RE: ESTABLISHMENT OF PROCEDURES AND PROTOCOLS FOR EMERGENCY
PURCHASES BY WELD COUNTY DEPARTMENT OF FLEET SERVICES OF NEW
VEHICLES DEEMED NECESSARY FOR THE PROTECTION OF LIFE, HEALTH,
AND/OR SAFETY ("NEW LHS VEHICLES")
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, David Springer, Director of the Weld County Department of Fleet Services,
has reported to the Board that new vehicles deemed necessary for the protection of life, health,
and/or safety are in extremely short supply because of supply -chain deficiencies being
experienced by manufacturers, and
WHEREAS, "new vehicles which are deemed necessary for the protection of life, health,
and/or safety" ("New LHS Vehicles") include, without limitation, Weld County Sheriff's Office
vehicles, vehicles used by Public Works to access parts of the County in all kinds of weather and
in places normal road vehicles do not go, and vehicles used by the Coroner's Office for transports
and investigations, and
WHEREAS, several industry and business journals and websites report that such supply
chain shortages will last to and until "mid -2023," including the following:

WHEREAS, as a result of the short supply of parts and equipment for the manufacture of
vehicles, the availability of New LHS Vehicles is severely limited, and delays caused by the
County's normal procurement process set forth in Article 4, Chapter 5 of the Weld County Code,
exacerbate such non -availability, and
WHEREAS, on November 21, 2022, the Board approved, by Emergency Ordinance, the
addition of Section 5-4-80 A.27.d. to the Weld County Code, reading as follows:
Sec. 5-4-80. Expenditures not requiring a procurement process.
A. It has been determined that it is in the best interests of the County to exempt certain
purchases of goods or services from the requirements of this code. The following is a list of

the expenses which will be processed for payment in the Department of Accounting without
a requisition and purchase order:
27. Emergency purchases when:
d. Purchases of new vehicles deemed necessary for the protection of life, health,
and/or safety during supply chain deficiencies to ensure availability at the most
efficient price. The Board of County Commissioners shall by resolution detail
procedure and protocol for such emergency purchases of new vehicles that
establishes a sunset date which may be extended by subsequent resolution of the
Board.
WHEREAS, to ensure availability of New LHS Vehicles, Director Springer recommends
that the Board approve this Resolution to authorize Fleet Services to purchase New LHS Vehicles
according to the Procedures and Protocols set forth in the attached Exhibit "A," and
WHEREAS, such authorization shall be effective through June 30, 2023, and may be
reauthorized by Resolution of the Board if such emergency supply -chain deficiencies persist.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that, pursuant to Section 5-4-80 A.27.d. of the Weld County Code, David
Springer, Director of the Department of Fleet Services, be, and hereby is, authorized to purchase
New LHS Vehicles by and through the Procedures and Protocols set forth in Exhibit "A."
BE IT FURTURE RESOLVED by the Board that this authorization shall end on June 30,
2023, but may be extended by Resolution of the Board, if deemed necessary.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 21st day of November, A.D., 2022.

Procedures and Protocols for Emergency Purchases by Weld County Fleet Services of
Vehicles Deemed Necessary for the Protection of Life, Health, and/or Safety
The Fleet Services Director shall
1 Determine the need and specifications of new vehicles deemed necessary for the
protection of life, health, and/or safety ("New LHS Vehicles")
2 Contact vendors that have provided bids for new vehicles to Weld County in the past two
years to determine their supply and availability of New LHS Vehicles meeting the
specifications
3 Choose the New LHS Vehicles that provide immediate availability, meet specifications,
and achieve best price
4 Provide a listing of the New LHS Vehicles recommended for purchase to the Clerk to the
Board for inclusion on the Board of County Commissioner's Consent Agenda for
approval
