DIVISION OF LAND - N0. 1053-16-2-RE-29
DETERMINED TO BE EXEMPT FROM THE DEFINITION OF SUBDIVISION
RANGE 64, TOWNSHIP 4, SECTION 16
SOUTH HALF OF THE NORTHWEST QUARTER (SiNW4)
WHEREAS, on May 5, 1972, the General Assembly of the State of Colorado,
enacted Senate Bill #35 as relates to Chapter 106 of the Colorado Revised Statutes,
and
WHEREAS, on August 30, 1972, the Board of County Commissioners of Weld
County, Colorado, adopted Subdivision Regulations for Weld County, Colorado to
comply with the prescribed Senate Bill #35, and
WHEREAS, the Weld County Planning Commission has recommended denial to
the Board of County Commissioners for recording of plat number 1053-16-2-RE-29 as
provided in Section 9 of the Subdivision Regulations (exemption rules and regulations)
for Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard all the testimony and
statements of those present; has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission, and having
been fully informed,
NOW, THEREFORE, BE IT RESOLVED, that said division of land determined to
be exempt from the definition of subdivision is more particularly described as
follows:
The South Half (Si) of the Northwest Quarter (NW4) of Section 16,
Township 4 North, Range 64 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows: Beginning
at the Northwest Corner (NWCor) of the Northwest Quarter (NW4)
of said Section 16, and considered the West line of the North-
west Quarter (NW4) of said Section 16 as bearing South 00°00'00"
West, and with all other bearings contained herein being relative
thereto; Thence South 00°00'00" West along the West line of the
Northwest Quarter (NW4) of said Section 16, 1319.96 feet to the
True Point of Beginning; Thence continuing South 00°00'00" West,
along the West line of the Northwest Quarter (NW4) of said Section
16, 1319.96 feet to the Southwest Corner (SWCor) of the Northwest
Quarter (NW4) of said Section 16; Thence North 89°54'08" East
along the South line of the Northwest Quarter (NW4) of said Section
16, 2639.39 feet; Thence North 00°01'34" East, 1318.78 feet; Thence
South 89°55'42" West, 2639.99 feet to the True Point of Beginning.
Said described parcel of land contains 79.938 acres, more or less
including a strip of ground 30 feet in width along the West side
for County Road Right-of-way purposes and is subject to any rights-
of—Way or other easements as recorded by instruments of record or
as now existing on said parcel of land.
BE IT FURTHER RESOLVED, by the Board of County Commissioners of
Weld County, Colorado, that the Chairman of the Board be and he is hereby authorized
to sign the plat of a division of land determined to be exempt from the
definition of Subdivision No. 1053-16-2-RE-29, for recording

Dear Mr. Lorenson:
Delivered with this letter are the Applications for Recorded
Exemption of Florence Wertz and William J. Wertz. Also de-
livered herewith is a check for $100. 00 to cover the two $50. 00
filing fees.
In my conversation with you yesterday, you indicated that the
access road to Lot B on the Florence Wertz property was not in
conformity with the County Zoning Resolution. The private access
road as platted is 20 feet in width and you have stated that this
private access road must be 60 feet in width before you will
accept the Application. I have checked the County Zoning Resolution
as well as Section 9 of the Weld County Subdivision Regulations
and can not find authority for your position. Hence, I request
that you either accept and approve the attached Applications and
submit them to the County Commissioners at their February 14, 1973,
meeting or specify your authority for requiring the 60 foot private
access road immediately so that if our position is erroneous we can
cure the defect and still have this matter approved by the County
Commissioners at their February 14, 1973, meeting.
The real estate transaction underlying these Applications for
Recorded Exemption is to close on February 15 , 1973, consequently,
time is of the essence.
If you feel you must remain firm in your position, I would request
that we submit this matter to the County Attorney for his review
in hopes that the matter can be resolved prior to February 14 .
