Our proposal seeks the approval to operate a seasonal "agrikanment" business on the current apple farm. The business will offer: a. U -Pick fruit - Seasonal (mid -August through October) U -Pick apples, pears and plums. b. Sponsor Educational seminars: school groups, church groups, ag groups... c. Special event venue: Host family reunions, weddings, birthday parties, meetings. Provide catered food, alcoholic beverages, d. Foodservice truck/trailer: offer on -site food/beverage service during season. e. Country Store: seasonal store to support picking operation and sell goods. Potentially sell alcoholic beverages and prepared food. The business name(s) will be: Adam's Apple Inc. and Adam's Apple Country Store, LLC. 2. Explain the need for the p roposed use. The need for the prosed use is to allow us to grow our business from a commodity fruit farm to an agriculture education/entertainment or "agritainment" experience for the region. To include: U -Pick apples, a country retail store, educational opportunities and a unique agricultural space for events — such as weddings, family reunions, meetings... 3. Describe the current and previous use of the land. The property is currently an apple, pear and plum farm consisting of 1800+ fruit trees representing over 150 varieties of apples, pears and plums on 15.2 acres of ground. To the best of my knowledge the previous use was irrigated crop land. 4. Describe the proximity of the proposed use to residences. Please see Map Exhibit A. There are four residences on WCR43 to the east of the property, north of VCR 86. There are two residences on the same quarter south of the property west of WCR 43 on WCR 86. S. Describe the surrounding land uses of the site and how► the proposed use is compatible with them. The surrounding land use is mixed. Active irrigated crop land to the north and west. Directly to the south is a 16 acre "mixed use" property with a residence/ animal barn, chickens, ducks, bees and dry pasture land. The properties to the east are also mixed u se - comprised of residences and agriculture/industrial use. The proposed use is compatible with our neighbors as we are proposing an agritainment business that will draw only passenger vehicles for a limited seasonal period that will not: modifying the existing terrain, add additional odors, add additional light pollution or create nuisance n oise. 6. Describe the hours and days of operation. We anticipate the business will operate with three components with the following seasonal operating days and hours: a. U -Pick Fruit: i. The orchard currently requires two FTE's to operate and maintain it. The proposed business would require keeping two ETE's, potentially adding a third FTE and hiring part- time, seasonal employees to support the picking operation, retail store and hosting events. In full season we anticipate needing 2-3 FTE's and 5 part time employees e quivalent to 1 FTE or+1- 2,000 annual labor hours. 8. Describe the maximum number of users, patrons, members, buyers or other visitors that the site will accommodate at any one time. With 5 or fewer employees, and very limited deliveries and use of contractors..., the majority of the people on -site will be customers or those attending an event. We anticipate the wedding/event attendees to be approximately 150 people, which we expect will be the largest visitor count at any one time. 9. List the types and maximum numbers of animals to be on the site at any one time. None - Not applicable to our proposal 10. List the types and number of operating and processing equipment. Operating equipment is limited to a small farm tractor and utility vehicle (ganger) There is no processing equipment required to operate the business. 11. List the types, number and uses of the existing and proposed structures. There are currently two structures on the site and one proposed for future build. Structure 1: Existing 30' X 481 pole barn on west end of site — used to store farm support equipment (tractor, sprayer, tools...) No employee or public access. Utilities — electric. Structure 2: Existing 24' X 32' pole barn with covered porch on east end of site — proposed for use as the Country Store. Currently has non-ADA public bathroom. Utilities — electric, water, septic. The existing landscaping is the land scape of the orchard. No additional landscaping is needed or proposed. 19. We do not believe the proposed use will alter the site in a way that reclamation of any kind will be required. 20. Describe the proposed fire protection measures. We will follow all recommendations made by the appropriate local fire authority. The vast majority of the activity by patrons will be outdoors.. The only proposed public access building in the proposal is Structure #2 which has/will meet all requirements for fire safety and protection. 21. Explain how this proposal is consistent with the Weld County Comprehensive Plan ("The Plan„) per chapter 22 of the Weld County Code. The proposal is consistent with The Plan's guiding principles. The proposal supports and helps achieve The Plan's land use, economic development, environmental and natural resource goals and objectives while bringing recreation and tourism. Specifically, the proposal: a. Incorporates the principles of The Plan by welcoming the public to experience one of the regions agricultural components and enhance the health and general welfare of the citizens of Weld County — Nothing like an afternoon outside picking apples! b. Promotes agricultural production, respects agricultural practices regarding water resources, and is in harmony with surrounding land uses. c. Supports economic development by increasing exposure of the regions agritainment and by indirectly supporting local businesses. d. Respects and promotes The Plan's environmental and natural resource objectives by using water conservation strategies and responsibly nurturing an orchard of 1,800+ trees in an area where orchards are scarce and trees are rare. e. Offers a great outdoor, recreational, educational and fun experience available to all citizens of Weld County and beyond. Bringing apple enthusiasts from across the state to see the wonder of Weld County is the right kind of tourism. 22. Explain how this proposal is consistent with the intent of the zone district in which it is located. The property is in Zone District A (Agriculture), The proposal is consistent with the intent of the zone district as it maintains and promotes agriculture as an essential feature of the County. The proposal fulfills the intent by making agriculture and ag related activities accessible to the general public while promoting the value and diversity of the County's agricultural landscape. The event experience will give others a unique opportunity to celebrate among the trees and develop a new appreciation and respect for farming and food production. 23. Explain how this proposal will be compatible with future development of the surrounding area or adopted master plans of affected municipalities. To our knowledge there are no future development plans or adopted master plans that impact the property or would negatively impact the compatibility of the proposal. 24. Explain how this proposal impacts the protection of the health, safety and welfare of the inhabitants of the neighborhood and the County. The proposal does not negatively impact the health, safety and welfare of the neighborhood or County. The proposal does not create notable, waste, noise, odor or traffic congestion. Our ability to grow and maintain the orchard in the high desert, making fresh fruit (and the picking experience) available to the public and encouraging outdoor activity will promote the protection of the health, safety and welfare of our neighbors and the greater community. 25. Describe any irrigation features. If the proposal use is to be located in the A (Agricultural) Zone District, explain your efforts to conserve prime agricultural land in the locational decision for proposed use. The proposal does not include any irrigation features. The orchard is currently being irrigated by an efficient drip system - directing water directly to the root system of the tree. Prime agricultural land is currently planted with fruit trees. The proposal does not require removing any land currently being used to grow trees. 26. Explain how this proposal complies with Article V and Article Xl of Chapter 23 if the proposal is located within any Overlay Zoning District or a Special Flood Hazard Area identified by maps officially adopted by the County. To our knowledge the proposal is not located within any Overlay Zoning District or a Special Flood Hazard Area. 27. Detail known State or Federal permits required for your proposal use(s) and the status of each permit. To our knowledge there are no State or Federal permits required for our proposed use. Including the approximate distance each access is from an intersecting county road. The current access location, to be used primarily for passenger vehicles of patrons, is on the east border of the parcel directly accessing WCR 43 - approximately 700 feet north of WCR 86. The proposed business will require fewer than 5 commercial deliveries per year. There is no additional access proposed. 2. Describe any anticipated changes to an existing access. We do not anticipate any changes to the existing access notwithstanding changes, if any, required by The Code. 3. Describe in detail any existing or proposed access gate including its location. There are currently two access gates on the parcel. The first is at the access entrance identified in #1 above directly accessing WCR 43. The manual gate will remain open during proposed business hours. The second access gate is on the south side of the parcel accessing the neighboring parcel's pasture land to the south. The gate is approximately 500' west of WCR 43 and approximately 500' north (across the neighboring parcel) of WCR 86. There is no road/public access to this gate. Describe the location of all existing accesses on adjacent parcels and on parcels located on the opposite side of the road, include approximate distance each access is from an intersecting county road. Beside our existing access, there is one adjacent access on the west side of WCR north of WCR 86 . That access appears to be ag access to a field. It is 1,400 feet north of WCR 86 on WCR 43 approximately 700' north of our existing access. There are 4 existing accesses on the opposite, or east, side of WCR 43. They are approximately 400', 900', 1400' and 2300' north of WCR 86 on WCR 43 respectively. 5. Describe any difficulties seeing oncoming traffic from an existing access and any anticipated difficulties seeing oncoming traffic from a proposed access. We do not believe there are any difficulties seeing oncoming traffic from the existing access. The flat terrain allows a very clear and distant line of site to oncoming traffic from both the north and south, No additional access is being proposed. 6. Describe any horizontal curve in the vicinity of an existing or proposed access. There are no curves in the vicinity of the existing access. No additional access is being proposed 7. Describe the topography of the road in the vicinity of an existing or proposed access. The topography of the road, and roads, in the vicinity of the existing access is flat. Discuss the existing and proposed potable water source. The existing potable water source is two North Weld County Water District taps (##3959) - currently providing 70% of 2,000 Acre Feet (456,000 gallons) of potable water per year. We do not anticipate needing additional water to operate the proposed business. 2. Discuss the existing and proposed sewage disposal system. What type of sewage disposal system is an the property. The existing sewage disposal system is a septic system installed in 2012. SP -1200151 Finaled 3/16/2022 which we understand is sized for two people. We will provide portable restroom(s) (including one ADA compliant) in addition to the existing indoor restroom and indoor hand washing stations during events and seasonal hours of operation. During non -business hours there are two employees working the orchard. 3. If storage or warehousing is proposed, what type of items will be stored? The proposal does not require storage or warehousing. 4. Describe where and how storage and/or stockpiles of wastes, chemicals, and/or petroleum will occur on this site. The proposal and operation do not, and will not, require storage or a need to stockpile waste, chemicals or petroleum on -site, S. If there will be fuel storage on site, indicate the gallons and the secondary containment. State the number of tanks and gallons per tank. There w totaling 4 be limited fuel stored on site. Describe any existing and proposed improvements to the property. The existing improvements to the property include: a. 2,000 fruit trees planted in 2012 & 2013 b. 2 steel buildings: 30'X48' and 24'X32' c. Concrete slabs/aprons totaling 940sq. ft. d. Gravel/dirt road through property e. 8' Game fence around perimeter f. Water and electricity to property There are no additional proposed improvements to the property other than planning an additional building on the property sometime in 2023 or 2024 pending business needs, permitting and economic factors. 2. Describe the exception being requested for consideration. We believe exception #8 of The Code - "Development of sites where the change of use does not increase the imperviousness of the site," is applicable to our proposal. Our proposal does not change the imperviousness of the site. The proposed business requires us to maintain more than 1,800 mature fruit trees on the property— all of which exist today and all of which improve the imperviousness of the site. 3. Describe where the water originates if it flows onto the property from an off -site source. No water flows onto the property from an off -site source. 4. Describe where the water flows as it leaves the property. There is no water flow leaving the property unless of a significant rain event— in that case the water flows into the WCR 43 ditch on the east end of the property. All irrigation done in the orchard is a drip system at the base of tree preventing any run-off or misdirected water. 5. Describe the direction of flow across the property. The direction of flow across the property is East/South East. 6. Describe previous drainage problems with the property. We are not aware of any previous drainage problems with the property. 7. Describe the location of any irrigation facilities adjacent to or near the property. The only irrigation feature we are aware of near the property is an irrigation ditch on the East side of WCR 43 — across the road from the east side of the property. 8. WELD COUNTY USR SOUND NARRATIVE June, 2022 Adam's Apple, Inc., a Colorado Corporation 42135 County Road 43, Ault, Co. 80610 Sound Narrative The following narrative is to determine the sound impact of a special event venue related to our USR request. The data collected demonstrates the sound impact of the venue will be within The County Code db(A) limits and further provides a monitoring plan to insure compliance during events. There are four residences potentially impacted by noise generated from the events. Two directly to the east of the property on WCR 43 (Map Exhibit #'s 1&2) and two on the south side of the property (Map Exhibit #'s 3&4) all of the current homes are more than 500 feet from the source of the sound. The land to the north and west of the property is irrigated farmland. The sound tests were taken with the source outside of the existing east building (Map Exhibit # 5) that will host any music/sound generation. The sound source will be facing northwest from the west side of the same building. With the sound source in excess of 110db(A) all sample readings were below 50db(A) at the eastern and southern perimeter of the property. The reading from the north perimeter was negligible (36.8) as the sound source is in excess of 1,000 feet from the western perimeter of the property. The property is covered with +1- 2,000 fruit trees, the emanating sound is buffered by the trees in all directions with the exception of due north following the dirt road. Based on the data gathered in various wind conditions, in the evening, from multiple points on the perimeter of the property we can insure the sound generated will be within the limits established by The Code. We will incorporate a monitoring plan on evenings when events occur to insure sound levels are within The County Code and are not a nuisance to our neighbors. We have purchased two sound level meters that will be used to monitor sound levels at the perimeter of the property plus 25 feet during events that include music. Describe now many roundtrips/day are expected for each vehicle type: All vehicles entering the site will be passenger vehicles with few exceptions for deliveries (4-6 per year) and garbage removal (bi-monthly in season) As a seasonal business, the roundtrip count will vary from 1-2 per day from December through May and increase during the season — June -November. In season, we anticipate the roundtrip maximum to occur during events and total 50 vehicles — primarily on weekends. 2. Describe the expected travel routes or haul routes for site traffic. Although somewhat hard to predict, there are four anticipated travel routes for traffic arriving to the site. The first has traffic arriving from origins north — Pierce, Nunn, Wyoming... most likely to arrive off of east bound WCR 90- then head south on WCR 43. The second, traffic arriving from the west —traveling west on Hwy 14— heading north on WCR 43. The third, traffic from the south — Eaton, Greeley... either directly north on WCR 43 or north on Hwy 85 into Ault then east on Hwy 14 to WCR 43 north. The fourth, traffic from the west — Windsor, Ft Collins... traveling east on Hwy 14 through Ault to north on WCR 43. On -site traffic flow: As traffic enters the site off of WCR 43 they head north on the gravel road and veer right at the intersection of Building 1- one-way until exiting traffic is rejoined. Handicapped parking spaces will be available at the store site — all other traffic will be directed to continue north on the gravel road to the designated parking area in the southwest corner of the site. Exiting traffic will travel south out of the parking lot on the gravel road and veer right at Building 1 —one-way traffic until entering traffic is rejoined. Traffic will continue south to exit on WCR 43. 3. Describe the travel distribution along the routes. We anticipate the travel distribution to be: Route 1— 30% North (traveling south on WCR 43 via WCR 90 to site entrance) Route 2 — 5% East (traveling north on WCR 43 via Hwy 14 to site entrance) Route 3 - 30% South (traveling north on WCR 43 to site entrance) Route 4 — 35% West (traveling north on WCR 43 via WCR 86 and Hwy 14 to site entrance) 4. Describe the time of day that you expect the highest traffic volumes.
