilizer
facility.
Tom Potter, 17511 CR 46, lives to the east of this property. He expressed concern over the additional
cargo containers and suggested building a larger structure to store items in the building so there are less
cargo containers. He stated that there is an existing cargo container in the front of the building currently
and he added that he hasn't seen a building permit for that cargo container. Mr. Potter stated that he has
observed RV repair work on their lot and believes it is a violation of their permit. He added that he is
concerned with discharging onto neighboring property for stormwater and increased traffic based on more
business in the area.
Mr. Winter said he understands that County Road 46 and the interchange with County Road 35 is not going
to change. He added that they will close the crossing over the tracks to Highway 85. With the new

overpass on County Road 44 the bulk of traffic will remain on County Road 35 and he added that they
project that 80 percent of the traffic will go that way. He said that he has a handful of clients that farm to
the east of him and they do come down County Road 46.
With regard to concerns with County Road 35.5, it has been a concern for some time. He added that there
is no borrow pit and the road is below all of the irrigation ditches and it is a mess when it rains. He said
that with asphalt being on County Road 35 they project 99.9 percent traffic will be on County Road 35 to
stay off of the gravel road. .
Mr. Winter referred to the gas wells and understands that they are to be closed in but doesn't have a time
frame of when that will happen. He added that the wells are not active. Mr. Winter further added that liquid
fertilizer does not have a huge flammable point and the tanks will be self-contained inside a containment
area that will control itself and will not get into any of the groundwater.
Mr. Winter referred to the high-pressure gas line and said that it is located on the property line and not
under any buildings.
Mr. Winter referred to the cargo container and said that he understands that he is allowed up to two (2)
storage containers on site. He added that they are proposing up to six (6) cargo containers to separate
items such as propane, fuel, etc. away from the seed warehouse. He said that they can move the containers
onto the north side where the building can act as a natural screen if it is a visual concern.
Mr. Winter said that he is not aware that there has been any maintenance on RVs. He said that he is aware
of winterizing of the RVs, but maintenance is not allowed.
Commissioner Cope asked what the natural slope of the property is. Mr. Winter said that it was a flood
irrigated farm and added that there is a very slight slope west to east when they irrigated. Mr. Cope referred
to pumping water from the detention pond and stated that State Law basically says that you are required
to discharge in its natural location. He said that he is a little concerned that if you are pumping out of the
detention pond if that is really following the natural direction. Mr. Winter said that with relocating that pond
there is a chance that they won't have to put those pumps in and it should be able to flow as it fills. Mr.
Cope understands that it still needs to be worked out but it looks like if you are discharging right near your
property line and it could have an impact on the neighboring property. Mr. Winter noted that there is a little
bit of a natural ridge there as well.
The Chair asked the applicant if they have read through the Development Standards and Conditions of
Approval and if they are in agreement with those. The applicant replied that they are in agreement.

Commissioner Cope said that during final site review he thinks the County needs to make sure that drainage
is proper and also the stormwater discharge requirement has more to do with sediment than fertilizer. He
added that it should be reviewed and considered to make sure that fertilizer is not getting into the
stormwater.
Commissioner Hatch appreciates Staff with their work on this project and agrees with Commissioner Cope's
comments regarding the water issue. He added that it is important to make sure that we have clean water
going back to our systems.

Kim Ogle, Planning Services, presented Case USR22-0002, reading the recommendation and comments
into the record. Mr. Ogle noted that this case was processed under a USR for a Major Facility of a Public
Utility under Section 23-2-300 which states that approval is required by the Planning Commission only.
Mr. Ogle recommended removal of Condition of Approval 1.B since County Road 13 is a Larimer County
maintained road, therefore, a Weld County Road Maintenance Agreement is not necessary. Additionally,
Mr. Ogle recommended removal of Condition of Approval 1.C as Staff has received a memorandum and
associated documents for the Decommissioning Plan. The Department of Planning Services recommends
approval of this application along with conditions of approval and development standards.

Dillon Cowing, 300 Plaza Drive, Highland Ranch, Colorado, stated that he is representing North Weld
County Water District. Mr. Cowing stated that this project started in early 2019 as the District had performed
a dive inspection on their tank and noticed that this existing tank, which was built in the 1960s, needs some
rehab. He added that for that to be done the tank needs to be taken out of service for four (4) weeks and
this new tank would allow rehab for the older tank. He further added that it would also provide additional
storage for future growth.

Kim Ogle, Planning Services, presented Case USR22-0006, reading the recommendation and comments
into the record. The Department of Planning Services recommends approval of this application along with
conditions of approval and development standards.
Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site
dust control, and the Waste Handling Plan.
Angela Knopf -Castle, 35093 CR 25, Eaton, Colorado, stated that she has been in athletics for the past 15
years and has started a mentorship program as teacher and coach to help individuals athletically as well
as to help them grow as people. Ms. Knopf -Castle said that she does a lot of training with volleyball using
perseverance, communication, and teamwork strategies. She added that they have an incredible space
for running these programs and the community can also use this space to run their recreation programs.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.

The Chair asked the applicant if they have read through the Development Standards and Conditions of
Approval and if they are in agreement with those. The applicant replied that they are in agreement.

Maxwell Nader, Planning Services, presented Case COZ22-0004, reading the recommendation and
comments into the record. The Department of Planning Services recommends approval of this application
along with conditions of approval.

Jorge Valdez, 11402 CR 46, Ft. Lupton, Colorado, submitted a folder of their business into the record. Mr.
Valdez stated that they started a trucking business with one (1) driver and has grown to 17 employees. He
stated that they will comply with all of the criteria and are happy to be in the county and productive.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
Kenny Perez, 11519 Frederick Street, Ft. Lupton, Colorado, stated that he has spoken with the applicants
multiple times as he lives adjacent to the docks of the warehouse. Mr. Perez said that in their conversations
with the applicants they mentioned installing a barrier wall between the properties for noise mitigation and
questioned if that will be done. He added that the applicants have been very good about keeping their
trucks on the west side of the building for noise mitigation. Mr. Perez expressed concern regarding dust
mitigation and that he doesn't know the limits of the trucks in and out of the facility.

Daniela Perez, 11519 Frederick Street, Ft. Lupton, Colorado, stated that these applications present that
they are primarily agricultural with some gravel hauling. She is concerned that it is growing into a big
trucking business.
Commissioner Cope said that this is a change of zone application so the Planning Commission doesn't get
into all the specifics of site development such as screening and dust mitigation. He added that the site
specific plan will be reviewed through Staff and will have no public hearings. Mr. Cope expressed
appreciation for their comments.
Mr. Valdez said that they are looking to install recycled asphalt to prevent any dust issues. He added that
they will honor what they told the neighbors. Mr. Valdez said that they will install trees or have a fence or
block wall installed for the neighbors.
The Chair asked if the gravel trucks will be the primary source of business. Mr. Valdez said that they will
mainly be agricultural but will have some gravel trucks leave the site in the morning and come back at the
end of the day.
The Chair asked the applicant if they have read through the Conditions of Approval and if they are in
agreement with those. The applicant replied that they are in agreement.
Motion: Forward Case COZ22-0004 to the Board of County Commissioners along with the Conditions of
Approval with the Planning Commission's recommendation of approval, Moved by Skip Holland,
Seconded by Butch White.
