Board of County Commissioners Weld County County Building Greeley, Colorado Gentlemen: This letter is written after conversation with your Mrs . Flaks this afternoon, with reference to a notice, heretofore sent our client, Mrs . Elizabeth Zadel. The reference to your file, as we understand, is Docket No. 7, and there is now proposed a hearing on February 22 , 1971. Insofar as the Notice indicates, there is a request for site approval for an aerated lagoon treatment plant, on a parcel of land not specifically described but located in the West Half of Section 19 , T2N, R67 W, 6th P .M. It is difficult for us to understand this, since Mrs . Zadel is the owner of that described area, except for a piece thereof now owned by Weld County Tri-Area Sanitation District, and used for such treatment purposes . One such installation is quite sufficient, and Mrs . Zadel objects to and formally protests hereby any zoning for any further or additional such installations . Moreover, since the Dacono District is not so far as we can ascertain an owner, it would appear that the Dacono District is making application for zoning of Mrs . Zadel 's property, which is legally quite impermissible . We therefore, on behalf of Mrs . Zadel, protest the whole of these proceedings, and ask that they be immediate- ly dismissed. We are asked to advise you that Mrs . Zadel will take every legal step ne essary to resist such a zoning, and to prevent acquisition of any of her land by the Dacono District, which has not purchased from her, owns no land as we are advised, and has taken no legal procedures to acquire such land, which procedures would be fully resisted if they had been taken. In view of this peculiar situation, we would appre- ciate advice from you as to whether you propose a hearing on February 22 .
