TO THE 1-2 (MEDIUM INDUSTRIAL) ZONE DISTRICT- R&N PROPERTIES, LLC
A public hearing was conducted on December 21, 2022, at 10:00 a.m., with the following present:

The following business was transacted:
El I hereby certify that pursuant to a notice dated November 15, 2022, and duly published
November 18, 2022, in the Greeley Tribune, a public hearing was conducted to consider the
request of R&N Properties, LLC, for Change of Zone, COZ22-0011, from the A (Agricultural) Zone
District to the 1-2 (Medium Industrial) Zone District. Bruce Barker, County Attorney, made this a
matter of record.
El Michael Hall, Department of Planning Services, presented a brief summary of the proposal
and location of the subject site. He shared no land use applications have been received and,
therefore, no physical development of the site has not been reviewed and is not a part of this
presentation or request. Mr. Hall described the sign posting, and stated the property is not located
within a Coordinated Planning Agreement boundary; however, it is located within the three (3)
mile referral area of Adams County, City of Dacono, Town of Erie, Boulder County, City of
Northglenn and City and County of Broomfield. He stated Adams County and City of Dacono both
responded with Referrals expressing no concerns; no other referrals were received. He shared,
upon review of staff, the proposed COZ complies with the goals of the Town of Erie's 2015
Comprehensive Plan, Land Use Map, specifically this property is designated I (Industrial) for
intended future land uses. He described surrounding zones and uses, pointing out the location of
uses within the residential areas. Mr. Hall described the site is located within a Geological Hazard
Overlay District and explained the underground coal mine, stating a Soil Report has been
requested; however, no requirements are specific to the COZ process. He stated the property is
located within the one (1) mile buffer surrounding 1-25 and is classified as being within the Weld
County Opportunity Zone. He shared historical use of the land and relayed nine (9) surrounding
property owners (SPOs) were noticed; however, no responses were received. He explained, per
the Development Review staff, access is via a frontage road, maintained by CDOT. Mr. Hall
entered the favorable recommendation of the Planning Commission into the record, as written,
and displayed images of the site and surrounding views.

= In response to Chair James, Mr. Hall confirmed access is from the 1-25 Frontage Road, and
a final CDOT Access Permit has been received.
IE Lauren Light, Department of Public Health and Environment, explained both residences on
this parcel are served by the Left Hand Water District, they each have valid septic permits, several
notes have been recommended for the plat which relate to water and sewer provisions and there
are no outstanding concerns with this request.
Nate Heuson, applicant, shared an overview of the property and the future
commercial/industrial use for the property.
El No public testimony was offered concerning this matter.
The Board reviewed the Conditions of Approval and accepted them as presented.
' In response to Chair James, Mr. Houstan indicated they have reviewed, and agreed to abide
by, the Conditions of Approval as presented.
Commissioner Freeman moved to approve the request of R&N Properties, LLC, for Change
of Zone, COZ22-0011, from the A (Agricultural) Zone District to the 1-2 (Medium Industrial) Zone
District, based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval, as presented. The motion was seconded by Commissioner Moreno, and
it carried unanimously. There being no further discussion, the hearing was completed at
10:58 a.m.
This Certification was approved on the 4th day of January, 2022.
