OUTDOOR STORAGE YARDS FOR OIL AND GAS VEHICLES AND EQUIPMENT IN
THE A (AGRICULTURAL) ZONE DISTRICT - CORY AND TRACI KNOTE,
C/O DIAMOND T SERVICES, INC.
A public hearing was conducted on August 17, 2022, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated July 14, 2022, and duly published July 16,
2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Cory and
Traci Knote, c/o Diamond T Services, Inc., for a Site Specific Development Plan and Use by
Special Review Permit, USR22-0012, for Oil and Gas Support and Service including Outdoor
Storage Yards for Oil and Gas Vehicles and Equipment in the A (Agricultural) Zone District.
Karin McDougal, Assistant County Attorney, made this a matter of record.
=! Chris Gathman, Department of Planning Services, presented a brief summary of the proposal
and the services provided, explained the laydown yard will encompass approximately five (5)
acres of the site, roll out dumpsters will be utilized, as needed, there are no set operating hours,
and traffic access is intermittent and is estimated at two (2) round trips per day for a pickup truck
and semi -truck. He relayed the application was submitted in response to an active zoning
violation, ZCV20-00212, for operating an Oil and Gas Support and Service Facility without
appropriate Land Use and Zoning permits. Mr. Gathman stated if this application is denied, the
Zoning violation case will proceed with the County Court process. Mr. Gathman displayed images
of the site, pointed out the depiction of the access location off of County Road (CR) 23, and stating
the laydown yard is not visually prominent. He described the surrounding Uses, explain the site
is located within the Coordinated Planning Agreement area of the City of Fort Lupton and the
Town of Firestone. The City of Fort Lupton and the Town of Firestone were notified of the request,
the City of Fort Lupton responded on January 15, 2021, and stated the applicant is not interested
in annexation and they would respond during the referral process. He shared the Town of
Firestone responded on November 10, 2020, and indicated they are not interested in annexation.

Mr. Gathman entered the favorable recommendation of the Planning Commission into the record
as written and displayed photos of the site.
Lauren Light, Department of Public Health and Environment, stated the existing residence is
served by a domestic well and a septic system permitted for three (3) bedrooms. She stated the
application indicated no restrooms are provided; however, employees retrieving or delivering
equipment should have access to restrooms; therefore, a screened portable toilet is acceptable
for employees or contractors onsite for less than two (2) consecutive hours a day, in accordance
with EH Policy, which is included in the Development Standards (DS). Lastly, she stated and
typical dust and waste standards are also included, and DS #14 - #19 address Environmental
Health items.
Mr. Gathman relayed the Development Review comments, concerning access to the site from
CR 23, which is a paved, collector road, averaging 2,734 vehicle trips per day, with 33% being
trucks, and the 85th percentile speed is 61 mph. He stated the application materials indicate there
will be up to two (2) pickup and semi -truck round trips per day, with 100% of the traffic coming
from the south on CR 23, and since there is limited traffic generated by the project, no tracking
control or road maintenance agreement is required. Mr. Gathman shared the applicant has
submitted a Drainage Report, which was reviewed and accepted by Development Review;
however, a Final Drainage Report and Certification of Compliance, signed and stamped by a
Professional Engineer, registered in the state of Colorado, with a cover sheet referencing the USR
land use case number, is required, and since more than one (1) acre of land will be disturbed, a
Grading Permit is required.
Cory Knote, applicant, was present and had no comments.
No public testimony was offered concerning this matter.
In response to Chair James, Mr. Knote indicated they had reviewed the Conditions of
Approval and Development Standards as presented, and had no concerns.
The Board discussed COA #F.7 (Detention Pond), and Mr. Gathman, confirmed a detention
pond will be required. Mike McRoberts, Development Review, shared a Retention Pond is
required as there was no suitable outfall for a Detention Pond and the applicant did not qualify for
a Stormwater Detention exemption.
In response to Chair James, Mr. Knote indicated they have reviewed, and agreed to abide
by, the Conditions of Approval and Development Standards, as presented.
'` Commissioner Moreno moved to approve the request of Cory and Traci Knote,
do Diamond T Services, Inc., for a Site Specific Development Plan and Use by Special Review
Permit, USR22-0012, for Oil and Gas Support and Service including Outdoor Storage Yards for
Oil and Gas Vehicles and Equipment in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval

and Development Standards, as presented. The motion was seconded by Commissioner Saine,
and it carried unanimously. There being no further discussion, the hearing was completed at
11:02 a.m.
This Certification was approved on the 31st day of August, 2022.
