James, Chair — EXCUSED Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick County Attorney, Bruce Barker Department of Planning Services representative, Michael Hall The following business was transacted: I hereby certify that pursuant to a notice dated March 8, 2022, and duly published March 11, 2022, in the Greeley Tribune, a public hearing was conducted on April 20, 2022, to consider the request of REI, LLC, dba Investors, LLC, and Beebe Draw Farms Authority, Second Amended Planned Unit Development Change of Zone, PUDZ22-0001, of Beebe Draw Farms and Equestrian Center PUD (AMZ-412) for E (Estate), C-1 (Neighborhood Commercial), C-2 (General Commercial), C-3 (Business Commercial), 1-2 (Medium Industrial) and A (Agricultural) Zone District uses, including generally defined open space, recreational uses, community services, and oil and gas production facilities. Bruce Barker, County Attorney, made this a matter of record. On April 20, 2022, the Board heard all of the testimony and statements of those present, and being fully informed, continued the hearing until October 19, 2022, to allow the case to be heard by the Planning Commission on October 4, 2022. = Michael Hall, Department of Planning Services, relayed the applicant has requested withdrawal of the application, due to their desire to proceed with their previously approved Filing 2 plat process. Commissioner Moreno moved to accept the request of REI, LLC, dba Investors, LLC, and Beebe Draw Farms Authority, to withdraw the application for Second Amended Planned Unit Development Change of Zone, PUDZ22-0001, of Beebe Draw Farms and Equestrian Center PUD (AMZ-412) for E (Estate), C-1 (Neighborhood Commercial), C-2 (General Commercial), C-3 cc .pL(TP/NN/Hfl) it/(o/22 2022-2829 PL0003 HEARING CERTIFICATION - REI, LLC, DBA INVESTORS, LLC, AND BEEBE DRAW FARMS AUTHORITY (PUDZ22-0001) PAGE 2 (Business Commercial), 1-2 (Medium Industrial) and A (Agricultural) Zone District uses, including generally defined open space, recreational uses, community services, and oil and gas production facilities, and dismiss the matter. The motion was seconded by Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing was completed at 10:02 a.m. This Certification was approved on the 7th day of November, 2022.
