This tract contains 14. 3 acres more or less, and WHEREAS, the petitioner was present and being represented by Mr. Kent Reitz, and WHEREAS, there was no opposition to the request of the peti- tioner, and WHEREAS, the said requested addition to an existing waste- water treatment facility is to be located in a agricultural zone as set forth in the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County a wastewater treatment facility or any additions thereto may be permitted upon approval of site by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner; and studied the recommendations of the Weld County Planning Commission, and WHEREAS, the said Board has carefully considered the petition, evidence, testimony, petitions and remonstances and given the same such weight as it, in its discretion, deems proper, and is now fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED, by the Board of County it/ .O._ 740282 Commissioners, that the application of Eastman Kodak, Windsor, Colorado, for site approval for an addition to an existing wastewater treatment facility on the premises indicated above, be, and it hereby it granted under the conditions following: 1. That any and all sewage treatment facilities to be in- stalled shall be approval by the State Health Department. 2. That petitioner shall proceed with due diligence to contruct said sewage treatment facility and shall have up to one year from date hereof to begin construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit " herein granted. 3. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Lupton sub-station . Installed in 1971 ; had approval of Weld County Utilities Board . At the time of installation , they were to be only temporary , but have found them to be quite useful and would like them to be permanent . Plans are to make them dual -fuel operation (the turbines ) and will operate on either natural gas or fuel . The two 21/2 million gallon fuel oil storage tanks will be used solely for the operation of these turbines . There will be a berm built around these tanks . Berm will be lined with a plastic liner which will be impervious to the oil . Do have a plat signed and approved by the State Oil Inspector . They are also installing a maintenance building and two smaller buildings . Unloading facility will be outside the fenced area . Trucks will not be on the roads . Planning staff recom- mends approval for the following reasons : ( 1 ) Ft . Lupton has no objections ; (2 ) Agrees with Weld County Comprehensive Plan and Weld County Zoning Regulations as a use permitted in the Agricultural zone . Subject to : (1 ) Health Dept . comments ; (2 ) Construction beginning within one years ' time from date of approval by Board of County Commissioners and limited to the plans submitted ; and (3 ) Agreements being reached between Ft . Lupton and Public Service regarding the proposed collector streets on County Road 31 and County Road 16 . Mr . Miller stated that in 1962 they discussed this problem with the County Commissioners (regarding the transmission line on the 1031 east side ) and at that time obtained a deed from the County Commissioners for that right-of-way through their property . Apparently , Ft . Lupton was not aware of this deed . The deed refers to the north-south road . Mr . Miller stated they were quite willing to cooperate with the Town of Ft . Lupton . No landscaping buffer is in the plans at this time . RESOLUTION : Be it therefore recommended to the Board of County Commissioners for approval subject to Planning staff recom- mendations . DISCUSSION : Mr. Reitz presented a slide show providing background information . Their industrial effluent goes through a lagoon and in turn goes to the Town of Windsor treatment system. The sanitary waste from the plant by-passes this lagoon and goes directly to the Town of Windsor waste treatment facility. The overflow tunnel between their current lagoon and the Windsor waste treatment plant overflow in the sense that it will re- lieve the restrictions imposed by these ( ? ) during periods of high water . The change would be to increase the capacity of the lagoons on the property . Would be able to discontinue use of the Town of Windsor facility and they would discharge directly into the Poudre River . This was the essential agree- ment with the Town when arrangements were made with them to treat their ( Kodak ' s ) industrial wastes . In addition to the lagoon itself , their would be a proposed temporary treatment plant to be installed between the two lagoons . Its goal would be to provide a discharge that would have no adverse affect on the Poudre River. Located on about four acres . New one will have rubber lining . Mr. Anderson inspected the area as the representative . He stated that this whole area was subject to flooding . He felt that sufficient plans had been made to relieve the problem. Planning staff recommends approval for the following reasons : ( 1 ) Agrees with the Weld County Comprehensive Plan ; (2 ) Agrees with the Weld County Zoning Regulations in the fact that their Industrial -Unit Development allows for some A-1 uses including this use ; (3 ) Weld County Health Dept . recommends approval . Some discussion of relocating the Gilcrest lagoons . Mr. Jost recommended that the Evan ' s application be signed ; but wait on Gilcrest ' s until everything is in . Possibly the Planning Commission could authorize a repre- sentative to sign the Gilcrest one when it comes up , because it does hold up the contract if it isn ' t signed , and there is a definite need to get this done as quickly as possible . It is intended that the Kodak Colorado Division (KCD) will pro- duce only a portion of the many photographic products that Kodak Park, Rochester (KP) , produces. It was recognized at the beginning that the KCD wastewater was going to be significantly different than that produced by KP. Another extenuating circumstance was that the KCD facility would be built in stages, with each succeeding portion adding to the wastewater. The first couple manufacturing processes (1971) produced very little wastewater. Then a manufacturing process came along with primarily inorganic discharges (1973) and only later would come the manufacturing process that produced the sig- nificant organic discharges (1975) . A cooperative waste treatment concept was developed with the town of Windsor. The town would build their Sanitary Sewage Treatment plant which must have excess capacity built in for future growth. Kodak would use this excess capacity until 1975 by sending indus- trial wastewater to the Windsor STP. Then when the entire indus- trial waste was fully developed, Kodak would build a separate facility and remove the industrial flow from Windsor's plant. Kodak would pretreat the industrial wastewater to assure that it would not adversely affect the Windsor STP. Under a contractural arrangement, CSU began a detailed survey of the Poiw1re River. The intent was to determine the initial conditions existing in the river and the subsequent changes and effects as the area became more urban in character and as the Kodak plant grew toward maturity. Besides this external monitoring program there is an internal monitoring and measuring program to get the present character- istics of the industrial wastewater. By superimposing the future discharges upon this, it is possible to determine the control program. The river standards have changed in the past and they will probably change more in the future. The Kodak organization has set a goal for water pollution control of not having an adverse effect on the river. This can probably be achieved most simply by limiting the Kodak discharge to what is in the river water upstream. This is the basic philosophy of the Kodak water pollution control strategy. The lagoon that is presently acting to equalize the varying nature of Kodak's industrial influent prior to dischnroe will serve the same purpose in the future, but it will be than discharging to a second lagoon wh'ero_ _' ? :_"_ )CTi'7,?i ;"radation will be necessary (See Figure 1) . That future waste tr(.uc ent process will also have a filtration system on the discharge and a disinfection system as well. Sludge disposal will also be included. The entire wastewater treatment system at the river will be a polishing step. Any additional treatment of a physical --2 April 8, 1974 chemical nature for removing a specific contaminant or to reuse a wastewater will probably be accomplished at the source, back within the production areas. These are usually more economical on small volumes. The process shown schematically in Figure 1 should be complete at the end of 1975 at which time the Kodak industrial wastewater will no longer be entering the Windsor STP but will be entering the river directly. The second lagoon is presently being designed. The contract documents should be ready by early May. Prior to that time, the plans for the lagoon will be submitted for CSUD review. The subsequent steps will be submitted after the pilot plant and laboratory information becomes available and translated into a full scale design. This should be prior to January, 1975. In the future there will be more effort toward recycling contami- nants and water at the source rather than making the central industrial waste treatment plant larger and more complex.
