Ashley and: Mr. Eugene McKenna, Director Weld County Department of Public Welfare Post Office Box A Greeley, Colorado 80631 Gentlemen: Replying to letter of July 24, 1971, from Mr. Eugene McKenna, Director, Weld County Department of Public Welfare, requesting approval of the State Depart- ment of Social Services for a layoff of approximately 90 percent of the Weld County Department of Public Welfare staff, stating as a reason that Weld County has insufficient funds for August 1971, I wish to state: The request made in accordance with Sec. 3914.55 and 3914.552, Vbl. III, of the Department of Social Services rules and regu- lations is denied and approval of the State Department of Social Services is hereby denied. You are directed to inform the employees that they will carry on with their work. State and federal law require staff sufficient to administer the various welfare programs. In each county the state has designated county welfare departments to be its agent in administering welfare programs within the county. These laws require prompt determination of'eligibility by applicants for welfare benefits and provision of money benefits and services to those eligible and a hearing prior to termination or reduction of benefits by the county department. Such requirements can only be met in Weld County by retaining at least the existing staff members because of the welfare caseload. You are aware of the provisions of Sec. A-7111.1, et seq., of the Department of Social Services rules setting out required standards for services staff of county departments, and the provisions of Sec. 4000.11, et seq., setting out required standards for eligibility staff. These standards are based upon Federal requirements which must be met under our various State Plans with HEW and were adopted by the Board of Social Services in accordance with 119-10-2 and 3-16-2, C.R.S. 1963, and 119-1-12 and 119-1-15. SS OLeg7 710489 Members of Weld County Board of Public Welfare and: Mr. Eugene McKenna, Director, Weld County Department. of Public Welfare July 30, 1971 Page Two Among the numerous Federal requirements is Sec. 205.120, Title 45, Chapter II, of the Code of Federal Regulations, which requires: "Sec. 205.120 Statewide operation: State plan requirements: A State plan under title I, IV-A, X, XIV, or XIX of the Social Security Act must provide that: (a) It shall be in operation, through a system of local offices, on a statewide basis in accordance with equitable standards for assistance and adminis- tration that are mandatory throughout the State; (b) If administered by political subdivisions of the State, the plan will be mandatory on such political subdivisions; (c) The State agency will assure that the plan is continuously in operation in all local offices or agencies through: (1) Methods for informing staff of State policies, , standards, procedures and instructions; and o (2) Regular planned examination and evaluation of operations in local offices by regularly assigned State staff, including regular visits by such staff; and through reports, controls, or other necessary methods.
