Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcel: 147131200097, 147131200098. The project proposes to: Change of Zone from the A (Agricultural) Zone District and the 1-3 (Heavy Industrial) to the 1-3 (Heavy Industrial) Zone District. ACCESS: Weld County Development Review has reviewed the application materials related to access. The two parcels have access onto State Highway 85 via an easement directly west of the CR 4 and State Highway 85 intersection. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways. Please contact Mr. Tim Bilobran at the Greeley office (970-350-2163) to verify the access permit or for any additional requirements that may be needed. (State Highway 85). ROADS AND RIGHT-OF-WAY: The property accesses onto State Highway 85. Contact the Colorado Department of Transportation (COOT) to determine what right-of-way shall be shown on the submitted plat. Reference the documents creating the right-of-way. Please contact Mr.Tim Bilobran at the Greeley office, phone number: 970-350-2163. The Colorado Department of Transportation (COOT) has completed a US 85 Planning and Environmental Linkages (PEL) Study. The objective of the US 85 PEL Study is to develop a strategic vision for US 85 between 1-76 and the Town of Nunn. Please review the US 85 PEL Study to ensure you are in compliance with the requirements. In addition to the US 85 PEL, there is a US Highway 85 Access Control Plan. The US 85 Access Control Plan includes the following: "CR 4 - This is a "T" intersection which is currently unsignalized. ... Properties on the west side of US 85 have access at the intersection. ... As soon as possible, this intersection will be modified to a 3/4 access (high priority). ... Property on the west side will have access from a new frontage road between CR 2 and CR 8, and east side properties will have access from CR 27. CR 4 (MP 237.06): An existing public road access on the east side of US 85. This access currently functions as a full movement, unsignalized intersection. In the interim, the intersection will be modified to a 3/4 access when improvements are made on CR 27 at all public road intersections between CR 2 and CR 8 to accommodate turns by large trucks. Ultimately, the access will be closed." TRAFFIC CDOT may request traffic information. No traffic information is needed by Development Review at this time. CONDITIONS OF APPROVAL: The plat shall be amended to delineate the following: 1. Show the Colorado Department of Transportation (CDOT) right-of-way on the plat along with the documents creating the right-of-way. (Development Review) 2. Show the approved Colorado Department of Transportation (CDOT) access point on the plat, the easements to reach this point, and label with the approved access permit number if applicable. (Development Review) 3. Show and label a 30 -foot minimum access and utility easement documenting legal access for the two parcels onto State Highway 85 at the shared access point. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. Access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. (Development Review) 3. The historical flow patterns and runoff amounts will be maintained on the site. The existing building is served by an individual well (59948-F) and a commercial on -site wastewater treatment system permitted for 10 employees (SP -0000059). We recommend the following appear as notes on the plat: 1. Water service may be obtained from an appropriately permitted well. 2. The parcel is currently not served by a municipal sanitary sewer system. Sewage disposal may be by an on -site wastewater treatment system designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division, and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Activity or use on the surface of the ground over any part of the OWTS must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. PARCEL: 147131200097 DELINEATE ON THE PLAT: 1. Show the floodplain and floodway (if applicable) boundaries on the map. Label the floodplain boundaries with the FEMA Flood Zone and FEMA Map Panel Number or appropriate study. PLAT NOTES: 1. A Flood Hazard Development Permit is required for all construction or development occurring in the floodplain or floodway as delineated on Federal Emergency Management Agency (FEMA) FIRM Community Panel Map # 08123C -2115F dated September 17, 2020 (South Platte River Floodplain). Any development shall comply with all applicable Weld County requirements, Colorado Water Conservation Board requirements as described in Rules and Regulations for Regulatory Floodplains in Colorado, and FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. The FEMA definition of development is any man-made change to improved or unimproved real estate, including by not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials. 2. FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any development activities, the owner should contact Weld County to determine if the floodplain boundaries have been modified. Hello
