HomeMy WebLinkAbout20231747.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, JUNE 21, 2023 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, June 21, 2023, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair — EXCUSED Commissioner Perry L. Buck, Pro-Tem Commissioner Scott K. James Commissioner Kevin D. Ross — EXCUSED Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Controller, Chris D'Ovidio • MINUTES: Commissioner James moved to approve the Minutes of the Board of County Commissioners meeting of June 7, 2023, as printed. Commissioner Saine seconded the motion and it carried unanimously. • CERTIFICATION OF HEARINGS: Commissioner Saine moved to approve the Certification of Hearings conducted on June 7, as follows: 1) PCSC22-0010 — Paul Page, 2) USR23-0004 - Shannon Kemp, and 3) USR22-0018 — Loveland Ready -Mix Concrete, Inc. Commissioner James seconded the motion, which carried unanimously. le AMENDMENTS TO AGENDA: Commissioner Saine moved to reconsider the motion regarding the Service Plan for First Five Years Early Childhood Development Service District. After discussion, there being no second, the motion failed. • CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Saine seconded the motion and it carried unanimously. I WARRANTS: 1) GENERAL WARRANTS - JUNE 20, 2023: Commissioner Saine moved to approve the General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. Minutes, Wednesday, June 21, 2023 Page 1 2023-1747 BC0016 BIDS: 1) APPROVE BID #62300119, COURTHOUSE ANNEX ROOF REPLACEMENT - FACILITIES DEPARTMENT: Carolyn Geisert, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, Front Range Roofing Systems, LLC, for a total amount of $325,000.00. Commissioner James moved to approve said bid. The motion was seconded by Commissioner Saine, and it carried unanimously. • 2) PRESENT BID #B2300126, JAIL R POD SKYLIGHT REPLACEMENT - FACILITIES DEPARTMENT: Ms. Geisert stated two (2) bids were received and staff will make a recommendation on July 5, 2023. • 3) PRESENT BID #B2300134, 2023 STEEL BID FOR CORRUGATED METAL PIPE - DEPARTMENT OF PUBLIC WORKS: Ms. Geisert stated one (1) bid was received and staff will make a recommendation �on July 5, 2023. g 4) PRESENT BID #B2300135, 2023 STEEL BID FOR FENCING AND MISCELLANEOUS STEEL - DEPARTMENT OF PUBLIC WORKS: Ms. Geisert stated one (1) bid was received and staff will make a recommendation on July 5, 2023. • 5) PRESENT AND APPROVE EMERGENCY BID #B2300136, 2023 STEEL BID FOR STRUCTURE STEEL (H- PILE) - DEPARTMENT OF PUBLIC WORKS: Ms. Geisert stated three (3) bids were received and staff recommends selecting the lowest bidder who met specifications on an emergency basis, Triad Metals International, for a total amount of $66,944.00, due to the rapidly increasing prices. In response to Commissioner James, Ms. Geisert confirmed the emergency is due to the rapid escalation in pricing for this steel product. Commissioner James moved to approve said bid, on an emergency basis. Seconded by Commissoiner Saine, the motion carried unanimously. El NEW BUSINESS: 1) CONSIDER CONTRACT ID #7067 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR PRO-TEM TO SIGN — IGNACIA VEGA: Jamie Ulrich, Director of the Department of Human Services, stated this is a provisional kinship foster care home located in Greeley, Colorado. Commissioner Saine moved to approve said contract and authorize the Chair Pro -Tern to sign. Seconded by Commissioner James, the motion carried unanimously. IE 2) CONSIDER CONTRACT ID #7068 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR PRO-TEM TO SIGN — MARCIA JOLLY: Ms. Ulrich stated this is a new foster care home located in Frederick, Colorado. Commissioner James moved to approve said contract and authorize the Chair Pro-Tem to sign. The motion was seconded by Commissioner Saine, and it carried unanimously. • 3) CONSIDER CONTRACT ID #7071 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR PRO-TEM TO SIGN - PETER AND KIM SERNA: Ms. Ulrich stated this is a new foster care home located in Eaton, Colorado. Commissioner Saine moved to approve said contract and authorize the Chair Pro-Tem to sign, which was seconded by Commissioner James, and it carried unanimously. Minutes, Wednesday, June 21, 2023 Page 2 2023-1747 BC0016 • 4) CONSIDER CONTRACT ID #7073 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR PRO-TEM TO SIGN — PAMELA BARDEN: Ms. Ulrich stated this is a new foster care home located in Eaton, Colorado. The motion to approve said contract and authorize the Chair Pro-Tem to sign was made by Commissioner Saine, seconded by Commissioner James, and it carried unanimously. El 5) CONSIDER CONTRACT ID #7076 AGREEMENT FOR RESPITE SERVICES AND AUTHORIZE CHAIR PRO-TEM TO SIGN — MARCIA JOLLY: Ms. Ulrich stated this a new respite care agreement for a home located in Frederick, Colorado. Commissioner Saine moved to approve said agreement and authorize the Chair Pro-Tem to sign. Seconded by Commissioner James, the motion carried unanimously. IE 6) CONSIDER CONTRACT ID #7069 AMENDMENT #2 TO INTERGOVERNMENTAL AGREEMENT FOR PURCHASE OF FOOD PREPARATION SERVICES AND AUTHORIZE CHAIR PRO-TEM TO SIGN - UNIVERSITY OF NORTHERN COLORADO: Ms. Ulrich stated this amendment is to an agreement with the University of Northern Colorado (UNC) to provide food preparation services for the Weld County senior nutrition program. In response to Commissioner Saine, Ms. Ulrich explained this is a one (1) time meal provided for seniors. Commissioner James moved to approve said amendment and authorize the Chair Pro-Tem to sign. The motion was seconded by Commissioner Saine, and it carried unanimously. El 7) CONSIDER CONTRACT ID #7096 MEMORANDUM OF UNDERSTANDING FOR CONSTRUCTION OF NEW HILL N PARK SENIOR CENTER AND AUTHORIZE CHAIR PRO-TEM TO SIGN — GREELEY-WELD HABITAT FOR HUMANITY: Ms. Ulrich stated this memorandum of understanding authorizes the Greeley -Weld Habitat for Humanity as the pass -through agency for funding to oversee the construction for a new Senior Center in the Hill N Park neighborhood. Commissioner Saine moved to approve said memorandum of understanding and authorize the Chair Pro-Tem to sign, which was seconded by Commissioner James, and it carried unanimously. • 8) CONSIDER STANDARD FORM OF AGREEMENT, RATES, AND PROVIDER LIST FOR INDIVIDUAL PROVIDER CONTRACTS FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR TO SIGN: Ms. Ulrich stated this template form is for program year 2023-2024 foster care individual provider contracts with rates referenced as Exhibit A, and the associated provider list. Commissioner James to approve said standard form, rates, and list of providers, and authorize the Chair to sign agreements consistent with said form. Commissioner Saine seconded the motion, and it carried unanimously. ▪ 9) CONSIDER GRANT APPLICATION FOR CASE MANAGEMENT RETENTION PHASE 2 AND STATEMENT OF ASSURANCE FORM, AND AUTHORIZE DEPARTMENT OF HUMAN SERVICES TO SUBMIT ELECTRONICALLY: Ms. Ulrich requested to submit an application for the Case Management Retention Payment Grant, for funding to help with retention during the case management agency transition phase. Commissioner James moved to approve said application and form and authorize the Department of Human Services to submit electroncially. The motion was seconded by Commissioner Saine, and it carried unanimously. • 10) CONSIDER SUBRECIPIENT INFORMATION FORM CERTIFICATION FOR BEHAVIORAL HEALTH GRANT PROGRAM FOR HIGH-FIDELITY WRAPAROUND PROJECT AND AUTHORIZE CHAIR PRO-TEM TO SIGN: Ms. Ulrich stated this is to continue funding for the 2023-2024 fiscal year through the Behavioral Health Administration 1281 Grant. Commissioner Saine moved to approve said certification and authorize the Chair Pro-Tem to sign. Seconded by Commissioner James, the motion carried unanimously. Minutes, Wednesday, June 21, 2023 Page 3 2023-1747 BC0016 • 11) CONSIDER CONTRACT ID #6781 AMENDMENT NOS. 2 AND 3 FOR SECURE ACT COMPLIANCE FOR 401(K) SAVINGS PLAN AND AUTHORIZE CHAIR PRO-TEM TO SIGN: Staci Datteri-Frey, Department of Human Resources, stated these amendments bring the Principal voluntary 401(K) Savings Plan into compliance with the Secure Act 2.0, effective January 1, 2023. Commissioner James moved to approve said amendments and authorize the Chair Pro-Tem to sign. Seconded by Commissioner Saine, the motion carried unanimously. • 12) CONSIDER CONTRACT ID #6971 AMENDMENT NOS. 1 AND 2 FOR CLARIFICATION OF ELIGIBILITY DESIGNATIONS FOR 457 DEFERRED COMPENSATION PLAN AND AUTHORIZE CHAIR PRO-TEM TO SIGN: Ms. Datteri-Frey stated these amendments clarify the elgibile employee groups for the Principal 457 Deferred Compenstaion Plan. Commissioner Saine moved to approve said amendments and authorize the Chair Pro-Tem to sign. The motion was seconded by Commissioner James, and it carried unanimously. • 13) CONSIDER CONTRACT ID #7075 AGREEMENT FOR RELOCATION OF ELECTRICAL FACILITIES FOR BRIDGE 54/13A RECONSTRUCTION PROJECT AND AUTHORIZE CHAIR PRO-TEM TO SIGN - POUDRE VALLEY RURAL ELECTRIC ASSOCIATION: Michael Bedell, Department of Public Works, stated this agreement is to convert the existing overhead electrical facilities to underground utilities, in addition to moving them further north for the cost of $578,255.33. He stated the County has purchased the right-of-way easement within the section the facilities are currently located; however, once relocated, Poudre Valley Rural Electric Association will share an easement with the Little Thompson Water District. In response to Commissioner James, Mr. Bedell clarified the County paid for both the easement and the relocation. The motion to approve said agreement and authorize the Chair Pro-Tem to sign was made by Commissioner James, seconded by Commissioner Saine, and it carried unanimously. • 14) CONSIDER DECLARING CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Chris D'Ovidio, Controller, referenced the list of equipment ready for auction (Exhibit A), and stated the necessary replacments have been placed into operation. Commissioner Saine moved to approve declaring said equipment as surplus, approve sale of same at auction, and delegate authority to the Controller to sign any necessary documents. Commissioner James seconded the motion, and it carried unanimously. • 15) CONSIDER APPOINTMENT TO REGIONAL COMMUNICATION ADVISORY BOARD: Commissioner James moved to approve said appointment. Commissioner Saine seconded the motion, and it carried unanimously. • PUBLIC COMMENT: 1) Steve Teets, Greeley resident, offered his comments to the Board. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
