HomeMy WebLinkAbout20232529.tiffHEARING CERTIFICATION DOCKET NO. 2023-33.B RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR22-0018, FOR OPEN MINING (SAND, GRAVEL AND STONE), EMPLOYEE AND EQUIPMENT PARKING ASSOCIATED WITH OPERATIONS OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - LOVELAND READY -MIX CONCRETE, INC. A public hearing was conducted on September 6, 2023, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Scott K. James Commissioner Kevin D. Ross Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Karin McDougal Department of Planning Services representative, Kim Ogle The following business was transacted: • I hereby certify that pursuant to a notice dated April 10, 2023, and duly published April 12, 2023, in the Greeley Tribune, a public hearing was conducted on June 7, 2023, to consider the request of Loveland Ready -Mix Concrete, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR22-0018, for Open Mining (sand, gravel and stone), employee and equipment parking associated with operations outside of subdivisions and historic townsites in the A (Agricultural) Zone District. At said hearing the Board continued the matter to September 6, 2023, to allow the applicant adequate time to perform a Traffic Impact Study on a newly proposed haul route, as well as time for staff to review. Karin McDougal, Assistant County Attorney, made this a matter of record. • Kim Ogle, Department of Planning Services, presented a request from the applicant to continue the hearing, to allow additional time for the Traffic Impact Study (TIS) to be submitted to Weld County, and to allow for the review of said TIS by staff, the Towns of Johnstown and Milliken, and the Colorado Department of Transportation (CDOT). He stated staff is in support of the request and there was discussion regarding the timeframe of the continuance. '. Stephanie Fancher-English, Loveland Ready -Mix Concrete, Inc., stated it is taking longer to get through the CDOT process than they anticipated, and agreed that four (4) months should be adequate to finalize the TIS and submit to staff for review. The Board and Ms. Fancher-English agreed on a hearing date of January 10, 2024, at 10:00 a.m. • No public testimony was offered concerning this matter. cc: FL (17/KW /10A414) O9 /2$/23 2023-2529 PL1373 HEARING CERTIFICATION - LOVELAND READY -MIX CONCRETE, INC. (USR22-0018) PAGE 2 Commissioner Saine moved to continue the matter to January 10, 2024, at 10:00 a.m., to allow additional time for the TIS to be submitted to Weld County and for the review of said TIS by staff, the Towns of Johnstown and Milliken, and the Colorado Department of Transportation. The motion was seconded by Commissioner Ross, and it carried unanimously. There being no further discussion, the hearing was completed at 10:06 a.m. This Certification was approved on the 20th day of September, 2023.
