RESOLUTION RE: ACTION OF THE BOARD CONCERNING REVOCATION OF PLANNED UNIT DEVELOPMENT FINAL PLAN, PF-1066 (TORGERSON PUD) - FAITH TABERNACLE MINISTRIES, INC., C/O DANNY PERDEW WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution #2006-1400, dated June 14, 2006, the Board approved the application of Mikal Torgerson, 223 North College Avenue, Fort Collins, Colorado 80524, for a Site Specific Development Plan and Planned Unit Development Final Plan, PF-1066, for nine (9) lots with E (Estate) Zone Uses, along with 28.4 acres of open space, for a parcel of land located on the following described real estate, to -wit: Lot B of Recorded Exemption, RE -2681; being part of the SE1/4 of Section 32, Township 8 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, current property owner, Faith Tabernacle Ministries, Inc., c/o Danny Perdew, 13248 County Road 72, Greeley, Colorado 80631, by letter dated February 24, 2022, have requested Revocation of the Planned Unit Development Final Plan, PF-1066 (Torgerson PUD), stating the Final Plan was submitted; however, never recorded, and WHEREAS, Section 27-8-50 of the Weld County Code provides standards for Revocation of said Planned Unit Development Final Plan, PF-1066 (Torgerson PUD), and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The PUD development has been abandoned, and the property owners do not have the willingness or ability to continue with the submittal of the PUD final plan. No Final Plan application has been submitted for Torgerson PUD. By letter dated February 24, 2022, the current property owners have requested revocation, stating they have no intent or desire to continue with the development or record a PUD Final Plan. 2. The conditions and statements made supporting the original approval of the PUD Zone District have changed, and the landowners cannot implement the PUD Final Plan. This Final Plan PF-1066 was approved on June 14, 2006, by the Board of County Commissioners. The Board of County Commissioners may revoke the PUD Final Plan if the Board determines that conditions supporting the original approval of the PUD cannot be met. Sec. 27-8-50. — Failure to record a PUD final plan. The applicant shall submit three (3) paper copies of the plat for preliminary approval to the County Department of Planning Services. Upon approval of the paper copies, the applicant shall submit a Mylar plat, along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of this Code. The Mylar plat and additional requirements shall be recorded within three (3) years from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. If a plat has not been recorded within three (3) years of the date of the approval of the Planned Unit Development (PUD) change of zone or final plan, or within a date specified by the Board of County Commissioners, the Board may require the landowner to appear before it and present evidence substantiating that the PUD has not been abandoned and that the applicant possesses the willingness and ability to record the plat. The Board of County Commissioners may extend the date for recording the plat. If the Board determines that conditions supporting the original approval of the PUD cannot be met, the Board may, after a public hearing, revoke the PUD.
