CONCERNING CHANGE OF ZONE
PETITION OF BILL CATES
The petition of Bill Cates, c/o Charles Kuechenmeister, Box 512,
Greeley, Colorado, requesting a change of zone from "A" Agricultural
District to "B" Business District of a parcel of land more particularly
described as follows, to-wit:
A parcel of land located in the Southwest corner of Section
23, Township 1 North, Range 68 West of the Sixth P. M.
Weld County, Colorado, and more particularly described
as follows: Commencing at the Southwest corner of said
Section 23, thence North a distance of 330 feet to the point
of beginning; thence East a distance of 660 feet; thence
North a distance of 330 feet; thence West a distance of
660 feet; thence South a distance of 330 feet to the point of
beginning, containing 5 acres, more or less,
came on for hearing on January 8, 1973, and the Board of County
Commissioners of the County of Weld, State of Colorado, having heard
the testimony and evidence adduced upon said hearing and having considered
the testimony, evidence and recommendations of the Weld County Planning
Commission filed with said Board, and having carefully weighed the same,
now makes the following findings:
1. The evidence discloses that the applicant failed to sustain the
burden of proof as to the need for a change of zone or that the present
zone is erroneous or that circumstances warrant a change of zone at that
time.
2. The evidence discloses that the present zoning is complementary
to the surrounding area.
3. The evidence discloses that the proposal would constitute spot
zoning and that if a commercial activity was allowed, it would encourage
strip commercial development along County Road No. 6 and that this would
not be in the interest of good planning.
4. The evidence and investigation shows that there is a need for a
study and development of a comprehensive plan for Weld County, which
would include the area sought to be rezoned, and therefore, any rezoning
of subject property at this time would be premature and not in the interest
of good planning.
5. That each of the preceding findings in and of themselves and
independent of each other constitutes a separate and individual ground for
denial of the change of zone.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, has heard the application of Bill Cates, c/o Charles
Kuechenmeister, Box 512, Greeley, Colorado, for a change of zone from
"A" Agriculture District to "B" Business District of a parcel of land as
hereinabove recited and made a part hereof by reference, and

WHEREAS, the said Board has carefully considered the petition,
evidence and testimony and the recommendations of the Weld County
Planning Commission and has given the same such weight as it in its
discretion deems proper, and is now fully advised in the premises;
NOW, THEREFORE, BE IT RESOLVED, that the petition of Bill
Cates, c/o Charles Kuechenmeister, Box 512, Greeley, Colorado,
requesting a change of zone from "A" Agricultural District to "B"
Business District of a parcel of land indicated above be, and it hereby
is denied on each of the grounds as set forth in the Board's findings
herein.

It has come to the attention of the Plann-ing
Commission that the property you own generally
known as the Washington mine adjacent to 1-25
in Weld County , has now been divided into some
number of parcels over four. This is a violation
of both the existing State and County laws and
any such division requires the process of sub-
dividing .
The Planning Commission wishes you to know that
it will not legalize any such divisions by rezon-
ing the parcels until you have provided a plat
acceptable to meet these regulations and further ,
preferably that if you wish to continue to attempt
to sell these parcels as -commercial , business and
industrial sites , that you submit a Planned Unit
Development proposing the orderly growth and devel -
opment of the entire remaining parcel .

Gentlemen:
Pt the hearing of the above captioned. application before
the tTeld County Planning Commission, concern_ was expressed
aheut prior applicants who had obtained. zoning changes in
this SRMP area of the county on the strength of certain
representations concerning their use of the property in
Quest-.ion and than failed to live up to those representations .
Mr. . Cates desires to reaffirm his intentions that the repre-
sentations contained in his application concerning) the
construction and landscaping upon, and use of the Property,
will be strictly observed . Specifically, the construction
of permanent structures, the instalment of a waste treatment
facility satisfactory to the Weld County Health Department,
and the landscaping and planting of shrubbery will be effecter:
as indicated in the application and allied papers . Mr . Cates
offers to bind his corporation and himself, individually and
personally, to the County of Weld as guarantors that the
representations in his application are true . As further evi-
dence of his good faith, he hereby offers to post a performance
bond in the amount. of $15,000. 00, all or hart of which may be
forfeited if he fails substantially to live up to the represen-
tations container) in his application. These offers are, of
course, condit-icned upon the granting of the zoning requested .
They are made in order to allay any doubts the Board may have
