This warrant was allowed; $25.00 for land taken and 4160.00 to pay for fencing to be built by A,Irs. McManie. The County Con issittners will be in session kebruary 6th and they will probably continue throughout that week. I would suggest tht you take the mgtter up directly with them at that time. Greeley, Colo . . Gentlemen: Referring to your letter of January 6th regarding warrant in favor of Viola C. MCManis, we note that you say this warrant is for $132. 50 and that $110.00 was allowed as damage and $12. 50 as compensation for the land. $110.00 plus $12 . 50 would make $:"122 . 50 instead of $132. 50. We note also that you say the warrant is six years 1` d and about to be canceled on this account . ' You are apparently referring to some warrant is- ed in the original proceeding and not in the second road \ a proceeding involving Mrs . McManis' land. We have before us a copy of warrant No . 12 ,216, series 1 , dated August 7th, 1917, for $185.00 to the order of Viola C . McManis out of general county funds "for right of way road purposes" . This is the warrant referred to by us in our letter of January 3rd and so we would ask that you look up this warrant and then let us have an answer to our letter of January 3rd because yours of January 6th does not answer that letter on account of your having found the wrong warrant . In the viewer' s report, granting the road throu -h her land, to the County, ,:12.50 was allowed as compensation for the four one-hcAE c:cres of land actually taken and ,„110.00 was allowed as damages to the residue on account of estimated cost of building a fence. As I remember there is a county warrant for $185.00 drawn to her order but which is still in your files. If I am correot in this will you please give me a copy of the warrant and also advise me what obligations, if any, will be imposed on Mrs . McManis by the acceptance of this warrant , particularly in regard to fencing. Neither Mrs. McManis nor I have ever felt that she received proper treatment at the hands of the county in regard to the proposed road but I am taking the matter up with her at the present time with a view to possibly arranging the final settlement of the matter for the reason that she is hav— ing more trouble than any two or three women ought to have and if I can get at least one of these matters adjusted and out of the way it will be that much less for her to worry about . 17,8 Will you please advise/at once and fully of the situation regarding the above matter and what can be done in the way of a settlement . Gentlemen: There appeared before this Board yesterday Attorney Whitehead and Mrs. Viola McManus , who stated that employees of the County had entered upon the State land in Sec. 26, Twp 4 N, R 62 W, and were building a gate and otherwise constructing or preparing to construct a road through the State land. It was also stated that the fence between Mrs. McManus' and the State land was about 100 feet on the State land. This you can verify through your surveys. In order that the County may be fully informed of the present condition of its application for right of way and to make the matter definite as to the present status , eliminat- ing any controversy or discussion of things which have trans- pired heretofore , the Board yesterday passed a resolution as follows : "WHEREAS The Board of County Commissioners of Weld County have made an application for a right of w$y through Sec. 26 , Twp 4 N, R 62 W, and WHEREAS There has been considerable correspondence and considerable controversy concerning the said right of way, and WHEREAS There may be at this time some confusion relative to the present status; THEREFORE, BE IT RESOLVED That a letter be written to the Board of County Commissioners , stating that the State has not yet granted a right of way across the said section to the County of Weld , and that the Coun- ty be informed that if it still desires this right of way it request this Board to fix a date and time when the County will present its case to the State Board of Land Commissioners , so that the State Board may de- termine the merits of the case and whether to approve and grant the right of way or to finally deny the same." In accordance with this resolution this letter is written. Board of County Commissioners Weld Co.--2 Therefore , as the County has not obtained a right of way, the Board requests that you desist from further work on the said road through the State lands until a right of way has been granted and a right of way deed issued to the County. That said petition does not contain the names of ten legal freeholders of said County residing within two miles of the Proposed road sought to he laid out as described in said petition. �• a That the load viewers appointed by the Board of County 'Commissioners to view said proposed •roadway did not lawfully assess the benefits and damages accruing to persons affected by said • roadway. 4. That the report of the said viewers was filed less than ten days im' ediately before the next regular meeting of the Board of County Comminsoners. 5. That said petition is fraudulent in that the signatures of some of the Unlit signers thereto were obtained by false repre- sentations to them by the person or persons who circulated the said Petition. That this affiant ' s name was used in naming the roadway in order to persuade some of the legal signers to sign said petition, S'rY._91/ and representations made to them that this affiant was desirous of having said roadway opened. 6. That the opening of the proposed roadway will work great damage and hardship to this affiant and it is not necessary to damage her real property for the reason that a good and suffidient road way can be opened along the uovernment section lines which said roadway along section lirfe 4 will be of far more use and accomodation to the ge eral public than the proposed roadway and will afford many other property owners access to their several properties while the proposed roadway will not afford such means of egress and from and ingress to/their respective properties. 7. Mr. John painter , Roggen, Colo. , • Dear Sir, I am enclosing herewith a petition for the McManus road. You will notice I have described this road by meets and- bounds. This -is the description made by L. D. • Stimson. When this petition is returned to the office of the commissioners I will attach to it the blue print. I cannot get the blue print today or I would attach it before I send it to you. We must have this petition signed by a majority of all free-holders residing within two miles of the proposed road. We want to be very careful this time to have the petition correct and I wish you would do the best you can to get a majority of such free-holders to sign it and be sure to have them put the description of their land after their names. You can have other persons sign it also , which would be all right , but be sure to get a majority of the free-holders residing within two miles in any direction. This means from either end of the road also . There is due to you, or whoever put it up, $15 for one of the roads that this connects with, but if it . -is -convenient -for-"you- to- do--so- -I- wish -you-would also send - --your check for ,; 15 to the commissioners along with this petition, but if you don't want to do so I suppose they can issue warrant for that 15 due to some of you and claim that Idin is the deposit but I would rather you send the check to save covering the warrant up in this way. I wish you could get this petition back to the commissioners by next Staurday so that they could act on • it when the meet the following Monday. Their regular meeting comes next Monday. I would like to have this acted on next Monday if possible so the viewers could be appointed and make their view in time to file their report more than ten days prior to the meeting May, at which time the commissioners would approve the report and order the road opened.
