HomeMy WebLinkAbout20220835.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, MARCH 16, 2022 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, March 16, 2022, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem - EXCUSED Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli MINUTES: Commissioner Moreno moved to approve the Minutes of the Board of County Commissioners meeting of March 2, 2022, as printed. Commissioner Buck seconded the motion, and it carried unanimously. PUBLIC INPUT: No public input was given. AMENDMENTS TO AGENDA: There were no amendments to the agenda. IE CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda, as printed. Commissioner Buck seconded the motion, and it carried unanimously. IR WARRANTS: 1) GENERAL WARRANTS - MARCH 11, 2022: Commissioner Moreno moved to approve the General Warrants, as printed. Commissioner Buck seconded the motion, and it carried unanimously. El NEW BUSINESS: 1) CONSIDER CONTRACT ID #5650 PETITION FOR ANNEXATION OF CR 90 AND AUTHORIZE CHAIR TO SIGN — TOWN OF PIERCE: Elizabeth Relford, Deputy Director of the Department of Public Works, stated the Board of County Commissioners have agreed to petition for the annexation of County Road (CR) 90, extending from the Town of Pierce city limits of U.S. Highway 85 to just past 4th Street (aka Row Avenue). She explained this is a follow-up from an Intergovernmental Agreement (IGA) with the Town of Pierce, approved in 2019, to share the cost of improvements needed from 4 /22 - Minutes, Wednesday, March 16, 2022 Page 1 2022-0835 BC0016 U.S. Highway 85 to CR 29, and the Town of Pierce has applied for a Department of Local Affairs (DOLA) grant this cycle. Ms. Relford confirmed the annexation plats have been prepared. Commissioner Buck moved to approve said Petition for Annexation and authorize the Chair to sign. The motion was seconded by Commissioner Moreno, and it carried unanimously. 2) CONSIDER CONTRACT ID #5659 AGREEMENT CONCERNING USE OF SOUTHWEST SERVICE CENTER POND AND AUTHORIZE CHAIR TO SIGN - NORTHERN COLORADO MODEL BOAT CLUB, NAMBA DISTRICT 20: Curtis Naibauer, Facilities Department, explained the Northern Colorado Model Boat Club, NAMBA District 20, has historically used the pond at the Southwest Service Center for model boat activity each summer and the agreement authorizes use of the pond from 7:00 a.m. to 5:00 p.m. on the dates listed. Commissioner Saine moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Buck, the motion carried unanimously. —�-- PLANNING: 1) CONSIDER REVOCATION OF PLANNED UNIT DEVELOPMENT FINAL PLAN, PUDF19-0003 (LONESTAR ESTATES PUD) - JOE AND LORI STRICKLIN: Diana Aungst, Department of Planning Services, stated staff received a letter, dated February 15, 2022, requesting revocation of Final Plan, PUD19-0003. She gave a brief overview of the location and history of this property, and stated the conditions supporting the original approval of the Planned Unit Development Zone District have changed. Ms. Aungst displayed aerial and vicinity maps for the record. Joe Stricklin, applicant, was present to answer questions and indicated the development and lack of North Weld County Water District supply, has made this development infeasible. No public testimony was offered concerning this matter. Commissioner Moreno moved to approve said revocation of the Planned Unit Development Final Plan, PUDF19-0003. The motion was seconded by Commissioner Buck, and it carried unanimously. 2) CONSIDER REVOCATION OF PLANNED UNIT DEVELOPMENT ZONE DISTRICT AND VACATION OF THE PLAT, PUDZ18-0003 (LONESTAR ESTATES PUD) - JOE AND LORI STRICKLIN: Ms. Aungst stated staff received a letter, dated February 15, 2022, to revoke the approval of the Planned Unit Development Zone District and to vacate the plat for PUD18-0003. She gave a brief overview of the location and history of this property, and stated the current property owners have no intent or desire to continue with the Planned Unit Development Final Plan, which is the second step needed to eliminate the development zoning and plat. Ms. Aungst displayed aerial and vicinity maps for the record. Joe Stricklin, applicant, was present to answer questions and confirmed this is no longer needed, since the development is too costly. No public testimony was offered concerning this matter. Commissioner Saine moved to approve said revocation of the PUD Zone District and vacation of the Plat. The motion was seconded by Commissioner Buck, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
