The provision of water service by extension of existing water Tines of the District to the above property and the installation of taps for lots is done under the terms of the Rules and Regulations of the District established by the Board of the District from time to time. You may obtain acopy of the Rules and Regulations from the District. This letter outlines the provisions of the Rules and Regulations; however, this letter does not change any provisions of the Rules and Regulations. The Board of the District may alter and amend the Rules and Regulations at any time, and the provisions of this letter are subject to alteration and amendment based on changes in the Rules and Regulations of the District. We currently own and operate a 12 -inch diameter waterline along WCR 15. We also own and operate a 6 -inch diameter waterline along Weld County Road 56 (WCR 56), that also traverses the subject property. The District can commit to provide service to the requested three 5/8 -inch non-residential taps, subject to the following additional limitations on the provision of water service: 1) All improvements to District facilities required to provide service will be the financial responsibility of the developer in accordance with the District Rules and Regulations. All improvements must conform to District Specifications. 2) The proposed lot along WCR 56 should be sewed from the existing 6 -inch diameter waterline along WCR 56. The remaining two proposed lots should be served from the existing 12 -inch diameter waterline along WCR 15. 3) As a result of the proposed southern lot and the existing railroad rights of way, the future tap and meter pit will not be located on the property which it is proposed to serve. As such, it will be necessary for you to create an easement exclusive to the District surrounding the future meter pit and service line from the meter pit to the east property boundary parcel 095719400002, which is the adjacent southern property. This exclusive easement must be a minimum of 10 feet in width and centered on the future meter pit and service to the mainl ine. See attached map showing a graphical representation of approximate tap and meter pit locations and the required easement. 4) It is also required that you create a utility easement of similar geometry for the future service line west of the future meter pit to the proposed southern lot. This utility easement will allow maintenance of the future service line downstream of the meter which is the responsibility of the homeowner. 5) The existing 6 -inch diameter waterline that traverses the subject property is assumed to be in easement. However, the District does nothave record of this easement. Please provide a copy of the recorded easement. If no easement exists, a new 20 -foot wide exclusive easement will be required for the portion of the 6 -inch diameter waterline that traverses the subject property. 6) Little Thompson Water District does not accept cash in lieu payments for water rights for developments, The developer will be required to provide water rights to meet the minimum projected needs of the proposed development at 0.70 acre-feet per tap, totaling to 2.10 acre-feet. Please contact the District's water resources staff, Nancy Koch, at 970-344- 6388 or Amanda Hoff, at 970-344-6304, to discuss options for water dedication for the development. 7) It should be noted that the specific water needs for the requested taps as it relates to flow rates and projected use were not identified in the request. As such, if it is determined that a larger tap is required due to flow rates and projected annual usage for the proposed lots, a new commitment letter will be required. 8) Please note that fire flow was not evaluated with this commitment request. Should fire flow be required, the applicant should contact the District for potential system upgrade requirements and fees for this provision. Please note that the annual allotment for a 5/8 -inch non-residential tap is 228,000 gallons (0.70 acre- feet). Responsible water use and conservation are of significant importance to ensuring the District has adequate water supply for all its customers. We strongly recommended that you, as the customer, strive to keep your water use to be within your annual allotment of 228,000 gallons (030 acre-feet) for the requested taps. It should also be noted that the requested 5/8 -inch non-residential taps may not be appropriately sized for the proposed heavy industrial uses of the properties. Upon development of the proposed lots, the projected water use will need to be submitted to the District for review. Based on the projected water use and the review from the District, larger taps may be required. This commitment letter will expire two years from the date of this letter if the tap has not been purchased, paid for and installed by that date of expiration. Please note that tap fees can change at any time within this two-year period. The current fee for one 5/8 -inch non-residential tap is $21,000 with installation and materials provided by the District. This fee does not include the required raw water dedication of 0.70 acre-feet per tap as noted in item 6) herein.
